PRB-TRIA~ MEMORANDUM OF DEFENDANT
I. STATEMENT OF FACTS
Plaintiffs are the owners of a 1968 Jeep Grand Wagoneer that
they first brought in to be serviced by Defendant on July 7,
1993. At that time, the vehicle had almost 90,000 miles on it.
Defendant clearly advised Plaintiffs that the engine was In poor
shape and needed to be replaced. Plaintiffs elected to have the
vehicle repaired rather than replace the engine.
Defendant
specifically advised Plaintiffs that one part of the engine might
be fixed and something else could go wrong.
Defendant made
several repairs to different parts of the engine between July and
November 1993. The repairs totaled approximately $1,200,00. In
addition, Plaintiffs had the vehicle serviced at other places
throughout this period.
On November 9, 1993 Plaintiffs brought the vehicle into
Defendant's place of business for service. At that time, the
vehicle had a little over 96,000 miles on it. Defendant replaced

Shortly after picking up the vehicle,
Plaintiff's wife was driving on the Pennsylvania Turnpike when
the engine failed. PIa int iff s I expert has indicated that the
engine failed because of faulty work performed on a certain
section of the engine upon which Defendant never worked,

plaintiff finally replaced the engine as originally recommended
by Defendant.
II. DAMAGES
plaintiff is claiming $2,636.72 representing the cost of ths
new engine. They ars also claiming $334.95 representing the cost
of a rental vehicle while the engine was being replaced.
Defendant denies any responsibility for the payment of any of
these charges, especially in view of the fact that the car needed
a new engine all along.
III. STATEMENT OF PRINCIPAL ISSUES OF LIABILITY AND DAMAGES
There are no complicated legal issues in connection with the
liability and damage positions of the parties.

AND NOW, comes Defendant by and through its attorneys,
Saidis, Guido, Shuff & Mas land, and answers the Complaint as
follows I
1. Admitted.
2. Admitted in part and denied in part. The allegations
dealing with the work done on Plaintiff's engine and the costs
thereof are admitted.
It is also admitted that Plaintiff was
advised to forego any repairs to the existing engine and replace
it with a new engine. All allegations dealing wich a purported
warranty are denied. To the contrary, Defendant specifically
advised Plaintiff that he should get a new engine rather than
make any repairs to the existing engine.

Defendant denies that the oil filter placed on Plaintiff's
vehicle was improper or in any way contributed his engine failure.

11. The responses set forth in paragraphs 1-10 above are
incorporated herein by reference.
12. Plaintiff's vehicle was a 1988 Jeep Wagoner with
approximately 90,000 miles on the date of first service by
Defendant.
13. On the date of first service by Defendant, and several
times thereafter, Plaintiff was advised that because of the age
and condition of the engine, he should obtain a new engine and
not make costly repairs to the current engine.

14, The work done by Defendant as outlined in paragraph 1
of the Complaint had nothing whatsoever to do with the engine
failure referred to in paragraph 7 of the Complaint. The work
was performed on a different portion of the engine and Defendant
had no reason to be working on the part of the engine that
eventually failed.
15, The work done by Defendant as outlined in paragraph 2
of the Complaint had nothing whatsoever to do with the engine

failure referred to in paragraph 7 of the Complaint. The work
wae performed on a different portion of the engine and Defendant

16. The work done by Defendant as outlined in paragraph 5
of the Complaint had nothing whatsoever to do with the engine
failure referred to in paragraph 7 of the complaint. The work
wae performed on a different portion of the engine and Defendant
had no reason to be working on the part of the engine that
eventually failed.
17. On November 9, 1993, Plaintiff's vehicle had over
96,000 miles on the engine.
lB. The placement of an improper oil filter onto
Plaintiff's vehicle (which is denied by Defendant for the reasons
set forth above) would not in any way contribute to the engine
failure referred to paragraph 7 of the Complaint.
WHEREFORE, Defendant prays this Honorable Court to dismiss
the Complaint and enter judgment in favor of the Defendant.
