AND NOW, this 11~3- day of June, 1994, comes the Plaintiff,
Lester K. stone, by his attorney, Gregory R. Reed, Esquire, and
files this complaint In Divorce of which the following is a
statement:
COUNT II DIVORCE
No-Fault. - section 3301(c)
l. Plaintiff is Lester K. stone, who currently resides 216
Faculty Road, Duncannon, Perry county, Pennsylvania.
2. Defendant is Dorothy J. stone, who currently resides 230
Salt Road, Enola, Cumberland County, pennsylvania.
3. Plaintiff and Defendant have been bona fide residents in
the Commonwealth of Pennsylvania for at least six (6) months
immediately previous to the filing of this Complaint.
4. The Plaintiff and Defendant were married on September
l4, 1941 at Hagerstown, Maryland.
5. A Complaint For Divorce was filed by Defendant on July
22, 1983 to No. 2166 Civil - S 1983 but on October 28, 1986 the
case was dismissed for inactivity ptlrSuant to Cumberland County
,
Rule of Procedure No. 228.
6. The marriage is irretrievably broken.
7. The Plaintiff has been advised of the availability of
counseling and that the Plaintiff my have the right to request
that the Court require the parties to participate in counseling.
WHEREFORE, Plaintiff requests your Honorable Court to enter
a Decree of Divorce, divorcing the Plaintiff and Defendant.
COUNT II: EOUITABLE DISTRIBUTION
B. Paragraphs 1 through 7 are incorporated by reference
hereto as fully set though the same were set forth at length.
9. Plaintiff and Defendant have legally acquired property,
both real and personal, during their marriage from September 14,
1941 through ~ebruary 1, 1994, the date of separation, all of
which is "marital property".
lOr Plaintiff and/or Defendant have acquired, prior to the
marriage or subsequent thereto, "nonmartial property" which has
increased in value since the date of the marriage and/or
subsequent to its acquisition during the marriage, which increase
in value is "marital property."
ll. Plaintiff and Defendant have been unable to agree as to
an equitable division of said property to the date of the filing

Lester K. stone, being duly sworn according to law, deposes
and says:
1. I have been advised of the availability of marriage
counselling and understand that I may request that the court
require that my spouse and I participate in counselling.
2. I understand that the court maintains a list of marriage
counselors in the Domestic Relations Office, which list is
available to me upon request.
3. Being so advised, I do not request that the court
require that my spouse and I participate in counselling prior to
a divorce decree being handed down by the court.
I understand that false statements herein are made subject
to the penalties of l8 Par C.S. Section 4904 relating to unsworn
falsification to authorities.

Date of Marriaae: September 14, 1941.
Date of SeDaration: Husband claims that the parties separated
on February 1, 1994. Complaint in Divorce at '9. Husband also
avers that the parties have been separated in excess of fifteen
years. Plaintirr's Petition for Bifurcation at '3. Wife
maintains that the parties have been separated since 1961.
Number of Marriaae: First for both parties.
Plaintiff: Husband Lester K. stone is 76 years old [DOB:
6/8/18). He resides at 216 Faculty Road, Duncannon, Perry county,
Pennsylvania with the parties' daughter Marion and her family.
DefencJAnjo: Wife Dorothy J. stone is 73 years old [DOB:
12/10/21). She resides in the former marital residence at 230 Salt
Road, Enola, Cumberland county, Pennsylvania.
~ Apalication or Relevant Caselaw:
Although Husband clearly has a right to request the divorce be
bifurcated, Wolk v. Wolk, 318 Par Superior ct. 311, 464 A.2d 1359
(1983), the disadvantages to Wife in this case far outweigh
Husband's interest in "getting on with his life." The areas
presenting the greatest prejudice to Wife are as follows:
Death of One partv
If one party dies during the pendency of the divorce action,
the surviving spouse risks the loss of benefits under the probate,
estate and fiduciary code. Because that individual is not the
surviving spouse, he or she will not be entitled to an elective

