MOTION FOR CONTINUANCE
AND NOW, comes the Commonwealth of Pennsylvania, Department of
Transportation, Bureau of Driver Licensing, by and through its
attorney, Matthew X. Haeckler, Esquire, respectfully requests s
continuance in the above referenced matter as follows:
1. The above referenced matter is an appeal of a six month
suspension imposed by the Department based upon a conviction of
~1313830 of the Crimes Code, delivery of a controlled substance.
2. A hearing in the above referenced matter is scheduled for
August 22, 1994 at 9:30 a.m. in court room number four.
3. Counsel for the Department is unavailable to attend the
hearing at the scheduled time and date as a result of a previously
scheduled vacation scheduled for the weeks beginning August 15, and
August 22.
4. Counsel for the Department has contacted William J.
Fulton, Esquire, counsel for Jason M. snyder, and Mr. Fulton does
not oppose the continuance of the above referenced matter. Mr.
Fulton further informed the Department that he also had a
scheduling conflict for that date.
Wherefore, the Commonwealth of Pennsylvania, Department of
Transportation, Bureau of Driver Licensing, respectfully requests
that the hearing scheduled in the above referenced matter for
August 22, 1994 be continued and rescheduled at the convenience of
the court.

PETITION FOR APPEAL
FROM ORDER SUSPENDING DRIVING PRIVILEGB
AND NOW, this 13TH day of July, 1994, comes
Petitioner/Appellant, JASON M. SNYDER, by and through his attorney,
WILLIAM J. FULTON, who, pursuant to 75 Pa.C.S.A. ~1550, files this
Petition for Appeal from an Order Suspending Driving Privilege
representing that:
1. Petitioner is JASON M. SNYDER, an adult individual
residing at 706 State Street, Lemoyne, Cumberland County,
Pennsylvania
17043.
2. Petitioner possesses a currently valid Pennsylvania
operator's license, Number 22 523 927.
3. Under letter dated June 17, 1994, the Pennsylvania
Department of Transportation, Bureau of Driver Licensing, notified
Peti tioner that as a result of an alleged
" conviction on
OS/24/1994 of violating Section 13A30 of the Vehicle Code, DELIVERY
OF CTRL SUB on 03/14/1992,"
his driving privilege was being
SUSPENDED for a period of six months as mandated by Section 1532C
1
of the Vehicle Code. A copy of the notice is attached hereto as
Exhibit nAn and is incorporated herein by this reference.
4. It is respectfully submitted that said suspension is
illegal and contrary to law for the following reasons:
(a) There is no section 13A30 of the Vehicle Code.
(b) Petitioner was never notified that his driving privilege
might be subject to suspension as a penalty. The suspension,
therefore, violates Petitioner's due process rights.
(c) Petitioner has been convicted of no offense arising under
the Vehicle Code.
(d) It appears that the record of Petitioner's alleged
conviction has not been properly and correctly certified pursuant
to 75 P.S. g6323(1) and 9511(h).
5. Petitioner respectfully reserves the right to raise
additional and supplemental reasons in support of his appeal should
other such grounds arise at or before hearing.
WHEREFORE, pursuant to 75 Pa.C.S.A. ft1550, Petitioner
respectfully prays that Your Honorable Court accept this Petition
for Appeal and grant him an appeal from the suspension order and
schedule a hearing dg DQYg to determine whether the Orders of the
Department of Transportation should be set aside and staying the
suspensions in the meantime.

03/14/1992, your driving privilege is being SUSPENDED for a
period of 6 MONTH(S) as mandated by Section 1532C of the Ve-
hicle Code.
In order to comply with this sanction you are required
to return any current driver's license, learner's permlt
andlor temporary driver's license (camera card) in your pos-
session no later than the effective date listed below.
Failure to comply with this notice shall result in this Bu-
reau referring this matter to the PennsYlvania State Police
for prosecution under Section 1571(a)(4) of the Vehicle Codo.

above term and number and shall be heard in one proceeding on

Supplemental Petition for Consolidated Appeals from SUbsequent
Orders Suspending Driving Privilege representing that:
1. Petitioner is .TASON M. SNYDER, an adult individual

2. Petitioner possesses a currently valid Pennsylvania

3. On or about July 14, 1994, Petitioner timely filed an
appeal from a Driver's License suspension notice dated June 17,
1994, wherein the Department of Transportation advised the
Petitioner that:
As a result of your conviction on OS/24/1994 of violating
Section 13A30 of the Vehicle Code, DELIVERY OF CTRL SUB on
03/14/1992, your driving privilege is being SUSPENDED for a

period of 6 MONTII( S) as mandated by Section 1532C of the
Vehicle Code.
4. That Petition was filed to the above-term and number; and,
on July 15, 1994, Your Honorable Court issued an order setting
August 22, 1994 as the date for a hearing ~ D2YQ.
5. By order dated August 16, 1994, upon motion of the
Department and with the express concurrence of undersigned counsel,
the hearing has been rescheduled for October 3, 1994 at 9:30 A.M.
6. Subsequent to the filing of said Petition for Appeal from
Order Suspending Driving Privilege, the Petitioner has received
two additional suspension notices from the Department of
Transportation.
7. Under letter dated August 01, 1994, the Department
notified petitioner that:
As a result of your conviction on OS/24/94 of violating
Section 13A30 of the Vehicle Code, DELIVERY OF CTRL SUB
ON 04/04/1991, you have been placed in habitual offender
status because this is your third major violation within a
five year period. Your driving privilege is being revoked for
a period of 5 YEAR(S) as mandated by Section 1542D of the
Vehicle Code.
A copy of that notice is attached hereto as Exhibit "B" and is
incorporated herein by this reference.
8. Under letter dated August 2, 1994, Petitioner received an
"ADDITIONAL NOTICE" advising him that:
As a result of your conviction on OS/24/1994 of violating
Section 13A30 of the Vehicle Code, DELIVERY OF CTRL SUB on
04/04/1991, you have been placed in habitual offender status
because this is your third major violation within a five year
period. Your driving privilege is being revoked for a period
of 5 YEAR(S) as mandated by Section 1542D of the Vehicle Code.

