Keefer and Patricia Keefer LEA ANN WRAY, Plaintiff IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA vs. SLOAN ERIC ATKINS AND JEREMY WENGER AND ROSS KEEFER and PATRICIA KEEFER, hlw AND RE/MAX HOMEFINDERS, Defendants DOCKET NO. 94-4334 CIVIL ACTION LAW MOTION FOR SUMMARY JUDGMENT The Defendants, Ross Keefer and Patricia Keefer, hlw, by and through their counsel, Harrington, Kauffman & Shilling, hereby files this Motion for Summary Judgment and avers as follows: I. According to the allegations of Plaintifr s Complaint, Plaintiff was injured on or about August 3, 1992 when she was bitten by a dog owned by Defendants Atkins and Wenger. 2. As a result orthe aforesaid attack, the Plaintiff filed the instant suit against the two owners orthe dog, the owners orthe property from whom Atkins and Wenger rented the property and the real estate agency who acted as the agent for Defendants Keefer. 3. According to the allegations ofPlaintifrs Complaint, it is alleged that Defendants Keefer were not residing at the address where the alleged attack took place. 4. According to the Plalntifrs Complaint, Plaintiff's injury occurred as. reault of Defendants AtkIns and Wenger allowing their dog to roam freely on the premises without. properly lICCUI'ed leash, failing to adequately control. vicious dog and failing to warn Plaintift' of the dog's vicious nature. S. The lease agreement entered into between Defendants Keefer and Atkins specifically set forth the requirement that no pets were allowed on the property. See the Lease Agreement which is marked as Exhibit "A," attached hereto and made a part hereof. 6. As a result of Defendants Keefer finding out about the dog on the premises, an action was filed on June 22, 1992 by Defendants ReIMax Homefinders VS. Atkins and Wenger. 7. The District Justice, on July 22, 1992, entered an order which stated, .intm: lIIiL that the dog was to be removed from the property. A copy of the notice of judgment and transcript is marked as Exhibit "B," attached hereto and made a part hereof. 8. All of the above-actions occurred prior to the alleged incident complained of in Plaintiff's Complaint. 9. The lease entered into between the Defendants Keefer and Defendants Atkins and Wenger stated in Paragraph 11 that Defendants Atkins and Wenger were responsible for providing their own confidence of liability insurance. 10. It has been agreed between counsel for Plaintiff and counsel for Defendants Ross Keefer and Patricia Keefer, h1w, that the Defendants Keefer were landlords out of possession and thus should not be a part of this action. 11. Despite counsel's representation, the Plaintiff has taken no action to dismiss Ross Keefer and Patricia Keefer, h1w, from this action. (" 12. Defendants Rosa Keefer and Patricia Keefer, hlw. were landlords out ofposaesaion of tho property upon which the Plaintiff contends she suffers injuries and thus arc not liable to tho Plaintiff for any damages she is alleged to have suffered u a result of this incident. WHEREFORE. since the Defendants Rosa Keefer and Patricia Keefer, hlw. were landlords out ofposscssion. had no obligation or legal liability to the Plaintiff, it is respectfiilly requested that this Honorable Court enter an order dismissing said Defendants from tho lawsuit. At all times material to plaintiff's cause of action, defendants permitted their dog to roam at large on his own and otherwise failed to restrain and control the animal. 12. At all times material to plaintiff's cause of action, defendants Atkins, Wenger, Keefer and Re/Max were aware that said dog had on previous occasions been involved in similar conduct and which fact is known by the defendants. 13. The defendants knew, or should have known, that the dog was of a dangerous and vicious nature and which by its breeding and training was accustomed to attacking and biting humans. 3 14. On or about August 3, 1992, Lea Ann Wray was acting In the course and scope of her employment as a meter person for PennElec, attempting to read the electric meter located on a property rented by defendants Atkins and Wenger, through defendant Re/Max, which was owned by defendants Keefer, namely 477% East King Street, Shlppensburg, Pennsylvania, when, as a result of defendants combined negligence and carelessness, In allowing the dog to roam freely on the premises, plaintiff was suddenly and without warning savagely attacked by defendants', Atkins and Wenger, dog. As a direct and proximate result of the negligence of defendants, plaintiff has suffered substantial physical Injuries along with mental pain and suffering and severe emotional distress and injury, more particularly hereinafter set forth. 