AND NOW, this 21st day of April, 1997, after
hearing and consideration of the testimony presented, we vacate
our Order of August 20, 1996, which suspended the Defendant's
visitation rights.
The District Attorney will be presenting a
nol-pros of the criminal charge against the Defendant, which
charge underlay the suspension of visitation. The Distriot
Attorney has indioated that he would be presenting this within
the next day or two.
Visitation of the Defendant father with the child
shall be in accordance with our Order of April 25, 1996, except
that Paragraph 3 is modified as followsl
(3) The Defendant, Patrick Fealtman, shall have
partial or temporary custody of the said minor child, for the
purposes of visitation, every other weekend from Saturday at
9100 a.m. until Sunday at 6100 p.m.
In all other respects, the April Order is
reaffirmed.

11 A Sixteen.

14 Q Where do you go to school?
15 A I'm a Cumberland Valley Student, but I go to
16 the alternative program at East Pennsboro.
17 Q What grade are you in?
la A I'm a sophomore.
19 Q Do you know Patriok pealtman?
20 A Yes, I do.
21 Q How long have you known him?
22 A Four or five years.
23 Q How do you know him?
24 A There was an inoident I live in a trailer
25 park along Carlisle Pike. There was an incident with him

1 and my best friend at the A Plus, and the cops brought him
2 back into the trailer park to question him. And a mutual
3 friend of ours, Heather, was at my house and took me outside
4 and introduced me to him.
5 Q Four or five years ago?
6 A Yes.
7 Q You were what?
8 A Eleven or twelve.
9 Q After you met him, did you have occasion to
10 be with him and be supplied alcohol by him?
11 A Yes, I did.
12 Q How old were you when he first supplied you
13 with alcohol?
14 A It was not too long after I met himl so, at
15 the oldest, I might have been thirteen.
16 Q Thirteen?
17 A Yes.
18 Q Where were you when he supplied you with this
19 alcohol?
20 A On one occasion, I was at Heather's house --
21 on more than one occasion, I was at Heather's house. There
22 was a time where we went -. a group of us went up off of
23 Wertzville Road, up into like the mountain, and we were up
24 there drinking.
25 Q Was there an occasion when he had sexual

relations with you?
A Yes, there was.
Q How old were you?
A The one time I was -- both times I was around
the age of fourteen.
Q Were those occasions with your consent?
A On one occasion, I was intoxicated, so I
can't really, you know --
Q Let's talk about that occasion. You were
fourteen?
A Yeah.
Q You were intoxicated, meaning you had
consumed alcoholic beverages?
A Yeah.
Q Who had supplied them to you?
A Pat.
Q Mr. Fealtman?
A Yeah.
Q Did he supply you with anything else that
day?
A Yes, he did.
Q What else?
A He had pot, which, at the time, he had said
was laced with acid, but I don't know if it was or not, and
he also had a little bit of coke that night.

think. Her boyfriend at the time was there, and I believe
her boyfriend at the time was Tom. There was also a friend
of Pat's there named Rick.

A I think Tom was nineteen, and I don't know
Rick's age.
Q Did Patrick Moonan supply them with alcohol,
as well -- I'm sorry, Patrick Fealtman? I got that wrong.
A Him and Rick had brought the alcohol there,
so, yeah.
a Did Patrick Fealtman also provide them with
marijuana?
A Yes, he did.
a How was it that he had sexual relatione with
you that night?
A I really don't know how it all came about. I
have heard different stories, because, basically, I blacked
out. From what I understand --

A Yes.
o Who was with you?
A Nobody.
o Did you talk to Patriok Fealtman later and
ask him about that inoident?
A No, I did not. I didn't see him after that.
o That was the last time you saw him?
A Well, I have seen him twioe sinoe then, I
think, but it was like I didn't see him after that for a
while.
o Do you believe he had sexual relations with

A I believe at the time she was eighteen or

A Maybe four or five .- anywhere from three to
five times.

a Miss Kope, you indicated that you met Mr.
Fealtman when you were about eleven or twelve years old?
A Yes.
a So that would have been what, 1991?
A Somewhere around then.
a The incident you testified to where he
supplied you with cocaine, when did that happen?
A It was like -- I believe it was 1993. It was
Easter weekend.
a You also indicated that you knew how to snort
coke?

