MARITAL SETTLEMENT AGREEMENT

~~Sband'" and Penny E. Bartakovits, hereinafter called "wife".
~ WHBRBAS, Husband and Wife were lawfully married on July l~,
1992, in cumberland county, Pennsylvania.
WHEREAS, differences have arisen between the parties and it
is the intention of Wife and Husband to live separate and apart,
and the parties hereto desire to settle fully and finally their
respective financial and property rights and obligations as
between each other including, without limitation by
spec,tfication: the settling of all matters between them relating
to the ownership and equitable distinction of real and personal
property; the settling of all matters between them relating to
the past, present and future support, alimony and/or maintenance
for Wife by Husband or of Husband by Wifet and in general, the
settling of any and all claims and possible claims by one against
the other or against their respective estates.

1. SEPARATION AND NON-INTERFERENCE I
It shall be lawful for eaoh party at all times
hereatter to live separate and apart trom eaoh other at such
place as he or she from time to time shall ohoose or deem tit.
The toregoing provision shall not be taken as an admission on the
part ot either party of the lawfulness or unlawfulness of the
oauses leading to their living apart.
Eaoh party shall be free from interferenoe, authority
and oontrol by the other, as fully as if he or she were single
and unmarried, except as may be neceesary to carry out the
provisions of this Agreement. Neither party shall molest or
attempt to endeavor to molest the other, or in any way harass or
malign the other, nor in any other way interfere with the
peaoeful existence, separate and apart from the other.
Wife her~by agrees that upon the entry of the final
Decree in Divorce in this matter, she will immediately apply to a
oourt of competent jurisdiction to retake her maiden name.
2. RECONCILIATION I
This Agreement shall not be deemed to have been waived,
extinguished, discharged, terminated, invalidated or otherwise
aftected by a reconciliation between the parties hereto,
cohabitation between the partieD, a living-together or resumption
of marital relations between them. They shall not be deemed to
have reconoiled with the intention of vitiating or terminating
this Agreement unless they make such actions through a written

Husband and Wife heroby acknowledge that they each may
hive the right to aasert a olaim for spousal support, alimony,
alimony pendente lite, costs and/or expenses, Further, Husband
and Wife acknowlodgo that they understand that said rights are

knowingly forever waive and relinquish any right they may each
hAve to assort a olaim now or in the future for spousal support,

5. JQUITADLB DISTRIBUTIONI

have heretofore divided to their mutual satisfaction all non-
mlrital and marital assets including, but without limitation,

Clothing, pensions, brokerage accounts, stocks, bonds, life
insuranoe pOlicies or other securities, Individual Retirement
Accounts, ohecking and savings accounts, mutual funds, and other
a.s.ts whether real, personal or mixed, tangible or intangible.
Husband and Wife further acknowledge and agree
that the aBsots in the possession of the other spouse shall be
that spouse's sole and separate property, each party hereto
specifically waiving, releasing, renounc~ng and forever
abandoning whatever claim, if any, he or she may have with

respect to any of the foregoing items which are the sole and
separate property of the other.
B. PaYment from Husband to Wifel
In exchange for Wife's waivers as defined in
preceding Paragraph Four (4) and her waivers as provided
hereinabove in Paragraph Five (5)' A, Husband hereby agreesl
1. That he shall pay to Wife the total sum of
Two Thousand Dollars ($2,000.00) in the
following manner. Five-hundred Dollars
($500.00) of which shall be paid to wife
simultaneously with the execution of this
Agreement. The balance owed to wife shall be
paid to Wife with six-percent interest
accruing in twelve equal monthly installments
of One Hundred thirty-two Dollars and Fifty
Cents ($132.50) commencing on the first day
of the first month following execution of
thi~ Agreement and thereafter on the first of
the month for a total of twelve months.
2. That he shall be solely responsible for all
joint and individual federal, state and looal
tax liabilities of the parties inourred
during their marriage, forever releasing any
claim he may have against Wife for payment
and/or reimbursement based thereon, now or in
the future.
3.
That he shall be solely responsible f~r the
Mastercard credit card debt in the
approximate amount of Two Thousand Dollars
($2,000.00), forev~r releasing any olaim he
may have against Wife for payment and/or
reimbursement based thereon, now or in the
future. Husband shall pay the Mastercard
debt as it becomes due. Wife hereby verifies
that the current balance owed on the
Mastercard credit card is not in excess of
Two Thousand Dollars ($2,000.00) and that
said credit oard account is closed. Wife
shall be responsible for the portion of the
Mastercard credit oard debt that is in excess
of Two Thousand Dollars ($2,000.00).

