PETITION rOR APPOINTMENT or BOARD or VIEW
TO THE HONORABLE, THE JUDGES OF SAID COURT:
The Petition of Norman W. Dyer and Dorothy D. Dyer, husband
and wife, by Dorothy D. Dyer, surviving spouse, Condemnees, by and
through their attorneys Joseph A. Klein, P'C" and Mark S. silver,
Esquire, respectfully represents that:
1. On or about July 26, 1994, and thereafter, Norman W. Dyer
and Dorothy D. Dyer, husband and wife, were the record owners, in
fee simple, of the premises situate in Upper Allen Township,
Cumberland County, Pennsylvania.
2. As of the date of condemnation and for all purposes as of
that date and thereafter, there were no persons other than Norman
W. Dyer and Dorothy D. Dyer, husband and wife, who had an interest
in the property referred to in the Declaration of Taking.
3. The said Norman W. Dyer died June 5, 1995, and is

survived by his wife, Dorothy D. Dyer.
4. The real estate which forms the basis of this action was
owned by Norman W. Dyer and Dorothy D. Dyer in their capacities as
husband and wife, and thus as tenants by the entireties, pursuant
to deed dated June 6, 1946, between "Walter B. Zacharias and
Alverda M. Zacharias, his wife, ... Grantors ... and Norman W. Dyer
and Dorothy D. Dyer, his wife, ... Grantees", recorded in the
Ottice ot the Recorder of Deeds of Cumberland County, Pennsylvania,
in Deed Book 13, Volume F, Page 579.
5. Upon the death of the said Norman W. Dyer, title to the
subject property vested in Plaintiff/Condemnee Dorothy D. Dyer by
operation of law.
6. By virtue of the Declaration of Taking filed on or about
July 26, 1994, docketed in the Court of Common Pleas of Cumberland
County to No. 94-4176 civil Term, the Commonwealth of Pennsylvania,
Department of Transportation, acquired, appropriated and condemned
Petitioner's aforesaid and above-described property in Upper Allen
Township, Cumberland County, Pennsylvania, in fee simple absolute
for purposes of highway construction.
7. There are no Preliminary Objections outstanding relating
to the Commonwealth of Pennsylvania, Department of Transportation's
Declaration of Taking.
S, An initial payment of estimated just compensation was
made by Defendant-Condemnor to Petitioners-Condemnees on or about
August 19, 1994.
