and Warwick Road, thence along the easterly line of Warwick Road in
a northerly direction ninety-seven and thirty-seven one hundredthl

COMPLAINT PURSUANT TO RULES 2951{b) AND 2971 (a)
FOR CONFESSION OF JUDGMENT FOR POSSESSION
OF REAL PROPERTY AND MONEY DAMAGES
AND NOW, comes the Plaintiff, by and through his attorney,
Joanne Marino McGreevy and avers as followSl
1. Plaintiff is Joseph C. Caro1in, an adult individual
residing at 4276 Spring Road, Cambersburg, PA 17201.
2. Defendant is Joseph C. Moore, an adult individual residing
at 1315 Warwick Road, Camp Hill, PA 17011.
3. On or about March 15, 1993, Plaintiff and Defendant entered
into an Installment Sales Agreement, a true and correct copy of
which is attached hereto as Exhibit "A" and made a part hereof by
reference.
4. Said Agreement has not been assigned by Plaintiff.
5. It is believed, and therefore averred that Defendant
currently occupies the premises at 1315 Warwick Road, Camp Hill,
Cumberland County, Pennsylvania.
6. No jUdgment on the Agreement has been entered in any
jurisdiction.
7. The aforesaid Agreement requires Defendant to pay unto
Plaintiff $643.70 per month, to reimburse Plaintiff for real estate
taxes, and to pay all trash, water and sewer charges.
8. Defendant has failed to make the required monthly payment of
643.70 for the month of June 1994, has failed to pay $883.30 in
school taxes, due and owing from August 31, 1993, and failed to pay
the trash and water and sewer charges from June 1993 so that
$466.05 is now due and owing.
9. Defendant has failed to make the required monthly payments
in a timely fashion.
10. Defendant paid the July 15, 1993 payment on August 25, 1993.
11. Defendant made the August 15, 1993 payment on August 25,
1993.
12. Defendant made the October 15, 1993 payment on November
27, 1993.
13. Defendant made the December 15, 1993 payment on December
27, 1993.
14. Defendant made the January 15, 1994 payment on January
21, 1994.
15. Defendant is obligated to pay late charges in the amount
of five (5) per cent per month.

17. Under the terms of the aforesaid Agreement, the Defendant
authorizes a warrant of attorney for Confession of Judgment in
amicable action of ejectment for breach of Agreement.
As a result of Defendant's failure to make the monthly

also obligated to pay the Plaintiff the expenses of collection,

judgment in amicable action in ejectment.

This agreement, made as of Ihis fifteenth (15th) day of March,
1993, by and between Joseph C. Carolin of FrankHl)J(;ounty?!

Cumberland County, Pennsylvaniat hereinafler referred to as the
"Buyer" .
The parties hereto, with inlent to be legally bound. do hereby
agree, covenant and represent as follows:

1. SALE AND PURCHASE OF REAL PROPERTY. The Seller shall
sell and convey to Buyer who shall purchase that certain lot or piece
of real property with improvements thereon erected. commonly
known and numbered as 1315 Warwick Road. Camp HilIt Cumberland
County. more parlicularly described in EXHIBIT At attached herelo
and made a pari hereof (hereinafter referred to as Ihe "Premises"),
upon the following terms and condilions.
FIXTURES AND PERSONAL PROPERTY. The following personal
propeny located on or within the Premises is included in Ihis sale:
All plumbing. healing and lighting fiXlures. and systems appurtenant
to the Premises and the improvemenls localed therein, or forming a
part thereof, as well as the ranget refrigeralor. drapes and blindst
and all treest shrubbery and plants now in or on the Premises.
Excluded from Ihe sale is the shelving in the basemenl. and all

foregoing, Buyer shall nOI permit any mechanicst lien or claim to be
asserted against or attach to thle to the Premises.

I \. BUYER'S DEFAULT.
(a) Payment by Ihe Buyer of all monies becoming due
hereunder and the performance of all covenanlS and condhions of
this Agreement to be kept and performed by Ihe Buyer are
condhions precedent to the Pcrfonnance by the Seller of the
covenants and conditions of this Agreement to be kept and
performed by the Seller.
(b) The occurrence of any of the following shall constitute
an Event of Default by Buyer:
(i) Failure to pay any monthly Installment or other sum
of money when due, If the failure continues for five (5) days aCler
notice has been given to Buyer;
(ii) Any attempl at assignment, lIansfer, or
encumbrance by Ihe Buyer of Buyer's inlerest under this Agreement
or in the Premises;
(Iii) If Buyer's interest in the Premises is levied upon in
execution or by any other process of law and said execution or other
process Is not stayed or satisfied within twenly(20) days of the
issuance thereof;
(Iv) Any assignment for the benefil of Buyer's creditors.
or other proceedings intended to liquidale or rehabilitate Buyer's
estate, which proceedings arc not discharged, vacaled, dismissed or
otherwise terminated and ended within ninety (90) days after the
filing of same or valid appeal taken therefrom and is pending; or
Buyer's becoming insolvent within Ihe meaning of the Federal
Bankruptcy Law,
(v) Failure to perfonn any other provision of this
Agreement if the failure to perform is not cured within thirty (30)
days aCler notice has been given to Buyer.
12. Seller's Remedies. Sel1er shall have the fol1owing remedies
if Buyer commllS an Event of Default. These remedies arc not
exclusive: they are cumulative and In addhlon to any other remedies
now or later al10wed by law or equhy:

by Buyer of the Premises or any part Ihereof, caused or occasioned

18. COMPLIANCE WITH LAWS. Buyer shall comply wilh all
valid laws, ordinances and regulallons of duly constituted public

adJacenl sidewalks or any improvements on Ihe Premises or the use
thereof. Buyer shall have the righl to conlesl the validlty of any
laws, ordinances or regulations adversely affecting his use of the
Premises and shall hold Seller harmless against violations by Buyer
of any such law, ordinance or regulation. As of the date of this
Agreement. Seller to Ihe best of his knowledge, has not received any
notice of a violation(s) of any governmental regulation or
requiremenl affecting Ihe Premises.
19. INSPECTIONS. Selier shall have no obligation or dUlY, but
shall have Ihe right at reasonable limes upon reasonable notice to
Buyer 10 make inspeclion(s) of Ihe Premises during reasonable hours
or al such other limes as Buyer and Seller may mutually arrange.
20. MAINTENANCE. Buyer agrees 10 keep Ihe Premises
(including landscaping) and all improvemenls in as good and
allractive repair and condition as exisled on the date of Ihls
Agreement. Any nOllce, ordinance or olher mailer filed subsequenl
to the date of this Agreemenl by any governing body regarding the
Premises shall be timely complied with by and al the sole expense of
the Buyer.
