COMPLAINT
AND NOW, comes Plaintiff, MOORE'S LUMBER AND BUILDING
SUPPLIES, a division of HARCROS LUMBER AND BUILDING SUPPLIES, INC.,
by its attorneys, KUNDRAT & SEDOR, and states the following cause
of actionl
1. plaintiff, MOORE'S LUMBER AND BUILDING SUPPLIES, a
division of HARCROS LUMBER AND BUILDING SUPPLIES, INC., is a
Virginia corporation registered to conduot business within the
commonwealth of PennSYlvania, with a place of business situate at
3442 simpson Ferry Road, Camp Hill, Cumberland county, Pennsylvania
17011.
2. Defendant, LimN S. BURKHOLDER, is an adult
individual with a last known address of 1151 ~ing Drive,
chambersburg, Franklin County, Pennsylvania.
3. Defendant, ROBIN R. BURKHOLDER,
individual with a last known address of 1151

4. Defendant LEON S. BURKHOLDER, INC., (IIBURKHOLDERII)
is a Pennsylvania corporation with offices and/or a place of
business situate at 1451 Lincoln Way East, Chambersburg, Franklin
county, Pennsylvania.
5. IIBURKHOLDERII is, and at all relevant times was, a
contractor.
6. On or about July 6, 1992, Defendant applied to
Plaintiff for credit. A true and correct copy of the credit
application is attached hereto and made a part hereof and marked
EKhibit IIAII.
7. Between November 26, 199J, and April 29, 1994,
various products, goods, supplies, and materials (hereinafter
collectively referred to as IIproductsll) were ordered by
IIBURKHOLDERII from Plaintiff. Plaintiff sold and provided the
products ordered by Defendant, the same being represented by the
invoices attached hereto and made a part hereof and collectively
referred to as Exhibit IIBII. However, the Invoices are omitted due
to their extensive volume, and will be supplied upon the request of
lJofendant.
8. The produots identified on the invoioes attaohed as
Exhibit "B" were supplied to and aooepted by "BURKHOLDER", or its
authorized representative.
9. The prioes oharged for the produots sold to
as Bet forth in EKhibit "B" were the fair, reasonable, and market
prices of the produots, and the prices that "BURKHOLDER" agreed to
pay.

10. Plaintiff has maintained a statement of account
keeping an accurate and running amount of debits and credits for
the sale of produots sold to "BURKHOLDER" by Plaintiff.
11. Plaintiff has submitted to "BURKHOLDER" statements
of account accurately showing all debits and credits for
transactions with "BURKHOLDER", said atatements of account showing
an amount owing to Plaintiff of $95,700.35 through April 29, 1994.
copies of the statements of account are attached hereto and made a
part hereof and collectively referred to as Exhibit "C". However,

