says he made diligent seat"ch and inquiry to locate one of tho within
named defendants, to wit, Cameron W. Carswell but was unable to
locate him in his hailiwick. lie thot"efore deputized the Sheriff of
Pert"y County, Pennsylvania to set"ve the within Real Estate Writ,
Notice, Poster and Dosct"iption accot"ding to law.

duly sworn according to law, says that he made a diligent search and
inquit"y for the within named defendant, to wit, Cameron W. Cat"swell
but was unable to locate him in his bailiwick. He therefore returns
the Writ, Notice, Poster and Description NO'r FOUND as to the within
named defendant, Cameron W. Carswell. So answers, George W.
Frownfelter,Sheriff of Perry County, Pennsylvania.

defendants, to wit, Cameron W. Carswell but was unable to locate him
in his bailiwick. He therefore deputized the Sheriff of Dauphin
County, Pennsylvania to serve the within Real Estate Writ, Notice,
Poster and Description according to law.

Cameron W, Carswell by personally handing to Cameron W. Carswell a
true attested copy of the original Real Estate Writ, Notice Poster &
Description and making known to him the contents thereof at 475 Main
Street, Steelton, Dauphin County, Pa. 17113. So answers, William H.
Livingston Sheriff of Dauphin County, Pa, by Deputy Sheriff.
Dauphin County return hereto attached.

says that he served Real Estate Writ, Notice, Poster and Description
in the following manner. The Sheriff mailed one of the within named
defendants, to wit. Cameron W. Carswell a notice of the pendency of
the action by certified mail marked DELIVERY ONLY TO ADDRESSEE, to
his last known address at 55 Parkway Drive #55, Liverpool, Pa. 17045-
9655. This letter was mailed under the date of ,January 4, 1995 and
was returned to the Sheriff's Office on January 23, 1995 with reason
marked FORWARDING ORDER EXPIRED. Letter is hereto at tached unopened.

Jennie P. Carswell by making known unto Jennie D, Carswell at 32 S.
Enoia Drive, Enola, Cumberland county, Pennsylvania, its contents and
at the same time handing to her personally the said true and attested
copy of the same.

says that he served the above Real Estate Writ, Notice, Poster and
Description in the following manner, The Sheriff mailed one of the
within named defendants, to wit! .Jennie P. Carswell a notice of the

that after due and legal notice had been given according to law, exposed
the within described premises at public venue or outcry at the Court
House, Carlisle, Cumberland County, Pennsylvania on March 8, 1995 at
10100 o'clock A.M., E.S.T., and Bold the same for the sum of $30,000.00
to Attorney Leon Haller for The Secretary of Housing and Urban Pevelopment
of Washington D, C., Its successors and assigsn. It being highest bid and
the best price received for the same The Secretary of Housing and Urban
Development of Washington D. C., Its successors and assigns at The
Wanamaker Building 100 Penn Square East, Philadelphia, Pa. 19107-3390
being the buyer in this Execution paid Sheriff R. Thomas Kline the

I. Plaintiff, MARGARETTEN & COMPANY, INC" F/K/A NATIONSBANC
MORTGAGE CORPORATION OF VIRGINIA, F/K/A SOVRAN MORTGAGE CORPORATION,
is a corporation having an office at P. O. Box 26388, Richmond,
Virginia 23260-6388.
2. Defendants, CAMERON W. CARSWELL and JENNIE D. CARSWELL, are
both adult individuals whose last known address is 333 West Perry
Street, Enola, PA 17025.
3. On or about July 20, 1989, the said Defendants executed and
delivered a Mortgage Note in the sum of $53,145.00 payable to SOVRAN
MORTGAGE CORPORATION (NOW MARGARETTEN & COMPANY, INC.), which Note is
attached hereto and marked Exhibit "A".
4. Contemporaneously with and at the time of the execution of the
aforesaid Mortgage Note, in order to secure payment of the same,
Defendants made, executed and delivered to original Mortgagee, a
certain real estate Mortgage which is recorded in the Recorder of
Deeds Office of the within County and Commonwealth in Mortgage Book
946, Pg. 352 conveying to original Mortgagee the subject premises.
said mortgage is incorporated herein by reference.
5. The land subject to the Mortgage is: 333 West Perry Street,
Enola, PA 17025, and is more particularly descI'ibed in Exhibit "B"
attached hereto.
6. The said Defendants are the real owners of the land subject to
the Mortgage.
7. The Mortgage is in default due to the fact that Mortgagors have
failed to pay the installment due on January 1, 1994, and all
subsequent installments thereon, and the following amounts are due on
the Mortgage:
(a) Unpaid principal balance
(b) Interest at $14.14 per day
from 12/1/93 to 8/15/94
(based on contract rate of 10.0\)

*Together with interest at the per diem rate noted in (b) above after

The attorney's fees set forth above are in conformity with the
Mortgage documentfl and Pennsylvania law, and will be collected in the
event of a third party purchaser at Sheriff's Sale. If the Mortgage
is reinstated prior to the sale, reasonable attorney's fees will be
charged that are actually incurred by Plaintiff.
8. No judgment has been entered upon said Mortgage in any
j urisdict ion.
9. Notice of intention to foreclose and to accelerate the loan
balance pursuant to Pennsylvania Act No. 6 of 1974 is not required in
that the original principal balance exceeds $50,000.00.
10. Defendants are not members of the Armed Forces of the United