share of the decedent I s estate. Additionally, the Probate Codtl now
provides that
If a person domiciled in this Commonwealth at the time of
his death is divorced from the bonds of matrimony after
designating his spouse as beneficiary of a life insurance
policy, annuity contract, pension or profit-sharing plan
or other contractual arrangement providing for payments
to his spouse, any designation in favor of his former
spouse which was revocable by him after the divorce shall
be come ineffective for all purposes unless it appears
from the wording of the designation or from either a
court order or a written contract between the person and
his spouse that the designation was intended to survive
the divorce. Unless restrained by court order, no
insurance company, pl!lnsion or profit-sharing plan trustee
or other obligor shall be liable for making payments to
a former spouse which would have been proper in the
absence of this section. Any former spouse to whom
payment is made shall be answerable to anyone prejudiced
by the payment.
20 Par C.S.A. S 6111.2 (Purdon Supp. 1994).
In this case, Husband has a pension with th~ city of Harris-
burg which will go into pay status in February 1995. Husband also
will receive a lump-sum payment of his contributions in excess of
$24,000 exclusive of interest earned on that sum.
The divorce
decree not only will compromise wife's interest in this benefit but
also will extinguiSh her rights to the "spouse's pension" to which
she is entitled as a surviving spouse.
Finally, the Dead Man's statute may prevent certain testimony
at the equitable distribution hearing, an outcome with potentially
adverse impact on the surviving spouse.

provertv and Third-Partv Riahts
In this case, the parties own as tenants by the entireties
improved real estate situated at 230 Salt Road, Enola, Cumberland
County, Pennsylvania. Entry of a divorce decree converts property
held in tenancy by the entireties to tenancy in common. 68
Pa.S.C.A. S 501. This may create a problem if one party has
credi tors seeking to attach property which no longer is held
jointly. Such risk is compounded in cases such as this in which
the parties have been separated for a long period of time and one
spouse is unfamiliar with the other's financial status. The
solvency of the marital estate thus may be affected in terms of its
availability for distribution. See Fidelity Bank v. Carroll, 416
Par Super. 9, 610 A.2d 481 (1992); Kronz V. Kronz, 393 Par super.
227, 574 A.2d 91 (1990); Klebach I,. Mellon Bank, 388 Par Super.
203, 565 A.2d 488 (1989); and Jawork V. Jawork, 348 Par super. 89,
548 A.2d 290 (1988). These cases highlight not only the conflicts
which may arise between the parties' rights to the marital estate
and the rights of creditors, but also the situations in which
creditors effectively may defeat a spouse's interest in the marital
estate.
Keystone Savings Association V. Kitsock, 429 Pa. Super. 561,
633 A.2d 165 (1993) does not warrant a contrary result. Although
marital property converted from tenancy by the entireties to
tenancy in common remains in custodia legis, substantial prejudice
to the former spouse militates against bifurcation in cases such as

this. see, e.g., In re Pollard, 152 B.R. 51 (W.D. Par 1993)(non-
debtor former spouse was unsecured creditor and lost equity in
marital residence); Nicols V. U.s. (92-1404 Memorandum Op., J.
Bloch) (state law of in custodia legis inoperable to prevent
attachment of federal tax lien).
Retirement. Pension and Health Care Benefits
Unless protected by a proper domestic relations order, the
former spouse's entitlement to pension and retirement benefits may
be impaired irreparably if the divorce decree is entored without
such order. See also 20 Par C.S.A. S 6111.2 and discussion, supra.
In the instant case, Husband collects a railroad retirement
pension. Annuities under the Railroad Retirement Act, 26 U.S.C. S
3201 et seq., are comprised of independently-calculated components
called "tiers". The "tier I" (social security level) component is
not divisible in divorce actions. The "tier II" component, which
is computed on the basis of railroad service alone, is divisible.
Former spouses are entitled to a portion of this divisible tier II
benefit. wife's entitlement to her portion of the tier II benefit
may be lost if the court enters a divorce decree prior to resolu-
tion of this issue and entry of an appropriate order awarding Wife
this benefit.
With respect to health insurance, entry of a divorce decree
terminates the former spouse's benefits. Even if continuation of
coverage is available under COBRA, the former spouse may not be
able financially to afford the premiums. Additionally, depending

