COMPLAINT
1. The plaintiff, Stewart L. Smyser,is an individual residinq
at 2001 Bastern Blvd., York, York County, Par 17402-2809.
2, The defendant owner, Robert L, Arnold, is an individual
residing at 347 N. Middlesex Road, Carlisle, Cumborland County,
Penna, 17013,
3. The defendant, Frederick M, Sipe, is an individual
residing at 429 Cresent St" Harrisburg, Par 17104,
3, On January 22, 1994, the plaintiff was the owner of a 1991
Dodge Caravan.
4, At or about 8140 A,M. on the aforesaid date, the plaintiff
was operating the said Caravan in a northern direction on Harrison
Street in York, York County, Penna.
5, At the same time and place, the defendant, Frederick M.
Sipe, while in the course and scope of his employment with Robert
L, Arnold,and acting as agent for Mr, Arnold, was operating a 1990
Ford Dump Truck in an eastern direction on Philadelphia Street,
York, York County, Penna,
6, The defendant was travaling in the wrong direction on
Philadelphia Street when he collided with the plaintiff's vehicle.
7, The collision was caused by the negligence of the
defendant in the following respectsl
a. In operating the said dump truck in the wrong'
direction on Philadelphia Street.

Leroy Hippensteel, Deputy Sheriff who being duly sworn according to
law, says on August 11, 1994 at 9103 o'clock A,M,E,D.S,T., he served a
true copy of Complaint in Civil Action Law and Notice in the above
entitled action upon one of the within named defendants to witl
Robert L. Arnold, by making knQwn unto Robert Arnold at 347 North
Middlesex Road, Carlisle, Cumberland County, Pennsylvania, its
contents and at the same time handing to him personally the said true
and attested copy of the same,
R. Thomas Kline, Sheriff who being duly sworn according to law,
says he made diligent search and inquiry for the within named defendant
to wit: Fredrick M. Sipe, but was unable to locate him in his bailiwick.
He therefore deputized the Sheriff of Dauphin County to serve the within
Complaint in Civil Action Law and Notice according to law.
DAUPHIN COUNTY RETURN: I. William H, Livingston, Sheriff of the
County of Dauphin Commonwealth of Pennsylvania, do hereby certify and
return that I made diligent search and inquiry for Fredrick M. Sipe
the defendant named in the within Complaint & Notice and tht I am unable
to find him in the county of Dauphin and therefore return same NOT FOUND
this 10th day of August 1994.
