consideration of the attached custody Co~Piliation Report, it is
ordered and directed as follows'
1. A earing is scheduled in this case on the'~'/U' day of
, " .1. V.'l , 1996 at '",,,. ~m. in Courtroom '2 of
t e Cu erland County Courthouse. At this hearing, the Court
will hear testimony solely on the issue of how the parties
will handle custody of the minor children on the Christmas
holiday. Each party is directed to file with the Court and
the opposing party a memorandum setting forth their position
on how the Christmas holiday custody should be handled. This
memorandum shall be filed at least ten (10) days prior to the
hearing date.
2. This Court's prior Order of April 12, 1995 is vacated.
3. The Mother, Paula E. Wardecker, shall have legal custody of
Robert Paul Wardecker, born August 23, 1982, Jonathan James
Davis Wardecker, born October 30, 1984, and Matthew David
Wardecker, born March 27, 1989.
4. The Mother shall enjoy primary physical custody of the minor
children with the Father, Robert L. Wardecker, having periods
of temporary custody as follows,
A.
On two weekends per month, being the weekends that the
Father has off from the work, with tIle time from Friday
evening at 6,00 p.m. until Sunday evening at 6,00 p.m.
For a seven-day period of time in the sununer for
vacation, with the Father to give 30-days' written notice
to the Mother. For the sun~er of 1996, the Father shall
have custody from July 26 at 6,00 p.m. until July 31 at
6100 p.m.

5. The parties shall alternate custody of the minor children on
the following holidays: New Year's Day, Easter, Labor Day,
July 4th, Memorial Day. The time shall be from 9:00 a.m.
until 6:00 p.m., with the Father having custody on Labor Day
1996.
6. The Thanksgiving holiday shall be alternated between two time
frames from 3:00 p.m. on the day before Thanksgiving until
3:00 p.m. on Thanksgiving Day and from 3:00 p.m. on
Thanksgiving Day until 3:00 p.m. on the Friday after
Thanksgiving. For 1996, Father shall have the first portion
of the Thanksgiving holiday from Wednesday at 3:00 p.m. until
Thanksgiving Day at 3:00 p.m.
7. On the birthdays of the children where the Father does not
have custody, Mother shall make arrangements for the Father to
have a period of at least four hours of custody on the
birthday or the day before or immediately after the child's
birthday.
8. For transportation for exchange of custody, Father shall pick
the children up when he is getting them for custody and Mother
shall pick them up upon the end of Father's custody. The
pick-Up point, absent agreement otherwise between the parties,
shall be the Sheetz store in Shippensburg.

CONCILIATION CONFERENCE SUMMARY REPORT
IN ACCORDANCE WITH CUMBERLAND COUNTY CIVIL RULE OF PROCEDURE
1915.3-8(b), the undersigned custody Conciliator submits the
following report:
PRIOR JUDGE,
1. The information pertaining to the children who are subject of
this litigation is as follows:
Robert Paul Wardecker, born August 23, 1982
Jonathan James Davis Wardecker, born October 30, 1984
Matthew David Wardecker, born March 27, 1989
2. A Conciliation Conference was held on July 12, 1996, at which
time the Father, Robert L. Wardecker, appeared without
counsel, and the Mother, Paula E. Wardecker appared with her
counsel, Carol Lindsay, Esquire.
3. At the Conciliation Conference, there were a variety of
disputes between the parties. The parties were able to reach
an agreement with respect to all matters on custody except for
the Christmas holiday. Father wants to alternate the
Christmas holidays so that he can have some time on Christmas
Eve and Christmas morning, but the Mother suggests that the
children should always be with her on Christmas morning.
4. The Conciliator recommends the Court schedule a short hearing
merely to address the Christmas holiday issue and to adopt an
order pursuant to an agreement by the parties for all other
matters dealing with custody.

