Legal custody of the child shall be shared by the parties. 2. Nankivell, by and through her attorneys, Wolfe & nice, and files the following Motion for interim custody order and in support thereof avers I 1. Plaintiff has initiated a custody action seeking to be granted partial physical custody of the parties minor child, Krystal Mae Nankivell, 2, The parties to this action separated in February, 1994. At the time of the separation, Plaintiff moved out of the marital residence. The parties minor daughter remained at the marital residence with the father, Defendant herein, 3. For the first month following the separation of the parties the mother and father had arranged a partial custody schedule with the daughter by mutual agreement. 4. Since March 21, 1994, Defendant has refused to allow Plaintiff to have any partial physical custody with the minor child, has refused to allow mother to telephone the child, has refused to allow the child to telephone mother, has changed the phone number at the marital residence to an unlisted number, and has otherwise cut off all contact between the mother, Plaintiff herein, and the child, 5. Plaintiff desires that an interim partial custody schedule be entered pending mediation conference and hearing. 6. Plaintiff desires that pending further Order of Court that she be granted partial physical custody of the child, Rrystal Nankivell, on each Saturday from 10100 a.m. to 7:30 p,m. 7. Plaintiff would be wiling to provide transportation for the exercise of the interim partial custody schedule pending further hearing.
