Defendant Dollar Bank, Federal Savings Bank, is a bank organized under the laws of the United States of America, and whose principal place of business is TIrree Galeway Center, 10 East, Pittsburgh, PelUlSylvania 15222. 3. On May 31, 1991, Plaintiffs were, and Ihey remain, the owners of a fee simple estate of certain real property located al 211 Old Slone House Road, Middlesex Township, Cumberlnnd County, more particularly described as follows: ALL THAT CERT AlN improved, part, parcel or lracl of ground located in Middlesex Township, CUIlIberland COWlty, PelUlSylvania, as hereinafter described, to wi\: BEGINNING at a point evidenced by a spike in Ihe cenlerline of Legislative Roule [now or fonnerly] 21028, known as Old Stone House Road; Ihence North 43 degrees 26 minutes 20 seconds East, a distance of 600.61 feel 10 an iron pin; Ihence SOUUl 47 degrees 27 minutes 10 seconds East, a distance of 461,72 feel 10 an iron pin; tllence South 12 degrees 2 minules 0 seconds Easl, a distance of670,06 feet 10 a spike in the centerline of Township Road known as T-573 (Appalachian Drive); Ulence SOUUl 75 degrees 34 minutes 0 seconds Wesl, a distance of269.24 feel 10 a spike in the cenlerline of the aforesaid Legislative Roule 21028 (Old Slone House Road); tllence North 46 degrees 33 minutes 40 seconds West, a distance of870,50 feet 10 a spike in Ule cenlerline of Legislative Roule 21028 (Old Slone House Road), Ule place ofBegiJUUng. Rowe Wld Mill)' Lou Rowe to Frederick J. HugwUr Wld Gail R. HugBllir, husband IlI\d wife, by Deed doled November 28, 1984, Wld recorded in Cwnberland COWlly Record Book "B," Volwne 31, Page 499, Wld being Lot No.5-A on Final Subdivision Plan prepared by Gerritt J. Belz Assoeiates,lnc., recorded in Cwnberland COWlIy Plan Book 46, page 123. (Hereinafter "the premises,") 4. On May 31, 1991, Plaintiffs granled Defendant a mortgage inlerest in the premises as security for a loan ofONE HUNDRED FORTY TIiREE THOUSAND ($143,000.00) DOLLARS. 5. On May 31, 1991, the said Mortgage was recorded in the office for the recording ofDeeds in and for Cwnberland COWlty, Pennsylvania. in Mortgage Book 1015, Page 105. On Februwy 9,1994, Defendanl provided Plaintiffs Wld their attorney with a notice for payolf(allached as "ExhibiI2") which specified the following address for tender of monies Wld requesl for satisfaction: 11le Mortgage Service Center, 217 Second Street NW, CWllon, Ohio 44702. 8, On Februlll)' 14, 1994, al Ule said CWllon, Ohio address, DefendWlt received from Plaintiffs Ule SWlI of ONE THOUSAND EIGHTY AND 59/100 ($1,080,59) DOLLARS (allached as "Exhibit 3"), wl amoWlt equal to Ule regular monthly mortgage payment, and as a resull, Ule remaining principle due U\BI date was ONE HUNDRED l11IRTY-SEVEN THOUSAND TWO HUNDRED AND 68/100 ($137,200,68) DOLLARS. 9. On Februwy 22, 1994, allhe said Canlon, Ohio address, Defendanl received from Plainli1fs the swn oCONE HUNDRED THIRTY EIGHT THOUSAND NINE HUNDRED ELEVEN AND 46/100 ,$138,911.46) DOl.LARS (allached as "Exhibit 4"), an wnOWlt equal to the payoff and satisfuction calculation provided by Defendanl in Exhibil 2, which was in excess of the principle wnowll then due. 10. TIle payment of February 22 was more thWl sufficient to pay both (1) all such swn and swns of money as were then really due to Ule Defendwll by such Mortgage, and (2) the TWELVE ($12.00) DOLLAR fee ofUle Recorder ofDeeds for entry ofsatisfuction on Ule record. 11. The aforesaid paymenl was accompanied by and referenced in a written request (attached as "Exhibil 5") thai the Defendanl enler satisfuction on the record. 12. On Febl1lhtY 22, 1994, Ule Defendant accepled Ule aforesaid payment as represenled by Ule endorsement enlercd on Ule back of the payoff check (see Exhibit 4). 13. On March 14, 1994, the Defendanl refWlded ONE THOUSAND FORTY-NINE AND 68/100 ($1,049,68) DOLLARS ofUle FeblllllIY 22, 1994 payment as excess over the swn of (1) the outstanding balance on Ule deb~ and (2) the aforeslaled 1WEL VE ($12.00) DOLLAR satisfuction fee, 14. Nolwithstanding Ule full paymenl and specific request for satisfuction, Ule Defendant has never satisfied tIle Mortgage. 15. More Ulan forty-five (45) days have elapsed from (I) payment in full, (2) payment ofUle TWELVE ($12.00) DOLLAR fee, Wid (3) Ule wrillen requesl of February 22,1994. 16. TIle PlalnlifTh have never received a satisfaction piece from Defendant. 