9 Q -- where it was supplied by somebody else?

11 Q Do you recall specifically when in 1994 you
12 had contact with Mr. Fealtman? You indicated there was an
13 incident where you were with him.
14 A It was -- it was the beginning of the summer.
15 Q Of 1994?
16 A Yeah. I would say it was probably somewhere
17 around the middle of Juna. Sometime in the month of June, I
18 believe. I'm not real sure, though.

do direot that the Defendant shall have a Christmas-time visit
with Gr8gory, which both sides have agreed shall be a

1915.3-8(b), the undersigned Custody Conciliator submits the
following reportl
1. The pertinent information pertaining to the child who is the
subject of this litigation is as followsl
Gregory Michael Fealtman, born February 11, 1992.
2. A Conciliation Conference was held on February 20, 1997, with
the following individuals in attendancel
The Father, Patrick Fealtman, who appeared without oounsel;
and the Maternal Grandfather, Patrick Moonan, who appeared
without counsel.
3. This is a situation that was before Judge George E. Hoffer on
a hearing in April of 1996 at which time he awarded custody of
the minor child to the Maternal Grandparents and provided the
Father with temporary oustody on an alternating weekend basis.
In August of 1996, the Maternal Grandparents filed a Petition
for Special Release suggesting that the Father recently was
charged with abducting a minor girl and also indecent assault
towards this minor girl. At that time, Judge Hoffer suspended
the Father's visitation rights with his son pending the
resolution of those criminal charges.
4. The Father went to trial in tIle fall of 1996 on the criminal
charges and there was a hung jury. The case is still pending
with the District Attorney for purposes of whether that office
will proceed with the second trial.
5. Father maintains hls innocence wi th respect to those criminal
charges. Furthermore, he suggests that there was not a
problem when he was seeing Gregory Michael from the April
Order until August when the Order was terminated. The Father
wants to again renew his periods of temporary custody wi th the
child. The Grandparents are reluctant to agree to the Father
seeing the child until more information is obtained and a
resolution is obtain with respect to the criminal charges.

IN ACCORDANCE WITH TilE CUMBERLAND COUNTY CIVIL RULE OF PROCEDURE
1915.3-8(b), the undersigned Custody Conciliator submits the
following report:
1. The pertinent information pertaining to the child who is the
subject of this litigation is as follows:
Gregory Michael Fealtman, born February 11, 1992.
2. A Conciliation Conference was held on July 17, 1997, with the
following individuals in attendance:
The Father, Patrick Fealtman, who appeared without counsel and
the paternal grandmother, Denise Moonan, who appeared without
counsel. The Mother of the child, Amy Moonan Lucas, is not
now living with here parents. She does see her son on
occasion pursuant to an agreement reached between her and her
parents.
There is a long historj' in this case. In February of 1995,
there was a Court Order after a hearing which provided the
Mother and Father would share legal custody with the Mother to
have primary physical custody and the Father to have what the
Conciliator believes to be liberal periods of temporary
custody. In July of 1995, the maternal grandparents filed a
petition at which time they were granted temporary custody
pursuant to the reconunendation of the Custody Conciliator.
The Father continued to have alternating weekends. In April
1996 at a hearing, the Father's periods of temporary custody
were reduced to so that he only had alternating weekends and
reasonable time at Christmas. The April 1996 Order eliminated
other periods of temporary custody that the Father had on
other holidays and vacation over the sununer. In August 1996,
the Court suspended the Father's visitation with the minor
child based upon criminal charges filed against the Father
involving the alleged abduction of a fourteen year old girl.
In April of 1997, tllose criminal charges were dismissed by the
district attorney's office and this Court issued an Order
reinstating the prior custody Order but reducing Father's
alternating weekends from Thursday until Sunday to Saturday
until Sunday.

4. Father now petltlons the Court to obtaln a one-week vaoatlon
wlth the mlnor chlld dur1ng the Bununer and to obtaln a
specUlc perlod of tlme over the Chr1stmas hol1day. The
maternal grandparents are unwl11lng to grant Father any more
tlme because they take the posltlon that they feel the Court
provlded Father wlth only 11mlted tlme because of what they
belleve to be Father's erratlc conduct. Father belleves he
has demonstrated that he ls able to take care of the chlld and
ls not a threat to the chl1d and ls deslrlng of at least a
week's vacatlon In the sununer and a speclfled tlme over
Chrlstmas. The partles could not agree, and a hearlng ls
necessary. A hearlng should take no more than two (2) hours.
5. The Concl1lator reconunends an Order ln the form as attached.

