HARRY B. CLARK, t/d/b/a JOY-ARK BUILDERS, Contractor, party
of the second part.
WITNESSETH:
WHEREAS, the above parties entered into a contract whereby
the party of the second part is to provide certain materials and
perform certain work necessary for the erection and construction
of a split level frame and aluminum siding single family dwelling
house with two-car integral garage upon ground more particularly
bounded and described on SchedUle A which is attached hereto and
made a part hereof.
NOW, THEREFORE, it is hereby stipulated and agreed by and
between the said parties, as part of the said contract, and in
consideration of the above recitals and in consideration of One

Dollar ($1.00) in hand paid by the said party of the first part
to the said party of the second part, that neither the
undersigned contractor, or any subcontractor or materialmen, nor
any other person furnishing labor or materials to the said
contractor under this contract, nor any other person whatsoever,
shall file a lien, commonly called a mechanic's lien, for work
done or materials furnished to the said building or any part
thereof.
IN WITNESS WHEREOF, the said parties hereto, intending to be
legally bound hereby, have hereunto set their hands and seals the
day and year first above written.

SCHBDULE a
ALL THAT CERTAIN lot or parcel of land situate in East
Pennsboro Township, Cumberland County, Pennsylvania, more
particularly bounded and described as follows, to wit:
BEGINNING at a point on the eastern right-of-way line of
Pepper Avenue at the line dividing Lot No. 1 and Lot No. 2 on the
hereinafter mentioned Plan of Lots; thence by said dividing line
North 58 degrees 30 minutes 00 seconds East a distance of 200.00
feet to a point at the line of lands now or formerly of stanley
M. and Rachel V. Kuhn; thence by the line of said lands of Kuhn
North 31 degrees 30 minutes 00 seconds West a distance of 38.16
feet to a point; thence continuing by the line of said lands of
Kuhn South 82 degrees 50 minutes 00 seconds West a distance of
219.50 feet to a point on the eastern right-of-way line of Pepper
Avenue; thence by the eastern right-of-way line of Pepper Avenue
South 31 degrees 30 minutes 00 seconds East a distance of 273.60
feet to the point and place of BEGINNING.
CONTAINING 16,675.93 square feet, more or less, and being
Lot No. 2 on the preliminary/Final Subdivision Plan for Thomas V.
and Betty M. Olsen dated 17 May 1994, revised 6 June 1994, and
recorded in the Office of the Recorder of Deeds in and for
Cumberland county, Pennsylvania, in Plan Book 68, page 42.
BEING the same premises which Thomas V. Olsen and Betty M.
Olsen, his wife, by their deed dated 20 July 1994 and recorded in
the Office of the Recorder of Deeds in and for Cumberland county,
Pennsylvania, in Deed Book 108, page 929, granted and conveyed
unto Thomas L. Olsen.
BEING also the same premises which Thomas V. Olsen and Betty M.
Olsen, his wife, by their corrective deed dated 22 July 1994 and
intended to be contemporaneously recorded in the Office of the
Recorder of Deeds in and for Cumberland County, Pennsylvania,
granted and conveyed unto Thomas L. Olsen.