MEMORANDUM IN SUPPORT OF PLAINTIFF'S
PETITION FOR BIFURCATION
FACTS
Lester K. stone, Plaintiff, is 76 years of age, having been
born on June 8, 19l8. He currently resides with his daughter and
her husband at 216 Faculty Road, Duncannon, Perry County,
Pennsylvania.
Mr. Stone is a retired railroad employee.
Defendant, Dorothy J. stone, currently resides in the
marital home at 230 Salt Road, Enola, Cumberland county,
Pennsylvania. She is 73 years of age having been born on
December lO, 1921. Mrs. stone is a retired PENNDOT employee.
Plaintiff and Defendant were married on September 14, 1941
and have two (2) adult children. Although Plaintiff and
Defendant have lived in the same home intermittently since their
marriage they have not lived together as husband and wife for at
least 15 years.
Between 1982 and 1988 Mrs. Stone lived in Florida and had a
boyfriend. In early 1994 Mrs. Stone forced Mr. Stone to leave
the marital home. He has resided with his daughter in Duncannon,
Pennsylvania since then.
Mr. stone is in very poor health. He suffered a seizure in
June, 1994 while driving a vehicle. This resulted in a traffic
accident causing him serious injuries. He was hospitalized in
the Polyclinic Hospital in Harrisburg, Pennsylvania from June 4,
1994 to August 5, 1994. The unresolved divorce action continues
to weigh heavily upon him ana affects his emotional and physical
well-being.
On July 22, 1983 Mrs. stone filed a divorce complaint to
2166-S-1983, Cumberland County, Pennsylvania, but the action was
purged due to inactivity. In March of 1994 Mr. stone attempted
to resurrect the 1983 divorce action but that was opposed by Mrs.
stone and her attorney, Donald B. Owen, Esquire. To avoid
unnecessary litigation Mr. stone simply filed the instant divorce
action.
On June 27, 1994 Donald B. Owen, Esquire notified Mr. stone,
through his counsel, that he would not be representing Mrs. stone
any longer.
On July 28, 1994 Theresa Barrett Male entered an appearance
on behalf of Mrs. stone in the instant case.
On August ll, 1994 Plaintiff served Defendant with
Interrogatories for Answer by Defendant. Defendant's Answers to
Interrogatories were not filed until after the Petition for
Bifurcation was filed. The Answers are woefully vague and

incomplete.

ARGUMENT
l. The Darties have in fact lived as divorced DeoDle for at
least 15 vears.
The parties have not had a sexual relationship for at least
15 years. Even when residing in the same household they
maintained separate sleeping quarters and did not venture into
the other's bedroom. The marriage has been irretrievably broken
for at least l5 years.
Plaintiff and Defendant used the same kitchen to cook meals
but they did not dine together. Plaintiff and Defendant did not
visit mutual friends or family together and did not entertain
their children and grandchildren together. In fact, Mrs. stone
has neglected her family for many years while Mr. Stone has
maintained a close, loving relationship with all of his children
and grandchildren.
Plaintiff and Defendant maintain separate bank accounts,
separate retirement plans and Defendant has maintained
considerable investments in her own name for many years.

Furthermore, Mrs. stone has maintained a longstanding
extramarital affair which caused her to establish a Florida
residence for almost six (6) years. Even after returning to the
marital home in 1991 Mrs. stone did not attempt to reconcile the
marriage.
This is a prime case for bifurcation. In Mackev v. Mackey,
Par Super , 545 A.2d 362 (1988) the Pennsylvania
Superior Court recognized the appropriateness of bifurcation
where the parties are merely "housemates."
However, for other more compelling reasons, bifurcation is
warranted in the instant case.
2. The Dendino Divorce is an emotional burden on Mr. Stone
and further delav will exaSDerate his condition.
Mr. Stone and Mrs. Stone have lived separate and apart for
at least 15 years. Mr. stone has wanted this divorce for most of
those 15 years but Mrs. stone and/or economic issues have stood
in the way. Now, at age 76 and in a broken physical condition he
needs the divorce for his own emotional and physical well-being.
Bifurcation will enable each party to live the last years of
their lives as separate individuals maintaining the lifestyles
they have grown accustomed to over the past l5 years.
"Bifurcation separates the termination of the marriage from the
distribution of property so that the marriage and each party's

