The Plaintiff, Moore Graphics, by Its allorneys, Brlgld Q. Alford, Esquire and
Boswell, Snyder. Tintner & Piccola, presenls Its Complaint as follows:
I. Plaintiff, Moore Graphics, Is a partnership doing business In the
Commonwealth of Pennsylvanln, with Its office locnted nt ~236 Trindle Road,
Mechnnicsburg, Cumberlnnd County, Pennsylvanln 170~~.

2. Defendant, Robert J. McCreery, tl a R&M Enterprises and tl a McCreery
Designs, R&M, Is an adult Individual presently residing at 4280 Northern Pike, Suite 480,
Pittsburgh, Allegheny Counly, Pennsylvania 15146.
3. Plaintiff Is a business that provides screen printing and heat sensitive T-shirts
In exchange for monelary consideration, the exact prices for each such product or service
being reasonable and customary In the local screen printing industry and based In part
upon lhe type of design and lhe size of lhe order.
4. On or about February 12, 1993, Plaintiff and Defendant entered into and
signed a written Contract Agreement ("Agreemenl"), a true and correcl copy of which Is
attached hereto, made a pari hereof, and identified as Exhibit "A".
5. Among the terms and conditions of the Agreement, Defendant agreed 10 pay
Plaintiff a sum not to exceed Four ($4.00) dollars per T-shirt based upon lhe agreement
that Defendant ordered approxlmalely 2000 10 4000 T-shirts per month.
6. Defendant further agreed that, ill lhe evenllhat It were to become necessary
10 maintain an action to place any of the Invoices in the hands of an attorney for
collection, or to enforce an of the lerms and conditions herein, reasonable attorney fees
would be charged to him, and lhat a service charge of I 112% per month would be made
on all past due balances, which Is an annual rate of 18%.
7. Al various times during lhe calendar year 1993, Plaintiff provided Defendant

with numerous quanlllles of T-thlrts, all of which Ihe Defendant had ordered and all of
which Defendanl accepted.
8. Plaintiff submllled an Invoice to Defendant with each Ihlpmenl of T-thlrlllhal
Plalnllff delivered to Defendan!. The Invoice sel forlh Ihe specific producll supplied
wllhln each shipment, nnd the charge for each producl: the total charges on lhese
Invoices submitted In Ma), Augusl, November & December, 1993, was $8,12~.14. True
and correCI copies of these Invoices are aUached herelo, made a pari hereof, and
Idenllned as Exhlbll "n -I" lhrough "n.19" respectively.
9. Defendanl has submllled parllal payments 10 Plaintiff 10lalling $1.947.77.
Plaintiff has credited Defendant's account accordingly.
10. To date, Defendanl owes Plaintiff $8,488,81 for the merchandise provided by
Plainllff, which Includes the unpaid balance on the Invoices, plus accrued Inleresl and
collecllon fees as per the lerms of the parties' Agreement.
II. Desphe repealed demands by I'lalnllff for paymenl of the same, Defendant
has failed and refused 10 pay Ihe amount owed.

WHEREFORE, Plalnllff Moore Graphics demands judgmenl against Defendant,
Robert J. McCreery, II a R&M Enlerprlses & II a McCreery Dellgns R&M, In Ihe
amount of $8,488.81, which amount II not In ellceSI of the jurlsdlcllonallimlt requiring
compulsory arbltrallon, together with costs of suit and Interell.

Or, this da)', the 12th dal' of February, 1993 and agreement has been
mndc between R & M Enterprises i.e. Rob MccreerYI and Moore Graphic~
i ,e. steve Moorel for the put'pose of prQviding heat sensitive
T-shirts. It i~ agreed that a sum not to exceed $4.00 per T-shirt
\.-ill be paid to Moore Graphics for each shirt ordered based upon the
tentative arrangement of approximatelY 2000 to 4000 shirts per month.
The $~. 00 cost per shirt is total cost for complete production. . It
is also agreed that with no more that 4000 ~hirts per month given to
Moore Graphics from R & M Enterprises, production should be completed
within 7 to 14 dars. It is agreed by Rob Mccreery that a majority of
the color discretion '.dll be up to,steve Moore of Moore Graphics.
Delivery of shirts will either be'by personal pick up by Rob McCreery
or an R & M Enterprises representative. ln the event that time
constraints do not allow for this method of pick up, shirts will be
sent through Jr,ail via r.ourier chosen by Rob P.ccreery. The cost of
this Jr,ethod of delivery \.'i 11 be paid by Rob Mccreery.
It is also agreed and fully understood that at no time will steve
Moore or any employee of Moore Graphics or any associate of anyone
involved with Hoore Graphicsl contact or attempt to contact any of
Rob McCreery's clients for any reason whatsoever1 for the purpose of
trying to obtain them as a client of Moore Graph cs, or for any
reason. ~on-adherence of this clause would be a strict violation of
the contract and legal action may be taken.
, At the time r: the signing of this agreement, both parties are
1n total agreement of their current and future busines~ dealings and
are both looking forward to a long, friendly and profitable
relationship with each other. Any changes in this c6ntract must be
done in \-Iriting and have the dgnature of both parties involved.