4. That he shall make, exeoute and deliver all
documents in the usual form conveying,
transrerring and granting to Wire all or his
right, title and interest in and to the real
estate situate known as 6309 stanford court/
Mechanicsburg, cumberland County,

acknowledges that he has no olaim, right,
interest, or title whatsoever in said
property and furth$r agrees never to assort
any claim to said prope~ty in the future.

This Agreement is intended to ~ all

any property may be omitted from this Agreement, it is understood
and agreed that the person having possession and/or title to such
property rollowing the execution of this Agreement shall be
deemed the owner thereof and each of the parties will execute any

Should it become necessary at any time for either
party to execute any titles, deeds or similar documents to give
errect to this paragraph, it shall be done immediately upon

I. AFTER ACOUIRED PROPERTY I
Each of the parties shall hereafter own and enjoy/
independel,tly of any olaim or right of the other/all items ot
property/ be they real, personal or mixed, tangible or
intangible, which are hereafter acquired by him or her, with tull
power in him or her to dispose of the same as fully and
eftectively, in all respeots and for all purposes, as though he
or she were unmarried.
The parties hereby agree that, as to all assets not
specifically mentioned herein which are presently titled in the
sole name of one of the parties hereto or/ if untitled, are
presently in the sole possession of one of the parties hereto,
the party not having title thereto or possession thereof hereby
waives, releases, relinquishes and forever abandons any and all
claims therein, and acknowledges that the party having title or
possession of suoh items'shall be the sole and exclusive owner
thereof.
7. DEBTS I
A. Marital Debtsl
Husband hereby reaffirms the terms as provided tor
under section 5 B. above. Wife hereby agrees to be responsible
tor the Montgomery Ward debt as well as the debt associated with
the refrigerator.

B. wite's Debtsl
Wife represents and w!rrants to Husband that since
the parties' ~eparation she has not and in the future she will
not contract or inour any debt or liability for whioh Husband or
his estate might be responsible and shall indemnity and save
harmless Husband from any and all olaims or demands made against
him by reason of debts or obligations inourred by her.
c. Husband's Debtsl
Husband represents and warrants to Wife that since
the parties' separation he has not and in the future he will not
oontraot or inour any debt or liability for which Wife or her
estate might be responsible and shall indemnify and save harmless
wite from any and all olaims or demands made against her by
reason of debts or obligations inourred by him.
All further debts incurred by the parties shall be
their individual responsibility.
D. Indemnifioationl
Eaoh party repr~sents and warrants to the other
that he or she has not inourred any debt, obligation, or other
liability, other than described in this Agreement, on whioh the
other party is or may be liable.
Eaoh party covenants and
agrees that if any claim, aotion or. proceeding is hereinafter
initiated seeking to hold the other party liable for any other
debts, obligations, liability, aot or omission of such party/