personal life are not held hostage to economic demands." wolk v.
Wolk. supra at 315, 364 A.2d at 136l, as cited in Leese v. Leese,
Par Super. ____, 534 A.2d ll01 (1987).
3. Bifurcation will eliminate the basis for Mrs. stone's
delav and actuallv saeed ua resolution of the economic issues.
Mrs. stone opposes bifurcation for one very invalid reason,
to wit: money or its equivalent. She has done everything in her
power to delay the resolution of the economic issues in the hope
that Mr. Stone will die and she will gain title to the real
estate as the surviving spouse.
Defendant did not answer Plaintiff's Interrogatories for a
period of over six (6) months and probably would not have
answered them on February 7, 1995 if Mr. stone had not filed a
Petition for Bifurcation. When Plaintiff did answer the
interrogatories the answers were ambiguous and vague. She
answered an interrogatory regarding her safe deposit box which
called for a specific and detailed response by stating,
"...Defendant maintains miscellaneous documents in this safe
deposit box." She answered interrogatories regarding her savings
and loan accounts, certificates of deposit, savings bonds,
treasury notes, shares of stock, securities or other investments
by stating: "Defendant has no records, nor has she been able to
secure any records... at the time of separation." Defendant

continues to live in the marital residence and all financial
records are available at her residence.
More importantly, Defendant revealed on her 1994 Income Tax
Return that she had the following Interest and Dividend Income:

Yet, in her answers to interrogatories the only revealed
investment or other source of compensation revealed by Mrs.
stone, other than Social Security and Retirement, was an IRA with
PSECU with a balance of $20,765.99. She failed to list her other
investments with the U.S. Government and Corestate. Obviously,
Plaintiff must now consume additional attorney's fees and
probably many more months of time by filing a Motion to Compel or
some other effort to compel accurate responses from Mrs. stone.
The Mackev Court emphasized that it is important to grant
the bifurcation petition so that Defendant must come to the table
and fully disclose her assets so that an equitable distribution
can be accomplished. Bifurcation in the instant case, as in
Mackev, will assist in speeding up the equitable distribution of
assets instead of delaying the process.
In a letter from Donald B. Owen, Esquire dated May 7, 1994
he states the following regarding Mrs. Stone's intentions:
The bottom line for the moment seems to be

that we are still miles apart in resolving
this matter with or without a divorce.
It would appear that you will have to file a
divorce complaint and proceed with discovery.
Mrs. stone is adamant about protecting ~
savings accounts, notwithstanding the concept
of marital property. She seems very prepared
to defend her notion of equitable
distribution to the death or jail, whichever
occurs first.
Thus, without bifurcation, this divorce may never be granted and
the equitable property issues will be held hostage.
In Leese v. Leese, ___ Pa.Super. ___, 534 A.2d 1101 (1987)
the wife-defendant was 56 years old and the husband-plaintiff was
85 years old. The trial court found that the "Wife-Defendant
believed that she would benefit financially by delaying the
divorce and acquire a greater interest in the entireties real
estate if her husband dies before a divorce decree." The
appellate court found that this was an inadequate reason for
denying the bifurcation petition. In fact, the court ruled that
if a husband did die after a divorce has been granted the
economic claims would be vested.
By virtue of equitable distribution of
marital property and the disposition of other
economic claims, some property may become an
asset of the decedent's estate and shall be
treated by the personal representative as any
other estate asset.

4. Defendant cannot avoid a divorce forever ~erelv to avoid
the Dotential loss of benefits.
Defendant openly opposes bifurcation because she may lose
some retirement benefits or other financial benefits. This is a
circular argument. She doesn't want bifurcation because she
perceives it as not being in her best interest. Defendant "wants
her cake and also wants to eat it." She has lived the life of a
divorced woman for decades but refuses every effort on the part
of Mr. Stone to conclude the marriage and the economic issues at
the same time. He has grown weary and now primarily wants the
divorce. If she truly wants to resolve the economic issues that
can be done after the divorce is granted.
other courts have recognized that the possible or potential
loss of benefits is no reason to deny bifurcation. Obviously
someone may lose something of value or bifurcation would not be a
disputed issue. For example, in Conrad v. Conrad, l2 D&C 4th 39
(1990), the trial court concluded that although certain benefits
may terminate on divorce that loss may not be legal cause for
delaying the divorce. The loss of such benefits cannot be
avoided forever. In addition, the loss of such benefits may be
adjusted by equitable distribution and alimony where warranted.
Furthermore, in the instant case, Defendant cannot establish the
loss of any such benefits, only the potential of such loss.

