R. Thomas Kline, Sheriff, who being duly sworn according to
law, says he made diligent search and inquiry for one of the within
named defendants, to wit. Transport Corporation of America Inc. but was
unable to locate them in his bailiwick. lie therefore deputized the
Sheriff of Lehigh County, Pennsylvania to serve the Sununons in Civil
Action Law according to law.

him to suddenly veer to his right. As he returned to the center
lane, said Defendant looked in his mirror and saw the Plaintiffs'
vehiole in the ditch. All other details oonoerning the incident
not specifioally admitted are hereby denied and proof there is
demanded.

MOLLY HOFFER V. GEORGE HENRY IlECKADON
19. The averments contained in paragraphs 1 through 18 above

20. The averments of this paragraph and each and all of its
subparts are denied in that I
(a) Defendant George Henry Heckadon did not fail to have his
tractor-trailer under proper and adequate control;
(b) Defendant George Henry Heckadon did not, under the
circumstances then and there prevailing, make an unsafe or
improper lane change in violation of 75 Pa.C.S.A. S3334(a),
and in further violation of 75 Pa.C.S.A. S3309(1);
(c) DefenrJant George Henry Heckadon did not attempt to
overtake and pass the Plaintiffs' vehicle in the manner
described in the Plaintiffs' complaint;
(d) Defendant George Henry Ileckadon did not operate his
tractor-trailer at an excessive rate of speed under the
oircumstances in violation of 75 Pa.C.S.A. S3361 and/or S3362;
(e) Defendant George Ilenry Ileckadon did not fail to keep a
reasonable lookout for other vehicles inoluding the
Plaintiffs' vehicle lawfully on the road;

(fl Defendant George Henry Heckadon did not fail to apply his
brakes in time to avoid a collisionl and
(gl Defendant George Henry Heckadon did not permit or cause
his vehiole to strike or collide with the vehiole of the
Plaintiff in the manner desoribed in the Plaintiffs'
complaint.
21. While denying the Plaintiffs' averments of negligenoe,
after reasonable investigation, the Defendants are without
knowledge or information sufficient to form a belief as to the
truth of the averments of this paragraph and the same are therefore

60. The Plaintiffs' causes of action and damages are barred
or limited by operation of the Pennsylvania Motor Vehicle Finanoial
Responsibility Law, 75 Pa.C.S.A. S1701 et seq.
61. Plaintiffs have not sustained such severe psychio shock
and mental distress as to entitle them to maintain actions for
negligent infliction of mental distress. By way of further answer,
it is believed and therefore averred that only Plaintiff Allison
Hoffer has received any psychological care for any matters arising
out of the subjeot accident, which was limited to a brief course of
treatment from which she has made excellent recovery.

limited by operation of the Pennsylvania comparative Negligenoe
statute, 42 Pa.C.S.A. S7102.

olaim

barred or limited by the comparative negligence of his wife,
Plaintiff Molly Diane Hoffer.

J'LAINTlfFS' PETITION FOR COURT APPROVAL OF A MINOR'S COMrROMJSE
AND NOW come Plaintiffs by their allomeys before the Honorable Judges of the Court
of Common Pleas of Cumberland County In petition as follows:
1. Molly and Charles Hoffer are husband and wife, are adult individuals and are the
parents and natural guardians of Allison Hoffer and Abby Hoffer all of whom reside at 5889
Laurel Street, Harrisburg, Pa, 17112,
2. Defcndant Transport Corporation of America, Inc. Is a corporation licensed to
transact business within thc Commonwealth of Pennsylvania.
3. This cause of action arises out of a collision which occurred on March 20, 1993
on Interstate 811n East Pennsboro Township, Cumberland County, Pennsylvania, At that time,
Molly Hoffer was driving her vehicle In which her daughters Al1Ison and Abby wcre passengers,
At or about 9:50 on the aforesaid morning a tractor trailer drlvcn by an employee of Dcfendant
struck and collldcd with the Hoffcr vehicle causing Injuries as wlll be set forth hereinafter.