1. Plaintiff, MARGARETTEN & COMPANY, INC., F/K/A NATIONSBANC
MORTGAGE CORPORA'l'ION OF VIRGINIA, F/K/A SOVRAN MORTGAGE CORPORATION,
is a corporation having an office at P. O. Box 26388, Richmond,
Virginia 23260-6388.
2. Defendants, CAMERON W. CARSWELL and JENNIE D. CARSWELL, are
both adult individuals whose last known address is 333 West Perry
Street, Enola, PA 17025.
3. On or about July 20, 1989, the said Defendants executed and
delivered a Mortgage Note in the sum of $53,145.00 payable to SOVRAN
MORTGAGE CORPORATION (NOW MARGARETTEN & COMPANY, INC.), which Note is
attached hereto and marked Exhibit "A".
4. Contemporaneously with and at the time of the execution of the
aforesaid Mortgage Note, in order to secure payment of the same,
Defendants made, executed and delivered to original Mortgagee, a
certain real estate Mortgage which is recorded in the Recorder of
Deeds Office of the within County and Commonwealth in Mortgage Book
946, Pg. 352 conveying to original Mortgagee the subject premises.
Said mortgage is incorporated herein by reference.
S. The land subject to the Mortgage is: 333 West Perry Street,
Enola, PA 17025, and is more particularly described in Exhibit "B"
attached herllto.
6. The said Defendants are the real owners of the land subject to
the Mortgage.
7. The Mortgage is in default due to the fact that Mortgagors have
failed to pay the installment due on January 1, 1994, and all
subsequent installments thereon, and the following amounts are due on
the Mortgage,
(a) Unpaid principal balance
(b) Interest at $14.14 per day
from 12/1/93 to 8/15/94
(based on contract rate of 10.0\)

*Together with interest at the per diem rate noted in (b) above after
August 15, 1994 and other charges and costs to date of Sheriff's
Sale.
The attorney's fees set forth above are in conformity with the
Mortgage documents and Pennsylvania law, and will be collected in the
event of a third party purchaser at Sheriff's Sale. If the Mortgage
is reinstated prior to the sale, reasonable attorney's fees will be
charged that are actually incurred by Plaintiff.
8. No judgment has been entered upon said Mortgage in any
jurisdiction.
9. Notice of intention to foreclose and to accelerate the loan
balance pursuant to Pennsylvania Act No. 6 of 1974 is not required in
that the original principal balance exceeds $50,000.00.
10. Defendants are not members of the Armed Forces of the United

1. Plaintiff, MARGARETTEN & COMPANY, INC., F/K/A NATIONSBANC
MORTGAGE CORPORA'l'ION OF VIRGINIA, F/K/A SOVRAN MORTGAGE CORPORA'nON,
is a corporation having an office at P. O. Box 26388, Richmond,
Virginia 23260-6388.
2. Defendants, CAMERON W. CARSWELL and JENNIE D. CARSWELL, are
both adult individuals whose last known address is 333 West Perry
Street, Enola, PA 17025.
3. On or about July 20, 1989, the said Defendants executed and
delivered a Mortgage Note in the sum of $53,145.00 payable to SOVRAN
MORTGAGE CORPORATION (NOW MARGARETTEN & COMPANY, INC.), which N~te is
attached hereto and marked Exhibit "A".
4. Contemporaneously with and at the time of the execution of the
aforesaid Mortgage Note, in order to secure payment of the same,
Defendants made, executed and delivered to original Mortgagee, a
certain real estate Mortgage which is recorded in the Recorder of
Deeds Office of the within County and Commonwealth in Mortgage Book
946, Pg. 352 conveying to original Mortgagee the subject premises.
Said mortgage is incorporated herein by reference.
5. The land subject to the Mortgage is: 333 West Perry Street,
Enola, PA 17025, and is more particularly described in Exhibit "B"
attached hereto.
6. The said Defendants are the real owners of the land subject to
the Mortgage.
7. The Mortgage is in default due to the fact that Mortgagors have
failed to pay the installment due on January 1, 1994, and all
subsequent installments thereon, and the following amounts are due on
the Mortgage;
(a) Unpaid principal balance
(b) Interest at $14.14 per day'
from 12/1/93 to 8/15/94
(based on contract rate of 10.0\)

event of a third party purchaser at sheriff's Sale. If the Mortgage
is reinstated prior to the sale, reasonable attorney's fees will be
charged that are a~tually incurred by Plaintiff.
8. No judgment has been entered upon said Mortgage in any
j urisdict ion.
9. Notice of intention to foreclose and to accelerate the loan
balance pursuant to Pennsylvania Act No. 6 of 1974 is not required in
that the original principal balance exceeds $50,000.00.

5. The land subject to the Mortgage is: 333 West Perry Street,
Enola, PA 17025, and is more particularly described in Exhibit "B"
attached hereto.
6. The said Defendants are the real owners of the land subject to
the Mortgage,
7. The Mortgage is in default due to the fact that Mortgagors have
failed to pay the installment due on Jlnuary 1, 1994, and all
subsequent installments thereon, and tha following amounts are due on
the Mortgage I
(a) Unpaid principal balance
(b) Interest at $14.14 per day
from 12/1/93 to 8/15/94
(based on contract rate of 10.0%)
