COMPLAINT
1. The plaintiff, Jeffrey Duncan, is an individual residing
at 100-8 South First Street, Lemoyne, Cumberland County, Pa. 17402.
2. The defendant, Ronald Zerance, is an individual residing
at 1027 Swarthmore Dr., New Cumberland, Pa. 17070.
3. On January 7,1994, the plaintiff was the owner of a 1985
Jeep CJ-7.
4. At or about 1150 P.M. on the aforesaid date, the plaintiff
was operating the said Jeep in a southern direction on Interstate
83 in Harrisburg, Pa.
5. At the same time and place, the defendant was traveling
directly behind the plaintiff in a 1991 Ford Pickup.
6. The defendant was operating his Ford Pickup at an unsafe
speed for the icy road conditions, and was unable to avoid
colliding with the plaintiff's Jeep after the plaintiff had lost
control, and his said jeep slid sideways and stalled. If the
defendant had operated his said pickup at a safe speed for the icy
road conditions, he would have been able to avoid the collision.
7. The collision was due to the negligence of the defendant
in the following respects 1
a. In traveling at an unsafe speed for the icy road
conditions.
b. In failing to operate his vehicle in a safe and
prudent manner.

c. In failing to keep adequate control of his vehicle
considering the inclement weather conditions.
7. As a result of the negligence of the defendant, the
plaintiff sustained $1,222.39 in damages to his said 1986 Jeep CJ-7
as is more fully set forth in the attached Exhibit A.
WHEREFORE, the plaintiff claims of the defendant the sum of
$1,222.39, an amount requiring compulsory referral to arbitration
under the local rules of court.