4. As a resuit of the aforesaid col1lslon, Molly Hoffer suffered carpal tunnel
syndrome in her left and right wrists and cubital tunnel syndrome In her left and right elbows,
along with other Injuries and dlsabllltles. Molly Hoffer underwent four separate surgical
procedures In an effort to repair the Injuries that she suffered in this collision, In addition,
Molly Hoffer was disabled from her employment for a period of approximately one year by her
injuries. Attached hereto and marked as Exhibit" A" are the office records of Dr. Keith Zellger.
5. Allison Hoffer at the time of this colllsion was a minor child of age 6 at the time
of the collision. She did not suffer any physical injuries as a result of the collision. Alllson did
suffer with severe emotional distress as a result of this collision. She came under the care of
Rosalee B. Keller-Brandt, M.S., a psychologist who provided psychotherapy to her for a period
of time after the colllsion, Attached hereto and marked as Exhibit "B" is a report dated August
3, 1993 from Rosalee Keller-Brandt, M.S. in which she reports that Alllson had satisfactorily
completed her psychological therapy and required no further treatment.
6. Abby Hoffer was a minor child, age 3 years old, at the time of the aforesaid
collision. At the time of the collision Abby Hoffer was recovering from a Wilm's tumor In her
right kidney. She was taken to Harrisburg Polyclinic Hospital, treated and released In the
emergency room and found to be without traumatic injury as a result of this colllsion. A copy
of the hospital records applicable to Abby Hoffer are attached hereto and marked as Exhibit "C"
and Incorporated herein by reference and made a part hereof.
7. Representatives of Defendant Transport Corporation of America have offered a
total amount of S16O,OOO to settle the entire claim.
8. His the request of the Petitioners thatlhe settlement proceeds be allocated by the
following proportion: 80% to Molly Hoffer; 10% to Alllson Hoffer and 10% to Abby Hoffer.

9. Petitioners believe that it would be In the best interest of Allison and Abby Hoffer
to accept said settlement alllounts In full and final settlement of theIr causes of action,
10, Petitioners acknowledge and understand that by accepting said selllement offer
neither they nor Allison Hoffer nor Abby Hoffer, nor anyone else acting on their behalf can ever
again make claim against Defendant Transport Corporation of America for the injuries that they
suffered which form the subject mailer of this lawsuit.
11. Petitioners acknowledge and understand that even if Allison and Abby Hoffer
should begin to manifest injuries which can be causally connected with this collision, neither
they nor Allison, nor Abby, nor anyone else acting on their behalf could file another lawsuit
against Defendant Transport Corporallon of America, Inc. for injuries arising out of this
collision.
12. Petitioners acknowledge and understand that their allomeys have Incurred a tolal
of SI ,796, 13 In litigation costs. A copy of the ledger card for these costs is attached hereto and
marked as Exhibit liD" and is incorporated herein by reference and made a part hereof.

Seen today in follow-up. lIer shoulder isn't any better. There are symptoms
radiating down her arm and up towards the neck. 1 really believe it's rotator cuff
in origin. I'll give her an injection to her shoulder which will be diagnostic,
in that if it relieves her pain, we know it's the rotator cuff, and therapeutic,
in that the corticosteroid in it can help relieva the inflammation. I'll see her
in a week.

Seen today in follow-up. The injection to her ahoulder didn't help at all. 1 feul
we cen rule out the shoulder es the source of the problem. 1 think since she's
having palpatory tenderness at the base of the cervical spine in the musculature
with trigger point noted there today, we can consider more of a muscular problem.
I cennot juatify evidence of a disc bulge or herniation in the neck. I'll treat
her with physical therapy to the neck for muscular problem in the base of the cervi-
cal spine. We can call it a cervical strain if We want 2" spasm. 1'11 soe her
after one week of P.T.

