COMPLAINT
AND NOW, comes TOWNSHIP OF MIDDLESEX, Plaintiff, by its
Attorneys, SNELBAKER & BRENNEMAN, P.C., and avers the following
cause of action in equity:
1. The Plaintiff herein is TOWNSHIP OF MIDDLESEX, a
municipal township of the second class located in Cumberland
County, Pennsylvania, having its municipal office at 350 North
Middlesex Road, Carlisle, PA 17013.
2. The Defendants herein are GARY G. JOHNSEN and JULIE A.
JOHNSEN, husband and wife, adult individuals, whose last known
addresses are 22 South Letort Drive, Middlesex Township,
Cumberland County, Pennsylvania.
3. Defendants are the owners and are in possession of the
premises known and numbered as 22 South Letort Drive located in
the Township of Middlesex, county of Cumberland and Commonwealth

of Pennsylvania, as more fully described in a certain deed from
Edward R. and Carol A. Stover to Defendants dated March 25, 1985,
and recorded on the same date in the Office of the Recorder of
Deeds in and for Cumberland County, Pennsylvania, in Deed Book
"E", Volume 31, Page 42 et seq., which description is

incorporated herein by reference thereto (hereinafter called
"Subject Premises"), The principal building on said Subject
Premises is a single-family detached dwelling house,
4. Plaintiff enacted a land use/zoning ordinance known as
"Middlesex Township Zoning Ordinance" as Ordinance No. 3-89 on
June 30, 1989, the provisions of which ordinance are incorporated
herein by reference thereto (hereinafter called "Zoning
Ordinance") .
5. Commencing at divers times prior to Hay 4, 1994, the
Defendants have caused or permitted the following acts to occur
on or about the Subject Premises:
A. Disposed of trash by discarding the same on
the Subject Premises causing it to spread on the
properties of others in the residential neighborhood in
which the Subject Premises is located.
B. Storage or placement of three unlicensed
and/or inoperable motor vehicles in the front yard of
the Subject Premises.
C. Placement and maintenance of a semi-trailer
for storage purposes in the front or side yard closer
to the adjoining street than any portion of the
dwelling house erected on the Subject Premises.
6. The foregoing acts or uses set forth in paragraph 5,
SUDra constitute violations of the Zoning Ordinance in the
following respects (the following subparagraphs being identified
by corresponding letters to the subparagraphs in paragraph 5):

A. section 14.17A which prohibits use ot any land
which discharges or disperses solid waste which
adversely attects the surrounding area, or which causes
annoyance or disturbance to any of the surrounding
properties or to their owners or occupants, or which is
unwholesome and may be prejudicial to health and
general welfare.
8. section 14.17F which prohibits the parking,
storage or placement of unlicensed motor vehicles for
more than thirty days on any exterior premises (except
within a licensed junk yard).
c. Section 14.01A which prohibits the placement
of any acoessory structure on any lot which projects
nearer to the street on which the principal building
fronts than such principal building.
7. Written notice of the above violations was delivered to
the Defendants by personal service upon Defendant Julie A.
Johnsen on or about May 4, 1994.
8. Defendants have failed and refused to comply with the
notice aforesaid and the cited provisions of the Zoning
Ordinance.
9. Defendants have failed to remove the three motor
vehicles mentioned in paragraph 58 hereinabove.
10. Efforts to encourage compliance with the Zoning
Ordinance have been rejected by Defendants. Defendants, through
Defendant Julie A. Johnsen, protest, inter alia, that they do not