12. Pursuant to the terms and oonditions of sale
contained on the credit application which terms and conditions were

17. The amount in controversy is not within the
jurisdictional amount requiring compulsory arbitration.

agreed to by Plaintiff and "BURKHOLDER", and as further stated on
the invoices attached as Exhibit "BII, Plaintiff is entitled to
receive a finance charge of 1.5% per month on past due amounts.
13. Pursuant to the terms and conditions of sale and
extension of credit, "BURKHOLDER" agreed to pay reasonable
attorney's fees and all court and collection costs.
14. Plaintiff has retained the services of the law firm
of KUNDRAT & SEDOR at the rate of $125.00 per hour in the
collection of the amounts due from Defendant.
15. Plaintiff has incurred reasonable attorney's fees
from the law offices of KUNDRAT & SEDOR as of June 22, 1994, in the
amount of $625.00 at the rate of $125.00 per hour in the colleotion
of the amounts due from Defendant incident to the commencement of
the within action; Plaintiff shall continue to incur such
attorney's fees throughout the conclusion of the proceedings.
16. Any and all conditions precedent to the bringing of
this action has been performed by Plaintiff.
COUNT I
KOORI'S LUMBER AND BUILDING SUPPLIIS V. LION S. BURKHOLDER. INO.
gplN AOCOUNT
18. Plaintiff incorporates by reference Paragraphs 1
through 17 of its Complaint as thuugh the same were set forth at
length herein.
19. The invoices attached to Plaintiff's Complaint as
Exhibit "B" represent products sold by Plaintiff and purchased by
"BURKHOLDER" pursuant to "BURKHOLDER'S" account with Plaintiff.
20. "BURKHOLDER" has not objected to any of these
invoices and has accepted the products provided thereby, but has
failed to pay Plaintiff despite demand pursuant to its open
account, all to the damage of Plaintiff.
WHEREFORE, Plaintiff MOORE'S LUMBER AND BUILDING BUPPLIES,
respectfully requeets thie Honorable Court to enter judgment in
favor of Plaintiff and against "BURKHOLDER" in the amount of
$95,700.35, plus interest at the rate of 1.5\ per month from June
fl, 1994, reasonable attorney's fees calculated at $125.00 per
hour, the coste of thie action, and such other relief as the court
deems just and proper.

NOORI'S LUNBRR AND BUILDING SUPPLIIS V.
LION S. BURKHOLDIR and ROBIN R. BURKHOLDIR
~OINTLY AND SIVIRALLY
(Guaranty)
u. plaintiff incorporates by reference Paragraphs 1
through 20 of its complaint as though the same were set forth at
length herein.
u. In consideration of the elCtension of credit by
Plaintiff to IIBURKHOLDER", Defendant, LEON S. BURKHOLDER and
Defendant, ROBIN R. BURKHOLDER, executed a personal guaranty being
incorporated into said credit application.
23. Pursuant to the terms and conditions of the
guaranty, Defendant, LEON B. BURKHOLDER and Defendant, ROBIN R.
BURKIIOLDER, jointly and soverally, unconditionally guaranteed the
payment of all amounte owed by "BURKHOLDERII to Plaintiff in
addition to reasonable attorneys fees and costs incurred in the
collection of any amount due from "BURKHOLDER".

24. Pursuant to the terms and oonditions of sale on
"BURKHOLDER'S" credit application, Defendants, LEON S. BURKHOLDER
and ROBIN R. BURKHOLDER specifically agreed that:
. . . the undersigned Guarantor (even if more than one)
hereby warrants and uncondi tionally guarantees to Moore's
the full and prompt payment when due (including any
accelerated or extended maturity) of all indebtedness,
obligations and liabilities of Customer to Moore's
including finance charges applicable hereto, now existing
or hereafter created or arising, even if such
indebtedness is in excoss of the applied for, or
established credit line. Guarantor further agrees to pay
all expenses, including expense of court costs and
attorney's fees paid or incurred by Moore's in
endeavoring to collect such indebtedness or any part
thereof or in enforcing the Guaranty.
25. Despite demand, Defendant, LEON S. BURKHOLDER and
ROBIN R. BURKHOLDER have refused to pay the past-due balance on the
open account of "BURKHOLDER" and all sums due and owing to
Plaintiff.
WHEREFORE, Plaintiff MOORE'S LUMBER AND BUILDING SUPPLIES,
respectfully requests that jUdgment be entered in its behalf and
against LEON S. BURKHOLDER and ROBIN R. BURKHOLDER in the amount of
$95,700.35 plus interest at the rate of 1.5% per month from June H,
1994, plus reasonable attorney's fees calculated at a rate of

$125.00 per hour, plus the oosts of this aotion, and suoh relief as
the court deems just and propsr.