She is seen today in follow-up. lIer neck is improving with the P,l', to this
point. 1 feel that the muscular problems from which she is suffering are
related to the way she sits at her desk at work and positions herself. Right
now her employer is investigating what can be done to repoaition her at the desk
in the way of poaitioning her CRT acreen ao aa not to strain har neck and
shoulder. I'm going to continue her P.T. in the meantime, es it doea help, and
we'll do what we can to try to facilitete getting her a mora ergonomically aet
up work aituation. I'll recheck her in three weeks.

She ia aeen today in follow-up. lIer neck ia doing much better. She has good
days and bad days; some dsyo ahe has no discomfort whatsoever, and other dsya
it can bother her. She has only rare, occasional symptoms going do~'l\ her arms,
mostly juat a tired sensation after using them a lot. She is in the process
of having her desk and the workplace set up more ergonomically correct, and
once that is completed I think she will do well. She can continue to do what
she has been doing in p, T. on her own, and a t this point I will see her only
on an as needed basis if there are other problems. If there are any concerns
or problems she will give us a call.

She's seen todny in follow-up. Tho Oruvoil dramatically improved nny symptomatology
remaining in her left arm and has improved the right arm to. One day when she
didn't take it, she noticed a definite incraase in her symptomD. I'll kanp her on
it over tha next three weeks and then have her Dtop it for a week. I'll see har
in four weeka, if being off the medication ahe' s improved, we'll go with it. If
there 10 increase in aymptomatolo!l)' nnd the medication isn't hen ling it, only
masking thn symptoms, then I think we should consider ulnar nervo transposition of
the right elbow.

She is seen todsy in follow-up. lIer right elbow is not improved st all. She
still has symptoms of cubital tunnel syndrome. There has baen failure of
complete resolution with the medication; the medication only calms it down a
little. At this point I am recommending an antsrior ulnar nerve trsnsposition
of the right elbow. We arc msking arrangements for this at Community General
Osteopathic Hospital on Thursday. 2/3/94. and I'll recheck her in the office
the following Tuesday to change the dressings and remove the splint.

She is seen today in follow-up. She is five days status post ulnar nerve
transposition of the right elbow, and it appears to be working, as the pain from
her elbow up toward the shoulder is gone; from the elbow down toward the ring
and small finger yet has to disappear. I'll recheck her next Tuesday to remove
the stitches. In the meantime we are putting a light dressing on it. and she
can get it wet in a bath or shower starting tomorrow. She can either cover it
with a dressing or leave it open to the air. She no longer needs a splint, and
docs not have to use the sling. I would like to hsve her begin using it and
moving it. and we'll see how it does,

She is seen today in follow-up. Her elbow ia healing nicely. We removed the
sutures. Her pain is now gone in the ring and small fingera; she has some
occasional d1ocomfort up toward the upper arm, nnd the elbow is aore. We are
going to have her continue to work on motion, as well as using the elbow as
she's comfortable to. I'll recheck her in one month.

Physical therapist called stating there Is Improved function of the left arm.
Continued discomfort right wrist. Progressive manual resistance exercises have
been occurring with success. Treatment progressing fine. If any suggestions,
please advise.

She 10 seen today in follow-up, First of all, her ulnar nerve transposition
seems to hsve done welll she is having no symptoms in relation to the ulnar
nerve or the median nerve in the left arm. She does have evidence of some
rotetor cuff tendinitia in both shoulders on examination, which saems to have
occurred over the last couple of weeks since she was leaning over a whirlpool
and leaning forward with a hot pack on her shoulders in P.T. We are going to
switch from using heat modalities there to ice message and ultrasound to the
should~rs, and maybe electrical stirn, but have them keep working on
strengthening to the left upper extremity.
We ere also going to have them treat the carpal tunnel syndrome in her right
hand with modalities as needed, as well as strengthening to the hand. r'll
recheck her in two weeks, and if there is no res 1 improvement we can consider
decompressing the corpal canal in her right wrist. I'm not going to obtain an
EMG because previously the carpal tunnel syndrome and the ulnar nerve symptoms
in her left arm did not show on EMG evaluation, although the problem was there
and disappeared with surgery. I have no reason to believa, tharefore, that an
EMG would be aignificantly positive in the right hand at this time. I think
she has definite symptoms of carpal tunnel syndrome involving pain, numbness
into the thumb, index and long fingers, has a positive Tinel's and Phalen's at
the right wrist. Therefore, I feel if it fails to respond to P.T."" we can
consider surgical intervention.

