FOGG, and JACK GAUGHEN REALTOR JURY TRIAL DEMANDED Defendants COMPLAINT 1. The Plaintiff, MARGARET E. BASOH, is an adult individual who currently resides at 239 Cumberland Road, Camp Hill, cumberland county, Pennsylvania 17011 2 . The De fendante, SHIRLEY WALKDEN FOGG and MARK E. FOG, husband and wife, are adult individuals with an address of 6203 Westover Drive, Hechanicsburg, Cumberland county, Pennsylvania 17055 3. The Defendant, JACK GAUGHEN REALTOR, is a corporation organized and doing business under the laws of the Commonwealth of Pennsylvania with an address of 3800 Harket street, camp Hill, Cumberland county, Pennsylvania 17011 4. Prior to July 10, 1991, the Defendants, Shirley Walkden Fogg and Hark E. Fogg, had entered into a listing agreement with Jack Gaughen for the sale of their home at 239 cumberland Road, Camp Hill, Pennsylvania. 5. Pursuant to the listing agreement it is believed and therefore averred that Shirley and Hark Fogg provided to Jack Gaughen Realtors a list of any defects, latent and patent, in the property. 6. Under the terms ot the atoresaid agreement Jack Gaughen Realtors was the agent of Defendants shirley and Mark Fogg. 7. On or about July 10, 1991, the Plaintiff entered into a written Agreement with Shirley and Mark Fogg to purchase the property at 239 Cumberland Road, Camp Hill, Pennsylvania 17011. (A copy of that Agreement is attached hereto as Exhibit "A"). 8. The Plaintiff made a visual inspection of the property to be sold. 9. Settlement occurred on September 17, 1991, at which time Plaintiff purchased the property from the Defendants for the purchase price of $76,000.00. COUNT I - DASOH vs. FOGG 10. The Plaintiff incorporates by reference thereto Paragraphs 1 through 9 of the within Complaint as if it were fully set forth herein. 11. At the time that Plaintiff made a visual inspection of the property, the Plaintiff attempted to make a visual observation of the basement but was unable to do so because ehe could not open the trap door which led down into the basement. 12. Shortly after having moved into the property, the Plaintiff, with the assistance of her son, was able to open the trap door and enter into the basement area. 13. Upon entering the basement area the Plaintiff observed evidence of flooding in the basement. 2 14. Since having lived in the residence, the Plaintiff has experience severe flooding problems in the basement area, which problems are continuous and it is believed such problems existed prior to the agreement of sale of the property to Plaintiff. 15. The Defendants/Owners of the property never advised the Plaintiff of this defect in the basement. 16. The Plaintiff contacted a waterproofing contractor to determine the cost of repairing the basement walls and footers. The cost to repair the basement and prevent future flooding is $9,572.00. 17. It is necessary for the Plaintiff to make the repairs since the appraised value of the property in question, when taking into account the problem with the flooding in the basement, is substantially less then the amount which she paid for this property, which was $76,000.00. 18. The Defendants are liable to the Plaintiff because of their negligent or intentional failure to disclose the water problems with the basement. 19. Since the Plaintiff was unable to gain access to the basement to make a visual observation of the basement, the defect of which Plaintiff complains is a latent defect for which the Defendants are liable. 20. In addition to the defective basement, the Plaintiff, shortly after having moved into the residence, diecovered that two skylights in the roof of the residence also had severe leaking 3 problems. 21. prior to purchasing the property, the plaintiff had specificallY asked about water leakage around the skylights and was advised by the Defendants that there was no water leakage problem. 22. After having experienced water leaks through the skylights, the plaintiff, upon making observations around the ceiling in which the skylights were located, determined that there were signs of previous water leakage which had been covered by paint prior to Plaintiff'S visual observation of the inside of the premises. 23. The Defendants, either negligently or intentionally, failed to disclose the water leakage problem around the skylights and/or attempted to conceal the evidence of water leakage around the skylights. 24. The plaintiff obtained an estimate for the repair of the ceiling and replacement of the skylights and said estimate is in the amount of $850.00. WHEREFORE, plaintiff seeks damages for both the repair of the defective basement and the defective skylights in a total amount of $10,422.00, plus costs and interest as the law may allow. COUNT II - BASOK va. JACK OAUOHBN RBALTORS 25. Paragraphs 1 through 24 are incorporated herein as if set forth at length. 26. Defendant Jack Gaughen Real tors was the agent for 4 Defendants Foggs for the purpose of selling the real property in question. 27. pursuant to the agreement whereby Jack Gaughen Realtors agreed to aot as the agent for Defendants Foggs, it is believed and therefore averred that the Defendants Foggs provided Jack Gaughen Realtors with a list of all latent and patent defects concerning the property in question. 28. It is believed and therefore averred that this list contained information concerning the water leakage problem in the basement. 29. Defendant, Jack Gaughen Realtors, and/or its agents and/or employees, failed to advise the plaintiff of the defective condition of the basement, the existence of which they either knew or had reason to know. 30. Plaintiff has sought to obtain a copy of the document provided to Defendant Jack Gaughen Realtors by the sellers of this property, but Jack Gaughen Realtors has refused to provide Plaintiff with a copy of that document which would have listed any latent or patent defects in the property. 39. Defendant Jack Gaughen Real tors is in the business of buying and selling property and acting as agents for the buyers and sellers of property and, therefore, were in a position to know of the seller's duty to inform the Plaintiff of any latent defects in the property. 5 ;1 i ~ .' I; :1 I 40. Defendant Jack Gaughen Realtors, failed to fulfill that duty, the benefit of which was for the Plaintiff/buyer in this case. 41. Defendant Jack Gaughen Realtors is therefore liable to the Plaintiff for the damages suffered by Plaintiff as a result of purchasing his property without knowledge of the latent defects aforementioned.