AND NOW, comes Plaintiff, MOORE'S LUBBER AND BUILDING
SUPPLIES, a division of HARCROS LUMBER AND BUILDING SUPPLIES, INC.,
by its attorneys, KUNDRAT' SEDOR, and states the following cause
of actionl
1. Plaintiff, MOORE'S LUMBER AND BUILDING SUPPLIES, a
division of HARCROS LUMBER AND BUILDING SUPPLIES, INC., iB a
Virginia corporation registered to conduct business within the
Commonwealth of PennsYlvania, with a place of business situate at
3442 Simpson Ferry Road, camp Hill, cumberland county, Pennsylvania
17011.
2. Defendant, LFON S. BURKlloLDER, is an adult
individual with a last known address of 1151 King Drive,
chambersburg, Franklin County, Pennsylvania.

business situate at 1451 Lincoln Way East, Chambersburg, Franklin
County, Pennsylvania.
5. "BURKHOLDER" is, and at all relevant times was, a
contractor.
6. On or about July 6, 1992, Defendant applied to
Plaintiff for credit. A true and correct copy of the credit
application is attached hereto and made a part hereof and marked
Exhibit "A".
7. Between November 26, 1993, and April 29, 1994,
various products, goods, supplies, and materials (hereinafter
collectively referred to as "products") were ordered by
"BURKHOLDER" from Plaintiff. Plaintiff sold and provided the
products ordered by Defendant, the same being represented by the
invoices attached hereto and made a part hereof and collectively
referred to as Exhibit "B". However, the Invoices are omitted due
to their extensive volume, and will be supplied upon the request of
Defendant.

8. The products identified on the invoices attached as
Exhibit IIBII were supplied to and accepted by IIBURKHOLDERII, or its
authorized representative.
9. The prices charged for the products sold to
as set forth in Exhibit "B" were the fair, reasonable, and market
prices of the products, and the prices that "BURKHOLDER" agreed to
pay.
10. Plaintiff has maintained a statement of account
keeping an accurate and running amount of debits and credits for
the sale of products sold to "BURKHOLDER" by Plaintiff.
11. Plaintiff has submitted to "BURKHOLDER" statements
of account accurately showing all debits and credits for
transactions with "BURKHOLDER", said statements of account showing
an amount owing to Plaintiff of $95,700.35 through April 29, 1994.
Copies of the statements of account are attached hereto and made a
part hereof and collectively referred to as Exhibit "C". However,
the statements are omitted due to their extensive volume, and will
be supplied upon the request of Defendant.
12. Pursuant to the terms and conditions of sale
contained on the credit application which terms and conditions were

agreed to by Plaintiff and "aURKHoLDERII, and as further stated on
the invoices attached as Exhibit "a", plaintiff is entitled t.o
receive a finance charge of 1.5' per month on past due amounts.
13. Pursuant to the terms and conditions of sale and
extension of credit, "BURKHOLDER" agreed to pay reasonable
attorney's fees and all court and collection costs.
14. Plaintiff has retained the services of the law firm
of KUNDRAT & SEDOR at the rate of $125.00 per hour in the
collection of the amounts due from Defendant.
15. Plaintiff has incurred reasonable attorney's fees
from the law offices of KUNDRAT & SEDOR as of June 22, 1994, in the
amount of $625.00 at the rate of $125.00 per hour in the collection
of the amounts due frum Defendant incident to the commencement of
the within action; Plaintiff shall continue to incur such
attorney's fees throughout the conclusion of the proceedings.
16. Any and all conditions precedent to the bringing of
this action has been performed by Plaintiff.
17. The amount in controversy is not within the
jurisdictional amount requiring compulsory arbitration.

HOORE'S LUHBER AND BUILDING SUPPLIES V. LEON S. BURKHOLDER. INC.
OPEN ACCOUNT
18. Plaintiff incorporates by reference Paragraphs 1
through 17 of its Complaint as though the same were set forth at
length herein.
18. The invoicee attached to Plaintiff's complaint as
EKhibit "B" represent products sold by Plaintiff and purchased by
"BURKHOLDER" pursuant to "BURKHOLDER'S" account with Plaintiff,
20. "BURKHOLDER" has not objected to any of these
invoices and has accepted the products provided thereby, but has
failed to pay Plaintiff despite demand pursuant to its open
account, all to the damage of Plaintiff.
WHEREFORE, Plaintiff MOORE'S LUMBER AND BUILDING SUPPLIES,
respectfully requests this Honorable Court to enter jUdgment in
favor of Plaintiff and against "BURKIIOLDER" in the amount of
$95,700.35, plus interest at the rate of 1.5' per month from June
8, 1994, reasonable attorney's fees calculated at $125.00 per
hour, the costs of this action, and such other relief as the court
deems just and proper.

