RICKY R. WILLIAMS and JIMMY RHEA/H.G. & F. CO., Defendants COMPLAINT AND NOW, comes the plaintiff, Kelli Evans, by her attorneys, Fowler, Addams, Shughart & Rundle, and makes the following complaint: 1. The plaintiff is Kelli Evans, an adult individual residing at 1467 Old Easley Highway, Easley, South carolina 29640. 2. Defendant Ricky R. Williams is an adult individual residing at Route 1, Box 217, Houston, Mississippi 38851. 3. Defendant Jimmy Rhea/H.G. & F. co., Inc., is a corporation with its offices and principal place of business at 564 Jackson, 1I0uston, Mississippi 38851. 4. At all times relevant hereto, Defendant Williams was acting as the agent, servant and employee of Defendant Jimmy Rhea/H.G. & F. Co., Inc., and was driving the tractor and trailer owned by said corporation. 5. On August 16, 1993, at about 9110 p.m. the plaintiff was a passenger in a 1993 Ford Aerostar van operated by Cheryl Ann Evans which was traveling south in the right hand lane of 1-81 at about milepost 33.5 in Penn Township, Cumberland County, Pennsylvania. 6. At said time and place Dsfendant Williams was operating a 1987 Freightliner traveling south in the left hand lane when he negligentlY and carelessly allowed his rig to leave the left side of the left lane. When he attempted to return to the left lane, his unit swerved to the right and the right front of the traotor collided with the left rear side of the Ford, causing it to spin out of control. It was again hit by the truck, flipped, and came to rest on its roof in the medial strip. 7. Defendant Ricky R. Williams was negligent and oareless inl A. Permitting his vehicle to leave the travel portion of the highway. B. Being inattentive to his driving. C. Failing to have his vehicle under control. D. Failing to yield the right of way to the plaintiff's vehicle. E. Failing to observe the plaintiff's vehiole in time to avoid a collision. 7. As a result of the negligence and carelessness of the defendants, the plaintiff sustained serious injuries including a complex laceration of her left hand with extensor tendon injury, which may be permanent. 8. As a result of her injuries, the plaintiff was admitted to the chambersburg lIospital and has inourred medioal eKpsns8 in exoess of $8,000.