have funds with which to comply.
11. Based upon the statements cited in paragraph 10 above,
the Plaintiff believes that its remedies via civil penalty would
be futile, leading to a multiplicity of actions and that the
violations would continue.
12. Plaintiff has no adequate remedy at law.
13. Equitable relief is needed to obtain actual compliance
with the Zoning Ordinance in order to protect and preserve the
welfare and common good of the citizens of Middlesex Township.
WHEREFORE, Plaintiff respectfully requests your Honorable
Court to:
A. Enjoin Defendants from discharging solid
waste, storing unlicensed and/or inoperable motor
vehicles and placement of accessory structures in
prohibited areas on the Subject ~remises;
B. Order and direct Defendants to abate the
continuing violation of the Zoning Ordinance by
removing all trash from the exterior of the Subject
premises, remove all unlicensed and/or inoperable motor
vehicles from the Subject Premises and remove the semi-
trailer storage structure from the prohibited area of
the Subject Premises;
C. Order and direct Defendants to obey the Zoning
Ordinance;
D. Order and direct Defendants to pay the costs
of this action and Plaintiff's expenses of enforcement

AND NOW, comes Plaintiff, TOWNSHIP OF MIDDLESEX, by its
Attorneys, SNELBAKER & BRENNEMAN, P.C., and submits the following
Memorandum pursuant to this Court's Order of August 18, 1995, in
accordance with C.C.R.P. 212-4:
1L--BASIC FACTS AS TO LIABILITY
Defendants are the owners of a single-family dwelling house
in a residential neighborhood. Their yard area is objectionable
to their neighbors and in violation of the Middlesex TownShip
Zoning Ordinance in the following ways:
A. Disposal of household trash by discarding it
in the yard area causing it to spread unto the
properties of neighbors.
B. storage and retention of unlicensed and/or
inoperable vehicles in the front yard.
C. Placement and retention of a semi-trailer for
storage purposes in the yard.
These uses are in violation of sections 14.01A, 14.17A and 14.17F
of the Zoning Ordinance. Notice of violation was given to
Defendants on or about May 4, 1994. Defendants have refused to
comply.

Julie A. Johnsen .s follows:
1. After reasonable investigation, this party is without
sufficient information to form a belief as to the truth of the
various averments contained in the Petition for an Extension
filed by Defendant Julie A. Johnsen AUgust 15, 1994; therefore,
same are denied. Nonetheless, Plaintiff has no objection to the
Court granting Defendant Julie A. Johnsen a thirty day extension
beginning Allgust 15, 1994 in which to file an Answer to the
Complaint, based upon Defendant's representation that an
extension is being requested in order for her to comply with
township ordinances.

COMPLAINT
AND NOW, comes TOWNSHIP OF MIDDLESEX, plaintiff, by its
Attorneys, SNELBAKER' BRENNEMAN, P.C., and avers the following
cause of action in equity:
1. The Plaintiff herein is TOWNSHIP OF MIDDLESEX, a
municipal township of the second class located in Cumberland
county, Pennsylvania, havin9 its municipal Office at 350 North
Middlesex Road, Carlisle, PA 17013.
2. The Defendants herein are GARY G. JOHNSEN and JULIE A.
JOHNSEN, husband and wife, adult individuals, whose last known
addresses are 22 South Letort Drive, Middlesex Town.hip,
Cumberland county, pennsylvania.
3. Defendants are the owners and are in possession of the
premises known and numbered as 22 South Letort Drive located in
the Township of Middlesex, County of Cumberland and Commonwealth
of Pennsylvania, as more fully described in a certain dee~ !~om
Edward R. and Carol A. Stover to Defendants dated March 25, 1985,
and recorded on the same date in the Office ot the Recorder of
Deeds in and ~or Cumberland County, Penn.ylvania, in Deed Book
"E", Volume 31, Page 42 et seq., which description is

