1. plaintiffs are Ljubisa stankovic and Mira stankovic, adult
individuals who reside at 1106 Gettysburg pike, Mechanicsburg,
Pennsylvania 17055.
2. Defendants are Don Paul Shearer and Dolores Hart, adult individuals
whose last known address was 10 North 30"' Street, Camp Hi 11,
Pennsylvania 17011 and Realty One Associates, Inc. a pennsylvania
Corporation whose last known address was 4 North 30~ street, camp
Hill, Pennsylvania 17011.
3. That Plaintiffs are the owners of 4 and 10 North 30~ street, Camp
Hill, pennsylvania 17011 and are Lessees in their own right and as
successors to Slobodan Momich Trustee under leases dated July 30,
1989, a true and correct copy of the lease to 10 North 30~ Street,
Camp Hill, Pennsylvania 17011 is attached hereto and incorporated
herein by reference as Exhibit "A" and a true and correct unsigned
copy of the lease to 4 North 30~ street Camp Hill, Pennsylvania is
attached as Exhibit "B", the fully executed copy being lost.
4. Defendants are Tenants in possession of 4 and 10 North 30~ Street,
Camp Hill, Pennsylvania 17011 under the terms of Exhibits "A" and
ItB".
5. That the leases obligate Defendants to pay rent in the amount of
$750.00 per month for 10 North 30~ street and $450.00 per month for
4 North 30~ street, camp Hill, Pennsylvania, plus pro-rated taxee
of $329.65 per month and late payment fees of $76.78 for payments
received after the due date.

6. That in addition the leases require tenants to pay all utility
bills and to keep the premises in a good state of repair in default
of which the costs associated therewith shall be collectible as
additional rent,
7. That the leases further provide for access by landlord upon
reasonable notice to inspect and comply with landlord's
responsibilities.
8. That Tenants are in default under the terms of the leases in that;
a. they have failed and refused to pay May, June, July and
August, 1994 rent; and
b.
failed to vacated the premises at the expiration of the term;
and
c.
failed and refused to maintain the premises and return it in
good order and repair; and
d.
failed and refused to permit entry by landlord for the
purposes of inspection and meeting landlords obligations under
the lease.
9.
That the breaches as set forth above have exposed landlord to
enforcement action by the Borough of Camp Hill notice of which
is attached hereto and incorporated herein by reference as
Exhibit "C".
10. That written notice of default was served upon Defendants by
posting the property pursuant to the landlord/tenant law on May 20,
1994. A true and correct copy of the notice is attached hereto as
Exhibit "0".

LHASB
THIS LEASE, entered into this _ day of , 1989,
by and between SI,OBODAN MOMICH, TRUSTEE FOR At,EI<SANDRA STANKOVtC,
NATA SA STANI<OVIC, and PETER S1'ANKOVIC, hereinafter known as
"Landlord", and REALTY ONE ASSOCIATES, INC., with DON P~l![, SlIUARER
and DOLORES HART as co-guarantors, hereinafter known as '~enant".

WITNESSETH I
That the Landlord in consideration of the rent and covenants
hereinafter set forth hereby leases unto Tenant the office located at
4 North 30th Street, Camp Hill, Cumberland County, Pennsylvania 17011
on the following terms and conditionsl
1. TERM OF LEASE I The term of the lease shall be for a period
of five (5) years commencing on the 1st day of August, 1989, and
ending on the 31st day of July, 1994, unl~ss sooner terminated or
extended in accordance with the terms and provisions hereinafter
stated.
2. B.faIT1 The Tenant shall pay unto the Landlord without demand
an annual net rental of Five Thousand Four Hundred ($5,400.00)
Dollars, payable in advance monthly installments, without setoff, of
Four Hundred Fifty ($450.00) Dollars on the 1st day of each month
throughout the term of this lease.
3. Securitv DeDositl Landlord acknowledges receipt of the sum
of $450.00 as a security deposit. Landlord shall retain said deposit
during the term hereof and refund same upon surrender of the demised
premises, pursuant to the terms hereof.
4. WASTE I No waste sh all be comm1tt ed and at the end of sa id
term, as renewed, the demised premises shall be delivered in as good
condition as at the commencement thereof, ordinary wear and tear and
unavoidable damage by fire, tempest, and lightning excepted.
5. LATE CHARGE I A late charge of five (5') percent of the
monthly rental Installment shall be imposed for any rental payment
received by Landlord more than five (5) days after the due date.
6. RESTORATION OF PROP~1 At the expiration of the term, as
renewed, the demised premises shall be restored by Tenant in the same
condition in which they were at the commencement of the original
term, ordinary wear and tear and the unavoidable damage referred to
in Paragraph 3, su~ra, excepted, and the cost of said restoration
shall be paid by Tenant, as additional rent.
7. UNLAWFUL OR DANGEROUS ACTIVITIES, Tenant shall use this
portion of the premises as an office. He shall not carryon any
unlawful or immoral business in or about the demised premises, and
shall not carryon any business which will endanger the improvements
from fire or cause a forfeiture of any fire insurance that the
Landlord has or may hereafter have on said building. Tenant shall
further refrain from any noise or other activity calculated to cause
annoyance to surrounding neighbors.
8. UTILITIES; Tenant shall pay all utility bills ~hich may be
incurred for light, power or heat used or consumed on the demised
premises, in addition to all telephone and TV cable charges, sewer
rental and taxes, as well as any special assessments.
9. OUIET ENJOYMENT, The Landlord shall provide Tenant with
quiet enjoyment of the premises for the term of the lease. Tenant
shall be responsible for loss or damage from freezing of water pipes
or plumbing fixtures in cold weather, or from stoppage of water
closet, which shall be repaired at the expense of Tenant, if due to
Tenant's negligence. ShOUld Landlord pay such expense resulting from
Tenant's negligence, Landlord shall be entitled to collect such sum
from Tenant as additional rent.
10. REPAIR/REFUSE; Tenant shall keep the premises in a good
state of repair. All refuse of any kind shall be removed from the
premises by Tenant at least once a week or more often, if necessary.
Should the Tenant fail to comply with this provision, Landlord may
enter the premises and make said repairs or remove said refuse and do
all other things as herein provided to be done by Tenant at the
expense of Tenant. The expense thus incurred shall be collected from
Tenant as additional rental undel this lease.
11. DEFAULT I At the end of the term, whether the same shall be
determined by forfeiture or expiration of the term, or upon the
breach of any of the conditions of this lease, Landlord declare a
default and, at his option, apply for all legal remedies.
12. ENTRY BY LANDLORD I lL is further agreed and understood that
Landlord, his heirs or assigns, may enter the leased premises at any
reasonable time during the term, as renewed, after reasonable notice,
in the presence of the Tenant, for the purpose of ascertaining
whether the said premises have been kept in good order and repair.
13. DAMAGES TO PREMISES; All damages or injuries caused by
Tenant to the leased premises, including damage to appliances, other
than those caused by fire, ordinary wear and tear, or by the act or
omission ot Landlord, shall be repaired by Tenant. If Tenant shall
neglect to make said repairs or commence same promptly, Landlord
shall have the right to make said repails at the expense of the
Tenant, and the amount thereof may be collected as additional rent