auch party will at his or her sole expenses, defend the other
against any such claim or demand, whether or not well-founded,
and that he or she will indemnity and hold harmless the other
party in respeot of all damages as resulting therefrom. Damages
as used herein shall include any olaim, aotion, demand, loa.,
ooat, expenses/ penalty, and other damage, including without
limitation, counsel fees and other costs and expenses reasonably
incurred in investigating or attempting to avoid same or in
opposing the imposition thereof or enforcing this indemnity,
reSUlting to HUsband or Wife from any inaccurate representation
made by or on behalf of either Husband or Wife to the other in
this Agreeme.nt, any breach of any of 'he warranties made by
Husband or Wife in this Agreement, or breach or default in
perfonnance by Husband or Wif.e of any of the obligations to be
perfonned by such party hereunder. The Husband or Wite agrees to
give the other prompt written notioe ot any litigation threatened
or instituted against either party which might oonstitute the
basis for a claim for indemnity pursuant to the terms of this
Agreement.
8. FULL DISCLOSURE I
The parties aoknowledge that they have been tully
advis4d and intormed of the wealth, real and/or personal
property/ eotate and assets, earnings and income of the other and
are familiar with and cognizant of suoh and the value thereof, or
has knowingly waived such advise and/or information. The parties

hereto have been fully advised and informed of all rights and
interests which, except for the execution and delivery hereof,
have been oonterred upon or vested in eaoh ot them by law with
respect to the property or estate ot the other by reason of their
marital status, or has knowingly refused or waived such advioe or
information.
t. CONSENT TO srON DOCUMENT~1
Eaoh party shall execute any and all documents which
may require his or her signature for the purpose of eftectuating
allot the terms and conditions of this Agreement so as to give
full force and effect to this Agreement.
10. RELEASES I
Except as otherwise herein provided, eaoh party
releases and discharges completely and forever the other from any
and all right, title, interest or claim or past/ present or
future support, division of property including in~Qme or gain
trom property hereafter accruing, right of dower and courtesy/
right to act as administrator or executor in the estate ot the
other, right to distributive share in the other's estate, right
ot exemption in the estate of the other, or any other property
rights, benefits or privileges accruing to either party by virtue
ot said marriage relationship/or otherwise, and whether the same
are oonferred by the statutory law or by the common law of the

commonwealth of Pennsylvania, or any other state/ or of the
oommon law of the United states of America.
It is further speoifically understood and agreed by and
between the parties hereto, that each party acoepts the
provilions herein made in lieu of and in full settlement and
satisfaotion of any and all of said parties' rights against the
other for any past, present and future claims on account of
support/ mainten~nce, alimony, alimony pendente lite, oounsel
tees/ oosts and expenses, equitable distribution ot marital
,roperty and any other claims of each party inoluding all claims
raised by them in the divoroe action pending between the parties.
11. TAX ON PROPERTY DIVIBIONI
Husband hereby agrees to pay all income taxes assessed
against him, if any/ as a result of the division of the property
of the parties hereunder. Wife hereby agrees to pay all inoom~
taxes assessed against her, if any/ as a result of the division
of the property of the parties hereunder.

12 . BREACH I
If either party breaches any provision of this
Agreement, the other party shall have the right, at his or her
election, to sue for damages for suoh breach. T.he party
breaChing this contract shall be responsible for the payment ot
reasonable legal tees and costs inourred by the other in

entorcing his or her riqhts under this Agreement/ or seeking 8uch
other remedy or relief as may be available to him or her.
13. ~ITIONAL INSTRUMBNTI
Each of the parties shall on demand execute and deliver
to the other any deeds, documents, records or closing statements
relating to the sale of real estate under this Agreement/ bills
of sale, assignment, oonsents to change of beneficiary on
insurance polioies, tax returna and other documents and do or
caused to be done any other aot or thing that may be neoessary or
desirable to the provisions and purposes ot this Agreement. If
either party fails on demand to comply with this provision, that
party shall pay to 1:he other all attorneys I fees / costs and other
expenses reasonable incurred as a result of such failure.
14. REPRESENTATION I
Both parties hava been given the opportunity to obtain
the advice of counsol regarding the provisions of this Agreement
and, their legal effect in advance of the date set forth above to
permit suoh independent review. In the event either party elects
to execute this Agreement without the advice of counsel, he/she
shall neverthelesfl be bound hereby and he/she specificallY and
knowingly waives his/her right, if any, to utilize his/her lack
ot legal representation as a basis to attack the validity of this
Agreement. Each party acknowledges that he or she has had the
opportunity to reoeive independent legal advice from counsel trom