MOORI'S LUMBER AND BUILDING SUPPLIES V.
LION S. BURKHOLDER and ROBIN R. BURKHOLDER
~OINTLY AND SEVERALLY
(Guaranty)
U. plaintiff incorporates by reference Paragraphs 1
through 20 of its complaint as though the same were set forth at
length herein.
22. In consideration of the extension of credit by
plaintiff to "BURKHOLDER", Defendant, LEON S. BURKHOLDER and
Defendant, ROBIN R. BURKHOLDER, executed a personal guaranty being
incorporated into said credit application.
23. pursuant to the terms and conditions of the
guaranty, Defendant, LEON S. BURKHOLDER and Defendant, ROBIN R.
BURKHOLDER, jointly and severally, unconditionally guaranteed the
payment of all amounts owed by "BURKHOLDER" to Plaintiff in
addi tion to reasonable attorneys fees and costs incurred in the
collection of any amount due from "BURKHOLDER".

24. Pursuant to the terms and conditions of sale on
"BURKHOLDER'S" credit application, Defendants, LEON S. BURKHOLDER
and ROBIN R. BURKHOLDER specifically agreed thatl
. . . the undersigned Guarantor (even if more than one)
hereby warrants and unconditionally guarantees to Moore's
the full and prompt payment when due (including any
accelerated or eKtended maturity) of all indebtedness,
obligations and liabilities of Customer to Moore's
including finance charges applicable hereto, now existing
or hereafter created or arising, even if such
indebtedness is in excess of the applied for, or
established credit line. Guarantor further agrees to pay
all expenses, including expense of court costs and
attorney's fees paid or incurred by Moore's in
endeavoring to collect such indebtedness or any part
thereof or in enforcing the Guaranty.
25. Despite demand, Defendant, LEON S. BURKHOLDER and
ROBIN R. BURKHOLDER have refused to pay the past-due balance on the
open account of "BURJ<HOLDER" and all sums due and owing to

WHEREFORE, Plaintiff MOORE'S LUMBER AND BUILDING SUPPLIES,
respectfully requests that judgment be entered in its behalf and
against LEON S. BURKIIOLDER and ROBIN R. BURKHOLDER in the amount of
$95,700.35 plus interest at the rate of 1.5% per month from June 8,
1994, plus reasonable attorney's fees calculated at a rate of

NOW COME, Defendants, Leon S. Burkholder and Robin R.
Burkholder, by their undersigned oounsel, and preliminarily
objeot to Plaintiff's Complaint as follows:
Petition Raising Question of Improper Venue

This action has been instituted in Cumberland County.

The Defendants are individuals residing in Franklin
County, Pennsylvania.
The venue of this action is improper in Cumberland County,
since under Pa. R. civ. P. 1006, Plaintiffs may only bring this
action against Defendant in the county in which he may be
served, or in which the cause of action arose, or where Q
transaction or occurrence took place out of which the cause of
aotion arose.

Plaintiff's Complaint against Defendants sets forth a
cause of action which arose in Franklin county, Pennsylvania,
where Defendants guaranteed the account of Leon S. Burkholder,
Inc. Leon s, Burkholder, Inc.'s principal place of business is
Franklin County, Pennsylvania. Defendants dealt with
Plaintiff's store located in chambersburg, Franklin County, Pennsylvani

No transaotion or ocourrence out of whioh the oauls of
action arOBe occurred in cumberland county.

Defendants were not personally served in Cumberland
county. Defendants were eerved with a copy of the complaint by
the sheriff of Franklin county, who wae deputized by the
Sheriff of thie cumberland county.

be dismissed for improper venue and/or transferred to Franklin
