COMPLAINT
AND NOW, comes the Plaintiff, Michael L. Hall, by his
attorneys, Caldwell & Kearns, P,C" and files the within
Complaint upon and against Gettys Builders, !nc" Defendant,
stating as follows:
1, The Plaintiff, Michael L, Hall, is an adult individual,
who conducts a construction and excavation business under his
name, styled as Hall's Excavation, with his residence and
business location at 4511 Highland Street, Swatara Township,
Harrisburg, Dauphin County, Pennsylvania, 17111,
2. The Defendant, Gettys Builders, Inc" is a Pennsylvania
corporation with its principal place of business located at 1901
State Street, Camp Hill, Cumberland County, Pennsylvania, 17011,
3. The Plaintiff is engaged in the construction business,
and provides the labor, equipment and materials necessary to
perform excavation work, site preparation, installation of
footers and walls of a block or concrete composition in the
construction of dwelling houses and other buildings. Plaintiff
customarily engages in his business activities as a subcontractor
for other contractors,
4. The Defendant, Gettys Builders, Inc" is a corporation
which engages in the construction of homes and other buildings as
a contractor of the homeowner and frequently engages
subcontractors to perform certain aspects of Defendant's
construction contracts.
5, On or prior to August 26, 1993, the Defendant, through
his authorized agent, did verbally request that the Plaintiff
provide the Defendant with a verbal quotation for the performance
of certain work at a construction site at which the Defendant was
constructing a dwelling.
6, The construction site of the Defendant is or was located
in Lower Allen Township, Cumberland County, at or near Cedar
Cliff Drive. Defendant's authorized representative requested the
Plaintiff to provide him with a price quotation for the
installation of:
70,5 lineal feet of concrete wall, a inches thick by a feet
high, and
39 lineal feet of concrete wall, 10 inches thick by a feet
high.
7. Plaintiff provided to Defendant, verbally, his quotation
that he would perform the requested installation of. concrete
walls for a price of $26 per lineal foot for the a-inch thick
wall and $32.50 per lineal foot for the 10-inch thick wall.
Plaintiff's verbal quotation was accepted by the authorized
representative of Defendant and Plaintiff was verbally instructed
to proceed to perform the requested construction work,
B, On or about August 26, 1993, Plaintiff appeared at
Defendant's job site and commenced th~ performance of the
aforementioned verbal contract.
9. During the course of the excavation work being performed
by Plaintiff at the Defendant's job site, the on-site
Superintendent of the Defendant verbally requested Plaintiff to
perform additional work, not previously requested by Defendant,
specifically, Defendant was requested to perform the following,
additional work:
A, To install a brick ledge across the opening in the
concrete walls to be constructed by Plaintiff;
8, To provide the forms for and to create in the
concrete walls two "pipe chases" for sewer and water lines,
and to create two "beam pockets" for the location of steel
beams; and
C, To provide the materials for and to install a
quantity of a-inch block in the vicinity of the concrete
walls,
10. All of the aforementioned additional or extra work was
agreed, by the on-site Superintendent of Defendant, and
Plaintiff, to be performed on a basis of a billing that would
represent the material provided and the labor provided for the
completion of the work,
11, On or about September 8, 1993, Plaintiff completed the
verbal contract he had made with Defendant and also completed the
additional or extra work which he had been requested by the
Defendant to perform, And, on October 8, 1993, submitted his
invoice to Defendant, itemizing all of the work performed and
setting forth the total amount of his invoice in the sum of
$4,110,50,
12, All work performed by Plaintiff, and all materials
utilized by Plaintiff in the performance of his work, was of good
and reasonable quality, and the work was performed in accordance
with the requests and instructions provided and, finally, was
performed in a good, proper and workmanlike fashion,
13. The invoice submitted by Plaintiff to Defendant, dated
August 10, 1993, is attached hereto, identified as Exhibit A, and
incorporated herein by reference,
14, Plaintiff has repeatedly demanded payment of the
aforementioned invoice but Defendant has failed and refused to
pay the same,
15, Plaintiff demands judgment against Defendant in the
amount of $4,110,50, together with interest at 6% from October 8,
1993, and costs of suit,
16, The amount in controversy, exclusive of interest, is
within the monetary limits requiring submission of the within
case to compulsory arbitration,
WHBRBFORB, Michael L, Hall, t/a Hall's Bxcavation,
respectfully requests this Honorable Court to enter judgment
against the Defendant, Gettys Builders, Inc" in the sum of
$4,110,50, together with interest from October 8, 1993, and costs
of suit,

through its attorneys, Stone LaFaver & Stone, and set. forth the
following answers to plaintiff's complaint.
