JOHNSEN, CIVIL ACTION - EQUITY Defendants COMPLAINT AND NOW, comes TOWNSHIP OF MIDDLESEX, Plaintiff, by its Attorneys, SNELBAKER & BRENNEMAN, P.C., and avers the following cause of action in equity: 1. The Plaintiff herein is TOWNSHIP OF MIDDLESEX, a municipal township of the second class located in Cumberland County, Pennsylvania, having its municipal office at 350 North Middlesex Road, Carlisle, PA 17013. 2. The Defendants herein are GARY G. JOHNSEN and JULIE A. JOHNSEN, husband and wife, adult individuals, whose last known addresses are 22 South Letort Drive, Middlesex Township, Cumberland County, Pennsylvania. 3. Defendants are the owners and are in possession of the premises known and numbered as 22 South Letort Drive located in the Township of Middlesex, county of Cumberland and Commonwealth LAW Ol'''Jc.I!S SNII.BAKER 6 Blur~NIMAN of Pennsylvania, as more fully described in a certain deed from Edward R. and Carol A. Stover to Defendants dated March 25, 1985, and recorded on the same date in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Deed Book "E", Volume 31, Page 42 et seq., which description is LAW OI"I"ICEB SNILBAKIlR . BFlI:NNltMAN incorporated herein by reference thereto (hereinafter called "Subject Premises"), The principal building on said Subject Premises is a single-family detached dwelling house, 4. Plaintiff enacted a land use/zoning ordinance known as "Middlesex Township Zoning Ordinance" as Ordinance No. 3-89 on June 30, 1989, the provisions of which ordinance are incorporated herein by reference thereto (hereinafter called "Zoning Ordinance") . 5. Commencing at divers times prior to Hay 4, 1994, the Defendants have caused or permitted the following acts to occur on or about the Subject Premises: A. Disposed of trash by discarding the same on the Subject Premises causing it to spread on the properties of others in the residential neighborhood in which the Subject Premises is located. B. Storage or placement of three unlicensed and/or inoperable motor vehicles in the front yard of the Subject Premises. C. Placement and maintenance of a semi-trailer for storage purposes in the front or side yard closer to the adjoining street than any portion of the dwelling house erected on the Subject Premises. 6. The foregoing acts or uses set forth in paragraph 5, SUDra constitute violations of the Zoning Ordinance in the following respects (the following subparagraphs being identified by corresponding letters to the subparagraphs in paragraph 5): -2- LAW O"lCIHI SNlLaAI<&:R . B"INNIMAN A. section 14.17A which prohibits use ot any land which discharges or disperses solid waste which adversely attects the surrounding area, or which causes annoyance or disturbance to any of the surrounding properties or to their owners or occupants, or which is unwholesome and may be prejudicial to health and general welfare. 8. section 14.17F which prohibits the parking, storage or placement of unlicensed motor vehicles for more than thirty days on any exterior premises (except within a licensed junk yard). c. Section 14.01A which prohibits the placement of any acoessory structure on any lot which projects nearer to the street on which the principal building fronts than such principal building. 7. Written notice of the above violations was delivered to the Defendants by personal service upon Defendant Julie A. Johnsen on or about May 4, 1994. 8. Defendants have failed and refused to comply with the notice aforesaid and the cited provisions of the Zoning Ordinance. 9. Defendants have failed to remove the three motor vehicles mentioned in paragraph 58 hereinabove. 10. Efforts to encourage compliance with the Zoning Ordinance have been rejected by Defendants. Based upon the statements cited in paragraph 10 above, the Plaintiff believes that its remedies via civil penalty would be futile, leading to a multiplicity of actions and that the violations would continue. 12. Plaintiff has no adequate remedy at law. 13. Equitable relief is needed to obtain actual compliance with the Zoning Ordinance in order to protect and preserve the welfare and common good of the citizens of Middlesex Township. WHEREFORE, Plaintiff respectfully requests your Honorable Court to: A. Enjoin Defendants from discharging solid waste, storing unlicensed and/or inoperable motor vehicles and placement of accessory structures in prohibited areas on the Subject ~remises; B. Order and direct Defendants to abate the continuing violation of the Zoning Ordinance by removing all trash from the exterior of the Subject premises, remove all unlicensed and/or inoperable motor vehicles from the Subject Premises and remove the semi- trailer storage structure from the prohibited area of the Subject Premises; C. Their yard area is objectionable to their neighbors and in violation of the Middlesex TownShip Zoning Ordinance in the following ways: A. Disposal of household trash by discarding it in the yard area causing it to spread unto the properties of neighbors. B. storage and retention of unlicensed and/or inoperable vehicles in the front yard. C. Placement and retention of a semi-trailer for storage purposes in the yard. After reasonable investigation, this party is without sufficient information to form a belief as to the truth of the various averments contained in the Petition for an Extension filed by Defendant Julie A. Johnsen AUgust 15, 1994; therefore, same are denied. Nonetheless, Plaintiff has no objection to the Court granting Defendant Julie A. Johnsen a thirty day extension beginning Allgust 15, 1994 in which to file an Answer to the Complaint, based upon Defendant's representation that an extension is being requested in order for her to comply with township ordinances. Disposed of trash by discarding the same on the subject premises causing it to spread on the properties of others in the residential neighborhood in which the Subject Premises is located. 2 B. storage or placement of three unlicensed and/or inoperable motor vehicles in the front yard of the subject premises. c. Placement and maintenance of a semi-trailer for storage purposes in the front or side yard closer to the adjoining street than any portion of the dwelling house erected on the subject premises. 6. The foregoing acts or uses set forth in paragraph 5, SUDra constitute violations of the Zoning ordinance in the following respects (the following subparagraphs being identified by corresponding letters to the subparagraphs in paragraph 5): A. Section 14.17A which prohibits use of any land which discharges or disperses solid waste which adversely affects the surrounding area, or which causes annoyance or disturbance to any of the eurrounding properties or to their owners or occupants, or which is unwholesome and may be prejudicial to health and general welfare. The said Defendants are directed not to further store trash and similar items, including unlicensed vehicles, upon the premises. 3. The said Defendants are directed to notify the owners of any such property directed to be removed of this Order of Court within 10 days of today's date. 4. In the event that the aforesaid materials and items are not removed from the aforesaid premises within 60 days of today's date, the Plaintiff is authorized to enter upon the premises and remove and dispose of, as it sees fit, the said automobiles, semi-trailer, and trash, and to file a municipal lien against the property for the costs of doing so without further Order of Court. Nothing herein is intended to prevent the Plaintiff from proceeding with a petition for contempt as an alternative or supplementary measure of obtaining relief in the event that the Defendants do not comply with this Order. It is noted that this Order has been entered with the consent of Defendant Julie A. Johnsen through her counsel, and that the Order was dictated in the said Defendant'a presence and in the presence of representatives of the Plaintiff.
