Bartakovits, hereinafter called "wife". ~ WHBRBAS, Husband and Wife were lawfully married on July l~, 1992, in cumberland county, Pennsylvania. WHEREAS, differences have arisen between the parties and it is the intention of Wife and Husband to live separate and apart, and the parties hereto desire to settle fully and finally their respective financial and property rights and obligations as between each other including, without limitation by spec,tfication: the settling of all matters between them relating to the ownership and equitable distinction of real and personal property; the settling of all matters between them relating to the past, present and future support, alimony and/or maintenance for Wife by Husband or of Husband by Wifet and in general, the settling of any and all claims and possible claims by one against the other or against their respective estates. , '.r: r'0 NOW THEREFORE, in consideration of the premises and of the r. mutual promises, covenants and undertakings hereinafter se~ forth .' The toregoing provision shall not be taken as an admission on the part ot either party of the lawfulness or unlawfulness of the oauses leading to their living apart. Eaoh party shall be free from interferenoe, authority and oontrol by the other, as fully as if he or she were single and unmarried, except as may be neceesary to carry out the provisions of this Agreement. Neither party shall molest or attempt to endeavor to molest the other, or in any way harass or malign the other, nor in any other way interfere with the peaoeful existence, separate and apart from the other. Wife her~by agrees that upon the entry of the final Decree in Divorce in this matter, she will immediately apply to a oourt of competent jurisdiction to retake her maiden name. 2. RECONCILIATION I This Agreement shall not be deemed to have been waived, extinguished, discharged, terminated, invalidated or otherwise aftected by a reconciliation between the parties hereto, cohabitation between the partieD, a living-together or resumption of marital relations between them. PaYment from Husband to Wifel In exchange for Wife's waivers as defined in preceding Paragraph Four (4) and her waivers as provided hereinabove in Paragraph Five (5)' A, Husband hereby agreesl 1. That he shall pay to Wife the total sum of Two Thousand Dollars ($2,000.00) in the following manner. Five-hundred Dollars ($500.00) of which shall be paid to wife simultaneously with the execution of this Agreement. The balance owed to wife shall be paid to Wife with six-percent interest accruing in twelve equal monthly installments of One Hundred thirty-two Dollars and Fifty Cents ($132.50) commencing on the first day of the first month following execution of thi~ Agreement and thereafter on the first of the month for a total of twelve months. 2. That he shall be solely responsible for all joint and individual federal, state and looal tax liabilities of the parties inourred during their marriage, forever releasing any claim he may have against Wife for payment and/or reimbursement based thereon, now or in the future. 3. That he shall be solely responsible f~r the Mastercard credit card debt in the approximate amount of Two Thousand Dollars ($2,000.00), forev~r releasing any olaim he may have against Wife for payment and/or reimbursement based thereon, now or in the future. Husband shall pay the Mastercard debt as it becomes due. Wife hereby verifies that the current balance owed on the Mastercard credit card is not in excess of Two Thousand Dollars ($2,000.00) and that said credit oard account is closed. The Husband or Wite agrees to give the other prompt written notioe ot any litigation threatened or instituted against either party which might oonstitute the basis for a claim for indemnity pursuant to the terms of this Agreement. 8. FULL DISCLOSURE I The parties aoknowledge that they have been tully advis4d and intormed of the wealth, real and/or personal property/ eotate and assets, earnings and income of the other and are familiar with and cognizant of suoh and the value thereof, or has knowingly waived such advise and/or information. If either party fails on demand to comply with this provision, that party shall pay to 1:he other all attorneys I fees / costs and other expenses reasonable incurred as a result of such failure. 14. REPRESENTATION I Both parties hava been given the opportunity to obtain the advice of counsol regarding the provisions of this Agreement and, their legal effect in advance of the date set forth above to permit suoh independent review. In the event either party elects to execute this Agreement without the advice of counsel, he/she shall neverthelesfl be bound hereby and he/she specificallY and knowingly waives his/her right, if any, to utilize his/her lack ot legal representation as a basis to attack the validity of this Agreement. The failure of either party to insist upon striot performanoe ot any of the provisions of this Agreement shall not be construed as a waiver of any subsequent default ot the same or similar nature. 1'. GOVERNING LAW I This Agreement shall be governed by and shall be construed in accordance with the laws of the commonwealth of Pennsylvania. 20. INDEPENDENT SEP~RATE COVENANTS I It is specifioallY understood and agreed by and between the parties hereto that each paragraph hereof shall be deemed to be a separate and independent oovenant and agreement. 14 . ENTRY AS PART OF DECREEI It is the intention of the parties that this Agreement shall survive any action for divorce which may be instituted or proseouted by either party and no order, judgement or deoree of divoroe, temporary/ final or permanent, shall affect or modify the financial terms of this Agreement. This Agreement shall be made in part of any such judgment or deoree of final divorce. Aocordingly, this Agreement shall be inoorporated but not merged into the decree of final divorce. 23. EFPB9T OF RBCONCILIATION. COHABITATION OR DIVORCB. This Agreement shall remain in full foroe and effeot and shall not be abrogated even if the parties effeot a reconciliation, cohabit as husband and wife or attempt to effeot a recon~iliation. This Agreement also shall continue in full force and effeot in the event of the parties' divorce. Undersigned counsel forwarded the agreement to Husband on December 12, 1994, requesting Husband' a counter-execution, (See attached Exhibit C) , 14, On December 28, 1994, the undersigned was contacted by counsel for Husband, 15, On December 29, 1994, the undersigned wrote to counsel for Husband, addressing the case generally and requesting any further modifications desired, (See attached Exhibit D) , 16, Throughout February and March, 1995, the undersigned and counsel. for Husband further defined the ter~s of settlement, 17, On March 14, 1995, counsel for Husband provided the undersigned with correspondence and a document which would finalize this matter in accordance with Husband's new terms, (See attached Exhibit E) , 18, Wife has complied with all terms of the agreement, including .the modifications requested by Husband's counsel, 19, Wife filed for support to Cumberland County DR 22,227, 20, A support conference in said action was scheduled for November 18, 1994 at 9 t 30 a, m, before Lucinda I!: , Sheaffer, (See attached Exhibit F), 21, Husband told the undersigned counsel that since the parties' reached terms of settlement as discussed hereinabove, Wife should agree to cancel the support conference and instear., end all matters relating to the parties' marriage, 22, Wife cancelled the support conference as requested, anticipating the dissolution of all matters relating to the parties' marriage, 23, Husband has positively refused to execute the Marital Settlement Agreement, 24, Husband and Wife entered into a sales agreement on May 5, 1993, for the real property known as 6309 Stanford Court, Mechanicsburg, Cumberland County, Pennsylvania, 17055, (See attached Exhibit G) , 25, The Marital Settlement Agreement calls for Husband's waiver of all right, title and interest to said real property, (See Exhibit B, Clause 5 - Equitable Distribution - page 4, section B 4) , 26. Husband's breach of the agreement has caused Wife to suffer problems, if not total denial, in obtaining a mortgage on said premises, 27.
