MEMORANDUM OPINION Al~D ORDER
Patricia Sinaiko (hereinafter Wife), the Defendant in
the above-captioned divorce, petitioned the Court for an award of
counsel fees in the amount of $83,550.81. For the reasons set
forth below, we award counsel fees in the amount of $39,936.
Peter Sinaiko, M.D. (hereinafter Husband), the
Plaintiff in the above-captioned divorce, and Wife entered into a
Property Settlement Agreement (hereinafter Agreement) on October
1, 1990 and the terms of said Agreement were incorporated into a
Decree in Divorce granted by the undersigned on October 5, 1990.
The parties are the parents of two sonSr Stephen, born March 6,
1967 and Daniel, born November 13r 1974. The parties also had a
daughter, Elizabeth, born September 15, 1968 who died in June,
1990.
The Agreement encompassed a number of issues, including
the equitable distribution of propertYr the past, present and
future support and maintenance of Wife, and the past, present and
future support and maintenance of the childrenr including medical

insurance coverage, unreimbursed medical expenses and education
through graduate school. Paragraph 17 of the Agreement
specifically addreseed the liability for and payment of legal
fees. It reads in pertinent part:
"Neither party shall have any responsibility for any
counsel fees of the other except that should either
party have to bring an action to enforce any provisions
of this Agreement, the party found to have breached
this Agreement shall be responsible for the
nonbreaching parties' reasonable legal fees, including
the legal costs and fees incurred to collect said legnl
fees. II
The Husband did not comply in a timely fashion with the
terms of the Agreement. Wife filed Contempt Petitions on
November 14, 1990, January 22, 1991, May 23, 1991 and December
16, 1991. There were hearings scheduled on the first three
Petitions but the issues resolved, at least temporarily, prior to
the contempt finding. Each time the issues were conferenced with
the undersigned and then moments before the hearing was to begin
the parties would reach a compromise. with regard to the final
Petition filed on December 16, 1991, not even the threat of Court
action resolved the matter. Three days of testimony were
required and at the close of testimony on February 12, 1992, the
Court asked counsel to submit briefs on the outstanding economic
issues to aid in adjudication. As of May 6, 1992, Wife had
incurred approximately $16,3761 in counsel fees in pursuit of her
claim that Husband owed here money under the Separation
Agreement, We note that the Husband also filed a Petition for

Contempt on non-economic issuesr alleging that Wife was
interfering with Husband's relationship with the son, and,
therefore violated the Agreement. Husband was awarded counsel
fees in the amount of $750. No Appeal was taken from this
finding.
Husband did not comply with the terms of the May 6,
1992 Order so Wife finally took the necessary steps to reduce the
Order to Judgment, docket the Judgment and issue a writ of
Execution with the Sheriff. The action of attaching Husband's
porsche finally engendered a change in his behavior.
Nevertheless, the Wife incurred an additional $12,8352 in counsel
fees from May 6, 1992 until October 23, 1992 when the parties
reached a settlement of all economic issues. On August 21, 1992,
Husband filed an Appeal to the May 6, 1992 finding of contempt.
The Appeal was subsequently withdrawn as part of the October
Settlement. At the time of settlement, Cross-Petitions for
counsel fees had been filed and the resolution of counsel fees
was specifically reserved for later decision. Wife continued to
incur additional counsel fee expenses attempting to resolve and
put to rest all economic issues.
On August 19, 1992, Wife had filed the aforementioned
Petition for Counsel Fees3. At the time of the filing of the
Petition, the total invoice of Wife's counsel fees had risen to
$47,388.92. Hearings on the counsel fee Petition were held on

September 11, 1992, December 1, 1992, January 29r 1993, March 19,
1993 and July 19r 1~93. The five days of hearings on the Counsel
Fee Petition and all related services added another $21r451 to
Wife's counsel fee indebtedness.4
The counsel fees that Wife incurred regarding the
litigation and eventual finding of Contempt amounted to $29,211.
Wife incurred an additional $21,451 in litigating the Counsel Fee
Petition. At least one-half of the testimony on the Counsel Fee
Petition involved the subject of Husband's nonpayment of the sums
due Wife which resulted in the May 6, 1992 Order and finding of
Contempt. Therefore, we are using one-half of the $21,451
figure, or $10,725. The sum of $10,725 and $29,211 is $39,936.
Husband forced Wife to litigate virtually every
financial aspect of this Agreement. For this reason we enter the
following Order.
ORDER
Peter Sinaiko, M.D. is ordered to pay to Patricia
Sinaiko the sum of Thirty-Nine Thousand Nine Hundred Thirty-Six
Dollars ($39,936) within one hundred twenty (120) days of the
date of this Order.