incorporated herein by reference thereto (hereinafter called
"Subject premises"). The principal building on said sUbject
premises is a single-family detached dwelling house.
4. Plaintiff enacted a land use/zoning ordinance known as
"Middlesex Township zoning Ordinance" a. ordinance No. 3-89 on
June 30, 1989, the provision. of which ordinance are incorporated
herein by reference thereto (hereinafter called "Zoning
ordinance") .
5. commencing at divers times prior to May 4, 1994, the
Defendants have caused or permitted the following acts to occur
on or about the Subject Premises:
A. Disposed of trash by discarding the same on
the Subject Premises causing it to spread on the
properties of others in the residential neighborhood in
which the SUbject premises is located.
B. storage or placement of three unlicensed
and/or inoperable motor vehicles in the front yard of
the Subject premises.
c. Placement and maintenance of a semi-trailer
for storage purposes in the front or side yard closer
to the adjoining street than any portion of the
dwelling house erected on the Subject premises.
6. The foregoing acts or use. set forth in paragraph 5,
SUDra constitute violations of the Zoning Ordinance in the
following respects (the following subparagraphs being identified
by corresponding letters to the subparagraphs in paragraph 5):

A. Section 14.17A which prohibit. u.e of any land

annoyance or di.turbance to any of the .urrounding
properties or to their owners or occupant., or which i.
unwholesome and msy be prejudicial to health and
general weUare.
8. Section 14.17F which prohibit. the parking,
storage or placement of unlicen.ed motor vehicle. for
more than thirty days on any exterior premise. (except
within a licensed junk yard).
C. Section 14.01A which prohibits the placement
of any accessory structure on any lot which project.
nearer to the street on which the principal building
fronts than such principal building.
7. Written notice of the above violation. was delivered to
the Defendants by personal service upon Defendant Julie A.
Johnsen on or about May 4, 1994.
8. Defendants have failed and refused to comply with the
notice aforesaid and the cited provisions of the Zoning
Ordinance.
9. Defendants have failed to remove the three motor
vehicles mentioned in paragraph 58 hereinabove.
10. Effort. to encourage compliance with the Zoning
Ordinance have been rejected by Defendants. Defendant., through
Defendant Julie A. Johneen, protest, inter alia, that they do not

have fund. with which to comply.
11. Ba.ed upon the .tatements cited in paragraph 10 above,
the Plaintiff believes that its remedies via civil penalty would
be futile, leading to a mUltiplicity of action. and that the
violation. would continue.
12. plaintiff ha. no adequate remedy at law.
13. Equitable relief i. needed to obtain actual compliance
with the Zoning ordinance in order to protect and pre.erve the
welfare and common good of the citizen. of Middle.ex TownShip.
WHEREFORE, Plaintiff respectfully requests your Honorable
Court to:
A. Enjoin Defendants from discharging solid
wa.te, atoring unlicen.ed and/or inoperable motor
vehicle. and placement of acces.ory structures in
prohibited areas on the subject Premises;
B. Order and direct Defendants to abate the
continuing violation ot the Zoning Ordinance by
removing all trash from the exterior of the Subject
premi.e., remove all unlicensed and/or inoperable motor
vehicles from the Subject Premises and remove the .emi-
trailer .torage structure from the prOhibited area of
the Subject premi..s;
C. Order and direct Defendants to obey the Zoning
Ordinance;
D. Order and direct Defendante to pay the coet.
of this action and Plaintiff'e expenles of enforcement

AND NOW, comes the Plaintiff, Township of Middlesex, by and
through its attorneys, Snelbaker , Brenneman, P. C., and files
the within Motion stating the following in support thereof:
1. By Order dated November 8, 1995, upon consideration of
Plaintiff's Petition to Join Additional Person as Party
Defendant, a Rule was issued upon Defendant Gary G. Johnsen,
Defendant Julie A. Johnsen and Jasmine J. Johnsen to show cause
why Jasmine J. Johnsen should not be added as a Party Defendant
in this matter. The Rule was returnable twenty days after
service thereof by first class mail, postage prepaid, upon
Defendant Gary G. Johnsen and Defendant Julie A. Johnsen at 22
South Letort Drive, Carlisle, PA 17013 and by personal service
upon Jasmine J. Johnsen.