AND NOW, this 13th day of March, 1995, comes the Petitioner,
LESTER K. STONE, by and through his attorney, Gregory R. Reed,
Esquire, and files this Petition for Bifurcation of the divorce
proceedings, the following being a statement:
1. The parties were married on september 14, 1941 in
Hagerstown, Maryland.
2. As a result of many unhappy and irreconcilable
differences, a complaint In Divorce was filed on July 1, 1994,
averring that the marriage is irretrievably broken. A copy of
said complaint is attached hereto as Exhibit "A".
3. The parties have been separated in excess of
fifteen (15) years.
4. The Petitioner and Respondent request and preserve all
ancillary claims of alimony, alimony pendente lite, counsel fees,
costs and expenses and equitable distribution of property.
5. Extensive discovery which will be required with regard
to Respondent's ancillary claims, has been commenced. Such
discovery will, by necessity, be protracted for many months.
6. The Respondent will in no way be prejudiced by the entry
of an Order for Bifurcation.
7. The benefits of granting the Bifurcation outweigh any
disadvantages.
WHEREFORE, the Petitioner prays this Honorable Court to
enter an Order bifurcating the divorce action and retaining
jurisdiction of all economic claims properly before it.

AND NOW, this 0' ;....- day of June, 1994, comes the Plaintiff,
Lester K. stone, by his attorney, Gregory R. Reed, Esquire, and
files this Complaint In Divorce of which the following is a
statement:
COUNT I: DIVORCE
No-Fault - section 3301(c)
1. Plaintiff is Lester K. stone, who currently resides 216
Faculty Road, Duncannon, Perry county, Pennsylvania.
2. Defendant is Dorothy J. stone, who currently resides 230
Salt Road, Enola, Cumberland County, Pennsylvania.
3. Plaintiff and Defendant have been bona fide residents in
the Commonwealth of Pennsylvania for at least six (6) months
immediately previous to the filing of this Complaint.
4. The Plaintiff and Defendant were married on September
14, 1941 at Hagerstown, Maryland.
5. A Complaint For Divorce was tiled by Defendant on July
22, 1983 to No. 2166 Civil - s 1983 but on October 28, 1986 the
case was dismissed for inactivity pursuant to Cumberland County
Rule of procedure No. 228.
6. The marriaq8 is irretrievably broken.
7. The plaintifl has been advised of the availability of
counseling and that the Plaintiff my have the right to request
that the Court require the parties to participate in counseling.
WHEREFORE, Plaintiff requests your Honorable Court to enter
a Decree of Divorce, divorcing the Plaintiff and Defendant.
COUNT II: EOUITABLE DISTRIBUTION
8. Paragraphs 1 through 7 are incorporated by reference
hereto as fully set tho~gh the same were set forth at length.
9. Plaintiff and Defendant have legally acquired property,
both real and personal, during their marriage from September 14,
1941 through February 1, 1994, the date of separation, all of
which is "marital property".
10. Plaintiff and/or Defendant have acquired, prior to the
marriage or subsequent thereto, "nonmartial property" which has
increased in value since the date of the marriage and/or
subsequent to its acquisition during the marriage, which increase
in value is "marital property."
11. Plaintiff and Defendant have been unable to agree as to
an equitable division of said property to the date of the filing

Pursuant to 23 Pa, C.S,A, 55 3104 and 3502 (Purdon 1991) and
Pennsylvania Rule of civil Procedure 1920,43, Petitioner Dorothy J,
stone, by her attorney, Theresa Barrett Male, Esquire, petitions
this court as follows:
1. Petitioner Dorothy J. stone, the defendant in the above-
referenced divorce action filed on July 5, 1994, currently resides
at 230 Salt Road, Enola, Pennsylvania 17025.
2. Respondent Lester K, stone, the plaintiff in the proceed-
ing, currently resides at 216 Faculty Road, Duncannon, Pennsylvania
17020.
3. The parties own as tenants by the entireties improved
real estate situated at 230 Salt Road, Enola, Cumberland County,
Pennsylvania.