NOW COMES the Defendant, ROBERT L. W ARDECKER, through his allorneys, the
Family L1W Clinic, and slates his position regarding custody of the minor children on the
Christmas holiday:
On July 12, 1996, a Conciliation Conference was held in order to try to resolve various
custody disputes and to set forth more clearly the rights of the parties. Thc parties were able
to agree on most issues, According to the Order of Court dalcd July 19, 1996, the Plaintiff,
Paula Wardecker (mother), has lcgal cuslody of Ihc children -- Robcrt Wardecker. age 14,
Jonathan Wardecker, agc II. and Mallhew Wardccker, age 7. The mother also has primary
physical custody, although Robcrt Wardeckcr (fathcr) has pcriods of tcmporary custody. Robert
Wardecker has custody two weekcnds pcr month, one week during thc summcr, on alternatc
holidays (New Year's Day, Enstcr, Lnhor Day, July 4th, and Mcmorinl Day), for part of
Thanksgiving, and for nt Icast four hours for ench or thc childrcn's hirlhdays,

Rohert Wardecker would like the children III he uhle III spend II period of twenty. four hours with
one parent from approxhlllllely 12:00 noon on Decemher 24th until 12;00 noon on December
25, 1996, Christmas Duy. The other parent would spend the nexltwenly.four hour period with
the children n from 12:00 noon onlhe 25th until 12:00 noon Oil the 26th of Decemher. Then,
on Christmas of 1997, the children would he ahle to spend Chrlstmus Eve und Christmas Day
with the other parent. Thus, on Ihe yellrs that the children would he ahle to spend with their
father, the children would he uhte to pllrtake in the customary celehratlon of Christmas with
Rohert Wardecker's parents, his sister, alld his sister's young children.
The preceding desired arrllngements for the Christmas holiday have heen proposed to the
mother, as well as two other variations. The mother rejected all proposed allempts to sellle this
issue amicahly. The mother refuses to allow the children to sleep ut the father's house on
Christmas Eve Into Christmas morning,
Rohert Wardecker's posillonon how the Christmas holiday custody should he handled
is consistent with the other periods of temporary cuslody that the parties have already agreed
upon, In the hest interests of the children n Rohert, Jonathan and Mallhew .- Rohert Wardecker
asks this Honorable Court to grant his request for the children 10 he able to spend Christmas Eve
and Christmas Day wilh him every olher year,

The parties In this case are parents of three children; Robert Paul Wardecker, born August
23, 1982; Johnathon James DavIs Ward ecker, born October 3D, 1984; and Mallhew David
Ward ecker, born March 27, 1989,
The parties are divorced and the children have been in the primary physical custody 01
Plaintiff since separation. Alter a conciliation, called for by Defendant's Petition to have Plaintiff
held In contempt of Court, this Honorable Court entered an Order on July 19, 1996, Atthe
conciliation, the parties were able to agree to all outstanding Issues except custody over the
Christmas Holiday.
Ills Defendant's position that he should have custody of the children, at least on alternating
years, over Christmas Eve and CllIIslmas Morning. Plaintiff recognizes that that arrangement for
Christmas is routinely ordered by the Courts, However, Plaintiff opposes this request for two
reasons. To begin, she has remarried, She and her new husband have a stable home
environment suited to the celebrolion of Christmas Eve and Christmas Morning with children.
Defendant, on the other hand, has not remarried, In fact, has not lelt his parent's house.
Secondly, Defendant's lack of rolionallty and stability, while not keeping him from contact with his

children, Is not conducive to a chlld.orlented Christmas In this of all special holidays, PI81ntlff will
abide by any Court Order In this regard. However, she believes that If the Court should enter an

testimony regarding his behavior and treatment of his children.

1, I am the named Plaintiff in the above-titled civil cause
of action and the Defendant is Robert L, Wardecker,
2. This Affidavit is made to inform the Court as to my
status of indigency and to induce the Court to grant me leave to
proceed in this cause as an indigent.
3. In making thie Affidavit, I am aware that perjury ie a
felony and that the puniehment is a fine of not more than $3,000.00
or imprisonment for not more than seven years or both.
4. I do not have any money on my person, at home, or
elsewhere which could be used for the expenses of this proceeding.
5. I do not own real eetate, personal property, or any other
assets other than personal and household items which are necessary
for my subsistence and which are of little monetary value. I am
not owed any amounts of money by any person.
6, My husband, Robert L. Wardecker, presently resides at 429
Arch Street, Carlisle, Cumberland County, Pennsylvania 17013. He
is 33 years old.
(a) I last lived with my husband May 13, 1993.

