BIEGUN, Defendants COMPLAINT COMBS NOW the Plaintiff, Ronald W. Kipps, through his attorneys, Andrews & Johnson and Ronald E. Johnson, Esquire, and states the following cause of action: 1. The plaintiff is Ronald W. Kipps who resides at R.D. 1, Uniondale, Pennsylvania, 18470. 2. The defendants are Deborah L. Smyser and Albert A. Biegun who reside at 14 Greenway Drive, Mechanicsburg, Cumberland County, Pennsylvania, 17055. 3. Plaintiff is the owner of certain real property located at 14 Greenway Drive, Mechanicsburg, Cumberland County, Pennsylvania, 17055. 4. Plaintiff and Defendants entered into a written lease agreement dated March 1, 1993, whereby Defendants rented a single-family residential property from Plaintiff located at 14 Greenway Drive, Mechanicsburg, Cumberland County, Pennsylvania, 17055. A copy of the lease agreement is attached hereto, marked "Exhibit A," and made a part hereof. 5. The lease agreement referred to above provides for a monthly rental of $1,253.00, payable on the first day of each month to Ronald W. Kipps. 6. Despite demand being made by Plaintiff to Defendants, Defendants have failed and refused to pay rent due and payable to Plaintiff for May 1994 and June 1994, which rental payments total $2,506.00. 7. Since on or about July 18, 1994, Defendants have not paid the monthly rental of $1,253.00 to Plaintiff but rather, in accordance with Rule 357 of the Rules of the Court of Common Pleas of Cumberland County, have paid said rental to the Prothonotary of cumberland County. However, the rental payment due for July 1, 1994, was not made until on or about July 18, 1994. 8. The lease agreement referred to above provides for a late payment charge of ten percent, due and payable as additional rental for all payments not made by the fifth day of each month. 9. The rental payments due for May, June, and July 1994 were not made on or before the fifth day of the month in which they were due, thus accruing late charges totaling $375.90. 10. The lease agreement referred to above provides for Defendants to pay as additional rental all utilities serving the premises including, but not limited to, sewer charges, and d~spi.te demand being made by Plaintiff to Defendants, Defendants have failed and refused to pay Upper Allen sewer charges in the amount of $1,229.52. A copy of said sewer bill is attached hereto, marked "Exhibit 8," and made a part hereof. 11. Toe lease agreement referred to above provides for a $25.00 coarge for each check returned for non-payment. Defendants' check number 714 in the amount cf $2,881.90 payable to Plaintiff was returned to Plaintiff for non-sufficient fundsl thus, Defendants, under the terms ?f the lease, have incurred an additional $25.00 charge for non-payment of said check. A copy of said check is attached hereto, marked .Exhibit C,. and made a part hereof. 12. The lease agreement referred to above provides for the payment of attorneys' fees in the amount of ten percent of all sums due and payable under the terms of the lease. The total amount due under the terms of the lease including the monthly rental, late charges, sewer charges, and returned check charge is $6,642.42. Accordingly, in addition to the above, Defendants are obligated to pay to Plaintiff attorneys' fees in the amount of $664.24. 13. By a notice dated May 17, 1994, Plaintiff gave Defendants notice to remove from said premises and to deliver possession to Plaintiff as a result of Defendants' failure to pay the rental due and the outstanding sewer bill. A copy of said notice is attached hereto, marked "Exhibit D,. and made a part hereof. 14. Kipps, Petitioner herein, by and through his attorneys, Andrews & Johnson and Ronald E, Johnson, Esquire, and respectfully represents as follows: 1. petitioner herein is the owner of certain real property located at 14 Greenway Drive, Mechanicsburg, Cumberland County, Pennsylvania, 17055. 2. Under the terms of a written lease dated March 1, 1993, Petitioner herein rented to Respondents herein the above-referred to premises for a monthly rental of $1,253,00, A copy of the lease agre~ment referred to herein is attached to Plaintiff's Complaint marked Exhibit A and made a part thereof, 3. That on or about June 2, 1994, petitioner filed a landlord-tenant complaint with District Justice Ronald E. Klair which resulted in an order being entered for Petitioner on June 16, 1994, granting judgment in the amount of $4,094,20 and also granting Petitioner possession of the premises, 4, On July 18, 1994, Respondents filed an appeal in the Court of Common Pleas of Cumberland County at which time they filed a certification of rent certifying that tho ront was in fact $1,253.00 per month, paid one month's rent In said amount, and obtained a supersedeaa of the order for p08sosoion in accordance with Pa, R.C.P.J.P, 1008(b) and C.C.R.!', ]57. 