17. PBIllI!I1lph 22 of Ule Mortgage provides: Upon payment of allsWllS secured by Utis Securily Instrument, Utis Security InstJUment BIld the estate conveyed shall ,enninale BIld become void. After such occwrence, Lender shall discharge BIld satisfy Utis Securily Instrument without charge 10 Borrower. Borrower shall pay BIlY recordation costs, 18. TIle Acl of May 28,1715, I Sm,L. 94, ~ 9, as llI1lended by Ule Act of October 28, 1983, P.L. 194, No. 52, ~ 1,21 P,S. ~ 681, provides: Any mortgagee of BIlY real or personal eslales in Ule CommonwealUl, having received full satisfaction BIld payment of all such SW1l BIld SW1lS of money as are really due to him by such mortgage, shall, at the requesl ofUle mortgagor, enter satisfaction either upon the margin of the record of such mortgage recorded in the said office or by means of a satisfaction piece, which shall forever thereafter discharge, defeat, BIld release the slll1le; BIld shall likewise bar all actions brought, or to be brought thereupon. 19. The Act of May 28,1715, I Sm.L. 94, ~ 10, as llI1lended, by the Act of July 31, 1968, P.L. 866, No. 259, ~ 1,21 P.S. ~ 682, provides: And if such mortgagee, by himself or by his allomey, shall no\, wiUrin forty.five days after request BIld tender made for ltis reasonable charges, relum 10 Ule said office, BIld there make such acknowledgemenl as aforesaid, he, she or they, neglecting to do so, shall for every such offence, forfeil BIld pay, Wllo the party or parties aggrieved, BIlY sum not exceeding the mortgage-money, to be recovered in BIlY Court of Record in \his CommonwealUl, by bill, complain\, or infonnation. 20. TIle premises have been subdivided BIld a portion Ulereof offered for sale, bultiUe is nol marketable because of Ule DefendBlll's aforesaid Mortgage of record. 21. A portion ofUle premises are subject to a new Mortgage granled to Fanners Trust Co. of Carlisle, PelUlSylvania; said Fanners Trusl Co.loBlled fWlds to PlaintilTh bosed upon the securily of a first mortgage interesl in Ule premises, which inlerest is now Utreatened by Defendant's failure to comply wiUI Ule Acl of May 28,1715, I Sm.L. 94, ~* 9 & 10,ll6ll11lended, 21 P.S, ** 681 & 682, insofar as Ule Defendant's W1Satislled Mortgage of record on the premises. The Defendant claims a lien againsl tile premises adverse to Plaintiffs; the Defendant's claim is without any righl whalever, for it has no estate, right, title,lien, or interest whatever in or to said premises. 24. Said Mortgage is invalid and unenforceable because thtl debl it secured has been fully paid. 25. Said Mortgage constilules a cloud on Plaintiffs' title to the premises. WHEREFORE, William G. Rowe and Mary Lou Rowe request judgment against Dollar Bank, Federal Savings Bank as follows: a. Money judgment in the amount of one hWldred forty tluee thousand (5143,000.00) dol1ars, pWSUWIt 10 tile Act of May 28,1715,1 Sm.L. 94, ~~ 9 & 10, as amended. 21 P.S. U 681 & 682, plus interest and cosls; and b. An order directing the Recorder of Deeds to mark in tile margin of Mortgage Book 10 IS, Page 105 that the Mortgage therein is satisfied; c. An order quieting title 10 the premises in Plaintiffs' and against Defendant and all persons c1aiming under Defendant, plus cosls and allomeys fees; and c. Anrument A TIlE PLEADINGS DEMONSTRATE THERE EXISTS NO GENUINE ISSUE OF FACT AS TO TIlE DEFENDANT'S LIABILITY FOR FAILURE TO SATISFY PLAINTIFF'S MORTGAGE; PLAINTIFF IS ENTITLED TO PARTIAL JUDGMENT AS A MATTER OF LAW. A Motion for Judgment on the Pleadings is authorized by Pa.R.Civ.P. 1034, which if granted, would further thc intercsts of judicial economy by limiting the role of the fact-finder to detennining the wnount of the penalty or "fine for neglect." This Court's standard of review for the Plaintiffs' Motion for Judgment on the Pleadings is well-settled: A motion for judgment on the pleadings should be granted only where the pleadings demonstrate that no genuine issue offact exists, and that the moving party is entitled to judgment as a mutter of law. It Is submitted that the pleadings resolve these issues in favor of the moving party, and judgment as to liability for a penalty should be entered accordingly. B. ALL PLAINTIFFS' INTERROGATORIES ARE RELEVANT TO ENABLE THE FACT-FINDER TO DETERMINE THE AMOUNT OF PENALTY. AND THE OBJECTIONS SHOULD BE DISMISSED. Dollar Bank objects to eleven questions posed by the Rowes, claiming they are "vexatious, overly broad, and are not likely to lead to any admissible information gennane to this case," A review of the questions will indicate that within the totality of the circumstance ofthis case, the questions are entirely appropriate for legitimate inquiries of the fact-finder to determine the amount of the penally or "fine for neglect" against Dollar Bank. Thot is, the questions and the IU\ljweTS they seek are relevant and gennane to this case. The Defendant appears to be under the mistaken impression that only actual damages may be proved, and therefore relevant to the fact-f1nder's inquiry. On the contrary, the Pennsylvania Supreme Court held in Werner v. Automobile Fillallce Co., 347 Pa. 217, 31 A.2d 898 (1943) that the trial court did have the right to review the evidence for the purpose of determining whether