The Borough of Mt. Holly Springs, by its Attorneys,
Snelbaker & Brenneman, P.C., files this Complaint against
Defendant, Jerry L. Kyle, as follows:
1. Plaintiff Borough of Mt. Holly springs is a duly
authorized and existing political subdivision with a place of
business and address at 200 Harman Street, Mt. Holly Springs,
Cumberland County, Pennsylvania 17065.
2. Defendant Jerry L. Kyle is an adult individual residing
at 121 Cold spring Road, Dickinson Township, Carlisle, Cumberland
County, Pennsylvania 17013.
3. Defendant is the owner of a parcel of real estate
located in Dickinson Township, Cumberland County, commonly known
and numbered as 121 Cold spring Road, Carlisle, Pennsylvania
(hereinafter referred to as the "Premises").
4. Defendant is provided at Defendant's Premises municipal
water service by Plaintiff.
COUNT I
5. The averments of Paragraphs 1 through 4, inclusive, of
this Complaint are incorporated by reference herein in their
entirety.

6. From December 17, 1993 through March 24, 1994, plaintiff
provided Defendant with water service at Defendant's premises.
7. The water service provided Defendant by plaintiff as
described in Paragraph 6 above was provided in accordance with
the terms and conditions as set forth in Mt. Holly springs
Borough Code of ordinances, Chapter XXIV, as amended.
8. On or about March 24, 1994, Defendant was provided by
Plaintiff with a written statement of the amounts due Plaintiff
for water service provided the Premises for the period of
December 17, 1993 through March 24, 1994.
9. Defendant has failed and refused to pay the total amount
billed for the water service provided for the period December 17,
1993 through March 24, 1994, which amount consists of a water
charge of $90.50 and an additional $9.05 in penalties as provided
by Ordinance.
10. The amounts charged by Plaintiff to Defendant for water
service were fair and reasonable and were never objected to by
Defendant.
11. Defendant's failure to pay for water service provided
the Premises is a material breach of the parties' understanding
and agreement whereby Plaintiff would provide such water service
to the Premises for Defendant and Defendant would pay for same in
accordance with Plaintiff's then current rates and service

charges.
WHEREFORE, Plaintiff demands judgment against Defendant in
the amount of $99.55, together with all costs, fees, interest,

COUNT II
12. The averments of Paragraphs 1 through 11, inclusive, of
this Complaint are incorporated by reference herein in their
entirety.
13. On or about August 31, 1993 a water meter was installed
on Defendant's Premises in accordance with the terms and
provisions as set forth in Mt. Holly springs Borough Code of
Ordinances, Chapter XXIV, as amended specifically by Ordinance
90-3 and Ordinance 90-4.
14. In accordance with the Mt. Holly Springs Borough Code of
Ordinances, Ordinance 90-4, all costs of the meters installed are
to be paid for by the property owner within three (3) months of
the date of billing.
15. The total amount billed to Defendant by Plaintiff for
water meter installation at Defendant's Premises was $530.42.
16. Defendant has failed and refused to pay the balance due
Plaintiff for the aforementioned water meter installation, which
balance is in the amount of $432.32.
17. The amount charged by Plaintiff to Defendant for the
water meter installation was fair and reasonable and never
objected to by Defendant.

WHEREFORE, Plaintiff demands judgment against Defendant in
the amount of $432.32 together with all costs, fees, interest and

COUNT III

18. The averments of Paragraphs 1 through 17, inclusive, of
this Complaint are incorporated by reference herein in their
entirety.
19. The water service and water meter installation provided
by Plaintiff to Defendant at Defendant's Premises was not
provided by Plaintiff to Defendant as a gratuity.
20. Charges for the water service and water meter
installation as more fully set forth in Counts I and II of this
Complaint, were fair, customary, reasonable and never objected to
by Defendant.
21. Defendant wrongly secured benefits from the use of the
water service and water meter installed and/or provided
Defendant's Premises that would be unconscionable for Defendant
to retain.
22. Defendant has been unjustly enriched at the expense of
Plaintiff in the amount of $531.87.
WHEREFORE, Plaintiff demands judgment against Defendant in
the amount of $531.87 together with interest and costs of this
action.
