PRELIMINARY OBJECTION
IN THE NATURE OF A MOTION TO STRIKE
MECHANICS' LIEN CLAIM
ON aROUND OF WAIVER OF LIEN
NOW COHES, Defendent, IlR&R des ign associates, by its attorneys,
RHOADS & SINON, and makes the following Preliminery Objection in the Nature of
a Hotion to Strike Claimant's Lien, as follows:
1. Defendant, IlR&R design associates, is a general reaidantial
development firm with its office in the City of Harrisburg, County of Dauphin,
Commonweelth of Pennsylvsnia, and is the owner/developer of real property
described as Lot 1-15, Floribunda lIeights Development, East Pennsboro Township,
Cumberland County, Pennsylvania, upon which it recently constructed a "lIome-A-
Ramo 1994" two-story residence.
2, Claimant, John p, Amick, is n trim and frama carpenter who ia
R resident of Herndon, County of NOl'thumbel'land, Commonwealth of Pennsylvania,

3. On July 11, 199/. Claimant filed a Claim of Uon in the Court
of Common Pleas of Cumberland County, 94.3750 MLD Term.
4. Defendant bellevos and therefore avers Claimsnt' s lien is
invalld es Claimant, by contract, had previously wsived, in wrlting, any and all
his rlghts to file a mechanic's llen claim.
5. Claimant signed a BR&R design associates standard form of
"Stipulated Sum" construction contract dated March 15, 1994 prior to commencemsnt
of the work on the 1I0me.A-Rama Project. A true and correct copy of the
"Stipulated Sum" contract, dated March 15, 1994, is attached hereto as Exhibit
"A" and, by this reference, made a part hereof.
6. Article 6 of the Construction Contract provides ths Claimant
shall not "file any mechanics' or materlalman' s lien or msintain any clsim
against the Owner's [Defendant's] premises or improvements for or on account of
eny work done, labor performed or materials furnished under thia "Agreement."
7. Claimant agreed to perform work 011 the lIome.A.Rama project in
addition to the work described 1n the March 15, 1994 contract. The additional
work consisted of trim work on the llome.A.Rama project.

8. By lotteI' dAted Aprll 22, 1994, DefendAnt confimed Claimant' e
bid propoul on the trim packAge, set the tems and provided "this ahall be an
extena10n of our Agreement doted Harch 15, 1994 ,.. And, aa auch all the parts
of tho ContrAct Documents And tho provisions of that Agroomont sholl remaln In
plAco tu cover thls Work." A true and correct copy of the April 22, 1994
correspondence Is AttAched oS Exhibit "8" and, by this reference, made part a
heroof.
9. Clalmant confirmed that arrangement by his providing a work
sheet thereunder for "time and work performed." A true and correct copy of
Clalmant'a work sheet ls attached as Exhibit "C" and, by this reference, made a
part hereof.
10. Further, pursuant to the sald Contract and Letter of April 22,
1994, on or about Hay 16, 1991, Claimant and Defendant executed a "Contractor's
Waiver of Liens" for fll1ng at the Courthouse. Again, Claimant agrsed to "waive
and rel1nqulsh all rights to file a mechanic's l1en claim or notice of Intention
to file any lien or clslm aod does hereby covenant, promise and agree that no
mechanic's l1en or claim or other l1en or claim of any kind whatsoever shall be
filed or malntalned agalnst the 1I0me or the estete or title of owner In the
property as described In . . ,." See Article 1 of the true and correct copy of the
document attached hereto as Exhlbl t "0" and, by this reference, made a part
hereof.
11, Horeover, Article 2 of the Contractor's Walvsr of Liens
provides lhat lhls Agreement Is an "Independent covenant and shall opsrate And

be effective as well with respect to work done and materlals furnlshed under any
supplemental conti'act [or extra work in the erection, construction and completion
of said 1I0me and as to any work and labor done and materials fUl'l1lshed under the
contract." See Article 2 of the Contractor's Waiver of Liens nttached hereto as
Exhibit "D."
12. Thua, Claimant is precluded from filing the lien by his own
writtsn waiver of that right under the "Stipulated Sum" Contract, dated March 15,
1994 and the written Waiver dated May 16, 1994. See Exhibits "A" and "D."
13. 1I0wever, Claimant has refused, and still refuses, to release
and d1schsrge the claim and strike the Uen, notwithstsnding Claimant's written
advance waiver snd a notice given by Defendant requesting Claimant to release and
d1scharge the mechanic's Uen claim, a copy of which ls attached as Exhibit "E"
and, by this reference, made a part hereof.
14. Claimant' a Claim of Llan is void and the Uen should ba
etrickan off the docket.
15. In Article 6.01, Indemnification of the Stipulated Sum Contract
attached as Exhibit "A," Claimant agreed to protect, defend, hold harmless and
indemnify Defendant from all suits and expenses "including attorneys fees" made
on account of Work which the fiUng of thls Claim is and which unlawful Claim of
Lien could be very harmful to Defendant should it need to close on the sale of
its 1I0me-A-Rama 1994 houae and lot quickly.