it supports the penally assessed. Granting that there is a distinction between damages and penalties, that the former are awarded as compensation to the aggrieved party and the latter are imposed with the primary object of punishing the offender (Cel/lral R. R. Co. v. Greet/, 86 Pa. 427, 27 Am.Rep. 718), the penalty fixed by the Act of 171 5 is intended to accomplish both purposes. The broad limitation of this act, that the penalty shall not be more than the face of the mongage, which may be large or small, implies that tbe amount IlIsessed will be detennlned by a consideration of tbe circumstances. A further examination ofthe circumstances that may be considered by the jury suppons our main conclusion. While it has been held that a plaintiff is not required to prove that he has suffered actual damages in order to make out a case (Crawfordv. SimcJ//, 159 Pa. 585, 588, 28 A. 491; Graham v. Mt. Airy B. & L. Ass'l/, 102 Pa.Super. 116, 121, 156 A. 592), it does notfollow tbat actual damages and other circumstances are not elements for consideration In detennlnlng the penalty to be Imposed. ... Certainly the actual injury to Plaintiffs is a matter for consideration. Among tbe circumstances to be considered are also the attitude and conduct of the defendant willi reference to the act. They may inquire whether the defendant's conduct was wanton and wilful. As it was expressed in Hel/ry v. Sims, I Whan. [187,] page 200: 'Everything which can and does make acts the subject of , . praise or censure; as of honesty or dishonesty, of kindness or cruelty, may enter into the consideration of the jury'. Werner v. Automobile Finance Co., supra at 219-220, 31 A.2d at 899, emphasis added. The objected-to questions address the issue of setting the amount ofthe penalty (not to prove damages) by learning of the circumstances relating to the attitude Wld conduct of the defendant. Ironically, Dollar Bank relies upon Krevollll v. Williams, 160 Pa.Super. 411, 51 A.2d 422 (1947) for a proposition that the Interrogatories are not relevant, when in fact Krevolill (relying upon Werner) emphasizes "that the jury must be instructed that tbe penalty found sball bear I proper rdatlon to the circumstances Ind conditions surrounding the neglect to sltlaCy," Id at 416, 51 A.2d at 425. Certainly, the resources of Dollar Bank and how it chooses its priorities in allocating its resources in regard to the transfer and collection of monies due to it, and satisfactions due from it, are relevant. That is to say, Dollar Bank may allocate a substantial amount of ita time and resources to collection of monies from mortgagees, but when it is time for Dollar Bank to deliver something of value to mortgagees, that effort may not be given the resources a jury would reasonably anticipate in the circumstances. Clearly, the bargaining power in the relationship between the powerful interstate banks and saving and loans on one hand, and the mom and pop residential borrower on the other, is one-sided. The remedy afforded by the statutel4 is needed even more today than when first enacted due to the ever-increasing gulf between the distant, anonymous financial institutions and the unsophisticated borrower. The penalty deterrent is crucial to a balancing of that relationship to satisfy the statutory purpose. Automobile FllIIJ/lCe Co., supra. If the objections were to be sustained, it would restrict the inquiry to actual damages, and Werner specifically finds that such a restriction would be r.ontrary to law. It is submitted that the questions presented are analogous to the questions a trial court addresses to a child-support scoffiaw in a contempt proceeding. Both mutters envision not just damages, but also a statutory penalty for the violation. It would be ludicrous to say that the resources of either are not relevant to the court's inquiry, for the relative amoWlt of the assets and liabilities, the allocation of resources, and the activities of the scoffiawlDollar Bank insofar as their "attitude and conduct" towards ensuring their statutory obligations are met are directly relevant to the assessment of a penalty (in addition to damages). Dollar Bank next argues that the interrogatories are "vexatious." Rules of Civil Procedure 4000 . 4025 do not address discovery in terms of "vexatiousness," but an analogy of the term can be drawn from 42 Pa.C.S.A. Sec. 2503(9), which states that conduct is considered "vexatious,. for purposes of awarding counsel fees because of vexatious conduct of opposing coW1SCI, iflt is instituted without sufficient grounds and serves only to cause annoyance. A1s stated above, there is a clear legal basis for discovering the information sought by the Interrogatories, so the argument must fail that the questions posed are without sufficient grounds and only cause annoyance.