(b) I believe that my husband is employed as an assembler at
the Little Tykes plant in Shippensburg, Pennsylvania, and
owns a Pontiac 1000 automobile. I do not have any other
information or knowledge as to whether my husband has any
money, owns real estate, or has any other personal
property or assets.
(c) My husband is presently paying child support of $75,00
per week pursuant to the Order of this Court dated June
14, 1994,
7, I have three children: Robert P. Wardecker born August
23, 19821 Jonathon J, D. Wardecker born October 30, 19841 and
Matthew D. Wardecker born March 27, 1989, who reside with me at 37
East Louther street, Carlisle, Cumberland County, Pennsylvania,
8. I am presently unemployed becauae the care of my young
children requires my presence at home. I last worked at JFC Temp
corporation on November 17, 1993.
9. My social security number is 159-56-6242.
10. I have the following monthly income I

continuation of the divorce proceeding commenced herein and

1, This Court's Order of February 6, 1995 is vacated.
2. The Mother, Paula E. Wardecker, shall have legAl custody of
Robert Paul Wardeoker, born August 23, 1982, Jonathan James
Davis Wardecker, born October 30, 1984, and Matthew David
Wardecker, born Marcil 27, 1989,
3. The Mother shall enjoy primary physical oustody of the minor
children,
4. The Father shall enjoy temporary physical custody of the
minor children as followsl
A. On alternating weekends from Friday evening at 6 P.M.
until Sunday evening at 6 P.M. This arrangement shall
start with the Father having temporary custody on the
weekend of April 7, 1995,
B. At such other times as agreed upon by the parties.
C. The parties shall continue to negotiate with respect
to arrangement for Father having custody of the children
on holidays and also for an extended period of time in
the summer for vacation. In the event the parties are
unable to reach an agreement with respect to these
issues, either party may petition the Court to have the
case again scheduled with the custody Conciliator for a
conference.
5.
During Father's time of temporary custody when the Father has
the children overnight, Father shall insure that at least
one of Father's parents are in the home during the night as
additional supervision for the children.

6. For transportation, Father shall pick up the children on
Friday evening and Mother shall pick them up on Sunday
evening, the pickup points to be as agreed upon by the
parties.

I. Petitioner is the Plaintiff herein,
?. In hie Answer and Counterclaim, the Defendant has
asserted claims for alimony and al imony pendente lite, custody,
partial custody and visitation.
3. The Defendant has been ordered to pay support to the
Plaintiff pursuant to an Order of the Domestic Relations Section of
this Court dated June 14, 1994. The Defendant's Petition to modify
the Order was denied by Order of this COlu-t dated September 21,
1994.
4. On October 12, 1994, this Cou rl. ordered the parties to
submit to marital counselling, which I.he parties have done.
5. By Orders of this Court dated Februery 6, 1995 and April
12, 1995, the Defendant has been granted tLllnporary physical custody
of the partiee' children.

