CLAIM FOR MECHANICS LIEN
Essis , Sons, Inc., by its attorneys, Broujos, Gilroy & Houston,
P.C., sets forth the following in accordance with the Mechanics
Lien Law of 1963, 49 P.S. Section llOl, et seq.:

The name and address of the Claimant is Essis , Sons, Inc., a
Pennsylvania corporation with principal offices located at 6220
Carlisle Pike, Mechanicsburg, Cumberland County, Pennsylvania
17055. The Claimant is a sub-contractor in this case.

The name and address of the owners or reputed owners are Brad
Hollinger and Deborah Welsh of 2850 Ford Farm Road, Mechanicsburg,
Cumberland County, Pennsylvania 17055.

The Claimant completed his work on the 26th day of April, 1994.

The Claimant contracted with Clemons & Sons, Inc., for purposes of
furnishing of carpeting and flooring materials at the aforesaid
premises. On April 22, 1994, preliminary notice, in accordance
with 49 P.S. 150l(a) was provided to the OWners and, formal notice
was served on June 3, 1994. A copy of said preliminary notice is
attached hereto and marked as Exhibit A and a copy of said formal
notice is attached hereto and marked as Exhibit B.

The Claimant contracted with Clemons , Sons, Inc., on or about
November 17, 1993, December 12, 1993, and December 17, 1993, for
the furnishing of carpeting and flooring materials at the premises
located at 2850 Ford Farm Road, Mechanicsburg, Cumberland County,
Pennsylvania. A copy of said contracts are attached hereto and
marked as Exhibits C, 0, and E, respectively.

The required work of furnishing carpeting and flooring to the
aforementioned real estate was completed by Claimant at the
mentioned real estate on the 26th day of April, 1994, as aforesaid.

The amount of $9,990.33 is due to Claimant from Clemons & sons,
Inc., including finance charges to April 21, 1994, with said
finance charges continuing to accrue on said amount at the rate of
1.5 per cent per month.

The property claimed to be subject to the lien is the real estate
located at 2850 Ford Farm Road, Mechanicsburg, Cumberland County,
Pennsylvania, as more particularly described in the desd
description marked as Exhibit F.
WHEREFORE, Claimant requests your Honorable Court to enter a lien
against the above-described property in the amount of $9,990.33,
plus interest at 1.5 per cent per month from April 21, 1994, plus

Please be advised that this office represents Essis , Sons, Inc.
In accordance with the provisions of the Mechanics Lien Law, you
are hereby placed on preliminary notice of our client's intention
to file a claim for labor and materials furnished for the
alterations or repairs done to your property located at 2850 Ford
Farm Road, Hechanicsburg, Pennsylvania.
As you are aware, my clients were subcontracted through James
Clemons of Clemons , Sons~ Inc., Contractor, to install carpet,
tile, and marble in your property. My client has been advised that
there are still a number of items which must be addressed with the
marble work before the work that has been performed to date has
been deemed by you to be completed. This is as per your letter to
the contractor dated April 19, 1994. As of this date, our total
claim for work performed pursuant to our subcontract which would
form the basis of a claim for a Mechanics Lien to be filed against
your property is $9,990.33. You should further be advised that
once the work has been completed, that we do in fact intend to
forward a formal notice to you in accordance with the provisions of
49 P.S. 1501(b) advising you that a Mechanics Lien will be filed
against your property at 2850 Ford Farm Road.

As you are aware, this office represents Essis , Sons, Inc. We
have been advised that all items previously addressed in my letter
of April 22, 1994, have now been completed by my clients. Please
be advised that in accordance with the provisions of the Mechanics
Lien Law, that my clients do intend on filing a claim and pursuant
to the provisions of 49 P.S. 150l(c) state the following:

AND NOW, comes the Claimant, Bssis , Sons, Inc., by and through
their attorneys, Broujos, Gilroy & Houston, P.C., who aver as
follows I

On August 3, 1994, a Claim for Mechanics Lien was filed at the
above-captioned term and number and a Notice of Filing of Mechanics
Lien was issued to the above-captioned OWners.

The Claimant has attempted personal service upon the OWners in
accordance with the requirements of 49 P.S. 1502.

The Cumberland County Sheriff's Department has attempted personal
service thirteen (13) times without having service accomplished, as
further set forth on the attached Affidavit.

49 P.S. l502(c) provides that if personal service cannot be made,
then service can be accomplished by posting upon a conspicuous
public part of the improvement.

Service must be accomplished within one (1) month after August 3,
1994.

Claimant requests that service be made upon OWners by posting in
accordance with the Mechanics Lien Law upon 2850 Ford Farm Road,
Mechanicsburg, Cumberland County, Pennsylvania.
WHEREFORE, Claimant requests a special order directing that the
Claimant may serve the Notice of Filing of Mechanics Lien upon
OWners by posting same upon a conspicuous public part of the
improvements at 2850 Ford Farm Road, Mechanicsburg, Cumberland
County, Pennsylvania.

captioned matter was forwarded to the Cumberland County Sheriff's
Department for personal service upon the above-captioned OWners.
I was notified on August 30, 1994, that the Sheriff's Department
had attempted service upon the Owners a total of thirteen (13)
times. Due to the time constraints imposed upon the Mechanics Lien
Law, service must be accomplished no later than September 2, 1994.
It is believed that service by posting in accordance with 49 P.S.
