After reasonable investigation, Defendant is without knowledge or information sufficient to form a belief aa to the veracity of all of the averments articulated in the corresponding paragraph and, therefore, pursuant to the apposite Pennsylvania Rules of Civil Procedure, they are deemed denied and at issue. Strict proof of all of the allegations in the corresponding paragraph is demanded at the trial of this cause. 2. Denied in part, and as stated. The correct legal entity is Octagon Associates, it being a Pennsylvania limited partnership which owns and operates Belle Terre Apartments. There is no Belle Terre/Nanrock Apartment Complex; rather, there are the Belle Terre Apartments and the Nanroc Apartment Complex, the latter being a group of 23 or so one-story townhouses situated near the apartment complex in question. Str ict pr.oof of all of the allegations in the corresponding paragraph is demanded at the trial of this cause. 3. Denied; see Paragraph 2., supra. . 4. Denied as stated, and in part, eee paragraph 3., eupra. Further, the corresponding paragraph asserts a conclusion of law which, pureuant to the apposite Pennsylvanla Rules of Civil Procedure, is deemed denied and at issue. Finally, because Defendant has no firsthand knowledge of the alleged accident or of what plaintiff was doing at the time, that averment in the corresponding paragraph is also expressly denied. 5. Denied. See Paragraph 4., supra. Further, all allegations respecting any accumulation of snow and ice on the ground are expressly denied. Finally, Defendant incorporates herein by reference thereto its Answer and New Matter, infra, as though delineated in extenso. 6. Denied; see paragraph 5., supra. 7. Denied; see Paragraphs 4. through 6., supra. B. Denied; all allegations respecting Plaintiff's injuries are expressly denied. By way of further denial, Defendant incorporates herein by reference thereto Paragraph 7., supra, ae though delineated in extenso. 9. Denied. All allegations of negligence, carelessness aJld recklessness on the part of Defendant, either directly or vicariously, are expressly denied. It is expressly denied by Defendant that any persons unidentified by Plaintiff in his Complaint were its agents, servants and/or employees acting within the course and scope of their ~gency or employment, until Defendant is given a reasonable opportunity to admit or deny agency. Strict proof of all of the allegations in the corresponding paragraph ie demanded at the trial of this cause. 10. Deniedl see Paragraphs 6. through 9., supra. 11. Denied. All a11egatione of misconduct or tortiousness on the part of Defendant, either directly or vicariously, are expressly denied. All allegations respecting Plaintiff' s injuries and consequential claims are expressly denied. All Allegations respecting Plaintiff's injuries, losses, diminutions, restrictions, medicbl expenees and consequential claims are expressly denied. Strict proof of all of the allegations in the corresponding paragraph is demanded at the trial of this cause. WHEREFORE, Defendant demands judgment in its favor. NEW MATTER 13. If it is determined that Defendant is liable on Plaintiff's cause of action, it avers that his recovery should be eliminated or reduced in accordance with the Pennsylvania 'Comparative Negligence Act, 42 Pa.C.S.A. Section 7102. 14. It is further averred by the Defendant that if Plaintiff suffered any injuries and/or damages as alleged, they were caused solely and primarily by his own carelessness, negligence andlor recklessness. Therefore, Plaintiff has no cause of action whatsoever agAinst Defendant. 15. It is further averred by Defendant that if Plaintiff suffered any injuries andlor damages as ~lleged, they were caused solely and primarily by the carelessness, negligence &nd/or recklessness of third parties, both unknown to it and over whom it had no control. Therefore, Plainti f f has no cause of action whatsoever against Defendant. 16. It is further averred by Defendant that if Plaintiff suffered any injuries and/or damages as alleged, he, by his own conduct, assumed the risk of those injuries and/or damages. Therefore, Plaintiff has no cause of action whatsoever against Defendant. 17. If, as alleged by Plaintiff, there was a dangeroul and/or slippery condi tion on the subject premises which proximately .caused his mishap, Defendant neither knew of it nor had a reasonable opportunity to discover it. and rectify the situation beforehand. Therefore, Plaintiff has no cause of action whatsoever against Defendant. 18. If, as alleged by Plaintiff, there was a dangerous and/or slippery condition on the subject premises which proximately caused his mishap, he should have seen it and averted it. His failure to do so constitutes negligence as a matter of law and bars any recovery. 