5. On August 5, 1994, Respondento paid tn the Prothonotary the additional sum of $1,253.00 which represented the rent dlle August 1, 1994. 6. On September 8, 1994, RespondentB filed an answer to Petitioner's Complaint. 7. As of September 15, 1994, Respondents had failed to pay to the Prothonotary the rent due and payable In the amount of $1,253.00 for the month of September 1994, which rental payment was due on or before September 1, 1994, A copy of the Docket entries reflecting entries made ak] of September 15, 1994 io attached hereto, marked Exhibit A and made a part horeof. 8. At all times relevant herein, Respondents have occupied the home owned by PetitJ.oner at 14 Greenway Dr'ive, Mechanicoburg, Cumberland County, Pennsylvania. 9. The Petitioner herein hae a mortgage on the premises situate at 14 Greenway Drive, Mechanicsburg, Cumberland County, Pennsylvania, which mortgage l'equ i res Respondent to make monthly payments in the amount of $928.00. 10. As a result of Reopondents pay1ng the rental payments due to the Prothonotary, Petitioner' has not had the use of said funds in order to pay the mortgage payments due on the premises, all of which has been to his financial detriment. 11. As of September 15, 1994, the Prothonotary of Cumberland County held in escrow the total sum of $2,506.00 which repres~nted rental payments due from Respondents and to Petitioner for the months of July and August 1994. 12. While this action is not yet final, Petitioner believes and therefore avers that he should be entitled to the above- referred to rental pa}~ents as Respondents have occupied and continue to occupy the home at 14 Greenway Drive, Mechanicsburg, Cumberland County, Pennsylvania, leased to them under the rental terms of the lease dated March 1, 1993, and petitioner further avers that to deny him the use of said rental payments during the pendency of this action would create an undue financial hardship upon him. 13. petitioner further believes and therefore avers that should the Respondents continue to make further rental payments to the Prothonotary, all said future payments should be turned over to petitioner approximately ten (10) days after said payment is made to the Prothonotary. 14. Petitioner further believes and avers that the Prothonotary should not be entitled to deduct any poundage or other costs from the rentaJ. paid to the Prothonotary as to do otherwise would deprive petitioner of the full rental due under the terms of the lease. It is denied that the Defendants are responsible for the payment of $1,229.52 or any amount whatsoever for the Upper Allen Sewer Authority charges. On the contrary the bill attached to the complaint and marked as "Exhibit B" reflects charges accrued since September, 1987, some 5.5 years prior to the lease between Plaintiff and Defendants. It is further denied that exhibit B accurately reflects the sewer charges for the period beginning March 1, 1993, the inception date of the lease. 11. It is denied that Plaintiff is entitled to collect a 25.00 fee on account of the check marked as exhibit "C" under the terms of the lease or on any account whatsoever. On the contrary, Exhibit "C" was replaced br a cashier's check prior to presentment for payment by the pla ntiff and Plaintiff had no right to present Exhibit "C" for payment of any rent due under the terms of the lease. 12. It is admitted that the lease provides for the parment of attorney's fees. It is denied that the Plaintiff is ent tled to attorney's fees in the amount of $664.24 or any amount whatsoever or that Defendants owe the Plaintiff the sum of $6,642.42 or any amount whatsoever on account of rent, late charges, sewer charges and returned check charges. 13. It is admitted that "Exhibit 0" was given to the Defendants. To the extent that "Exhibit B" constitutes a notice to quit and to deliver possession to Plaintiff, such allegations constitute conclusions of law to which no answer need be made. 14 . It is deni<<ld that Defendants have failed or refused to quit the premises or to deliver possession to the Plaintiff despite repeated demands to do so. 15. It is admitted that additional rent will accrue during the pendency of this action.