3. Jasmine J. Johnsen was served with a copy of the
Complaint in this matter together with the November 8, 1995 Order
and a copy of tho Petition to Join Additional Person as Patty
Defendant on November 16, 1~95 by Timothy Reitz, Deputy Sheriff
of Cumberland County as evidenced by the Sheriff's Return, a copy
of which is attached hereto as Exhibit liB" and incorporated
herein by reference thereto.
4. More than twenty days has elapsed since service upon the
effected persons.
5. As of the filing of this Motion, no response to the Rule
issued November 8, 1995 has been filed.
WHEREFORE, Plaintiff, Township of Middlesex, respectfully
requests your Honorable Court to make the Rule issued November 8,
1995 absolute and to order and direct that Jasmine J. Johnsen be
added as a Party Defendant in this matter.

1. The Plaintiff herein is TOWNSHIP OF MIDDLESEX, a
municipal township of the second cla.. located in Cumberland
County, Pennsylvania, having its municipal office at J50 North
Middlesex Road, Carlisle, PA 17013.
2. The Defendants herein are GARY G. JOHNSEN and JULIE A.
JOHNSEN, husband and wife, and their daughter, JASMINE J.
JOHNSEN, adult individuals, whose last known addresses are 22
South Letort Drive, Middlesex Township, Cumberland County,
Pennsylvania.
3. The original Complaint in this action was filed on or
about July 25, 1994. At that time, the Defendants were Gary G.
Johnsen and Julie A. Johnsen. Defendants are the owners and are
in possesslon of the premises known and numbered as 22 South
Letort DrivQ located in the Township of Middlesex, County of
Cumberland and Commonwealth of Pennsylvania, as more fully

described in a certain deed from Edward R. and Carol A. stover to
Defendants dated March 25, 1985, and recorded on the same date in
the Office of the Recorder of Deeds in and for cumberland County,
pennsylvania, in Deed Book "E", Volume 31, Page 42 et seq., which
description is incorporated herein by reference thereto
(hereinafter called "Subject Premises"). The principal building
on said subject Premises is a single-family detached dwelling
house. By deed dated February 15, 1995, Defendants Gary G.
Johnsen and Julie A. Johnsen purported to grant and convey the
subject premises to Julie A. Johnsen and Jasmine J. Johnsen, as
joint tenants with right of survivorship. Said deed was recorded
on May 1, 1995 in Deed Book 121, Page 554 in the Office of the
Recorder of Deeds in and for Cumberland County, Pennsylvania.

Defendant Julie A. Johnsen, protest, inter alia, that they do not
have funds with which to comply.
11. Based upon the statements cited in paragraph 10 above,
the Plaintiff believes that its remedies via civil penalty would
be futile, leading to a multiplicity of actions and that the
violations would continue.

12. Plaintiff has no adequate remedy at law.
13. Equitahle relief is needed to obtain actual compliance
with the Zoning Ordinance in order to protect and preserve the

14. Following the filing and service of a Petition to Join
Additional Person as Party Defendant, a Rule was issued to show
cause why Jasmine J. Johnsen should not be added as a party
Defendant. By Order of Court dated December 13, 1995, Jasmine J.
Johnsen was joined as a Defendant in this action.

15. The prior pleadings in this case consisting of a
Complaint, a Petition For Extension, and Plaintiff'. Answer to
Defendant's Petition For Extension are attached hereto as
Exhibit. A, Band C, respectively, and are incorporated herein by
reference thereto.
16. Trial is scheduled in this case for February 1, 1996 at
9:00 A.M. in Courtroom No.5, Cumberland County Courthouse,
Carlisle, Pennsylvania before the Honorable J. Wesley Oler, Jr.
WHEREFORE, Plaintiff respectfully requests your Honorable
Court to:
A. Enjoin Defendants from discharging solid
waste, storing unlicensed and/or inoperable motor
vehicles and placement of accessory structures in
prohibited areas on the Subject Premises;
B. Order and direct Defendants to abate the
continuing violation of the Zoning Ordinance by
removing all trash from the exterior of the Subject
Premises, remove all unlicQnsed and/or inoperable motor
vehicles from the Subject Premises and remove the semi-
trailer storage structure from the prohibited area of