She is seen today in follow-up. lIor left wrist carpal tunnal is doing wel1.
The left elbow cubital tunnel is doing okay; thero ia much less pain and her
preoperative symptoms seem to be casing. She is having some pain on the back
of the forearm, which I think might be a mild tendinitis from over-use and
weakness. We are going to have them work on that in therapy. Aside from that,
she has carpal tunnel and cubital tunnel symptoms down her right arm now, 1
am also going to have them work on that in r. T.. put a cockup splint on her
right wrist. If thore is not significant improvement in two weeks, we might
need to consider other alternatives on the right aide, although I hope we don't
have to.

She ia seen today in follow-up. lIer left elbow incieion hae healed nicely, The
elbow is better than it Was before surgery, but still has s ways to go yet. she
has a lot of soreness in the elbow, but it's posterior in the tricepe insertion.
lIe'll have them working on strengthening to her triceps, biceps, foreerm muse lee
and her grip atrength in the loft hand, as well as trying to treat and calm down
her carpal tunnel symptoms on the right. She has been using a cockup splint
and they have been working on the right, but so far it I S bean to no avail. I
am hoping as the left gets stronger and she can uaa it more. the right will get
less abused and therefore the symptoms will dissipate, If not, wa might need
to decompresa her right carpal tunnel.

She is 6een today in follow-up. P. T. has helped her elbow and her wris t to some
degree, but it is not completely batter. I om going to continue her in therapy
lit this time, seeing her again in two weeks to note how she's doing at that
point.

She is secn today in follow-up. lIer left elbow is still very bothersome I the
injection didn't help. She hes cubital tunnel syndrome, on physical
examination, involving the ulnar nerve at the left elbow, although tho carpal
tunnel syndrome is nearly completely resolved at the wrist, I'm going to place
her into a resting splint on her elbow for the cubital tunnel syndrome. If this
doesn't help, in conjunction with the therapy, then we'll need to consider an
anterior ulnar nerve transposition at the left elbow. I'll recheck her next
Thursday and determine further care.

She is still having problems with her left elbow. The splint actually worsened
the condition. She has a significantly positive Tinel' s at the elbow. She hss
failed to respond to splinting or bracing, failed to respond to conservative
management in the form of physicel therapy, injections, hea t, anti-
inflammatories, and therefore I feel we can proceed with an anterior ulnar nerve
transposition of the left elbow. We are going to schedule her for Honday,
August 16, for outpatient surgery at eGOn. I'll recheck her in the office then
on Thursday, August 19, for redressing.

She is seen today in follow-up. She is three days status post anterior ulnsr
nerve transpoRition of the left elbow. She is having a fair amount of
discomfort at this time, but there is very little swelling or bruising sround
it. We are placing her back into the splint, and I'll recheck her next Tuesday
in the office at which time we will remove the oplint, possibly remove the
sutures and begin motion to her elbow.

Seen today in follow-up. We're removing the sutures from her elbow and
discontinuing the splint. She'll begin motion to the elbow. I'll see her in
two weeks. She's much less painful than she was and I think will go on to have
a good result. A lot of the tingling is disappearing in the fingers and as time
goes will continue to get better. She should avoid over doing it with her
elbow, just slowly gradually working on the motion and activities with it as
she can tolerate it.