15. The negligence and carelessness of the defendants consisted of the following: (a) Failing to regard the rights, safety and position of the plaintiff at the point aforesaid; (b) Failing to adequately control a vicious dog; (c) Failing to adequately control a dog which defendants knew, or should have known, had dangerous propensities; (d) Allowing their dog to roam freely on the premises without a properly secured leash; (e) Failing to warn plaintiff, and others similarly situated, of the dog's vicious nature; (f) Failing to adequately control or secure said dog In an area where plaintiff, 4 and other similarly situated, would be safe; (g) Failing to post signs warning of a vicious dog; (h) Allowing their dog to roam without restraints, when aware of propensity of dog to engage In similar conduct; (I) Violating the local ordinances and statutes of the Commonwealth of Pennsylvania pertaining to the above; 0) Being guilty of wilful, wanton and reckless misconduct In the foregoing; and (k) Being otherwise negligent and careless. 16. As a result of the aforesaid, plaintiff sustained Injury to her torso and upper and lower extremities, their bones, cells, tissues, nerves, muscles and functions, including puncture wounds to her right upper thigh, left hip, and left forearm, lacerations and abrasions to her arms and hands, strain and sprain to her lower back, and shoulder areas, together with a severe shock to her nerves and nervous system, some or all of which plaintiff has been advised are or may be permanent in nature. 17. As a result ofthe aforesaid, plaintiff has undergone great physical pain and mental anguish and will continue to endure the same for an indefinite time in the future, to her great detriment and loss. 18. As result of the aforesaid, plaintiff has been unable to attend to her usual and daily duties and occupations and she will be unable to attend to the same for an indefinite time in the future, to her great detriment and loss. 19. As a result of the aforesaid, plaintiff has suffered a loss and depreciation of her earnings and earning power and she will continue to suffer such loss and 5 depreciation for an Indefinite time In the future, to her great detriment and loss. Harrington, Kauffinan & Shilling, hereby submits the following Briefin support of the Motion for Summary Judgment. I. mSTORY OF THE CASE: The Plaintiff, Lea Ann Wray, commenced the instant action against the Defendants Ross Keefer and Patricia Keefer, hlw (Keefer), et aI. on August 2, 1994 alleging she was injured on or about August 3, 1993 when she was bitten by a dog owned by Defendants Atkins and Wenger. Defendants Atkins and Wenger had rented the premises known as 4477 ~ East King St. in Shippensburg from Defendant Keefer on January 31, 1992. The lease agreement entered into between Defendants Keefer and Atkins and Wenger, specifically set forth the requirement that no t. pel. were allowed on the property. Contrary to thi.leue agreement, Defendant. Atkina and Wenger had the dog which i. the subject matter ofthi. cue. Upon learning of tho dog'. presence on the leased premises, Defendant. Keefer, through their agent I, Defendant. ReMax Homefindcrs, filed an action on June 22, 1992 against Atkins and Wenger. On July 22, 1992, District Justice Donald W. Daihl entered an order which stated, inlm: IIiI. that the dog wu to be removed from the property. This wu approximately 11 days prior to the incident complained of in Plaintifr s Complaint. PlaintifFWray contends that she wu injured during the course and scope of her employment u a meter reader for PennElec when she entered the premises leased by Atkins and Wenger in order or read their electric meter. As the result of these alleged injuries, she has filed the instant Complaint. Defendants Keefer have filed a responsive pleading to this Complaint and have now filed this Motion for Summary Judgment u landlords out of possession. II. OUESTION PRESENTED: WHETHER SUMMARY JUDGMENT SHOULD BE ISSUED TO THE DEFENDANTS ROSS KEEFER AND PATRICIA KEEFER, H1W, AS LANDLORDS OUT OF POSSESSION? SUGGESTED ANSWER: YES. III. ARGUMENT: In considering a motion for summary judgment, the Court is not to resolve any genuine issues of material facts. Its sole responsibility is to dctennine whether such an issue exists. Imn Morello Canst. Co.. Inc. v. BridgCJ)ort Federal Savings & Loan Assoc.. 