STIPULA TION AGAINST LIENS
THIS AGREEMENT made the .2Cthday of July, 1994, by and between.
CHARLES M. KELSO, of 148 Newville Road, Newburg, I)ennsylvania, hereinafter referred to as
ContrClctor.
AND
FRED B. HOCKERSMITH, of2240 Hall Avenue, Shippensburg. Pennsylvania hereinafter referred
to as Owner;
WHEREAS, the said Contractor undertook and agreed to make certain improvements to
Owner's property situate in the Borough of Shippensburg. Cumberland County, Pennsylvania.
known as Lot No, 9, Jwnes Circle, Shippcnsburg, Pennsylvania, more fully described in Exhibit "A"
attached hereto and made a part hereof.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for
and in consideration of the sum of One Dollar ($1,00) to said Contractor in hand paid by Owners.
the receipt whereof is hereby acknowledged, and the further consideration mentioned in the
agreement aforesaid. for himsclf, and his subcontractors, and all parties acting through or under
them. covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or
any of them against the said buildings and improvements and the lot of ground appurtenant thereto
for or on account of any work done or materials furnished by them or any of them under said
contract or otherwise, for. towards, in, or about the erection and construction of the said
improvements on the lot above described, and the said Contractor, for himself, his subcontractors
and others under him hereby expressly waive and relinquish the right to have, file, and maintain any
mechanic's liens or claims against the said buildings or any of them. and agree that this instrument.

ALL that certain tract orland situate in the Borough of Shipp ens burg, Cumberland County,
Pennsylvania, more particularly bounded and described ns follows:
BEGINNING at a point on the northern edge of James Circle at common comer of Lot No. 10
and Lot No.9 as shown on Subdivision Plan of Hallwood Heights West dated May 21,1992, and
recorded in Cumberland County Plan Book 65, Page I; thence along Lot No, 10, South 41
degrees 55 minutes 06 seconds West, 155,82 feet to a point; thence along lands now or formerly
of Bruce R, and Julie L, Beam, and a 14 feet wide unopened alley, North 48 degrees 42 minutes
53 seconds West 100,01 feet to a point; thence along lot No, 8 of the aforesaid subdivision,
North 41 degrees 55 minutes 06 seconds East 131.60 feet to a point on the southern edge of
James Circle; thence along the southem edge of James Circle by a curve to the len having a
radius of 60.00 feet, a chord bearing of South 58 degrees 21 minutes 25 seconds Enst, an arc
distance of 80.81 feet to a point; thence continuing along the southern edge of James Cirele by a
curve to the right having a radius of 35,00 feet, a chord bearing of South 72 degrees 30 minutes
43 seconds East, an arc distance of29.85 feet to a point, the point and place ofBEGlNNING.
BEING all of lot No, 9 on Subdivision Plan ofHallwod Heights West dated May 21, 1992, and
recorded in Cumberland County Plan Book 65, at Page I,
CONTAINING 0.3099 acres more or less.
BEING the same real estate which H. Scolt Garling and Michael J, Cassidy, co-partners, tld/b/a
G & C Associates. by their deed dated the 20th day of May, 1994, and recorded in Cumberland
County Deed Book 106 at Page 601 ,conveyed to Fred B. Hockersmith, the
owner herein,
UNDER AND SUBJECT, nevertheless, to such agreements, conditions, and restrictions as
appear of record,
