COMPLAINT
AND NOW, comes Samuel S. Potteiger, through his attorney-in-
fact, Aaron L. Potteiger, by his attorneys, Snelbaker &
Brenneman, P.C., and avers a cause of action in Mortgage
Foreclosure as follows:
1. The Plaintiff is Samuel S. Potteiger, an adult
individual, who resides at 940 Walnut Bottom Road, Carlisle,
Cumberland County, Pennsylvania, having a mailing address in care
of Aaron L, Potteiger, 204 Ridge Hill Road, Mechanicsburg, PA
17055,
2. The Defendant is Frank D. Potteiger, an adult
individual, who resides at 269 North Middlesex Road, Carlisle
(Middlesex TOWnship), CumbJrland County, Pennsylvania.
3. Plaintiff brings this action to foreclose upon a
Mortgage dated July 1, 1988 in the principal amount of $65,000,00
between Defendant, Mortgagor, and Plaintiff, Mortgagee, which
Mortgage was recorded in the Office of the Recorder of Deeds in
and for Cumberland County, Pennsylvania on May 5, 1989 in
Mortgage Book 938, Page 17, A true and correct copy of the
aforementioned Mortgage is attached hereto and incorporated by
reference herein as "Exhibit A".
4. The real estate subject to said Mortgage i. oommonly
known and numbered as 258-B South Locust Point Road,
Mechanicsburg, Pennsylvania, and is more fully desoribed in the
legal description attached hereto and incorporated by referonoe
herein as "Exhibit B",
5. Defendant is the owner of the real estate eUbjeot to the
Mortgage described herein. Defendant has an address as set forth
in Paragraph 2, above.
6. The Mortgage is in default due to Defendant's failure to
make payment to Plaintiff of principal and interest at various
times during the course of the term of the obligation and to pay
the total balance of principal and interest due upon maturity on
July 1, 1993.
7. As a result of Defendant's default, the following
amounts are presently due and owing Plaintiff on the Mortgagel
Principal balance:

In addition to the above, Plaintiff demands and claims interest
from June 30, 1994 at $17.808 per day on the principal balance

LEGAL DESCRIPTION
ALL THAT CERTAIN piece or parcel of land, situate in the Township
of silver spring, county of Cumberland and State of Pennsylvania,
more particularly bounded and described as follows, to wit:
BEGINNING at a point on the eastern line of Locust Point Road (L.
R. #21012), at the corner of Lot No.4 on the hereinafter
mentioned Plan of Lots; thence by the dividing line between Lot
Nos. 3 and 4 on said Plan, North 72 degrees 46 minutes 00 seconds
East, one hundred sixty-eight and seventy hundredths (168,70)
feet to a point; thence by the dividing line between Lot Nos. 3
and 5 on said Plan, North 12 degrees 31 minutes 00 seconds West,
fifty-nine and ninety-four hundredths (59.94) feet to a point;
thence by the dividing line between Lot Nos. 2 and 3 on said
Plan, South 72 degrees 46 minutes 00 seconds West, one hundred
sixty-seven and ninety-seven hundreths (167.97) feet to a point
on the eastern line of Locust Point Road (L. R. #21012); thence
by the eastern line of Locust Point Road (L, R, #21012), South 11
degrees 49 minutes 40 seconds East, sixty (60.00) feet to a
point, the place of BEGINNING,
BEING Lot No. 3 on the Plan of Kingston Place, as recorded in the
Office of the Recorder of Deeds in and for Cumberland county,
Pennsylvania, in Plan Book 49, at Page 95.
BEING the same premises which Samuel S. Potteiger, by his Deed
dated July 1, 1988, and recorded in the Recorder's Office
aforesaid, in Deed Book "X", Volume 33, at Page 1086, granted and
conveyed unto Frank D, Potteiger, the Mortgagor herein,
HAVING THEREON erected a dwelling known and numbered as 258-B
South Locust Point Road, Mechanicsburg, Pennsylvania.