280 Pa. All doubts to the existence oft genuine ISlUe of material fact must be reaolved against the moving pll1y. Rlchland Mallcourt v. Kasco Const.. Inc.. 337 Pa. Super. 204,486 A.2d 978 (1984). In the Instant cue, it Is clear from the record that the property in question was leased by Defendants AtkinI and Wenger from Defendants Keefer. It is also clear from the record that the Keefers did not allow their tenants to have any type of pets on the leased premises. The fact that Defendantl Atkins and Wenger had a dog which they kept as a pet on the leased premises was In violation of the terms ofthe lease. It Is also clear from the record that as soon as the Keefers determined that Atkins and.Wenger had a dog on their property In violation ofthe tenns of the lease, that they took the necessary steps through our judicial system to have the dog removed. It is also clear from the record and the tenns of the lease, that Keefers were landlords out of possession at the time the PlaintilfWray contends that she was injured during the course and scope ofher employment. A landlord out of possession might be liable for personal injuries sustained by a tenant due to the fact that the condition of the leased premises where a landlord conceals a dangerous condition of which he has knowledge and of which the tenant has no knowledge or cannot be expected to discover. Looez v. Gukenback, 391 Pa. 359, 137 A.2d 771 (1958). The only time that a landlord out of possession has liability is In the case ora multiple tentative building where the landlord has control of common approaches such as sidewalks and passages. In the current case, we do not have such a condition. In Ott v. Unclaimed Freiaht Co.. 395 PI. Super. 483 577 A2d 894 (1990), the Court found that lIand10rd had no duly to I plaintiff' who wu injured while walking across I parking lot on rented premises where there wu no evidence that the landlord retained the right to control the parking lot. In the present cue, the landlords, Patricia and Ross Keefer, did not retain control of the leased premises. Further, they specifically prohibited the leuees from maintaining any pets on the leased premises. Further, the leased entered into between Keefer and Defendants Wray and Atkins, only set forth four obligations that the leuor, the Keefers, had to comply with. It wu set forth in the lease agreement that the Keefers would comply with all codes, whether state, county or municipal; make all repairs to keep the leased premises in a fit and habitable condition; maintain a good and safe working order the necessary utilities in order to maintain a habitable condition; and to keep all common areas of the leased premises in a clean and safe condition. All other duties and obligations were upon the leaseees, Defendants Atkins and Wenger, to maintain the property in question. Keefers not only were landlords out of possession, but as soon as they ascertained that Defendants Atkins and Wenger were in violation of the lease, they took the necemry steps through the judicial system to ensure that the dog in question was removed from the property. At no time were Keefers aware that the dog had any vicious propensities as Plaintiff' alleges in her Complaint. To date, that is an unsubstantiated allegations put forth by the Plaintiff. ,- IV. CONCLUSIONS; For all of the foregoing reuons, it is submitted that the Defendants Ross Keefer and Patricia Keefer, hlw, were landlords out ofpoSlCllion and thus did not owe any duty to the Plaintiff Lea Ann Wray nor were they responsible for any injuries that the Plaintiff may have suffered as a result of the dog which was kept on the property rented from Keefers by Defendants Atkins and Wenger. Strict proof of this allegation is demanded at time of trial. 6. Neither admitted nor denied. Plaintiff is unaware as to when defendants were first aware that Adkins and Wenger were maintaining a dangerous and vicious dog on their property. 7. The Order speaks for itself. . 