Plzczolkowlki opened . perlonal checking account at CCNB/ account number 003-0024-004/ renumbered on or about Auguet 6/ 1993 ae PNC account 51-4013-4521 on which he wae the only designated signator. 5. On or about August 23/ 1993/ plaintiff drew Check No. 3436 against the Medical services account in the amount of $6/700 to hil own order which was deposited the same date to hie personal account. A copy of Check No. 3436 is attached hereto and marked Exhibit "A". 6. Check No. 3436 was drawn against insufficient funds and credit given for it in the personal account was reversed. On August 31, the check was resubmitted and was recredited to the personal account. The check was again returned for insufficient funds but, by error, the credit given in the personal account was not immediately reversed. 7. By reason of the error, $6/700/ the amount for which Check No. 3436 was drawn, was not debited to the personal account/ following credit to that account on August 31/ until November 29/ 1993. When charged to that account/ there resulted a debit (or negative) balance in the account in the amount of $6/631.57. 8. AI ot November 29/ 1993/ the Medical Service I account had 2 13. plaintiff, by receivinq cndit from PNC for an in.trument that hacS been cSi.honored, wa. unju.tly enriohed. WHEREFORE, PNC demand. judgment in it. favor for the amount of $6,700, le.. oudit for $68.43, a net amount due of $15,631.!17, toqether with intere.t and co.t. thereon. COUllT I II 14. The averments of paragrGphs one through nine hereof are incorporated herein by reference. 15. Following November 30, 1993, various communioation. enaued between PNC and Plaintiff. On February 21, 1994, Plaintiff declined to immediately repay his obligation in full, but atated that he could pay $700 upon acceptance, and $600 per month thereafter. A Clopy of Plaintiff'a letter of February 21 ia attached hereto and marked Exhibit "B". 16. Following a further demand, defendant wrote on April 1, advising that he was unable to pay the amount demanded at that time, but would pay $1,300 upon acoeptance of his proposal, and $900 a month for six months.
