wit: James W. Herrold, but was unable to locate him in his bailiwick. He
therefore deputized the Sheriff of Snyder County, Pennsylvania, to serve the
within Summons in Civil Action Law according to law.
SNYDER COUNTY RETURN: Now, August 4, 1994 at 3:45 o'clock P.M.,
served the within Writ of Summons, upon James W. Herrold at Snyder County
Sheriff's Office, l2 South Main Street, Middleburg, Snyder County,

PLAINTIFF'S COMPLAINT
AND NOW, come the Plaintiffs, Sara A. Hanlon a/k/a Sally
Hanlon and her husband John T. Hanlon, by and through their
counsel Thomas M. Devlin and aver the following Complaint against
Defendants as follows:
1. Plaintiffs, Sara A. Hanlon a/k/a Sally Hanlon and John
T. Hanlon, husband and wife, are adult individuals who reside at
12916 Cohasset Lane, Woodbridge, Virginia 22192.
2. Defendant James W. Herrold is an adult individual who is
believed to reside at R.D. #1, Box 13, Port Trevorton, Snyder
County, Pennsylvania.
3. Defendant Weis Markets, Inc. is believed to be a
Pennsylvania corporation with headquarters at 1000 South Second
Street, P.O. Box 471, Sunbury, Pennsylvania.
4. At all relevant times pertaining to the averments of
this Complaint, Defendant James W. Herrold was a representative,
agent or employee of Defendant Weis Markets, Inc.
5. On or about August 6, 1992, James W. Herrold was
traveling north driving a 1982 Ford 9,000 truck tractor and a
1986 Great Dane semi-trailer, both owned by Defendant Weis
Markets, Inc. as he was approaching the intersection of U.S.
Route 15 and Lisburn Road, in Cumberland County, Pennsylvania.
G. As Defendant James W. Herrold approached the
intersection of U.S. Route 15 and Lisburn Road, he failed to see
other vehicular units which were stopped for a red traffic light
at that intersection and subsequently collided with the vehicle
owned and driven by Wendy Sue Looker forcing that vehicle into
the rear of the vehicle in front of her which was the vehicle
driven by Plaintiff John T. Hanlon, forcing the Hanlon vehicle
into and underneath the vehicle owned by Shirley M. Corman and C.
A. Overcash, Jr. and driven on that occasion by Clarence
Overcash, Jr. Then the tractor trailer driven by James W.
Herrold again caused a second collision with the Hanlon vehicle.
7. As a result of the collisions, Plaintiff Sara Hanlon,
who was reclining in the back seat of the vehicle driven by her
husband, was violently thrown about the backseat of the vehicle
and was temporarily trapped in the backseat in her seatbelt.
8. As a result of the collision, Sara Hanlon suffered
injury to her back, neck and skull and was impaled by glass
shards. She also experienced bleeding in her urine, experienced
pain and numbness in both of her arms, and dizziness, as well as
great pain, embarrassment and emotional distress in the aftermath
of the collision.
COUNT I - NEGLIGENCE
SARA A. HANLON a/k/a SALLY HANLON AND
JOHN T. HANLON V. JAMES W. HERROLD
9. Plaintiffs herein incorporate by reference their
allegations in paragraphs 1 through 8 inclusive as if fully set
forth herein at length.
10. Said accident was directly and proximately caused by
the negligence, wantonness, and recklessness of Defendant James
W. Herrold consisting, among other things, of the following:
a. Failing to have his vehicle under proper control;
b. Failing to exercise due care for the safety of
Plaintiffs and Plaintiffs' property;
c. Failing to make necessary and reasonable observations of
roadway conditions;
d. Failing to stop in time to prevent collision with
Plaintiffs' vehicle;
e. Following the vehicle driven by Wendy Sue Looker too
closely;
f. Traveling at an excessive rate of speed;
g. Traveling too fast for the conditions then existing;
h. Traveling at an unsafe speed such that he was unable to
bring his vehicle to a stop within the assured clear distance
ahead, in violation of the assured clear distance rule;
i. Negligence per se for violating the safe speed
provisions of 75 Pa.C.S.A. ~3361 ("driving a vehicle at safe
speed") ;
j. Negligence per se for following the vehicle driven by
Wendy Sue Looker more closely than what was reasonable and
prudent and failing to have due regard for the speed of the
vehicles and the traffic upon the condition of the highway in
conjunction with the condition of the tractor trailer he was
driving in violation of 75 Pa.C.S.A. ~3310; and
k. Negligence per se because he knew or should have known
that his vehicle's brake system was substandard and failing to
meet the Pennsylvania inspection requirements inasmuch as there
was a severe air leak from the brakes in the tractor unrelated to
the damage from the collision itself, with the leak emanating
from the third axle left side type 30 clap brake chamber in
violation of 75 Pa.C.S.A. ~4107.
WHEREFORE, Plaintiffs demand judgment against Defendant
James W. Herrold in an amount in excess of $20,000.00 together
with interest, damages for delay, costs and such other
recoverable damages which the law will allow.
COUNT II - NEGLIGENCE
SARA A. HANLON a/k/a SALLY HANLON AND
JOHN T. HANLON V. WEIS MARKETS, INC.