8. Admitted. It is obvious that defendants Keefer were aware of the dog. The Keefers' depositions have not yet taken place, so as to determine when they were aware of the dog. 9. Denied as irrelevant. It is specifically denied that the Answering Defendants, Ross Keefer and Patricia Keefer, h/w, knew or should have known that the dog was of a dangerous and vicious nature or that by its breeding and training was accustom to attacking and biting humans. On the contrary, the dog in question was known by the plaintiff to have a very even and friendly temperament. 14. Admitted in part, denied in part. It is admitted only that the Defendant Sloan Atkins was renting property through the Defendant Re/Max Homefinders, which property was owned by the Answering Defendants, Ross Keefer and Patricia Keefer, h/w, said property being known as 477 1/2 East King street, Shippensburg, Pennsylvania. It is specifically denied that the Answering Defendants were careless or negligent in any respect or that the Plaintiff sustained any injuries or damages as a direct and proximate result thereof. On the contrary, at all time material hereto, the Answering Defendants acted in a careful and prudent manner. With regard to the remaining averments of paragraph 14 , ~ f: of the Complaint, after a reasonable investigation, Answering Defendants are without sufficient knowledge or information to form a belief as to the truth or accuracy of said averments, and, accordingly, said averments are denied. strict proof thereof is demanded at the time of trial. 15. It is further averred: (a) They did not fa~l to regard the rights, safety and position of the Plaintiff; (b) They did not fail to adequately control a vicious dog in that they had no knowledge that there was any dogs alleged to be vicious in or about their property; (c) They did not fail to adequately control a dog which they knew or should have known had dangerous propensities, they had no duty to control an animal that they knew or should have had reason to know was gentle in nature; (d) Inasmuch as the Answering Defendants did not own a dog, this averment relates to others than the Answering Defendant and thus no answer is required under the applicable rules of civil procedure; (e) The Answering Defendants had no duty to warn the Plaintiff or others situated of the dog's vicious nature inasmuch as the Answering Defendants did not know of such a nature; (f) The Answering Defendants had no duty to adequately control or secure the dog in question. /. ..........4~. . P.J.. AND HESS. J. OPINION AND ORDER OF COURT Before the Court is the summary judgment motion of defendants Ross Keefer and Patricia Keefer. The Keefers are the owner of the premises where plaintiff, a meter reader, was allegedly attacked by the dog of defendants Sloan Eric Atkins and Jeremy Wenger, lessees. We heard argument on March 5, 1997. FACTS AND PROCEDURAL HISTORY Plaintiff's Complaint alleges that on or about August 3, 1992r during the course of her employment as a meter person for PennElec, plaintiff was attacked and severely injured by the dog of defendants Atkins and Wenger, who leased premises owned by the Keefers through Re/Max Homefinders, the other named defendants. (Pl.'s Compl. ! la, ! 14). Plaintiff further avers that at all times relevant to her cause of action, defendants were aware the dog was permitted to roam at large on his own without restraint, and that defendants knew or should have known the dog was of a dangerous and vicious nature. (Id.,! 12, ! 13). After filing a responsive pleading to the Complaint, the " NO. 94-4334 CIVIL TERM Keefers (hereinafter defendants) filed a Motion for Summary Judgment claiming that as landlords out of possession, they had no obligation or legal liability to plaintiff. Attached to their motion is a copy of the lease signed by Atkins and Wenger indicating that no pets were allowed on the premises. (Defendants' Motion for Summary Judgment, Exhibit A). Also attached is a copy of a judgment entered by District Justice Donald W. Daihl dated July 22, 1992, in favor of Re/Max Homefinders and against Atkins and Wenger, in part, directing the removal of the dog within thirty (30) days. (Id., Exhibit B). DISCUSSION The new summary judgment rule can be found in Rule 1035.2 of the RuleB of Civil Procedure, setting forth: After the relevant pleadings are closed, but