BLOSSER, JR., Defendant ANSWIR AND, NOW, comes Defendant, Robert L. Blosser, Jr., by and through his attorneys, Landis, Black & Schorpp and files the following Answer to complaintl 1. Admitted. 2. Admitted. 3. Admitted. 4. Denied. On the contrary, it is averred that Defendant was and is employed on a full-time basis, but would assist when able which Defendant did after his regular workday and at other times. 5. Admitted. 6. Denied. The extent of Defendant's agreement is contained in the building proposal prepared by Plaintiff and attached hereto as Exhibit "B". 7. Admitted. B. Admitted. 9. Denied. On the contrary, it is alleged that Plaintiff'. advises as to cost information was hopelessly confusing and Defendant never knew where he actually stood on the construotion contraot. 10. Denied. On the oontrary, it is averred that the overruns on the contra~t were as followSI a. Plumbing and heating - $741.21, b. shinglee - $118.88, o. Lighting - $550.00, d. Painting - $25.12, e. Driveway, septic and exoavation - $186.50, f. Deck - $1,540.37. 11. Denied. On the contrary, it is averred that the underages on the contract were as followSI a. Electrio - $796.42, b. Flooring - $768.59, o. Framing - $258.75. Other underages are more fully set forth in the Counterclaim as hereinafter set forth. 12. Denied. It is expressly denied that there were any net construction overruns on this project but, on the contrary, the underages exceeded the overruns. 13. Denied. After reasonable investigation, Defendant is without knowledge or information sufficient to form a belief as to tho truth of this averment and proof is demanded. It is further averred as followSI a. French doors were installed rather than sliding glass doors. -2- b. A basement window was installed. a. The bathroom wall was relocated prior to its construction. d. No invoice was provided for this item. e. Framing for one door was included in ths blueprints. f. This door frame was moved. g. This window was moved. h. The labor for construction of the deck was inoluded in the labor portion of the original contract. The deck material was purchased by the Defendant as set forth in the contraot. i. Proof demanded on this item. j. A whirlpool tub was installed. k. The bathroom window was moved. 1. This item has already been charged under the allowance for excavating, etc. m. Defendant did not request nor desire the soffit in the kitchen. n. Cedar was installed in the living room. o. Proof demanded of this item. 14. Denied. The proposal and contract attached as Exhibit "8" speaks for itself. 15. Denisd. The answsr to Paragraph 14 i. incorporated by reference herein. -3- . ~ 16. Admitted. 17. Denied. The answer to Paragraph 13 i. incorporated by reterence herein. 18. Admitted. 19. Denied. Plaintiff has failed to oomplete the residenoe in a good and workmanlike manner as more fully set forth in the Counterclaim hereinafter set forth. 20. Admitted as the various charges are not due to the Plaintitf as more fully set forth in this Answer and the Counterclaim hereinafter set forth. 21. Dsnied. On the contrary, it is averred that Plaintiff has not performed all of the conditions of the contract, has not constructed the home in a good and workmanlike manner, all as more fully set forth in the Counterclaim hsreinafter set torth. 22. Denied. Ths Defendant has paid the fivs percent fee of $6,406.00 as set forth in the construction contract attached hereto marked Exhibit "8". WHEREFORE, Defendant demands Plaintiff's claim be dismissed, COUNT II 22. Admitted. 23. Admitted in part and denied in part. It is admitted that the Defendant has taken possession of the residence but it is denied that there are any net cost overages or net cost extras all as previously set forth in this Answer and the fOllowing , r , "' :1 -4- '! ~ 'j Counterclaim. 24. Denied, On the contrary, it is averred that there are no net costs overages or net cost extras due the Plaintiff. 25. The answer to Paragraph 24 is incorporated by reference herein. 26. The answer to Paragraph 24 is incorporated by reference herein. WHEREFORE, Defendant demands Plaintiff's claim be dismissed. COUNTIRCLAXN 27. Blosser avers the following underages have accrued on the contract I a. Electric - $796.42, b. Flooring - $768.59, c. Framing - $258.75, d. Well - $1,212.50 e. InSUlation - $755.86, f. Drywall - $948.88. g. Total undsragss - $4,741.00 28. Plaintiff has failed to credit the Defendant with the $1,000.00 utilities allowance and for the sum of $1,763.00 that Defendant paid Plaintiff for the whirlpool tub in the total sum of $2,763.00. 29. In order to complete the residence in accordance with the plans and specifications and in a good and workmanlike -5- manner, Blosser will be required to install varioue shelving, remove and replace ca~pot padding, remove and replaoe soffit in kitchen, change electrical switching and wiring, replace wall register, and complete miscellaneous carpentry and electrical repairs to a total amount of $1,353.00. 30. Blosser avers that Feuchtenberger removed some 200 tons of top soil from the site of the residence and that Blosser will be required to expend the sum of $1,530.00 to replace and spread such top soil. 31. Although Feuchtenberger had an estimate of $450.00 to complete the final grade of the lot, he paid $1,117.00 for this work reSUlting in an overcharge of $667.00.