Seen today in follow-up. lIer back was doing very well with P,T. until this last
Sundsy when sitting in church, her back went into spasm, it is getting batter at
this time and is not as painful. There is no significant radistion on a continual
basis down the legs, but she does get aome irritation of the L5 nerve root, giving
her pain down the side of thigh and towarda her knee on occasion. even making her
leg with a lot of activity feels as if it is getting weak. I feel if they continue
working on her yet s couple of weeks in P.T., hopefully that will pass to the point
that she can do it on her own and with continued exercising at home. hopefully this
will all disappear in the back. Her carpal tunnel syndrome is still bothersome.
She still has a positive Tinel's and Phalen's test at the right. She has pain from
the elbow into the tip of the long finger and I think haa significant median nerve
problems in the left wrist. Continue P.T. Although it has been improving overall,
if it is not a lot better in two weeks, I think we should consider the possibility
of surgically decompressing the median nerve to get rid of this problem. If she
is still having difficulty with grabbing things, using her hand at home for daily
activities. chances are it is due to the median nerve problem, The arm is awakening
her at night. We will give this another two weeks to see if it improves, if not,
consider surgical decompression as an outpatient under local anesthesia to take care
of the median nerve problem in the wrist. I'm hoping the back will continue to
improve with exercising.

status poet carpal tunnel decompression. Overall the wound ia healing nicely,

The pain in her thumb and index finger is a little bit less at this point.
The long finger 1& somewhat irritable, and the ring and small fingers are
somewhat irritated. The elbow also still hae some irritetion. 1 think aa tho
swelling goes down in her hand and she starta uaing it mora after wa discontinue
the eplint next Tuesday and remove the suturea, she will be feeling better.
At this time I would like to have her move her elbow. her thumb. and her
fingers ss ahe is comfortable to, elevating it and icing it, and using the pain
medication aa she neede to. We will determine further care next Tuesday.

I saw Holly Hoffer today in the office, 4/23/93, at your request. Molly
is a 31-year-old female who works for Amp Inc. as a customer service
representstive. She presents todsy with symptoms srising out of a motor vehicle
accident of 3/20/93. She was the driver of a car that was struck on the
driver's side by a tractor trailer. She was wearing a seat belt at the time,
and denies any loss of consciousness. She states that in the accident shs was
holding very tightly to the steering wheel, alternating the brake with the gss
pedal in an attempt to try to get out of the way. However. when unable to do
so. she slanuned on the brakes and braced herself for the impact. She waa thrown
around somewhat, but did stay within the seat, and the seat belt remained
intact. She was unable to get out the driver's sida door because the automatic
door locks januned in the locked position, and she therefore had to climb out
of the window. She was able to leave the car under her own power and walk away
from the scene of the accident without medical assistance.
Shortly after this, Harch 22. she began to have severe pain in her lower
back with some radiation beginning down her left leg. across the buttock cheek,
as if something was stebbing her in the left buttock, down the posterior aspect
of the left thigh, behind the left knee, the left calf. and onto the bottom of
the left foot. She slso hed similar symptoms, but to e much lesser extent I down
the right leg. She says they are worse when she is lying in bed et night, that
it is uncomfortable and makes it difficult for her to find a position to sleep
in. Coughing or sneezing or valsalva meneuvers do not increase her
symptomatology.
On physical exam we note good heel-and-toe walking. There is no weakness
to the extensor hsllucis, calf muscles, or quadriceps. There are no reflex
chenges involving the petellar or Achilles reflexes. but there is a very
positive sitting-root sign on the left end positive straight leg reising on the