4. Plaintiff enacted a land u.e/zoning ordinance known ae
"Middle.ex Town.hip Zoning Ordinance" as Ordinance No. 3-89 on
June 30, 1989, the provisions of which ordinance are incorporated
herein by reference thereto (hereinafter called "zoninq
Ordinance").
5. commencinq at divers times prior to May 4, 1994, the
Oetendants have caused or permittsd the tollowinq acts to occur
on or about the SUbject pruises:
A. Dispo.ed of tra.h by discarding tho same on
the subject pruises causing it to spread on the
properties of others in the re.idential neiqhborhood in
which the SUbject prubes i. located.
B. storage or placement of three unlicen.ed
and/or inoperable motor vehicles in the front yard of
the Subject premises.
c. Placuent and maintenance of a semi-.trailer

to the adjoininq street than any portion of the

6. The foregoing acts or uses set forth in paragraph 5,

fOllowing respects (the following sUbparagraphs being identified
by corresponding letters to the subparagraphs in paragraph 5):

unwholesome and may be prejudicial to health and
qeneral weltare.
8. Section 14.17F which prohibits the parkinq,
.torage or placement ot unlicenaed motor vehicles tor
more than thirty days on any exterior premi.es (except
within a licensed junk yard).
c. Section 14.0lA which prohibita the placement
of any accessory structure on any lot which projects
nearer to the atreet on which the principal buildinq
tronts than such principal buildinq.
7. Written notice ot the above violation. wa. delivered to
the Oefendants by personal .ervice upon Detandant Julie A.
John.en on or about May 4, 1994.
8. Detendants have failed and refused to comply with the
notice afor.said and the cited proviaions ot the Zoninq
Ordinance.
9. Detendants have tailed to remove the three motor
vehicles mentioned in paraqraph 58 hereinabove.
10. Ettorts to encourage compliance with the Zoning
Ordinance have been rejected by Oetendant.. Detendant., throuqh
Defendant Julie A. Johnsen, protest, inter alia, that they do not

11. Baled upon the .tatement. cited in paragraph 10 above,
the Plaintiff believes that its remedie. via civil penalty would
be futile, leading to a multiplicity of action. and that the
violations would continue.

13. Equitable reliet is needed to obtain actual compliance
with the Zoning Ordinance in order to protect and pre.erve the
welfare and common good of tt.e citizen. of Middle.ex Town.hip.
WHEREFORE, Plaintiff respectfully reque.t. your Honorable
Court to:
A. Enjoin Defendants from discharqinq solid
wa.te, storing unlicen.ed and/or inoperable aotor
v.nicle. and plac..ent ot acc...ory structure. in
prohibited areas on the Subject Premise.;
B. Order and direct Defendants to abate the
continuinq violation ot the Zoninq Ordinance by
removinq all trash from the exterior ot the Subject
premi.e., remove all unlicensed and/or inoperable motor
vehicles from the Subject premi.e. and remove the semi-
trailer storage structure from the prohibited area of
the Subject premi.e.;
C. Order and direct Defendants to obey the Zoninq
ordinance;
D. Order and direct Defendants to pay the co.ts

cause of action in equity:
1. The Plaintiff herein is TOWNSHIP OF MIDDLESEX, a
municipal township of the second class located in Cumberland
County, Pennsylvania, having its municipal office at 350 North
Middlesex Road, CarliSle, PA 17013.
2. The Defendants herein are GARY G. JOHNSEN and JULIE A.

