WHEREAS, MARK R. BURKHEAD and DONNA J. BURKHEAD of Bolling Springs,
Pennsylvania, Is about to execute contemporaneously herewith, a contract, with Leisenring and Associates
of Lewlsberry, Pennsylvania, for the erection of a building upon premises commonly known as 406
RAYMON AVE., S. MIDDLETON 1WP. BOILING SPRINGS. CUMBERLAND County,
Pennsylvania, as set forth In the deed dated June 23, 1987. recorded June 25, 1987 at Deed Book T-32,
Page 206, In the Recorder's Office for CUMBERLAND County, Pennsylvania, as more specifically
described In Exhibit. A. which Is Incorporated herein and attached hereto.
NOW, JULY 29, 1994, at the time of and Immediately before the execution of the principal
contract, and before any authority has been given by the said Owner to the said Contractor to commence
work on the said building, or purchase materials for the same in consideration of the making of the said
contract with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by
Owner, It Is sgreed that no lien shall be filed against the building by the Contractor, or any subcontrsctor,
nor by any of the materialmen or workmen or any other person for any labor, or materials purchased,
or extra labor or materials purchased for the erection of said building. the right to file such liens being
expressly waived.

BEGINNING at a point on the southern dedicated right-of-way line of 50 foot
wide Raymon Avenue at the dividing line between Lots No.s 21 and 22 on the
hereinafter mentioned Subdivision Plan; thence along said dividing line,
north 00 degrees 28 minutes 14 seconds West, 220.55 feet to a point; thence
along lands now or formerly of Glenn R. Miller, South 71 degrees 24 minutes
02 seconds West, 88.83 feet to a point; thence continuing along same, North
06 degrees 25 minutes 41 seconds West, 150.00 feet to a point; thence along
the dividing line between Lots Nos. 22 and 23 on said Plan, North 00

dedicated right-of-way line of Raymon Avenue; thence long said right-of-way