11. Plaintiffs herein incorporate by reference their
allegations in paragraphs 1 through 10 inclusive as if fully set
forth herein at length.
12. In addition, said accident was directly and proximately
caused by the negligence, wantonness, and recklessness of
Defendant Weis Markets, Inc. and consisting but not limited to
the following:
a. Negligent supervision of its driver, James W. Herrold;
b. Negligent entrustment of the tractor trailer in question
to James W. Herrold;
c. Failing to properly maintenance the tractor trailer,
including but not limited to, failure to adequately maintenance
and have inspected the tractor brake system; and
d. Negligence per se of 75 Pa.C.S.A !H107 ("unlawful
activities - violation of vehicle equipment standards and other
violations under said section").
13. At all relevant times hereto, Defendant James W.
Herrold was acting on behalf of Weis Markets, Inc. in his
capacity as representative, agent or employee of Weis Markets,
Inc.
WHEREFORE, Plaintiffs demand judgment against Defendant Weis
Markets, Inc. in an amount in excess of $20,000.00 together with
interest, damages for delay, costs and such other recoverable
damages which the law will allow.
COUNT III
SARA A. HANLON a/k/a SALLY HANLON V.
JAMES W. HERROLD AND WEIS MARKETS, INC.
14. Plaintiff Sara A. Hanlon incorporates by reference
paragraphs 1 through 13 inclusive as if fully set forth herein at
length.
15. As a result of aforesaid accident, the injuries set
forth herein were sustained by Plaintiff Sara A. Hanlon a/k/a
Sally Hanlon as a direct and proximate result of the careless,
negligent and wanton behavior of Defendants.
16. As a direct result of aforesaid accident, Plaintiff
Sara A. Hanlon has sustained the following personal injuries,
including but not limited to:
a. Bumps, bruises and contusions;
b. Injury to her back, neck and skull;
c. Impalement of her skin with glass shards;
d. Internal injuries resulting in blood in her urine;
e. Numbness in both her arms and dizziness;
f. Severe pain in her neck and back;
g. Chronic conditions of moderate to severe pain in her
neck;
h. Severe upper back pain, having a dull to sharp quality
equal on both sides;
i. Pain in the shoulders radiating at the base of the
skull, neck and left shoulder;
j. Headaches, neck pain, stiffness, insomnia, dizziness,
heaviness feeling to her head and shoulders, pins and needles
sensation in her arms, extreme fatigue and buzzing in her ears;
k. Additionally, she has experienced cervical subluxation
with acute paravertibral spasms and acute cervical sprain and
strain with attendant myalgia of the extensor muscles of the
cervical spine, and traumatic insult to the soft tissues in the
neck and immediate cervical paravertibral musculature;
1. Subluxation complex of the cervical region with
radiating pain to the skull via the cervical plexus
"radiculitis", acute traumatic cervical sprain and strain
associated with cervicalgia and cephalalgia complicated by
subluxation complex of the cervical spine;
m. Aggravation of pre-existing conditions, which were
nondisabling or asymptomatic until they were aggravated by the
accident, and therefore she has an aggravation of her pre-
existing conditions of cervical spondylosis and arthritic
conditions;
and
n. Myofascial pain syndrome causing tightness and spasms;
o. Aggravation and exacerbation of her preexisting medical
problems as a result of chemotherapy which have added to her
distress.
17. By reason of the negligence of the Defendants, Sara
Hanlon has or will incur and continue to incur various expenses
for the care and treatment of said injuries, including but not
limited to, medications, physical therapy or chiropractic
treatments, and therefore she has incurred and will incur major
medical expenses.
lB. As a direct result of the negligence of the Defendants,
Sara Hanlon has suffered past and will suffer future pain,
sUffering, embarrassment, humiliation, mental anguish and past
and future loss of life's enjoyment.
WHEREFORE, Plaintiffs respectfully request that judgment be
entered against Defendants and in favor of Plaintiffs in an
amount in excess of $20,000.00 plus interest, damages for delay,
costs and such other recoverable expenses to which they may be
entitled under the law.

20. As a result of aforesaid accident, the injuries set
forth hereinafter were sustained by John T. Hanlon as the direct
and proximate result of the careless and negligent behavior of
Defendants.
21. As a direct result of the aforesaid accident, Plaintiff
John T. Hanlon has sustained and will continue to sustain for
some time in the future the following injuries, including but not
limited to:
a. Loss of consortium with his wife Sara A. Hanlon by
disruption of their normal marital relations;
b. He has had to take up most of the heavy lifting or
reaching within the household and many if not most of the
household tasks;
c. Because of his wife's condition, John T. Hanlon has had
to drive his wife to and from doctors' visits incurring costs and
expenses; and
d. In addition, John T. Hanlon has had work loss due to the
necessity of having to care for his wife and drive her to
doctors' visits.
WHEREFORE, John T. Hanlon respectfully requests that
judgment be entered Defendants and in favor of Plaintiffs in an
amount in excess of $20,000.00 plus interest, damages for delay,
costs and such other recoverable expenses to which he may be
entitled to under the law.
