4. The events hereinafter complained of occurred on March
25, 1994, when the Plai nti ff and Defendants entered' into the
following oral agreement: Plaintiff would trade her Tennessee
Walker Painted horse named Duke for the Defendants' Fox Trotter
brown mare named Lady, along with a cash payment of $300.00
from Plaintiff to Defendants.
5. On March 25, 1994, the above
orally between the parties and at
the D~fendants the sum of $300.00.
agreement was entered into
that time, Plaintiff paid
6. On March 25, 1994, the Plaintiff and the Defendants agreed
that the exchange of the horses and cash payment by Plai tiff
would be contingent upon a thirty (30) day approval period by
both Plaintiff and Defendants.
7. The Plaintiff took the Defendants' horse to a veterinarian
within the thirty day period and discovered that the Defendants'
horse was lame.
8. Approximately two weeks after March 25, 1994, well wi thin
the thirty day grace period agreed upon between the parties,
Plaintiff contacted the Defendants informing them that she
was not satisfied with the exchange of horses and requested
the return of her horse along with the payment of $300.00
previously rendered.

Ie) An additional bill for a veterinary visit in connection
with the Fox Trotter horse of the Defendants in the amount
of $50.00.
13. The Plaintiff has been forced to lose time at work and
has suffered loss wages in the amount of $68.00 per day for
two days. Plaintiff demands the Defendants reimburse the
Plaintiff for said loss wages in the amount of $136.00.
14. Plaintiff has expended the sum of $300.00, cash payment
to the Defendants at the time of the exchange of the horses
pursuant to the oral agreement entered into by the parties on
March 25, 1994, and Plaintiff demands a return of said sum of
$300.00.
15. Defendants have rendered one payment to the Plaintiff,
thereby affirming the debt owed to the Plaintiff, in the amount
of $328.00, and Plaintiff is agreeable to a credit to the
Defendants in said amount.
16. As a result of the Defendants' breach of the oral and
written agreements, as well as their breach of the express and
implied warranties, Plaintiff has been forced to expend sums
for payment of suit and costs in connection with this action.

AND NOW, comes the Detendants, Dennis Albright and Cheri
Freeman, by and through their counsel, MANCKE, WAGNER, HERSHEY &
TULLY, who respectfully tiles these Preliminary Objections to
Plaintift's Complaint and avers as tollows:
I. 1I.ILllll1lUY OBJICTIO.

1. The causes ot action asserted in Plaintift's complaint
involved breach of oral and written contracts and breach ot express
and implied warranties.
2. Detendant Dennis Albright currently residos at 1075
Carlisle Road, Biglerville, Adams County, pennsylvania 17307 and
has resided there since January, 1994.
3. The Detendant Dennis Albright runs a business known as
Albright Concrete which said business is operated trom One Mount
Zion Road, Carlisle, Cumberland County, Pennsylvania 17013.
4. Detendant Cheri Freemen currently resides at 1075
Carlisle Road, Biglerville, Adams County, Pennsylvania 17307.
5. All face to face meetings between the Plaintiff and the
Defendants took place in Adams County, Pennsylvania.
6. All telephone conversations that took place between the
Plaintiff and the Defendant occurred while the Defendant. were in
Adam. county, Pennsylvania.
7. All contracts, both oral and written alleged in
plaintiff's Complaint were executed in Cumberland County.
Moreover, both express and impli,ed warranties alleged in
Plaintiff'S complaint were rendered in Cumberland County.
8. Because the cause of action asserted herein arose in
Adams County, Pennsylvania and the Defendants reside in Adams
County, pennsyl vania, this Court does not have personal
jurisdiction over the Defendants.
9. There are insufficient contacts for this Court to
exerche either general jurisdiction over the person of the
Defendants Dennis Albright and Cheri Freeman or specific
jurisdiction with respect to the cause of action.
WHEREFORE, the Defendants Dennis Albright and Cheri Freeman
respectfully request that Plaintiff's Complaint be dismissed.

Prothonotary indicating such.

1. The causes of action asserted in Plaintiff's Complaint

8. The venue of this action is improper in this county,
since under Pa.R.Civ.P. 1006, plaintiff may only bring this action
against the defendants in the county in which they may be served or
in which the cause of action arose, or where the transaction or
occurrance took place out of which the cause of action arose.
WHEREFORE, the Defendants Dennis Albright and Cheri Freeman
respectfully request that Plaintiff's complaint be dismissed for
improper venue and transferred to the Adams County Court of Common
Pleas pursuant to Rule 1006(d)(2).

10. Plaintiff commenced this action by filing a complaint on
August 8, 1994 in the Cumberland County Court of Common Plea..
11. Rule 1005(d) require.:
"The party filing Complaint under Rule 1004
shall forthwith serve it upon the opposite
party in the appeal by leaving a copy for or
mailing a copy to him at hi. address a. shown
in the District Justice record. mentioned in
subdivision a of this Rule .. "
12. Rule 1005(e) of the District JUlltice Rules of civil
Procedure states:
"Service and proof of service may be made by
attorney or other agent."
13. Defendant Cheri Freeman was never served with the
Complaint filed by the Plaintiff nor has there been any certificate
of service or proof of service filed with the Cumberland County
Prothonotary indicating such.
WHEREFORE, the Defendant Cheri Freeman respectfully requests
that plaintiff's Complaint be stricken.

7. Denied. To the contrary, when the Defendants sold the
horse to plaintiff, the Defendants indicated to the Plaintiff that
the horse had arthritis. The Plaintiff responded that she did not
care because she wanted a horse that was quiet 80 that a child
could ride it safely.
8. Denied. To the contrary, the Plaintiff came back after
thirty (30) days and requested the contract be rescinded and for
the Defendants to return the horse. Defendant Cheri Freeman
indicated to the Plaintiff that the horse that the Plaintiff
exchanged in the agreement was already sold and it would be
impossible for the Defendants to give back the horse.

10. Admitted in part denied in part. It is admitted that
Defendant Dennis Albright signed the piece of paper attached as
Plaintiff's exhibit. All further aspects of this averment are
denied. To the contrary, a check was never issued to Dennis
Albright. Therefore, no consideration was ever given and a legally
enforceable contract was never executed.
U. Denied. This piece of paper attached as Plaintiff's
Exhibit "A" did not constitute an agreement. If the Court
determines that this was an agreement, it is denied that the
Defendant breached the agreement between them and the Plaintiff.
