COMPLAINT
1. The Plaintiff Dauphin Deposit Bank and Trust Company, is a Pennsylvania
Corporation licensed under the banking laws of the Commonwealth of Pennsylvania with
an office located at 3607 Derry Street, Harrisburg, Dauphin County, Pennsylvania
2. The Defendant, Kimberly D. Steward, is an individual residing at CME Lot
154, Newville, 17241, Cumberland County, Pennsylvania,
3. On or about April 28, 1990 the Defendant made an application for a loan to
Plaintiff Dauphin Deposit for the purpose of financing the purchase of a 1990 Chevrolet
Cavalier. The loan was approved by Dauphin Deposit Bank and Trust Company. (Exhibit
"A").

4. Dauphin Deposit Bank accepted the application and requested that the
Defendant execute a "Pennsylvania Motor Vehicle Installment Sales Contract" (Exhibit "B").
5, Pursuant to Exhibits "A" and "B" the Defendant agreed to make payments in
monthly installments of $296.32 to Dauphin Deposit for a term of sixty (60) months payable
on the twenty-elghllh (28th) day of each month.
6. The Defendant has defaulted under the terms and conditions of said
agreement, Exhibit "A" and "B" herein, in that he has failed to make sufficient and consistent
payments in accordance with the terms and that no payments have been received since July
30, 1991.
7. The Defendant voluntarily surrendered the car which was the collateral for the
loan to Dauphin Deposit and was notified by Dauphin Deposit of the intended sale of the
car to be held at Public Sale (Exhibit "C").
8. The Defendant was given notice that the car was sold at a public sale by
Dauphin Deposit on February 22, 1991. (Exhibit "D"),
9. Total proceeds generated by the public sale were $3,550.00. Costs of sale were
$275.00. The net amount applied to the principal owed on the Defendant's account was
$3,275.00.
10, Repeated demands of the Defendant has been made by Dauphin Deposit and
Dauphin Deposit's counsel for the principal balance owed of $9,601.76 (Exhibit "E").

11. The Defendant has refused to pay the deficiency balance owed and is therefore
liable for Interest, attorney's fees and costs of suit.
WHEREFORE, the Plaintiff Dauphin Deposit Bank and Trust Company demands
judgement against the Defendants in the amount of $9,601.76 together with attorney's fees
of twenty percent (20%), interest and costs of suit.