AND NOW come the above-named Plaintiffs, by thier allomey, Samuel L. Andes,
and petition the court for special relief in the above mailer based upon the follow:
I, The petitioners herein are Patrick Moonan and Denise Moonan, his wife. The
respondent herein is the Defendant Patrick Fealtman,
2, By an order dated 25 April 1996, entered after a full hearing, this Court
awarded Petitioners primary physical custody of the minor child. Gregol)' Michael
Fealtman, bom II FeblUary 1992, and granted the respondent limited contact with the
child,
3, This Court entered that order, based upon, in pal)', the respondent's histol)' of
sexual abuse of young girls and abuse of dl1lgs and conllPtion of minors.
4, In May of 1996. the defcndant was charged criminally with Unlawful Restraint.
Conllption of Minors an dlndesccllt Assault by thc Pennsylvania State Police, That
charge resulted from his abducting a fourtecn year old girl, at knife point, in a attempt to
force her to hove sex with him,

list of witnesses that will be called by each party, and a summary
of the anticipated testimony of each witness. This Memorandum
shall be filed at least ten (10) days prior to the hearing dats.
2. Psnding further Order of this Court, this Court's prior Order
of February 6, 1995, shall remain in effect subjeot to the
following modifications I
A. The maternal grandparents, Patrick Moonan and Denise
Moonan, shall have temporary custody with the minor child from
July 2B, 1995, until August 6, 1995, for purposes of taking
the child to Indiana for a family trip. In light of this
vacation, the Father's weekend of temporary custody to start
on July 27 shall be suspended.
B. The Father shall have exclusive physical custody of the
minor child from August 7, 1995, through August 13, 1995, for
purposes of Father's vacation with the child. After the
Father delivers the minor child back to the Mother on August
13, his alternating weekends shall again start on August 24.

1915.3-B(b), the undersigned Custody Conciliator submits the
following report I
1. The pertinent information pertaining to the child who is
the subject of this litigation is as followSI
Gregory Michael Feltman, born February 11, 1992
2. A Conciliation Conference was held on July 26, 1995, with
the following individuals in attendance I
The Father, Patrick Feltman, with his counsel, Richard Webber,
Esquire, and the Mother, Amy Moonan Lucas, along with her
parents, Patrick and Denise Moonan, who were all represented
by Michael Bangs, Esquire.
3. This case was previously before the Court in February at which
time the Court held a hearing and issued an Order dated
February 6, 1995, which gave shared legal custody to the
Mother and the Father with the Mother enjoying primary
physical custody and the Father enjoying visitations on
alternating weekends from Thursday through Sunday. The Order
also addressed alternating holidays.
4. At the time of the hearing, the Mother was living with her
parents. Since that time, the Mother has married and has
moved out of the parents' home. However, the minor child has
continusd to reside with the maternal grandparents. The
maternal grandparents and the Mother suggest that the maternal
grandparents have been the primary caretaker of this child for
the child's entire life and, on that basis, stand in loco
parentis with the child.
5. The Father filed a Motion to have the existing Custody Order
changed alleging that the Mother is no longer living with the child
and alleging that he can provide a better home for the child. The
Father contests the grandparents' etanding in this case. Although
the grandparents were named as parties in the initial Complaint,
the Court did not address the standing of the grandparents in its
November 6, 1995 Order.
6. The parties are unable to reach an agreement and a hearing is
necessary. The threshold issue at the hearing will be whether the
grandparents have standing to seek custody. In the alternative,
the issue will be may the Mother retain primary physical custody of
the minor ohild and, under her authority as primary physical
custodian, allow the child to remain living with the maternal
grandparents.
7. The grandparents and the Mother also suggest that the Father
is again involved in illegal drug activity and other illicit
behavior. They are seeking supervised visitation while the child
is in the Father's care.
B. The Conciliator needs to address a summer vacation that was
planned by the grandparents and a summer vacation planned by the
Father. The recommended Order proposes to allow the grandparents
a vacation with the minor child and the Father vacation with the
minor child. Based on the limited information received at the
Custody conciliation Conference, the Conciliator is not in a
position to recommend supervised visitation with the Father at this
time and would defer to the Court on that issue after testimony is
presented.
9. The Conciliator recommends an Order in the form as attached.

3. This is a situation where the Mother lives with her parents
and the Maternal Grandparents have provided parenting to the
minor child for a very long period of time. A dispute arose
when Father took the child on one evening and did not return
the child. Mother and her parents desire an Order giving
them custody with restricting visitation for the Father to be
supervised. Father desires primary physical custody of the
minor child.
4. The Mother expressed some concerns about the Father having
any kind of unsupervised visitation with the child. The Father
has not seen the child for a long period of time. Father
suggests his failure to have contact with the child is a result
of the Mother's unwillingness to let the child go with him.
Naturally, that issue is disputed. The Conciliator feels the
Father should have some contact pending the Hearing, but that
overnights should not start until the Court has had an
opportunity to review this case at a Hearing.