accruing for the month fol~owing the date of the said repairs. If
the said expense is made at the expiration of the term, then the cost
thereof may be collected by Landlord as additional rent for the use
of the premises during the entire term.
14. NOTICE. All notices to be forwarded by one of the parties
to the other shall be effectuated by certified mail, return receipt
requested.
15. INSURANCE. Tenant shall be responsible and shall provide
insurance for his own personal belongings. Landlord shall have Sub-
Tenant named as an additional insured in Landlord's fire and
liability insurance policy.
16. IMPROVEMENTS, Tenant shall make no structural improvements,
alterations or repairs without the prior written approval of
Landlord. Further, Tenant may paint or wallpaper, or make other
cosmetic changes to the interior of the premises, with Landlord's
prior notice and approval, which approval shall not be unreasonably
withheld.
17. MODIFICATION. There shall be no modification of the terms
or conditions of this lease agreement, except as shall be made in
writing signed by the parties hereto. This lease contains the
entire, complete and exclusive agreement between the parties hereto,
and shall not be changed or modified in any manner except by an
instrument in writing executed by the parties hereto.
18. HOLDING OVER. If Tenant shall continue in possession of the
premises upon the expiration of the term of this lease agreement,
such holding over of possession may, at Landlord's option, be deemed
a renewal of this lease on a month to month basis.
19. ASSIGNMENT. This lease agreement may be sublet by Tenant to
Don Paul Shearer to operate as a real estate appraiser and
consultant. Further subletting to others is subject to the approval
of Landlord, which approval shall not be unreasonably withheld.
However, such shall not release the original persons, identtfied as
Tenant herein, from the terms hereof.
20. AGREEtlf~T BINDING 9N IIEIRSI This lease agreement shall be
binding and shall inure to the benefit of the parties hereto, and
their respective heirs, executors, administrators, successors and

convenience of the parties and shall not in any way limit or be used
to interpret the meaning of any paragraph.

8 (c) Denied. The Plalnllffs spent thousands of dollars during the lease In Improvements and
repairs to the premises Including new carpet In December, 1993, new light fixtures, cell-
fans, palnllng etc, Furthermore, the premises were delivered In fer beller condlllon than
when Inlllal possession was given by Plalnllffs to Defendants,
8 (d) Denied. The Plalnllffs made at least one Inspecllon during each and every year of the
lease.
9. Denied. The complaint before the Borough of Camp HIli was flied by the next door
neighbor which was a result of the Plalnllfrs failure end neglect to replace the pool liner
which resulted In the Defendant's Inability to keep the pool full of water and to maintain
the pool property. Plaintiffs were nollfled In wrlllng on numerous occasions regarding the
need for a new liner In the pool,
10. Admllled. However, the Plaintiffs were denied a judgment by Jusllce Manlove at the
hearing on July 5. 1994, a copy of which Is allached hereto, The Plalnllffs did not file
any appeal to the ruling of Jusllce Manlove within the statutory period. The rulings made
by Jusllce Manlove InCluded denial of any money judgment against the Defendants and
a judgment for possession for Plaintiffs which was subsequently defined In another
complaint med by Plaintiffs and the order Issued by Justice Manlove for possession to be
tendered by August 10. 1994, a copy of which Is allached hereto.
11 Denied. Jusllce Manlove ruled that the Defendants were not responsible for any further
rental payments after July 5. 1994 nor responsible for any further repairs to the
premises. However. the Defendants chose. despite the ruling of Justice Manlove, to
shampoo the carpet In the dwelling and office, to paint several rooms, to generally
clean the dwelling and office InclUding windows, mirrors and floors and they continued
lawn maintenance on and through the date of surrender of the premises.
