MYERS, Defendants IN REI PRE-TRIAL CONFERENCE At a pre-trial conferenoe held Wednesday, April 30, 1997, on the above-captioned oase before the Honorable Harold E. Sheely, President Judge; preBent for Plaintiff, shirley H. Hess, was Joseph E. Dixon, Esquire; present for the Defendants, Darvin M, Hyers and Cheryl H. Hyers, was stephen L. Banko, Jr, Esquire. This is a jury trial which should take two days to complete. It was continued from the last term by order of Judge Bayley since Mr. Banko had several cases on the trial list. I would recommend that we start with this case in Courtroom 1 for that reason. This case arises from a motor vehicle accident which occurred in Cumberland county on August 3rd, 1992, and it is alleged that the Defendants struck the Plaintiff from the rear. Liability has been admitted in this case so the only issue will be on damages. The only damages claimed by the Plaintiff are physical pain and suftering, mental anguish, discomfort, inconvenience, distress, embarassment and humiliatl.on, and loss of life's pleasures. There is no claim for lost wages or any ~ future loss of earning capacity, plaintiff had $100,000.00 medical insurance coverage with ner own carrier, and I was informed that as of this date only $14,000,00 in medical bills have been paid. Plaintiff indicated that there ie a large number of medical bills that ~emain to be paid, but apparently for some reason her carrier has refused to pay them, and she is seeking to have the bills presented at trial. I would ask for a memo from the plaintiff's counsel and defense counsel on that issue as to whether or not she is entitled to recover any medical expenses in this trial since Plaintiff had sufficient insurance coverage from her own carrier to pay the bills that have not been paid. Plaintiff proposes to call all of her expert witnesses in person at trial, and most of Defendants' expert witness will be by videotape, although some may be called in person at trial. According to the Plaintiff's pre-trial memo, the problems in this case to Plaintiff, shirley M. Hess, have resulted from a closed head injury and soft tissue injuries. She claims difficulties have continued since the time of the accident and will continue in the future. Plaintiff was about 40 years of age at the time of the accident and was divorced. Apparently during the marriage she assisted her husband doing tax work, and it was noted at the pre-trial conference that even though they are divorced that they are apparently now back living together. MYBRS, I I Defendants I JURY TRIAL DEMANDED PRE-TRIAL MEMORANDUM This case is a motor vehicle accident case in which there i. clear 100 percent liability with the Defendant, Darvin M. Myers. Despite the fact that the Plaintiff was rear-ended while making a left hand turn by a vehicle driving at an unoafe speed, the Defendant, Darvin M. Myers, to date has not otipulated as to liability. Therefore, evidence will be presented at the trial to prove the liability of the Defendant, Darvin M. Myers, J.n this CA8e. Concerning damages, the Plaintiff suffered from a closed head injury, as well as soft tillsue injuries. The Plaintiff has residual cognitive difficulties and has been disabled since the time of the accident. In addition, the Plaintiff has residual physical problems from the accident. The principal issue in this case is the extent of the damage.. This author doe. not feel the Defendants seriously are contesting the liability issue, but they, of course, can speak for them.elve.. Myers was negligent i.n the operation of his motor vehicle by failing to be able to bring his vehicle to a stop within the assured clear distance ahead. The facts and occurrences herein took place on August 3, 1992, at approximately 4100 P.M. on Silver Spring Road near the intersection of Basehore Road in Silver Spring Township, Cumberland County, Pennsylvania, 5. At afore.aid time and place, the Defendant, Darvin M. Myer., was driving a 1987 Pontiac Sunbird owned by the Defendant, Cheryl M. Myers. 6. At all times material hereto, the Defendant, Cheryl M. Myers, had given permission and consent to the Defenaant, Darvin M. Myer., to operate said motor vehicle at said time and place. 7. At all times material hereto, the Defendant, Darvin M. Myers, had the authority both real and apparent to act on behalf of and drive the motor vehicle of the Defendant, Cheryl M. Myers. 8. At aforesaid time and place, the Plaintiff was driving a 1991 Chevrolet Prism motor vehicle owned by her son, James Hess, II. 9. At aforesaid time and place, the Plaintiff was traveling in a southerly direction on Silver Spring Road when she stopped to make a left-hand turn into a private driveway. lO. At said time and place, the Plaintiff utilized her left- hand turn signal and was waiting for traffic to clear before she made the turn. ll. At aforesaid time and place, the Defendant, Darvin M. Myers, was traveling in a southerly directipn on Silver Sprin9 Road. 2 12. At afore.aid time and place, the Defendant, Darvin M. MyerB, turned onto the berm of the road to pass a tractor/trailer which had stopped to make a left-hand turn onto Basehore Road. l3. After passing the tractor/trailer on the berm of the road, the Defendant, Darvin M. Myers, re-entered the southerly lane of traffic on Silver Spring Road and struck the rear portion of the motor vehicle driven by the Plaintiff. 14. As a result of said collision, exten3ive damage oocurred to the Plaintiff's vehicle, including the breaking of the Plaintiff's seat in her motor vehicle. 15. As a result of said collision, the Plaintiff sustained severe personal injuries and damages whioh are more particularly described herein. 16. Said oollision was due to the negligence and carelessness of the Defendant, Darvin M. Myers, as more particularly described below in this Complaint. l7. Said collision was in no way caused by the conduct of the Plaintiff. 18. As a sole and proximate result of the negligence of the Defendant, Darvin M. Myers, the Plaintiff has suffered severe and permanent injuries. These injuries include, but are not limited to, a concussion, closed head injury, brain injury, headaches, 3 blurred vision, depression, post traumatJ.o stress disorder, inoontinenoe, right carpal tunnel syndrome, tingling in the right thumb, tingling in the fingers, ringing in the ears, right myooervioal sprain, lumbosaoral strain/sprain, oervioal strain/sprain, L-5, 8-1 herniated diso, cervical radioulopathy, lumbosacral radiculopathy, post traumatic cephalgia, cognitive deflcits, memory problems and myofascial pain syndrome. 19. As a result of said injuries, the Plaintiff has undergone in the past and will in the future undergo great pain and .uffering. 20. As a result of sald injuries, the Plaintiff has been advised and therefore avers that she will always have continuing problems and limitations in her personal and professional activities. 21. As a result of said injuries, the Plaintiff has been obliged to receive 6nd undergo medical care and spend various sums of money and incur various expenses for the injuries she suffered. The total amount of these losses is unascertained at this time. 22. As a result of sald injuries, the Plaintiff has lost substantial lost wages to date. In addition, she continues to lose 4 lo.t wage. and opportunitie. to earn additional wage.. The total amount of thi. lo.s is una.certained at thie time. 23.