South Letort Drive, Middlesex Township, Cumberland county,

3. The original Complaint in this action was fil.d on or
about July 25, 1994. At that time, the Defendants were Gary G.
Johnsen and Julie A. Johnsen. Defendants are the owners and are
in pos~ession of tne premises known and numbered as 22 South
Letort Drive located in the Township of Middlesex, County of
Cumberland and Commonwealth of Pennsylvania, as more fully

described in a certain deed from Edward R. and carol A. stover to
Defendant. dated March 25, 1985, and recorded on the same date in
the Office of the Recorder of Deeds in and for cumberland county,
Pennsylvania, in Deed Book "E", Volume 31, page 42 et seq., which
description is incorporated herein by reference thereto
(hereinafter called "subject premises"). 'l'he principal building
on said subject premises is a single-family detached dwelling
house. By deed dated February 15, 1995, Defendants Gary G.
Johnsen and Julie A. Johnsen purported to grant and convey the
subject premises to Julie A. Johnsen and Jasmine J. Johnsen, as
joint tenants with right of survivorship. Said deed was recorded
on May 1, 1995 in Deed Book 121, Page 554 in the Office of the
Recorder of Deeds in and for cumberland county, Pennsylvania.
4. plaintiff enacted a land use/zoning ordinance known as
"Middlesex Township Zoning ordinance" liS Ordinance No. 3-89 on
June 30, 1989, the provisions of which ordinance are incorporate
herein by reference thereto (hereinafter called "Zoning
Ordinance").
5. commencing at divers times prior to May 4, 1994, the
Defendants have caused or permitted the following IIcts to occur
on or about the subject premises:
A. Disposed of trash by discarding the same on
the subject premises causing it to spread on the
properties of others in the residential neighborhood in
which the Subject Premises is located.

dwelling house erected on the subject premises.
6. The foregoing acts or uses set forth in paragraph 5,
SUDra constitute violations of the Zoning ordinance in the
following respects (the following subparagraphs being identified
by corresponding letters to the subparagraphs in paragraph 5):
A. Section 14.17A which prohibits use of any land

adversely affects the surrounding area, or which causes
annoyance or disturbance to any of the eurrounding
properties or to their owners or occupants, or which is
unwholesome and may be prejudicial to health and
general welfare.

Johnsen on or about May 4, 1994.
8. Defendants have failed and refused to comply with the
notice aforesaid and the cited provisions of the Zoning
ordinance.
9. Defendants have failed to remove the three motor
vehicles mentioned in paragraph 5B hereinabove.
10. Efforts to encourage compliance with the Zoning
Ordinanoe have been rejected by Defendants. Defendants, through
Defendant Julie A. Johnsen, protest, inter alia, that they do not
have funds with which to comply.
11. Based upon the statements cited in paragraph 10 above,
the Plaintiff believes that its remedies via civil penalty would
be futile, leading to a multiplicity of actions and that the
violations would continue.
12. plaintiff has no adequate remedy at law.
13. Equitable relief is needed to obtain actual compliance
with the zoning Ordinance in order to protect and preserve the
welf.are and common good of the citizens of Middlesex Township.
14. Following the filing and service of a petition to Join
Additional Person as Party Defendant, a Rule was issued to show
cause why Jasmine J. Johnsen should not be added as a party
Defendant. By Order of Court dated December 13, 1995, Jasmine J.
Johnsen was joined as a Defendant in this action.

15. The prior pleadings in this Qase consisting of a
Complaint, a Petition For Extension, and Plaintiff's Answer to
Defendant's Petition For Extension are attached hereto as
Exhibits A, Band C, respectively, and are incorporated herein by
reference thereto.
16. Trial is scheduled in this case for February 1, 1996 at
9:00 A.M. in Courtroom No.5, Cumberland County Courthouse,
Carlisle, pennsylvania before the Honorable J. Wesley Oler, Jr.
WHEREFORE, Plaintiff respectfully requests your Honorable
Court to:
A. Enjoin Defendants from discharging solid
waste, storing unlicensed and/or inoperable motor
vehicles and placement of accessory structures in
prohibited areas on the Subject Premises;
B. Order and direct Defendants to abate the
continuing violation of the Zoning Ordinance by
removing all trash from the exterior of the Subject
Premises, remove all unlicensed and/or inoperable motor
vehicles from the SUbject Premises and remove the semi-
trailer storage structure from the prohibited area of
the SUbject Premises;
C. Order and direct Defendants to obey the Zoning
Ordinance;