PETITION TO MODIFY ORDER OF CUSTODY;
REQUEST FOR TEMPORARY PRIMARY PtlYSICAL CUSTODY
AND NOW, comes the Petitioner, Robert L. Wardecker. and respectfully
files this petition.
In support thereof, Petitioner respectfully avers as follows:
I. Petitioner Is Robert L. Wardecker, defendant In the above captioned
matter, an adult Individual, and the natural father of the minor children
named In paragraph 3, who currently resldas at 429 Arch Street, Carlisle,
Cumberland County, Pennsylvania.
2, Respondent Is Paula E. Wardecker, Plaintiff In the above captioned
matter, an adult Individual, and the natural mother of the three minor
children named In paragraph 3, who currently resides at an unknow location.
3. As a result of the parties' marriage, three minor children were
born namely: Robert Paul Wardecker (O.O.B. August 23. 1982), Jonathon
James Davis Wardecker (D.O.B. October 30, 19B4), Matthew David Wardecker
(O.O.B. March 27, 1989), all of whom reside with there mother at an
unknown location.
4. The children currently reside In the custody of the respondent
and petitioner does not currently enjoy partial physical custody or
visitation rights, having waived same until further order of this court.
5, Petitioner still maintains shared legal custody of the minor
children and there are no Orders of Court revoking said custody.
6. Since entry of the Court,s Order of August 5, 1993, a substantial
and material change In circumstances has occurred, ylvln9 rise to the
filing of the Instant petition:
(a) Petitioner has stabilized his living situation and personal
life and Is fully prepared and capable of providing for all three children
should custody be awarded to him.
(b) Petitioner Is now In a position to ensure the children will
be provided for adequately and safely.
(c) To the Petitioner,s great alarm, Respondent has repeatedly
threatened that she would kill the children before allowing Petitioner
to see them again.
(d) As a result of these threats, Petitioner fears greatly for the
continued well-being, safety. and lives of the children,
(e) Petitioner believes that the chIldren are not being properly
cared for. As a result. there physical and emotional well-being Is being
jeopardized. Petitioner Is, therefore unable to ascertain wether they
are In good emotional and physical health.
(f)Respondent refuses to provide or allow access to any Information
concerning the children, once again causing Petitioner to further fear
for the continued emotional and physical well-being of the children.
(g) Respondent has repeatedly told Petitioner. both directly an
through Intermediaries that In the event he tried to re-establish custody
and/or visitation, she would Iwnedlately flee the Commonwealth.
(h) Petitioner firmly believes that the Respondent Is capable of
following through on the aforementioned threats to kill the children
or to leave the Commonwealth with them, and continues to fear for the
continued safety and well-being of the children.
(I) Respondent has on two occasions changed her living location
In an attempt to conceal the location of the children from Petitioner.
The first attempt was In November of 1993 and the second attempt has
been attempted on November 4, 1994. Petitioner believes that she has
moved to the Shlppensburg area.
(j) Petitioner has learned that the Respondent and her live-In boyfriend,
one Dan Singleton, Are actively engaged In the use, sale, and distribution
of crack cocaine and are possibly engaged In the sale of other controled
substances.
(k) Petitioner has learned that the children have been physically
abused by the Respondent and/or Oan Singleton to the extent that one
or more of the children has been taken to the Carlisle Hospital where
they received treatment Including, but not limited to, stlches for lacerations.
(I) The aforementioned Dan Singleton, has repeatedly threatened
Petitioner that he would kill both Petitioner and the children. Mr,
Singleton has physically threatened Petitioner with bodily harm and
a complaint has been filed with the Carlisle Borough Police Department,
7, The children,s current living situation Is not conductive to
there growth and nurturing and Is detrimental to there best Interests
and permanent wealfare,
B. The best Interests and permanent welfare of all three minor children
will be served by a modification of the Court's Order by awarding physical
custody of the children to Petitioner.
9. Petitioner Is willing to fully cooperate with any measures that
the Court may deem appropriate In order to monitor Petitioner's parental
activities and to ensure a smooth transition for the children. so as
to minimize any potential disruption In there lives due to a change
of residence and/or reestabllsment of the custodial relationship with
the Petitioner.
10. It Is also In the best Interests of the children that a home
study of the living conditions of the mother and the children be ordered
by the Court. Insomuch as the living conditions of the children Is In
controversy, and there Is an affirmative duty to develop a record and
to conduct a thorough Investigation with the aid of outside experts.
11. The costs of such examinations shall be paid as ordered by the
Court.
WHEREFORE, Petitioner requests that this Honorable Court grant this
request for a modification of an Order of Custody by ordering the following:
I. That physical and legal custody of the minor children be awarded
to the Petitioner,
2. That Respondent Is directed to absolutely refrain from attempting
to remove the children from the jurisdiction of this court, or conspiring
with others to do so, and Is hereby directed to refrain from taking
the children anywhere except with-In a ten mil radius of the borders
of the Borough of Carlisle;
3. That the respondent be directed that she Is not to physically
or mentally harm or threaten the children In any way;
4. That Respondent Is absolutely prohibited from either using drugs
or a 1 coho I, or be I ng under the I nf! uence of same, I n the presence of
the ch 11 dren.
5. That visitation between Respondent and the children be restricted
to supervised visitations and that Respondent be directed to undergo
and successfully pass a complete drug and alcohol screening, prior to
visitation be allowed;
6, That the Respondent surrender to the Sheriff of Cumberland County,
or other law enforcement agency, any and all firearms or other weapons
from within her residence and the Immediate surrounding area and that
she be prohibited from possesion of same or allowing them at her residence;
7. Issue a restraining order on both Respondent and Dan Singleton,
prohibiting Mr. Singleton from having any physical or other contact
with the Petitioner and the children, either by himself or through
an Intermediary, with further condition that he not be permitted to
come within 1500 feet of the Petitioner or the children at any time;
B. Enter an Order of Court directing that the mother submit to a
detailed home examination at a time and a manner directed by this said
court and that said examinations be conducted as soon as possible, and
that prior notice not be required. It Is further requested that the
examining parties deliver to this Honorable Court and to the attorneys
of record, copies of the detailed written report setting out the findings,
and conclusions of said study no later than ten (10) days prior to the
date of a hearing and/or coference on the merits of this case.
9, Enter an Order of Court awarding temporary physical custody of
the children to Petitioner until the date of a hearing and/or conference
on the merits of this case.
10. Further relief as the Court may deem appropriate.