2. Defendant, Robert J. McCreery, tla R&M Enterprises and II a McCreery
Designs, R&M, Is an adult Individual presently residing at 4280 Northern Pike, Sulle 480,
Pittsburgh, Allegheny County, Pennsylvania 15146.
3. Plaintiff Is a business that provldes'screen printing and heat sensitive T -shlrls
In exchange for monetary consideration, the exact prices for each such product or service
being reasonable and customary In the locol screen printing industry and based in part
upon the type of design and the size of the order.
4. On or about Pebruary 12, 1993, Plaintiff and Defendanl entered into and
signed a written Contract Agreement ("Agreement"), a true and correct copy of which Is
attached hereto, made a part hereof, and Identified as Exhibit "A".
5. Among the terms and conditions of the Agreement, Defendant agreed 10 pay
Plaintiff a sum not to exceed Pour ($4.00) dollars per T-shirt based upon lhe agreement
lhat Defendant ordered approximately 2000 to 4000 T-shirts per month.
6. Defendant further agreed that, ill lhe eventlhat it were to become necessary
to maintain an action to place any of the Invoices In the hands of an attorney for
collection, or to enforce an of the terms and conditions herein, reasonable attorney fees
would be charged to him, and that a service charge of I 112% per monlh would be made
on all past due balances, which 15 an annual rate of 18%,
7. At various times durlnllthe calendar year 1993, Plaintiff provided Defendant

with numerous quantllles of TlIhlrls, all of which the Defendant had ordered and all of
which Defendant accepted.
8. Plalnllff submitted an Invoice to Defendant wllh each shipment of TlIhlr18 lhat
Plaintiff delivered 10 Defendan!. The Invoice sel forlh Ihe spectnc products supplied
wilhln each shlpmenl, and Ihe charge for each producl; Ihe 10lal charges on these
Invoices submitted In May, August, November & December, 1993, was $8,125.14. True
and correcl copies of these Invoices are aUnched herelo, made a part hereof, and
IdenUfied as Exhibit "8 -I" Ihrough "8-19" respectively.
9. Defendant has submlued parUal payments 10 PlalnUff totalling $1.947.77.
Plainllff has credited Defendant's account accordingly,
10. To date, Defendant owes Plalnllff $8,488,81 for the merchandise provided by
Plaintiff, which Includes the unpnid balance on the Invoices, plus accrued Inlerest and
collection fees as per the terms of Ihe parties' Agreement.
II. Despite repeated demands by PlalnUff for payment of the same, Defendant
has failed and refused to pay Ihe amounl owed.
WHEREFORE. PlalnUff Moore Graphics demands judgmenl agalnlt Defendant,
Roberl J. McCreery, lla R&M Enterprises & l/a McCreery Designs R&M, In the

On this da)', the 12th da)' of February, 1993 and agl.eel1lCnt has been
mnde between R , K Enterprises i.e. Rob Mccreery; and Moore Graphics
i.e. steve Moore; for the purpose of pr9viding heat sensitive
T-shirts. It is agreed that a sum not to exceed $4.00 per T-shirt
\.-ill be paid to )',oore Graphics for each shirt ordered based upon the
tentative arrangement of approximately 2000 to 4000 shirts per month.
The ~4. 00 cost per shirl is total cost for complete production. ' It
is also agreed that with no more that 4000 shirts per month given to
Moore Graphics from R & )', Enterprises, production should be completed
within 7 to 14 days. It is agreed by Rob Mccreery that a majority of
the color discretion will be up to. steve Moore of Moore Graphics.
Delivery of shirts \.'111 either be'by personal pick up by Rob McCreery
or an R & M Enterprises representative. In the event that time
constraints do not allow for this method of pick up, shirts will be
sent through mail via courier chosen by Rob l'.ccreery. 'l'he cost of
this n,ethod of delivery l.-ill be paid by Rob Mccreery.
It is also agreed and fully understood that at no time will steve
l'.oore or any employee of Moore Graphics or any associate of anyone
involved with Moore Graphics; contact or attempt to contact any of
Rob McCreery's clients for anv reason whatsoeverl for the purpose of
trying to obtain them as a chent of Moore Graplllcs, or for any
reason. ~on-adherence of this clause would be a strict violation of
the contract and legal action may be taken.
At the time r.: the signing of this agreement, both parties are
in total agreement of their current and future busines~ dealings and
are both looking forward to a long, friendly and profitable
relationship with each other. Any changes in this contract must be
done in writing and have the signature of both parties involved.