and have been fully informed as to his or her legal rights and

of any duress or undue influenoe, and that it is not the result
of any improper or illegal agreemGnt or agreements.
15. VOLUNTARY EXECUTION I
The provisions of this Agreement are fully understood
by bot~1 parties and eaoh party aoknowledges that this Agreement
is fair and equitable, that it is being entered into vOluntarily
and that it is not the result of any duress or undue influenoe.
Further, eaoh party acknowledges that he or she has the mental
oapaoity to understand tho terms provided herein and has not been
placed under duress, ooeroion or any physical or mental stress.

This Agreement oontains the entire understandin9 of the
parties and there are no representntions, warranties, covenants
or undertakings other than those expressly set forth herein.

17. P~IOR AORIIMINTI
It is undo~stood and agreed that any and all property

18. MODIFICATION AND WAIVERI
Any modifioation or waiver of any provision of this
Agreement shall be etfeotive only if made in writing and exeouted
with the same formality as this Agreement. The failure of either
party to insist upon striot performanoe ot any of the provisions
of this Agreement shall not be construed as a waiver of any
subsequent default ot the same or similar nature.
1'. GOVERNING LAW I
This Agreement shall be governed by and shall be
construed in accordance with the laws of the commonwealth of
Pennsylvania.
20. INDEPENDENT SEP~RATE COVENANTS I
It is specifioallY understood and agreed by and between
the parties hereto that each paragraph hereof shall be deemed to
be a separate and independent oovenant and agreement.

If any term/ oondition, clause, or provision of this
Aqreement shall be determinod or deolared to be void or invalid
in law or otherwise, then only that term, condition, clause or
provision shall be strioken from this Agreement and in all other
respeots this Agreement shall be valid and oontinue in full
force, efteot and operation.
22. ENTRY AS PART OF DECREEI
It is the intention of the parties that this Agreement
shall survive any action for divorce which may be instituted or
proseouted by either party and no order, judgement or deoree of
divoroe, temporary/ final or permanent, shall affect or modify
the financial terms of this Agreement. This Agreement shall be
made in part of any such judgment or deoree of final divorce.
Aocordingly, this Agreement shall be inoorporated but not merged
into the decree of final divorce.
23. CONSENTS TO DIVORCEI
The parties agree that they shall execute Aftidavits ot
Consent which shall be filed with the oourt along with a Praeoipe
to Transmit the Record in order that a Decree in Divoroe

The parties hereto acknowledge and agree that for
purposes of distribution of property as provided for in this
Agreement, the date of execution of this Agreement shall be known
as the Distribution Date.
2S. DATB OF EXBOUTIONI
The parties hereto acknowledge and agree that the date
of execution referred to herein shall be known as the last date
upon which either party executes this Agreement.
2G. EFPB9T OF RBCONCILIATION. COHABITATION OR DIVORCB.
This Agreement shall remain in full foroe and effeot and shall
not be abrogated even if the parties effeot a reconciliation,
cohabit as husband and wife or attempt to effeot a
recon~iliation. This Agreement also shall continue in full force
and effeot in the event of the parties' divorce. There shall be
no modification or waiver of any ot the terms hereof unless the
parties in writing execute a statement deolaring this Agreement
or any term of this Agreement to be null and void.

