CIVIL ACTION - LAW JEFFREY A, KINTZ and INGRID KINTZ, Defendant No. CIVIL 1994 COMPLAINT 1, The Plaintiff Dauphin Deposit Bank and Trust Company, is a Pennsylvania Corporation licensed under the banking laws of the Commonwealth of Pennsylvania with an office located at 3607 Derry Street, Harrisburg, Dauphin County, Pennsylvania 2. The Defendant, Jeffrey A, Kintz, is an individual residing at 672 Laurel Drive, Boiling Springs, 17007, Cumberland County, Pennsylvania. 3. The Defendant, Ingrid Kintz, is and individual residing at 286-C South Locust Point Road, Mechanicsburg, 17055, Cumberland County, Pennsylvania. 4, On or about September 14, 1989 the Defendants made an application for a loan to Plalntj(1 Dauphin Deposit for the purpose of financing the purchase of a 1990 GEO Tracker, The loan was approved by Dauphin Deposit Bank and Trust Company, (Exhibit "A"). 4, Dauphin Deposit Bank accepted the application and requested that the Defendants execute a "Pennsylvania Motor Vehicle Installment Sales Contract" (Exhibit "B"), 5, Pursuant to Exhibits "A" and "B" the Defendants agreed to make payments In monthly Installments of $363,53 to Dauphin Deposit lor a term of fifty-four (54) months payable on the twenty.ninth (29th) day of each month. 6, The Defendant has defaulted under the terms and conditions of said agreement, Exhibit "A" and "B" herein, in that he has failed to make sufficient and consistent payments in accordance with the terms and that no payments have been received since September 13, 1991. 7. The Defendants voluntarily surrendered the car which was the collateral for the loan to Dauphin Deposit and were notified by Dauphin Deposit of the intended sale of the car to be held at Public Sale (Exhibit "C"). 8, The Defendants were given notice that the car was sold at a public sale by Dauphin Deposit on December 14, 1991. (Exhibit "0"). 9, Total proceeds generated by the public sale were $5,800.00, Costs of sale were $275.00. The net amount applied to the principal owed on the Defendant's account was $5,525,00. 10, Repeated demands of the Defendants hve been made by Dauphin Deposit and Dauphin Deposit's counsel for the principal balance owed of $. (Exhibit "E"). 1 1, The Defendant has refused to pay the deficiency balance owed and is therefore liable for Interest, attorney's fees and costs 01 suit.
