5. Subsequent to the delivery of the Master Card credit c~rd
to the Defendant, and therein acceptance of same, Monogram Bank USA
for valuable consideration and in the normal course of business,
sold, assigned and transferred the Defendantls account to Plaintiff
which is now and has been since the date of the assignment, the
legal owner and holder of said agreement.
6. The Defendant subsequently received a cash advance and
incurred addit ional obligations in the sum of $2,195.75, no part of
which has been paid since May 16, 1994 although duly demanded. A
true and correct copy of a statement of account in connection with
said credit card is attached hereto, made a part hereof and marked
Exhibit "B".
7. Notwithstanding the frequent demands by Plaintiff for
payment of the amount duel there has been a failure and refusal by
the Defendant to pay the same or any part thereof.
8. In accordance with the terms of Exhibit "A" Defendant
agreed to pay the Plnintiff a finance charge on all sums due at an
annual percentage rate of 16.8\ and Plaintiff is entitled to
additional finance charges from May 16, 1994.
9. In accordance with the terms of Exhibit "A", Defendant
agreed to pay to Plaintiff a reasonable attorney's fee if the
account was referred to an attorney for collection, and Plaintiff
will incur an attorney's fee in the amount of $439.00.
WHEREFORE, Plaintiff demands judgment ainst the Defendant
in the sum of $2,634.75 plus interest from Ma and cost of
this action.

belief. She further slates the annexed account against STEPHEN C. CASSEL Is correctly
copied from the books of original entry of First Deposit National Credit Card Bank that the
charges were made in said books at or about the time of their respective dates; that the charges
are correct and the account is just and true as Slated; that there is now due and owing thereon
the sum of $2195.75 plus interest and attorney fees; that no part of said sum has been paid or
in any manner :JCttled; and that there are no deductions or offsets of any ltind, except as are
therein specified and credited. She further understands that false statements made herein are
subject to the penalties of 18 Pa.C.S. Section 4904, relating to unsworn falsification to
authorities.

4. In District Justice Docket No. CV-0000209-95 (Common
PleaB No. 95-4003)/ Matt corporation made a claim for $4,013.44/
plus interest and costs, against Domingo T. Alvear, M.D., and
Veneranda B. Alvear, M.D., for a debt owed to Plaintiff.
5. In District Justice Docket No. CV-0000210-95 (Common
Pleas No. 95-4002), Matt Corporation made a claim for $7,003.2!S,
plus interEst and costs, against Veneranda B. Alvear, M.D., for a
debt owed to Plaintiff.
6. District Justice Farner entered judgment against the
Defendants in both actions on June 29, 1995.
7. Defendants filed appeals and praecipes to enter rule to
file complaint and rule to file in both actions on July 28/ 1995.
8. Upon appeal, District Justice Docket No. CV-0000209-95
was docketed as Common Pleas No. 95-4003, and District Justice
Docket No. CV-0000210-95 was docketed as Common Pleas No. 95-4002.
9. Plaintiff timely filed its Complaints in the above
matters on August 17, 1995. Plaintiff filed duplicate originals of
the same Complaint to both matters, in which the causes of action
were set forth in separate counts.
10. A court may order the consolidation of actionB upon
petition by any party when the pending actions involve a common
question of law or fact or which arise from the same transaction or
occurrence, in order to avoid unnecessary cost or delay.
Pennsylvania Rule of civil Procedure 213 (e) .

a. Both actions concern claims for the payment of funds
advanced by Matt Corporation to pay personal loan obligations of
the Defendants.
b. The agreements with Matt corporation upon which its
claims are based were entered into by Domingo T. A~vear, M.D./ on
behalf of he and his wife, or ac~ing as his wife's agent.
c. Witnesses in both actions would be the same.
d. Counsel for the parties in both actions are the same.
13. The consolidation of the above actions would not
prejudice the substantive rights of any party to the actions and
would eliminate the duplication of effort and reduce delay and
exp4lnses, which would benefit both the court and the respective
parties.
14. Anthony J. Nestico, Esqui~e, counsel for Defendants,