left for leg pain very dominant at that point ovar the back pain. She hes Dome
symptoms in the right leg, but mostly just in the buttock. and definitely not
nearly aa severe as the left. There is minimal apasm noted in the lumbar apina
to palpation, and significant tendernesa to palpation in the left sacroiliac
joint and in the left buttock in the sciatic notch which reproduces the symptoma
through her leg.
She complained of symptoms beginning in her left arm on April 7.
Examination of her upper extremitiea shows tingling into the ring lInd small
fingers of ths left hand. She has some minor soreness in her neck which is
intermittent, but is not nesrly as symptomatic as the tingling and pain she has
into the fingers. She is right hand dominant, She hos a scar in her left palm
from a previous carpal tunnel decompression done in 1982 or 1983 by Dr. Scott
Harrison, en orthopedic surgeon now retired, but who had been in practice at
Harrisburg Hospital. Ha operated on her wrist for apparent csrpal tunnel
syndrome. and found sn abnormal muscle in the hand, which does occur on
occasion, specifically the palmaris msnus brevis which causes compression. but
actuslly when released along with release of the median nerve. usually causes
the symptoms to resolve. Her initial carpal tunnel type symptoms did completely
bO lIway in her hand and were not bothersome to any degree prior to this
accident. She describes holding the steering wheel very tightly during the
accident, and may have suotained an extension type injury, or impaction injury,
to the wrist as a result of this.
She has a positive !inel's and Phalen's at the left wrist on examination,
reproducing the symptoms in her fingers end all the way up her arm toward her
neck. Compression of the head reproduces some symptoms into the base of the
neck, but 1I0t all the wsy down the arm to the fingers.
X-rsys of the neck taken today in the office are essentially unremarkable.
We do note on x-raya of her lumbar spine that she apparently has six lumbar
vertebrae, or essentially a lumbarization of the first sacral vertebra.
At this time 1 sm going to place her into a cockup splint for hsr left
wrist, have her take the snti-inflammatory medication she has at home including
the Tslscen, but stop the muscle relaxant. 1 will obtsin EMG's of her upper
and lower extremities to evsluate for carpal tunnel, as well as for an 51 root
radiculopathy in the left leg, We will slso obtsin an MRI scan of her lumbar
spine. We'll hold her preeent physicel therapy, rechecking her in the office
following the studies, snd will determine further care st that time.

Allison was referred by her family doctor, William Bird, because she is
experiencing emotional reactions to several significant stressors. She and her
mother and sister were recently in a vehicle accident and her younger sister,
Abby, is being treated for cancer. This treatment has included
hospitalization and surgery.
Because of these stressful events, Allison has had difficulty sleeping and has
developed several fears. She is fearful of riding in vehicles on major roads
and is feerful of trucks passing by. She has had a few behavioral problems at
school and her mother worries that she is underachieving in her academics.
Allison is currently enrolled in the first grade class of Mrs. Gipe in the
Linglestown Elementary School, Central Dauphin School District.

hopeful that the glasses will help her be more successful in the classroom.

Observations
Allison is a blonde haired girl with light eyos. She appears to be of average
height and weight for her age. She was generally restless and talkative.
The examiner had been working with her in consultation and counseling since
April of 1993 following the vehic10 accident March 20, 1993, Abby was riding
with her mother and sister when they were hit by a truck which crossed the
road and pushed their vehiole over 200 yarde. Subsequent to that event, her
sohool bus was involved in an accident on April 2nd and, at a later date, the
family witnessed a tractor trailer truck losing part of its tire -- smOking
and loud sounds were observed -- adding to the trauma. For awhile, Hrs.
Hoffer said, they all felt as if they were "cursedll because of the frequency
at the traumatio events.
Because of the previous counseling seasions, Allison was fairly relaxed about
the evaluation session and was looking forward to it.
She showed a oooperative and friendly attitude

WISC-R Test Interpretation
Allison obtained a WISC-R Full Scale IQ of 136, which places her in the Very
superior range of intelligence. While this score is subject to a small degree
of error, the probability is 90' out of 100 that her true lQ score is betweon
130 and 142.
lIer Verbal IQ and Performance IQ scores did not differ signif1cantly,
indicating that her verbal and visual-motor skills are practically equal.
Accordingly, her Full Scale IQ score is a valid indicator of her general
intellectual ability.

The Rorschach Ink Blot 'l'est and several projective drawings were administered
earlier, during individual counseling sessions, to assist in assessing the
emotional effect of the accident.
The Rorschach Ink Blot responses were reflective of Allison's intelligence and
visual awareness. All the rosponses were accurate and appropriate in form
quality and in content. There were, however, an inordinate amount of
references to winged creatures, butterflies and birds. Even in her drawings
of House-Tree-Person, she added birds. Frequent references to winged
creatures in an indication of a desire to escape or to be free from current