within such time as not to unreasonably delay trial, any party may move for summary judgment in whole or in part as a matter of law (1) whenever there is no genuine issue of material fact as to a necessary element of the cause of action or defenBe which could be established by additional discovery or expert report, or (2) if, after the completion of discovery relevant to the motion, including the production of expert reports, an adverse party who will bear the burden of proof at trial has failed to produce evidence of facts essential to the cause of action or defense which in a jury trial would require the issues to be submitted to a jury. 42 Pa.C.S.A. S 1035.2. The moving party has the burden of proving the non-existence of any genuine issue of fact, whereas the non-moving party must demonstrate that there is s genuine issue of fact, without reliance on averments in its pleadings. 2 NO. 94-4334 CIVIL TERM Merriweather v. Philadelphia Newspapers, Inc., 453 Pa.Super. 464, ___, 684 A.2d 137, 140 (1996) (citation omitted). The trial court muet examine the record in a light most favorable to the non- moving party, and any doubts must resolved in favor of the non- moving party. Id. If it is clear and free from doubt that the moving party is entitled to judgment as a matter of law, the granting of summary judgment is proper. Id. Mindful of this stringent standard, this Court does not believe that summary judgment should be granted in favor of defendants at this time. Defendants are correct in their argument to the extent that the general rule of PennBylvania provides that a landlord out of possession is not liable for injuries caused by animals kept by the tenant when the tenant has exclusive control of the premises. The Superior Court has set forth this rule in Palermo v. Nails, 334 Pa.Super. 544, 483 A.2d 871 (1984). After stating the general rule, however, the Palermo court then adopted the holding of a California case, Uccello v. Laudenslayer, 44 Cal.App.3d 504, 118 Cal.Rptr. 741 (1975), and ruled that "a landlord out of possession may be held liable for injuries by animals owned and maintained by his tenant when the landlord has knowledge of the presence of the dangerous animal and where he has the right to control or remove the animal by retaking possession of the premises." Palermo, 334 Pa.Super. at 547, 483 A.2d at 873. In Gallick v. Barto, 828 F.Supp. 1168 (M.D. Pa. 1993), the Third Circuit relied in part on Palermo in 3 . ' NO. 94-4334 CIVIL TERM denying summary judgment for the landlords who were aware of the presence of a ferret (which the court held to be a wild animal) when the ferret attacked a child. In the instant case, defendants had the power to remove the animal from the premises as indicated by the judgment entered by District Justice Daihl. Because the lease provided that no pets were allowed on the premises, defendants also had as a remedy the power to retake the premises after pursuing the matter through the judicial system. A jury question exists as to whether obtaining a judgment in and of itself w~s sufficient to absolve defendants of negligence. It is also not established by the record whether or not defendants had taken any precautions before the dog bite incident in view of the fact that Atkins and Wenger had thirty (30) days to remove their dog. We recognize that Palermo was presented in the context of the landlord's duty to the tenant's invitees. This Court, though, believes that Palermo is not narrowed to the duty owed to the tenant's invitees because the Superior court did not expressly limit the holdingr as indicated by the language quoted above. Thus, the case at bar falls into an exception to the general rule that landlords out of possession are not responsible for injuries cause by an animal kept by the tenant. In addition to the foregoing exception, we also believe that a question exists as to whether defendants were responsible for a dangerous condition of the premiseB over which they had control. 4 " , . .. NO. 94-4334 CIVIL TERM See Dorsey v. Continental Associates, 404 Pa.Super. 525, 530, 591 A.2d 716, 718 (1990). The record is silent as to the area where plaintiff read the meter and whether defendants had assumed responsibility for that particular area. Accordingly, we will deny defendants' Motion for Summary Judgment at this time.