4. By letter dated March 13, 1995, Respondent I. coun..l
forwarded to Petitioner's counsel a delinquent tax notice for the
19!/4-95 real estate taxes on the property, True and correct cop i..
Clf the letter and the notice are attached as Exhibit "A" and "B"
respectively.
5. Petitioner received no notice regarding the taxes prior
to receipt of counsel's March 14, 1995 letter because the tax bill
was forwarded to Respondent IS residence in Ouncannon and not to the
property address.
6, By letter dated March 20, 1995, Alicia stine, Treasurer
of East pennsboro Township, confirmed that the original notice was
mailed to Respondent at 216 Faculty Road, Ouncannon address on July
1, 1994. A true and correct copy of the letter is attached as
Exhibit "e",
7. Under cover of letter dated March 29, 1995, Petitioner's
counsel forwarded to Ms, stine a check in the amount of $938.29
toward payment of the taxes, and advised her that any deficiency
was the responsibility of Respondent, A true and correct copy of
the letter is attached as Exhibit "0",
8. By letter dated March 29, 1995, Petitioner's counsel
requested that Respondent pay the difference, which amounted to
$114,89. A true and correct copy of the letter is attached as
Exhibit "E",
9. By letter dated March 30, 1995, Ms. stine returned
Petitioner's check, indicating that she would not accept partial

payment for the delinquent taxes. A true and correct copy of the
letter is attached as Exhibit "F".
10, Petitioner's counsel has not received a rep~y to her
March 29, 1995 letter to opposing counsel.
11. The taxes will be turned over to the Cumberland County
Tax Claim Bureau on April 15, 1995 if payment in full is not
received by that date,
12, Petitioner is prepared to pay $938,29, the amount of the
taxes due by August 31, 1994.
13, Respondent's nine-month delay in forwarding the tax
notice should not enure to Petitioner's detriment.
14, At present, the difference between the taxes due in July,
1994 and the tax payment due now is $114.89,
15, Petitioner is 73 years old and on a fixed income.
WHEREFORE, Petitioner requests the court to enter an order
requiring Respondent to pay any all interest and penalties accrued
on the tax liability from September 1, 1994 to present,

Pursuant to Rule 4019 of the Pennsylvania Rules of Civil
Procedure, Defendant Dorothy J, Stone, by her attorney Theresa
Barrett Male, Esquire, moves the court to order Plaintiff's
compliance with discovery as follows:
1. Under cover of letter dated September 29, 1995, defen-
dant's counsel. served plaintiff with Interrogatories pursuant to
Pennsylvania Rules of civil Procedure 1920.22 and 4005.
2. In accordance with Rule 4006, plaintiff'S answers were
due on or about October 29, 1995,
3, Plaintiff failed to answer the interrogatories by October
29, 1995.
4, Under cover of letter dated July 26, 1996, defendant's
counsel served plaintiff with a second set of Interrogatories.

6. Plaintiff failed to answer the interrogatories by August

7. Under cover of letter dated september 3r 1996/ defen-

8. By letter dated september 4/ 1996, plaintiff's counsel
advised defendant's counsel that plaintiff would not answer the

9. On information and belief, the problem is with plaintiff

litigation and live the balance of his life free of interference
from Defendant, As such, he had great difficulty, mentally and
emotionally, responding to discovery requests,
9. Plaintiff's response to paragraph 8 of Defendant's Motion
is incorporated herein by referenced as though fully set forth
herein,
10, Preparation of interrogatories and several letters are
costs which Defendant would have incurred regardless of when the
interrogatories were answered, Furthermore, the failure to
respond was substantially due to circumstances beyond Plaintiff's
control and certainly was not vexatious or designed to harm
anyone,
11, Both sets of Interrogatories have been answered, Under
the circumstances of Plaintiff's deteriorated physical and
emotional condition his failure to promptly answer
interrogatories is understandable, There was nothing vexatious
about his failure to promptly answer the interrogatories and he
certainly was not acting in bad faith, Furthermore, Defendant
has a history of dilatory conduct. She filed a divorce action
against Plaintiff in Cumberland County to No, 2166-S-1983 on July
22, 1983 but it was purged because of inactivity,