16. Further, Defendant will have incurred an estimatod $1,500.00

WHEREAS. the Contractor is a successful bidder for the
completi"n of the Home's framing and remediation of the in-place
framin~ of the Home based upon meetings and discussions at the
Home and at OWl1er's office to review the Home's plans, specs.

NOW. THEREFORE, intending to be legally bound hereby,
Owner and Contractor agree as set forth herein:
ARTICLE 1. The Contract Documents. The Contract
Documents consist of this Agreement. the Conditions of the
Contract (General, Supplementary and other Conditions), the
Drawings. the Specifications. all Addenda issued and all
Modifications issued after execution of this Agreement (the
"Contract Documents" I. These form the Contract. and all are as
fully a part of the Contract as if attached to this Agreement or
repeated herein. An elaboration of the Contract Documents appears
in Article 7.
1.01 Changes. No change in the Contract Documents
shali be made without the written approval of the Owner. and a
request for any change must be made in writing. Verbal
instructions given by any of the officers, agents, or emplo~el3 01'

3.02. Expenses. Should it. become necessari for Owner

but not limited to substandard quaiity of workmanship or

for and hereby agrees to pay all Owner's costs IInd e~penses of
cure or remediation and collection. including reasonable
attorney's fees and legai expenses. which Owner may incur. Owner
may offset from Contractor's draws hereunder all such costs, etc.
3.03. Arbitration. The venue and Jurisdiction for any
litigation concerning any mattel' associated with this Agreement
shall be solely in the Court of Common Pleas of Dauphin County,
3.04. Two Year Limited Warranty. Contractor
acknowledges that the structural integrity of the Home is his
principal responsibility. The structure of the Home shall be fre~
of faults and defects for thirty (30) years. Contractor i1grE>es
that any relocation or reconstruction made necessary in order to
comply with the plan shall be at its soie cost and e~pen5e.
Contractor warrants that ail materials and workmanship shall be
free of faults and defects for two (2) years after the date of
Owner's settlement on the Home. Any other warranties of
manufacturers shall be passed through to Owner. This warranty is
not limited by any other provisions of this Contract. ReqUests
for warranty service from Owner andlor homeowner shall be
responded to by Contractor within five (5) working days of the
date of request. Emergency warranty service shall be re5Pond~d to
immediately.
3.05. Wor\< Site. Contractor acknowledges that the Home
Is in the center of a residentiai area and agrees to piclo. up and
prop~rly dispose of the lunch trash of its personnel and
construction debris resulting from the Work before the end of
every work day subject to a tlOO.OO daily deduct in the evenl lhal
debris and trash are at the site or in the Home after the worhman
ieave.

at whi.:h point ail retainage shall be released, less such amounts
as the Owner shall determine for all lncompiete Work and unsettled
claims as provided in the Contract Documents. Owner. at its sole
discretion. reserves the right to hoid retainage through the
warranty period if problems should persist during the Contract
period.
5.02. Progress Pa)ments. Owner agrees to make Progress
Payment(s) as required. billable hourly for services provided to
date. not to exceed the Contract Sum, pending Owner's approval of
the applicable Work and invoice. less retainage, and less 5u.:h
amounts as the Owner shall determine for all incomplete Work and
unsettled claims as provided in the Contract Documents. Payments
due and unpaid under the Contract Documents shall bear inter~5t

5.03. Finai Payment. Owner agrees to make a final
payment for the balance of the Contract Sum upon the completion of
the Wor" within (30) thirty days of Owner's approval of the

as the Owner shall determine for all incomplete Work and unsettled
claims as provided in the Contract Documents. Payments due and
unpaid under the Contract Dor.uments shall bear interest from the

ARTICLE 6. Waiver of Liens. Neither the Contractor ~or
any of its subcontractors shall file any mechanic's or
materialman's lien or maintain any claim against the Owner's
premises or improvements for or on account of any work done, labor
performed or materials furnished under this Agreement. The
Contractor shall for itself as well as require its subcontrd.:tor!
to. e~ecute and file. with the Dauphin County Prothonotary,
no-lien stipulatiol1s (Waiver of Liens) in form satisfactor) to th~
Owner and Contractor. Failure by the Contractor to secure and
provide evidence of filing of said waiver prior to each
subcontractor placing materials or providing labor to the Project
shall be a default of this Agreement unless O~ner and Contrdr.tar

In follow up of our discussion earlier today, thank you for your
verbal bid proposal on the trim rack age for our Home-A-Rama home at
an hourly rate of $11.00 for tr m carpentry and, in the .v.nt the
'Work would entail any coordination ~f sit. work while trimming at
an hourly rate of $16.10.
This letter serves as acknowledgement of our acceptance of thes.
rates. This shall be an extension of our Agreement dated 3/15/94
for "the completion of the Home I s framing and remediation of the
in-place framing of the Home" in its entirety and as such all the
parts of the Contract Documents and the provisions of that
Agreement shall remain in place to cover this Work. Pleas. provide
a wQrk sheet for time and work perform.d during that time for
confirmation.
If everything turns out well during this' trial period w. will b.
happy to discUBB a long term contractual relationship for Bite
coordinations and carp.ntry services.