1. Amy D. Moonan Lucas has not residsd with minor child, Gregory
M. F'ealtman, for a pel"lod of as least) months after the court order
during which time she was to have primary physical custody.
2. Amy D. Moonan Lucas has resided at 262 S. Lewisberry Rd.
Mechanicsburg from above said time.
). The minor child has resided at 10) Woodside Dr. Mechanicsburg.
with his grandparents, with visits from his mother of two hours per week
with the exception of Easter Weekend.
4. The mother cannot provide shelter, food or meet the other
financial expenses of the child. even with the help of support. and husband.
5. The police had to be involved to remove Amy from the residence
of Patrick shortly after last hearing because of an outraged mental and
and abusive fit while Patrick had custody of the child. (12-27-94)

custody lIith the child. The child developo a very mean temperment after
the mother has been around. She trieo to correct him for no apparent
reason IIhile Patrick is in charge of the child.

Samuel L. Andes, and the natural Mother, Amy Moonan Lucas, who
also appeared without counsel.
3. The history of this case is tha t there was a hearing in
October 1995 and the Court issued an Order dated April 25,
1996, awarding custody of the minor child to the maternal
grandparents and allowing the Father limited periods of
temporary custody on alternating weekends and some time over
Christmas. The Court Order did not provide the mother with
any specific custody rights.
4. Father has filed a Petition for Modification of the Court
Order requesting a one week period of vacation with the minor
chi Id in the summer, expanded visi ta tion on the hol idays, and
an Order holding the Moonans in contempt for failure to
deliver the child to the Father on a scheduled weekend.
5. The Moonans' position is t/lat all of these issues were
previously litigated in the October 1995 hearing. They assert
that the Court gave the Father llmited visitation with the
child because of testimony that was presented at that hearing
and they believe that evidence still is relevant.
Specifically, the testimony was a suggestion that the Father
had a long criminal history that involved sexual and illegal
drug acts with minor girls. The Moonans also asserted at this
time that the Father is presently subject to pending charges
that 11ave been bound over for Court and these charges again
involve a c11arge of indecent assaul t, unlawful restraint, and
corruption of minors. The Moonans are not willing to agree to
any expansion of the current schedule.
6. The Moonans have indicated that they may file a Petition for
Special Relief to have the existing alternating weekends
schedule terminated in light of these recent charges filed
against the Father.
7. The Mother appeared at the hearing and suggested that she
wanted to assert some rights for custody. However, the Mother
has not filed any petition or complaint in these proceedings.
8. The parties are unable to reach an agreement. A hearing is
required. The conciliator recommends an Order in the form as
attached.

During the interviow alone with the father, he alleyes that
there have been other episodes over the past several months where

I examined the child it became apparent that he was using the
ord "hinny" to refer to his penis). The child then requeated
that the father be present In the room and the father waB brought
Into the exam room. The stepmother and the father then sat quietly
throughout the rest of my interview with the child alld my examlnatioll
of the child. 'rhey did not offer any promptiny or answers for
the child. On examining the patient's skin, there was one area
of ecchymosis over the left anterior shin. 'I'here were several
small erythematous oval scaling areas over the lower abdominal
reylon, approximately 4 to 5 In number, with the laryest measuring
about 3 to 4 mm. These had been noticed on previous exam of
the child earlier this weekend. On examination of the buttocks,
there was no evidence of any bruising. On examination of the
penis. It showed the phalus to be circumcised. Testes were bilaterally
descended. The undersurface of the penis demonstrated an erythematous
dry nonblanching rash which extended from the distal shaft of
the penis all the way to the base of the penis and just down
onto the scrotum. There was no oozing or weeping. There is
no evidence of any ecchymosis. This rash did not demonstrate
the similar scaling of the rash on the abdominal region. When
1 personslly questioned the patient with regard to the rash,
he independently offered information that "Mary did it". upon
further questioning the patient how this occurred, he Informed
me that she had done It with a Power Ranger sword. 1 was unable
to elicit any further details from this 3~ year old with regard
to the manner in which the Power Ranger sword caused this injury.
Following examination, gonorrhea, chlamydia and herpes cultures
were obtained.
Following my interview and examination, Children and Youth
Services were contacted and I spoke to a Teresa at Children and
Youth Services to relate this information. 1 also contacted
Officer Parsons at the Upper Allen Police Department to inform
him of my findings. They each questioned me with regard to the
nature of the rash and 1 informed them that 1 felt that the rash
was consistent with an abrasion type injury.
Children and Youth will be cOlltactlng me again later this
evening with regsrd to their instructions and follow-up recommendations
for further investigation.

trial term of thie year, I had the occasion to try the defendant
on the above-captioned charges. That jury trial resulted in a
hung jury. To date, I am still evaluating whether the case

In my case, the victim was a fifteen year old girl on her
way to school when the defendant used a knife to convince her to
come back to his trailer home where he grabbed her breasts, and

1. Legal custody of the minor child. Gregory Michael Feallman, born
February 11, 1992, Is hereby awarded to his maternal grandparents, the plalnllffs,
Patrick Moonan and Denise Moonan.
