WIIEREAS, Ronald L. Giroux and Ellen L. Giroux, of 655 Deer
Road, Boiling springs, cumberland county, Pennsylvania entered into
a contraot with Roger Fickett, contractor, of 1416 Kuhn Road,
Boiling springs, cumberland county, PBnnsylvania, to provide
materials and perform labor nocessary for the construction of a
residence, upon the follow ing tracts of land located in south
Middleton Township, Cumberland county, pennsylvania, more
specifically describod as follows, to witl
TRACT 11
ALL THAT CERTAIN lot or parcel of land, situate in south
Middleton Township, cumberland County, Pennsylvania, more
particularly bounded and described aB fo1lowsI
BEGINNING at an iron pin on the easterly right-of-way line of
Derbyshire Drive, a 50.00 foot wide right-of-way, which said point
is more particularly located at the intersection of the easterly
right-of-way line of Derbyshire Drive and the dividing line between
Lots Nos. 53 and 54 on the Plan of Lots known as "Final Plan for
Mayapple Village, Derbyshire Lots 40-73"; TIIENcE from said point of
beginning along the dividing line between Lots Nos. 53 and 54,
North 00 degrees 04 minutes 07 seconds West, a distance of 125.00
feet to an iron pin located on the southwesterly property line of
other lands of Mayapple village; TIIENcE from said point along the
southwesterly property line of other lands of Mayapple Village,

feet to a concrete monument on the dividing line between Lots Nos.

iron pin on the easterly right-of-way line of Derbyshire Drivel
THENCE from said point along the easterly right-of-way line of
Derbyshire Drive, South BB degrees 37 minutes 11 seconds West, a
distance of 117.41 feet to an iron pin; THENCE from said point
continuing along the easterly right-of-way line of Derbyshire
Drive, in a northweBterly direction, on a curve to the right having
a radius of 275.00 feet, an arc distance of 12.59 feet to an iron
pin, the point and place of BEGINNING.
BEING Lot No. 54 containing 0.3693 acres on the Plan of Lots
known as "Final Plan for Mayapple Village, Derbyshire Lots 40-73,"
prepared by statler-Brehm, Engineering and Planning consultants,
dated January 26, 19B9, and recorded in the Office of the Recorder
of Deeds of cumberland county, Pennsylvania in Plan Book 5B, Page
6B-B.
UNDER AND SUBJECT to building setbackB as set forth on the
above mentioned plan, being a 30 feet front setback line, a 40 feet
rear setback line, and a 10 feet side setback line.

known as "Final Plan for Mayapple village, Derbyshire LotB 40-73,"
prepared by statler-Brehm, Engineering and Planning Consultants,
dated January 26, 19B9, and recorded in the Office of the Recorder
of Deeds of cumberland county, Pennsylvania in Plan Book 5B, Page
6B-B.
UNDER AND SUBJECT to building BetbackB as set forth on the
above mentioned plan, being a 30 feet front Betback line, a 40 feet
rear setback line, and a 10 feet side setback line.
ALSO UNDER AND SUBJECT to restrictions of record.
NOW, THEREFORE, it is hereby stipulated and agreed by and
between the said parties as part of the said contract and for the
consideration therein set forth, that neither the undersigned
contractor, any sub-contractor or mater ial man, nor any other
person furnishing labor or materials to the said contractor under
this contract shall file a lien, commonly called a mechanicB' lien
for work done or materials furnished to the said building or any
part thereof.
This stipulation is made and intended to be filed with the
county Prothonotary within ten days after date, in accordance with
tho requirements of Act or Assembly of pennsylvania, in such caso
provided.