directed as follows:
1. The Mother, Paula E. Wardecker shall have legal custody of
Robert Paul Wardecker, born on August 23, 1982, Jonathon
James Davis Wardecker, born October 30, 1984, and Matthew
David Wardecker, born March 27, 1989.
2. The Father shall enjoy temporary custody with the minor
children as follows:
A. On every Saturday from noon until 3 P.M. This period
of temporary custody shall be exercised at the
Father's parents house and subject to the supervision
of Father's parents,
3. The parties shall convene for another custody Conciliation
Conference on April 6, 1995, at 9:30 A.M.
4. For purposes of transportation, the Mother shall handle the
transportation for exchange of custody and deliver the
children to Father's home and pick the children up at the
designated time unless Mother advises Father on Friday, the
day before the visitation is to occur, that she is unable to
drive. Under such a situation, Mother shall designate a
location that Father shall pick up the chijd~n at noon and

2. The Mother, Paula E. Wardecker, shall have legal custody of

3. The Mother shall enjoy primary physical custody of the minor

A. On alternating weekends from Friday evening at 6 P.M.
until Sunday evening at 6 P.M. This arrangement shall
start with the Father having temporary custody on the
weekend of April 7, 1995,
B. At such other times as agreed upon by the parties.
C, The parties shall continue to negotiate with respect
to arrangement for Father having custody of the children
on holidays and also for an extended period of time in
the summer for vacation, In the event the parties are
unable to reach an agreement with respect to these
issues, either party may petition the Court to have the
case again scheduled with the Custody Conciliator for a
conference. '
5. During Father's time of temporary custody when the Father has
the children overnight, Father shall insure that at least
one of Father's parents are in the home during the night as
additional supervision for the children.

Friday evening and Hother shall pick them up on Sunday
evening, the pickup points to be as agreed upon by the

consideration of the attached Custody ~~iation Report, it is
ordered and directed as follows'
1. A h~ri g is scheduled in this case on the ~ day of
, 1996 at "3'.00 ....f....m. in Courtroom 12 of
the C erlan County Courthouse. At this hearing, the Court
will hear testimony solely on the issue of how the parties
will handle custody of the minor children on the Christmas
holiday, Each party is directed to file with the Court and
the opposing party a memorandum setting forth their position
on how the Christmas holiday custody should be handled. This
memorandum shall be filed at least ten (10) days prior to the
hearing date.
2. This Court's prior Order of April 12, 1995 is vacated.
3. The Mother, Paula E. Wardecker, shall have legal custody of
Robert Paul Wardecker, born August 23, 1982, Jonathan James
Davis Wardecker, born October 30, 1984, and Matthew David
Wardecker, born March 27, 1989.
4. The Mother shall enjoy primary physical custody of the minor
children with the Father, Robert L. Wardecker, having periods
of temporary custody as follows,
A. On two weekends per month, being the weekends that the
Father has off from tIle work, with the time from Friday
evening at 6,00 p.m. until Sunday evening at 6,00 p.m.
B. For a seven-day period of time in the sununer for
vacation, with the Father to give 3D-days' written notice
to the Mother. For the sununer of 1996, the Father shall
have custody from July 26 at 6,00 p.m. until July 31 at
6,00 p.m,

S. The parties shall alternate custody of the minor children on
the following holidays: New Year's Day, Easter, Labor Day,
July 4th, Nemorial Day. The time shall be from 9:00 a.m.
until 6:00 p.m., with the Father having custody on Labor Day
1996.
6. The Thanksgiving holiday shall be alternated between two time
frames from 3:00 p.m. on the day before Thanksgiving until
3:00 p.m. on Thanksgiving Day and from 3:00 p.m, on
Thanksgiving Day until 3:00 p.m. on the Friday after
Thanksgiving. For 1996, Father shall have the first portion
of the Thanksgiving holiday from Wednesday at 3:00 p.m. until
Thanksgiving Day at 3:00 p,m.
7. On the birthdays of the children where the Father does not
have custody, Nother shall make arrangements for the Father to
have a period of at least four hours of custody on the
birthday or the day before or immediately after the child's
birthday.
8. For transportation for exchange of custody, Father shall piok
the children up when he is getting them for custody and Nother
shall piok them up upon the end of Father's custody. The
pick-up point, absent agreement otherwise between the parties,
shall be the Sheet. store in Shippensburg.