1, 1\, Complaint in Divorce under Section 3301 (c) of the
Divorce Code was filed on JULY 28, 1994,
2, The marriage of Plaintiff and Defendant is irretrievably
broken and ninety (90) days have elapsed from the date of filing
the Complaint,
3. I consent to the entry of a final Decree in Divorce,
4, I understand that I may lose rights concerning alimony,
divi~ion of property, attorneys' fees or expenses if I do not claim
them before a divorce is grant~d,
5, I have been advised of the availability of marriage
counseling, and understand that I may request that the Court
require that my spouse and I participate in counseling, I further

agreement,
finding Defendant/Respondent,

("Husband") in breach thereof, and award Wife's counsel fees based
thereon and for reasons therefore states:
1, Wife is Penny E, Bartakovits, Plaintiff in the above captioned
divorce
action,
residing
at

Stanford
Court,
Mechanicsburg, Cumberland County, Pennsylvania, 17055,
2. Husband is Edward Bartakovits, Defendant in the above
captioned divorce action, having a mailing address of 33
Robinhood Drive, Etters, York County, Pennsylvania, 17319,
3, The parties were married on July 15, 1992, in Cumberland
County, Pennsylvania,
4, Wife currently is employed as a sales professional,
5, Husband is self employed as a chiropractor,
6, The parties share no children in common,
7, On July 2B, 1994, Wife filed a complaint in divorce pursuant
to section 3301(c) of the p~nn6ylvania Divorce Code,
8, Counsel for Wife prior to receiving a certified copy of the
complaint in divorce, provided Husband with a courtesy copy of
the complaint in divorce by letter dated July 27, 1994, (See
attached Exhibit A) ,
9, On or about August 4, 1994, Husband contacted the undersigned
by telephone stating that he was not represented by separate
counsel and inquired about being served with the certified
copy of the complaint in divorce,
10 . On August 5, 1994, Husband was served wi th the divorce
complaint by certiE ied mail, number P 016 244 540, and an
Affidavit of Service was duly filed in accordance with the
Pennsylvania Rules of Procedure,
11, Throughout the Fall of 1994, Husband, Dr, Bartakovits who had
been previously married and divorced, negotiated on his on
behalf, terms to the Marital Settlement Agreement, In
particular, Husband discussed with undersigned counsel, terms
to the agreempnt on November 2, 1994, November 15, 1994,
November 16, 1994, and November 17, 1994,
12, On December 7, 1994, at 1105 p,m" Husband contacted the
undersigned's office and stated that he wanted the agreement
immediately so he would have a divorce by Christmas (December
25, 1994),
13. On December 7, 1994, the undersigned prepared the Marital
Settlement Agreement in accordance with the negotiated terms
between the parties,
12, Based upon Husband's agreement to the negotiated terms of
settlement, Wife executed said agreement on December 12, 1994,
(See attached Exhibit B) ,
13. Undersigned counsel forwarded the agreement to Husband on
December 12, 1994, requesting Husband' a counter-execution,
(See attached Exhibit C) ,
14, On December 28, 1994, the undersigned was contacted by counsel
for Husband,
15, On December 29, 1994, the undersigned wrote to counsel for
Husband, addressing the case generally and requesting any
further modifications desired, (See attached Exhibit D) ,
16, Throughout February and March, 1995, the undersigned and
counsel. for Husband further defined the ter~s of settlement,
17, On March 14, 1995, counsel for Husband provided the
undersigned with correspondence and a document which would
finalize this matter in accordance with Husband's new terms,
(See attached Exhibit E) ,
18, Wife has complied with all terms of the agreement, including
.the modifications requested by Husband's counsel,
19, Wife filed for support to Cumberland County DR 22,227,
20, A support conference in said action was scheduled for November
18, 1994 at 9 t 30 a, m, before Lucinda I!: , Sheaffer, (See
attached Exhibit F),
21, Husband told the undersigned counsel that since the parties'
reached terms of settlement as discussed hereinabove, Wife
should agree to cancel the support conference and instear., end
all matters relating to the parties' marriage,
22, Wife cancelled the support conference as requested,
anticipating the dissolution of all matters relating to the
parties' marriage,