19. It is believed and therefore averred by Defendant that there was no accumulation of snow and ice on the subject premises which proximately caused Plaintiff's mishap. Rather, it was actually snowing at the time and any dangerous and/or slippery condition were due to the falling snow not the result of any tortiousness on the part of Defendant. Therefore, Plaintiff has no cause of action whatsoever against Defendant. 20, The correct legal entity is Octagon Associate., it being a PennBylvania limited partnership which owns and operates the Belle Terre apartments. Plaintiff's cause of action, if any, can only be against Octagon Associates. There is no legal entity known 88 octagon Associates, d/b/a Belle Terre/Nanroc Apartment Complex. 21. Plainti ff did not fall and injure h lmself on property which Defendant owned, possessed, controlled, occupied or maintained or for which it was in any way responsible. Therefore, Plaintiff has no cause of action whatsoever against Defendant. 22. Defendant asserts all of the defenses, limitations and provisions of the lease between it and plaintiff as though delineated in extenso. 23. Defendant asserts that at the time and place referenced by Plaintiff in his complaint, an emergency situation had developed which was not engendered by it and, therefore, it cannot be held liable on his cause of action. 24. It is further averred by Defendant that Plaintiff's cause of action is barred by the apposite statute of limitations. 25. In the event Plaintiff requests damages for delay pursuant to Pennsylvania Rule 238, Defendant challenges the applicability and constitutionality of said Rule and places it at . issue. CIVIL 1994 CIVIL ACTION LAW JURY TRIAL DEMANDED COICl)LAIIIT 1. The Plaintiff, WILLIAM L. HYNOSKY, is an adult individual residing at 611-A Geneva Drive, Apt. 21, Mechanicsburg, Cumberland county, Pennsylvania 17055. 2. The Defendant is OCTAGON ASSOCIA'r:::s, who operates an apartment complex known as the BEI,LE TERRE/NANROCK APARTMENT COMPLEX with its principal office located at 613-A Geneva Drive, Mechanicsburg, Cumberland county, Pennsylvania 17055. 3. At all times material hereto, Defendant owned, possessed, operated, and maintained and/or controlled the Belle Terre/Nanrock Apartment Complex in Mechanicsburg, Pennsyl vania, including the roads, walkways, parking lots and other common areas. 4. At all times material hereto, Plaintiff leased Belle Terre Apartment No. 21, which is located in the Belle Terre/Nanrock Apartment Complex, from the Defendant, and, at all times material hereto, was rightfully and lawfully on or about the Defendant's premises. 5. On or about January 7, 1994, Plaintiff was exiting his vehicle in the parking lot of the Belle Terre Apartments, when he was caused to slip and fall on snow and ice which had previously accumulated on the ground. 6. At all times material hereto, Defendant knew or had reason to know ot the dangerous ice and snow acoumulation in the parking lot and the slippery condition of the parking lot due to the accumulated snow and ice. 7. The Detendant was responsible for the removal of snow and ice accumulation in the common parking lot used by all tenants. 8. plaintiff's injuries were due in no way to any act Or failure to act on his part. 9. As a result of the accident, which is due to the negligence, carelessness and recklessness of the Detendant, acting through its agents, servants and/or employees within the course and scope of their agency or employment, Plaintitf suffered injuries as are more fully set forth below. 10. The negl igence, carelessness and recklessness of Defendant, included but was not limited to: a. Failing to properly and adequately remove ice from the aforesaid parking lot, where Defendant knew or should have known persons such as Plaintiff would be walking; b. Allowing a dangerous condition to exist without due regard to the rights and safety of persons such as Plaintiff ; c. Failing to correct said dangerous condition; d. Failing to warn of said dangerous condition; e. Failing to keep the subject property free and clear of dangerous substances; f. Failing to arrange for competent and/or qualified snow and ioe removal servioe, g. Failing to insure the reasonable removal of alippery substances from the parking lot area, h. Failing to arrange for salting or cindering of the parking lot area. 11. solely as a result of the Defendant's misoonduct, Plaintiff sustained serious injuries, inoluding but not limited to, oontusion to right knee with tear of the right medial collateral ligament, pain and suffering, injuries to muscles, bones, tendons, ligaments, nerves and fascia, mental and emotional distress, some or all of which are or may be continuing in nature. 12. As a result of those injuries, Plaintiff suffered lost earnings and/or loss of earning capacity, a restriction of his activities and loss of life's pleasures, and has expended sums of money for medical care and treatment, rehabilitation and assistance, some of which are or may be continuing in nature.
