PROTECTIVE ORDER
AND NOW, this ~day of July, 1994, upon consideration of
the Consent Agreement of the parties, the following Order is
entersd:
1. The defendant, JONATHAN W. SMALL, is enjoined from
physically abusing the plaintiff, ANGELA M. KING, or from placing
her in fear of abuse.
2. The defendant is ordered to refrain from harassing or
stalking the plaintiff.
3. The defendant is ordered to refrain from harassing ths
plaintiff's relatives or minor children.
4. The defendant is ordered to refrain from damaging or
destroying any property jointly ownsd by the partiss or owned
solely by the plaintiff.
6. This Order shall remain in effect for a period of one
ysar.
6. The New Cumberland Police Department will be provided
with a copy of this Order by attorneys for plaintiff and may
enforce this Ordsr by arrest for indirsct criminal contempt
without warrant upon probable cause that this Order has been
violated, whether or not the violation is committed in the
presence of ths police officer. In the event that an arrest is
made under this section, the defendant shall not be taken to jail
but shall be taken without unnecessary delay before the court
that issued the Order. When that Court is unavailable, the
defendant shall be arraigned before a district justice who shall
set bail according to the provisions of Chapter 4000 of the
Pennsylvania Rules of Criminal Procedure (23 PS Ssotion 6113).

A, ABUSE
1. The plaintiff is an adult individual whose permanent
address is 524 Fourth Street, New Cumberlsnd, Cumberlsnd County,
Pennsylvania, 17070.
2. The defendant is an adult individual residing at 524
Fourth Street, New Cumberland, Cumberland county. Pennsylvania,
17070.
3. The defendant ls father of the plaintiff's child.
4. Since approllimately 1991, the defendant has attempted to
cause and has intentionally, knowingly. or recklessly caused bodily
injury, and by physical menace has placed the plsintiff in fear of
imminent serious bodily injury. This has included. but is not
limited to. the following specific instances of abuse:
a. On or about June 4, 1994 the defendsnt became angry with
the plaintiff and pushed the plaintiff. knocking her down to the
fl oor,
When the plaint i ff got uP. the defendsnt chased the
plaint1ff, taokled her to the floor, and dragged her by her feet
from the kitchen. When the plaintiff attempted to reaoh the phone
to call for help, the defendant ripped ths phone out of the wall,
smashing it on the floor and told the plaint1ff. "You're not
calling anyone". The defendant then grabbed the plaint1ff and
thrsw her into the kitohen oabinets, oausing her hsad to hlt the
cabinets, The plaint1ff was terr1fied and sat on the floor,
crying. The defendsnt then threw spprollimately 36 glsss beer
bottles onto the floor, causing them to shatter around the
plalntiff oovering the kitchen floor and oounter tops.
A short time later, when ths plaintiff was able to get up and
attempt to gst out of the house, the defendant grabbsd her bsfors
she got outside, The defendsnt slapped her, and said, "You ars not
going anywhsre", Fsellng trapped, the plalntiff feigned a leg
injury, hoping that the defendant would take her to the hospltal,
However, the defendant contacted his mothsr instead.
Whsn ths defendant realized that the plaintiff's leg was not
broken, he became enraged snd threatened, "Your leg's not broken?
Well, its gonns bs," When the plaintiff again attemptsd to lsave
the house, the defendant grabbed the plaintiff's foot and slammed
her leg into the floor approximately 15 times. The defendant then
slapped the plsintiff in her faoe approllimately 6 to 8 times.
When the defendant flnslly left the room, the plaint1ff ran
out of the house, but when shs reached ths other side of the
strest, the defendant taokled her and slapped the plaintiff in the
facs about 20 timss. The defsndant then grabbed ths plaintlff by
the shoulders and shook her, causing her head to hit the ground.
The plaintiff pretended she was unconscious because she wss
terrified that the defendant would kill her, The defendant
screamed at the plaint iff to get up, but she didn't move. The
defsndant then began to drag the plaintiff across the street, The
defsndant's mother thsn cams outside and helpsd the defendant carry
the plaintiff back to the house. As a result of the defendant's
abuss, ths plaintiff suffered a swollen face, chipped tooth, sore
jaw, wel ts and bruiSing on her ankles snd arms and temporary
hearing loss ln her right ear.
c. In addltlon to the above incidents, the defendsnt has, on
numsrous occaslons, threatened to kill the plaintiff.
5. The plalntiff bellevss and therefore avers that she will
be in lmmedlate snd present danger of abuse from the defendant and
that she Is in need of protection from such abuse,
6, The plaintiff desires thst the defendant be restrained
from harssslng or stalking the plaintiff and harassing or stalking
the plaintiff's relatives or minor children.
7. The plaintiff desires that the dsfendant be restrained
from damaging or destroying any of the plalntlff's property or any
property jointly owned by the plaintiff and defendant,
e, STATUS TO PROCEED IN FORMA PAUPERIS
8, The defendant Is employed at Square D snd has an annual
salary in excess of $19,000.
9, The plalntlff currently has no Income.
10. The plalntlfl does not have funds availabls to pay the
fees for filing and servloe,
WHEREFORE, pursuant to the provisions of the "Protection from
Abuse Aot" of October 7, 1076, 23 P,S, 06101 at Beg., as amended,
the plaintiff prays this Honorable Court to grant the following
relief:
A, Grant a Temporary Order pursuant to the "protection from
Abuse Act:"
1. RSQulrlng the defendant to refrain from abusing the
plaintiff or placlng her In fear of abuse.
2, RSQulrlng ths defendant to refrain from harassing or
stalking the plaintiff, and from harassing the plaintiff's
rslatlves or minor children.
3, Requiring ths defsndant to refrain from damaging or
destroying any property jolntly owned by the parties or owned
solely by the plaintiff,
B. Schedule a hearing In accordancs with the prOVisions of
ths "Protection from Abuse Act," and, after such hsarlng, enter an
ordsr to bs in effsct for a period of one year:
1, Requiring ths defendant to refrain from abusing the
plslntlff or placing her In fear of abuss.
2, ReQulrlng the defendsnt to refrain from harassing or
stalking the plslntlff, and from harassing the plaintiff's
relatives or mlnor children,
3. ReqUiring the defendant to refrain from damaging or
destroying sny propsrty jointly ownsd by the parties or owned
solely by the plaintiff,

On July 29, 1994, Judge J. Wesley Oler Issued a protect ion order pursuant to 94-3960 r.lvi 1.
As port of that order Judge Oler ordered that the defendant, Jonnthon Small, was enjoined from
placing the plaintiff, Angela King, in fear of ahuse. lie fnrther ordHed that tlw defendant
refrain from physically ahuslng and/or harassing the plaintiff.
On January 13, 1995, at approximately 2302 hours, Jonathon Small did leave tile address or
524 4th St., his home along with Angela Kiog, Jonathan did leave the residence fur approximately
5 minutes, taking his son, Nicholas, along with him when he left. When Jnnathan returned to
the residence with Nicholas, he entered the dwelling, proceeded to put Nicholas down and then
went over to where Angela King was Inside the dwelling at which time he grahhed lwr hy both of
her shoulders, then proceeded to push her up against a wall at which time he had shaken Angela
with force, thla Is the act that Angela claims happened, there were nu vlsable marks, bruises
or redness areas on Angela In the area she said Jonathan had grabhed her.