A copy of that "additional notice" is attached hereto as Exhibit
"c" and is incorporated herein by this reference.
9. In addition, Petitioner received a fourth letter from the
Department, this one dated August 2, 1994, which advised him that
despite the first appeal filed to the above term and number, his
driving privilege remains withdrawn, apparently because of the 5
year suspension(s) referenced above. A copy of that letter is
attached as Exhibit "D" and is incorporated herein by this
reference.
10. It is believed and averred that the 5 year suspension, or
suspensions as the case may be, are improper and contrary to law
for the following reasons:
(a) Petitioner's driving record should not contain the number
and type of violations which trigger an habitual offender
suspension pursuant to Section 1542D of the Vehicle Code.
(b) Suspensions imposed pursuant to Section 1532C of the
Vehicle Code, 75 Pa.C.S.A. ~1532(c), formerly Section 13(m) of the
Drug Act, 35 Pa.C.S.A. P80-113(m), should not be used by the
Department as predicate offenses under Section 15420 of the Vehicle
Code, 75 Pa.c.S.~1542(b)(I).
(c) Employing drug case license suspensions as predicate
offenses triggering 5 year habitual offender suspensions results in
a draconian collateral civil penalty which violates federal and
state constitutional protections against double jeopardy and cruel
and unusual punishment.

(d) The Department of Transportation may have impermissibly
and geometrically enhanced separate counts of conviction in I'

imposing sanctions upon an offender, who, prior to his plea(s) of
guilty, had not previously been convicted of an offense.
(e) Petitioner respectfully reserves the right to raise and
additional and supplemental reasons in support of these appeals
should other such grounds arise at or before time of hearing.
11. In the interests of jUdicial economy, Petitioner
respectfully requests Your Honorable Court to accept this
Supplemental Petition for Consolidated Appeals from Orders
Suspending Driving Privileges, the holding in ~onwealth of
Pennsylvania. Department of Transportation v. Slack, Pa.
Cmwlth. ___, 623 A.2d 364 (1991) notwithstanding.
12. It has been held that although challenging mul tiple
administrative orders in a single appeal is generally improper,
there are circumstances in which consolidation may be appropriate
and not juriSdictionally fatal. Posel v. Redevelonment Authority
of the citv of PhiladelJ2h.i.ll, 72 Pa. Cmwlth. 115, 456 A.2d 243
(1983); Philadelnhia Federation of Teachers v. Board of Education.
458 Pa. 342, 327 A.2d 47 (1974).
13. Although more than one suspension order are now appealed
from, because the underlying drug case gives rise to each license
suspension, because of the identity of parties and isaues
presented, it is respectfully submitted that the orders are in ~
materia and should be reviewed in one proceeding and that the

orders are properly challenged in a consolidated petition for
Appeal.
WHEREFORE, pursuant to 75 pa.C.S.A.~ 1550, Petitioner
respectfullY prays that Your Honorable court accept this
supplemental Petition for consolidated Appeals from orders
suspending Driving privileges and grant him an appeal from the
subsequent Orders of the Department attached hereto, to hear all
matters at the hearing scheduled for october 3, 1994 and to stay
the additional suspensions in the meantime.

for two drug offenses on May 24, 1994, and that prior to
pleading guilty to the charges which led to that sentencing he
had not been previously convicted of any drug offense, the
within appeals are sustained in part, and the order of the
Department of Transportation suspending the appellant's
operator's license for a period of six months is affirmed, but
the order of the Department suspending the operator's license of
the appellant for a period of five years is vacated.

been advised by the parties that because the dates of the offenses
for which the defendant was sentenced on May 24, 1994 preceded the

113(m), the period of suspension should be 90 days as opposed to
six months, the Order of October 3, 1994 entered in this matter is
HEREBY AMENDED and the Department of Transportation is ordered to
impose a suspension of 90 days. Otherwise, the Order of October 3,
1994 is reaffirmed in all respects.

Dear Judge Hess:
In discussing this matter with Matt Haeckler, the attorney for
the Department, on Friday, October 7, 1994, he advised me that
because the dates of the underlying offenses in this case preceded
the effective date of the 1992 amendment to Section 13m of the Drug
Act, the correct period of suspension should be 90 days as opposed
to six months. Matt said he would be communicating this fact, or
legal conclusion, to the Court; but, he asked that I submit the
enclosed proposed Amended Order of Court.
I apologize for not having figured this out prior to or at the
hearing of Tuesday, October 4, 19941 and, I would like to commend
Mr. Haeckler for his courtesy and candor in bringing this matter to
the attention of counsel and the court.
