eigning. ,
9. Raquel Brenizer was given a copy at the signing of the
contrect:. She evidently misplaced the copy in re-locating her
residence. She esked for another copy in April 1991 and was given.
Since Requel Brenizer enrolled in school she would make an attorney
call the school for any little problem. I had discussed with her
during a couneeling session that ehe should feel free to ask us
directly for any problem or anything pertaining her schooling.

11. Raquel Brenizer requested Commonwealth National Bank a loan for
$2,625.00 but obtained $2,467.50.
12. True, Requel Brenizer came beck and asksd in the middle of
Jenuary 1991 for three (3) months medical leave. Shs also informed
me that she could stay back and attend ths classss but due to
insurance reasons she was advised to stay away. Raqual Brenizer
came back in April of 1991, took leave of absence in June 1991.
13. Yes, when she came back she told me she was shaken up, due to
an accident and wanted medical leave, which she was granted.

llchool contracte had either expired or terminated and the school

by a letter, She made no attempts to return. Sometime in early
1993 Raquel Brenizer called me at my home number, I had a long
conversation with her in which I refreehed her memory about her
leave of absence and termination. Bhe would bring the conversation
back to the one queetion again and again that Ie "which year and
month the echool was closed"? Blnce this converaation took place
at home, I could not recall the exact date of eloeing, I informed
her politely that the eehool did not owe any refund or it would
have been sent to I'IIEAA et the time of her termination, I advieed
her that she will have to start making her loan payments. In raply
to this statement, Raquel Brenizer informed me that she will have
to sue me since the school ie closed,
25, Raquel Brenizer owes a balance of $382.00 for hot schooling.

NOW COMES, Plaintiff, Raquel Brenizer, by and throuQh her
attorney, John L. Perry, Esquire, and states the followinQI
1. Plaintiff, Rllquel Brenizer, is an adult individual
residilllj at 24 winchester Gardens, carlisle, PA 17013.
2. Defendant, Barry Maker, is an adult individual residing
at 25 Laurel Drive, Hschanicsburg, PA 17055.
3. Defendant, at all times relevant hereto, was the owner
and operator of an insti tution known as Ilairl'lasters Academy,
located in carlisle, PA,
4. At all times relevant hereto Ilairmasters Academy wall
engaged in the business of cosmetology training.
5. Sometime in Ootober of 1990, Plaintiff enrolled at
Ilairmasters Academy,
6, Plaintiff enrolled as a part-time student for a period of
nine months in order to secure the necessary hours of instruction
to sit for the Pennsylvania cosmetology Licenser EXam.
7. Plaintiff and Defendant signed a contract outlining thelle
terms and the tuition for this course of instruction.
8. Plaintiff was nsver provided with a copy of this contract
by Defendant.
9. Plaintiff did request, both personally and through hsr
attorney, a copy of this contract.
10. Plaintiff believes, and theretore avera, that Dat.ndant
is presently in poseesoion of the oriQinal and/or copie. of this
dooument.
11. Plaintiff obtained a pennsYlvania Higher Eduoation
A..1stanoe Agenoy (PIIEM) stafford Loan from commonwealth National
Bank (now Hellon Bank) in the amount of $2,625,00 to pay for this
course of study.
12. Plaintiff nttended classes from late Ootober until
January 1, 1991,
13. At that time, PlRintitf was injured in an automobile
acoident which tempornrily procluded her continued attendance.
14, Plaintiff provided Defendant with documentation of her
medical condition.
l!i. Defendllnt agreed that Plaintiff could have up to 3 monthe
of medical leave from her course of study at lIairmasters Aoademy
and her contract would be extended accordingly.
16. Defendant agreed to contact PHAA in order to attempt to
obtain an extension of the start date for the repayment of
Plaintiff'. student loan to reflect this period of medicnl lenve.
17. Sometime in Jnnunry of 1991, Defendant received
Plaintiff's student loan check from Commonwenlth National Dank in
the amount of $2,467.50.
18. This check wnB pnyable to Plaintiff and lIail'masters
Acndemy.
19. Plaintiff endorsed this check at Ilnirmnsters Academy.
20. Defendant negotiated this check on behalf of Hairmasters
Academy.
21. Plaintiff attempted to return to classes at Hairmasters
Academy Bometime in April of 1991.
22. At that time, 11ft! rmnsters Academy had ceased operations
and a FOR BALE sign was posted on the premises.
23. Plaintiff believea and therefore aver. thatl at the time
that Defendant negotiated Plaintiff's studsnt loan check, she knew
or should have known that ehe would be unable to provide the course
of instruction agreed to by the parties.
24, Plaintiff hay made numerous attempt., both in person at
the former loclltion of Ilai rmuters Academy, by telephone and by
letter, to contact HrH. Haker regarding a refund of her tuition
pftyment,