herein by reterence thereto (hereinatter called "Zoning
ordinance") .
5. Commencing at divers time. prior to May 4, 1994, the
Detendants have cau.ed or permitted the following acts to occur
on or about th. Subject premis..:

propertie. ot others in the re.idential neighborhood in

8. Detendants hllve tailed and retused to comply with the
notice atoresaid and the citeel provi.ion. ot the Zonin9
Ordinance.
9. Detendants have failed to remove the thre. motor
vehiclea mentioned in paragraph 5B hereinabove.
10. Efforts to encourage compliance with the zoninq
Orelinance have been rejected by Detendant.. Defendants, throuqh
Defendant Julie A. Johnsen, protest, inter alia, that thay do not

DECREE NISI
AND NOW, this 1st day of February, 1996, upon
conaideration of the complaint in equity filed in the
above-captioned matter, and following a trial, and it appearing
that Defendants Julie A. Johnsen and Jasmine J. Johnsen were
served in this matter/ and that Defendant Gary G. Johnsen was
not aerved with process/ the Court finds that the premises at 22
South Letort Drive, Middlesex Township, Cumberland county/
Pennsylvania, owned by Julie A. Johnsen and Jasmine J. Johnsen,
are in violation of Plaintiff's zoning ordinance with respect to
sections 14.17A, 14.17F, and 14.01A, by virtue of the storage of
unlicensed automobiles, a semi-trailer, and various items of
trash in the yard of the premises, and accordingly, it is
ORDERED and DECREED as follows:
1. Defendants Julie A. Johnsen and Jasmine J.
Johnsen jointly and severally are enjoined to remove within 60
daya of today's date the three automobiles, semi-trailer, and
trash raferred to in testimony in this matter from the aforesaid
premiaee.
.
2. The said Detendants are directed not to
further .tore trash and similar items, including unlicensed
vehicles, upon the premises.
3. The said Detendants are directed to notity
the owners ot any such property directed to be removed of this
Order of Court within 10 days of today's date.
4. In the event that the aforesaid materials and
items are not removed trom the aforesaid premises within 60 days
of today's date, the plaintiff is authorized to enter upon the
premises and remove and dispose oft as it sees tit, the said
automobiles, semi-trailer, and trash, and to tile a municipal
lien against the property for the costs of doing so without
further Order of Court.
Nothing herein is intended to prevent the
plaintitf trom proceeding with a petition for contempt as an
altern~tive or supplementary measure of obtaining relief in the
event that the Defendants do not comply with this Order.
It is noted that this Order has been entered with
the consent of Defendant Julie A. Johnsen through her counsel,
and that the Order was dictated in the said Defendant's presence
and in the presence of representatives of the Plaintitf.
This Decree Nisi shall automatically become a
Final Decree, unless post-trial motions are filed by a party in
the matter within 10 days of the entry of this Order.

2. The said Defendants are directed not to
further store trash and similar items, including unlicensed
vehicles, upon the premises.
3. The said Defendants are directed to notify
the owners of any such property directed to be removed of this
Order of Court within 10 days of today's date.
4. In the event that the aforesaid materials and
items are not removed from the aforesaid premises within 60 days
of today's date, the Plaintiff is authorized to enter upon the
premises and remove and dispose of, as it sees fit, the said
automobiles, semi-trailer, and trash, and to file a municipal
lien against the property for the costs of doing so without
further Order of Court.
Nothing herein is intended to prevent the
Plaintiff from proceeding with a petition for contempt as an
alternative or supplementary measure of obtaining relief in the
event that the Defendants do not comply with this Order.
It is noted that this Order has been entered with
the consent of Defendant Julie A. Johnsen through her counsel,
and that the Order was dictated in the said Defendant'a presence
and in the presence of representatives of the Plaintiff.
This Decree Nisi shall automatically become a
Final Decree, unless post-trial motions are filed by a party in
the matter within 10 days of the entry of this Order.