23, Husband has positively refused to execute the Marital
Settlement Agreement,
24, Husband and Wife entered into a sales agreement on May 5,
1993, for the real property known as 6309 Stanford Court,
Mechanicsburg, Cumberland County, Pennsylvania, 17055, (See
attached Exhibit G) ,
25, The Marital Settlement Agreement calls for Husband's waiver of
all right, title and interest to said real property, (See
Exhibit B, Clause 5 - Equitable Distribution - page 4, section
B 4) ,
26. Husband's breach of the agreement has caused Wife to suffer
problems, if not total denial, in obtaining a mortgage on said
premises,
27. Husband's breach of the agreement has caused Wife to incur
additional attorney fees in the enforcement of the agreement,
in excess of $250,00, (See attached Exhibit H) ,
28, At no time has Husband alleged that he was placed undel'
duress I suffering from undue influence or misrepresentation or
fraud; nor that. the agreement was prepared by mistake, without
consideration, based upon illegality or immorality; nor has
impossibility of performance been alleged,
29, Husband, Dr, Bart.akovits who was previously married and
divorced, has not been committed to a mental institution as a
result of suffering from incompetence,
30, Husband's dilatory and malicious conduct. has caused Wife to
suffer insurmountable financial obstacles and expense,
31, In accordance with clause 5 - Equitable Distribution - section
B 1, (page 4 Exhibit B), Husband was to pay Wife $2/000,00,
32, TO date, Husband has failed to pay Wife in accordance with the
terms described in the preceding paragraph,
33. In accordance with clause 5 - Equitable Distribution - section
B 3/ (page 4 Exhibit B) / Husband was to be responsible for the
Mastercard debt,
34. To date, Husband has failed to pay the debt associated with
the creditor described in the preceding paragraph.
35, In accordance with clause 9 - Consents to Sign Documents,
(page 7 Exhibit B), Husband agreed to sign all documents
necessary to effectuate the terms of the subject agreement,
36, To date, Husband has failed to sign the marital settlement
agreement as well as his Affidavit 0f Consent as called for
under clause 24 - Consents to Divorce, (page 10 Exhibit B) ,
37, 23 Pa,C,S,A, section 3502(e) provides that your Honorable
Court may enter judgment against Husband for the relief
requested by Wife; award interest on the payment as called for
under Clause 5 - Equitable Distribution - section B1; transfer
all of Husband's interest to Wife in the real property known
as 6309 Stanford Court, Mechanicsburg, Cumberland County,
Pennsylvania, 170551 award Wife's counsel fees and costs
associated with the enforcement of the agreement as well as
all matters occurring prior hereto; and, find Husband in
contempt, (See attached Exhibit I - 23 Pa, C,S,A, section
3502 (e)) ,

This A9reement shall not be deemed to have been waived, extinguishfld,
discharged, terminated, invalidated or otherwise affected by a reconciliation

or resumption of marital relations between them, They shall not be deemed to
have reconciled with the intention of vitiating or terminating this Agreement
unless they make such actione through a written instrument, executed and
acknowledged in the same manne~ as this Agreement,

It is specifically understood and agreed by the parties that the prOVisions
ot this Separation Agreement relating to equitable diatribution of property ot
the portiea are accepted by each party as a final settlement for all purposes
whatsoever, as contemploted by the Pennsylvania Divorce Code,
Should a decree, judgment or order of separation or divorce be obtained by
either ot the perties in this or any other state, country or jurisdiction, each

thereof and each of the parties will execute any and all legal documents without
any charge therefor to evidence title to such property in the other party,

counsel regarding the provisions of this Agreement and their legal effect in

event either party elects to execute this agreement without the advice of
counsel, he/she shall nevertheless be bound hereby and he/she apecHically and
knowingly waives his/her right, if any, to utilize her lack of legal
representation as a baais to ottack the validity of this Agl"eement, Each party

of the provisions of this Agreement shall not be construed as a waiver of any
subsequent default of the same or similar nature,
