4. On or ebout December 30, 1994, the Plelntlff, through their attorney of
record, served Interrogatories and e Request for Production of Documents upon the
Defendant, by mailing the documents, first class mall, postage prepaid to Defendant's
counsel of record. A copy of the trensmlttalletter to Defendant's attorney Is attached
hereto and marked Exhibit" A" .
6, No objections to Plaintiff's Interrogatories or Request for Production of
Documents were flied by Defendent or Its attorney.
6. On February 2, 1995, counsel for the Plaintiff wrote to Defendant's
counsel and requested that he serve Answers to Plaintiff's Interrogatories and
Response to Plaintiff's Request for Production of Documents, as thay were overdue
In accordance with the Pennsylvania Rules of Civil Procedure, A copy of the
correspondence to Defendant's counsel Is attached hereto and marked Exhibit "8",
7, On March 1, 1996, counsel for Plaintiff once again wrote to Defendant's
counsel Inquiring as to the whereabouts of the responses to the discovery requests,

owed by the Defendant for the same reason set forth in
Defendant's New Matter, It i8 admitted that the Plaintiff's
Accounts Receivable are attached.
6. Admitted and denied. It is admitted that the Defendant
has demanded account balance of $85,106.09 plus interest. It is
denied that the Plaintiff i8 owed this amount for the reasons set
forth in Defendant'8 New Matter.
WHEREFORE, Defendant re8pectfully reque8t8 that the
Complaint of the Plaintiff be di8mi88ed.

7. Defendant incorporate8 its an8wer8 in Paragraph 1
through 6 a8 if 8et forth at length.
8. The good8 and merchandi8e 8ent by the Plaintiff to the
Defendant were defective becau8e of improper 8izing. Defendant
advi8ed the Plaintiff of the problem8 with the 8izing problems of
the merchandise. On March 25, 1994, Defendant reque8ted that it
be allowed the return of the defective merchandi8e. Such reque8t

AlID NOW, comes the petitioner, Francis M. Socha, Esquire,
attorney for the Defendant in the above-captioned matter, and
respectfully requests this Honorable Court permission to withdraw
his appearance as counsel for the Defendant, Mid-Lantic Footwear,
Inc., and in support thereof avers the following.
1. Petitioner is privately retained counsel for the
Defendant in the above-captioned matter.
2. petitioner has made numerous attempts to contact the
Defendant, both in writing and by phone messages, to discuss the
status of ~he litigation and to request Defendant's assistance in
the responding to Plaintiff's discovery requests.
3. The Defendant, for a period of four (4) months, has
ignored all written correspondence and phone messages left by the
Petitioner requesting its representative to address the statue of
the discovery requests of Plaintiff.
4. Defendant has ceased business and closed its busine.s
