On or about November l7, 1993, the Defendant did order carpet from
the Plaintiff to be cUlltom inlltalled at a property upon whioh the
Defendant waB doing oonstruction work being looated at 2850 Ford
Farm Road, Mechanicsburg, Cumberland county, Pennlylvania,
(hereinafter referred to as "the premiseB") with laid purohal.
Order bearing No. A84557, and with the total amount of laid
purchaBe order being $3,600. A copy of laid purohaBe order il

attached hereto and marked al Bxhibit A and i. incorporated herein
by reference.

On or about November l7, 1993, the Defendant did execute a pure hale
order for the purohale of tile to be installed at the premises,
with said Purohase Order being No. A1l455B, with the total amount of
said purohaBe order being in the amount of $5,100. A oopY of said
purchase order is attached hereto and marked as Exhibit B and is
inoorporated herein by reference.

On or about December 12, 1993, the Defendant did place an order
from the Plaintiff for the installation of carpet in the premises,
with said purchase order bearing No. AB457l and being in the amount
of $3,059. A copy of said purohase order is attached hereto and
marked as Exhibit C and is incorporated herein by referenoe.

On or about December 17, 1993, the Defendant did place an order
with the Plaintiff for the purohase of marble for the premises with
said purohase order bearing No. AB4574 and being in the amount of
$1,245. A copy of said purchase order is marked as Exhibit D and
is attached hereto and is incorporated herein by reference.

The items purchased by the Defendant, as referenced in Exhibits B,
C, and D, have been installed in the premises as per the purchase
orders to the satisfacticn of the owners cf the premises, beinq
Brad Hollinger and Deborah Welsh (hereinafter referred to as "the
owners"). Attached hereto and marked III Bxhibit B is a oopy of laid
correspondence froDl the property owner which ill incorporated herein
by reference.

The letter from the owners, being Exhibit E, authorized the
Defendant to pay to Plaintiff the tctal SUDlS due and owinlJ to
Plaintiff for all items installed at the premises, being the items
ordered by Defendant and referenced as Exhibits B, C, and D.

The oarpet ordered by the Defendant, as reflected in the purchase
order attached as Exhibit A, is currently at the Plaintiff's place
of business and has been cut and is ready fcr installation.

On or about April l5, 1994, the Defendant notified Plaintiff that
it was no longer interested in pur.chasing the carpet as reflected
in the purchase order as referenned in Exhibit A.

The carpet ordered by the Defendant, as refleoted in the purch.se
order attached as Exhibit A, has been custom cut and fitted as per
the Defendant's specifications and is no longer .uitable for ..le
by the Plaintiff.

The Defendant has ordered fr.om the Plaintiff various c~rpet, tile,
and marble, as reflected in Exhibits B, C, and D, which have been
installed at the premises at the direction of the Defendant.

The owners of the premises, being satisfied with the Plaintiff's
produotrJ and installation, have authorhed payment to Plaintiff for
the total sums due and owing to Plaintiff by the Defendant.

The purchase orders are reflected in Exhibits B, C, and D were
included in a statement for charges due to Plaintiff by Defendant.
A copy of said statement is attached hereto and marked as Exhibit
F and is incorporated herein by reference.

Included in Exhibit F is a statement that a one-and one-half per
cent service charge would be added to all accounts over ten days
old.

The payment due d.ate for the tile purchased in Exhibit B was
November 30, 1993.

Despite repeated requests from Plaintiff to Defendant to pay on
said purchase orders, Defendant has and oontinues to refuse to pay
Plaintiff the total sums due and owing.

The total sum due and owing on Purchase Orders reflected in
Bxhibits B, C, and D, including finance charges to April 21, 1994,
is $9,990.33.
WHBRBFORE, Plaintiff seeks judgment against Defendant for the total
sum of $9,990.33 plus finance charges and court costs, being an
amount requiring compulsory arbitration.

The purchase order submitted by the Defendant, as reflected in
Bxhibit A, had been pre-cut as per specifications for a customized

purposes.

The Defendant advised the Plaintiff by letter dated April 15, 1994,
that he wa~ going to be proouring carpet elsewhere and would not be
pu.rchaeing the oarpet previously ordered, as reflected on Exhibit
A. Attached hereto and marked IlB Exhibit G ill a copy of the letter
from the Defendant to Plaintiff, which is incorporated herein by
reference.

Piaintiff was ready, willing and able to prooeed and install the
carpet referenced in Exhibit A but only after assuranoes had been
made to Plaintiff by Defendant that payment would be made to
Plaintiff for the purchase of oarpet, marble, and tile as reflected
in Exhibits a, c, and D.

Defendant has given assurances to Plaintiff that payment would be
rendered for the purchases as reflected in Exhibits a, c, and D.

The statements made by the Defendant in Exhibit G indicated that
the Defendant was not going to perform his oontractual duties And
PAY PlAintiff for the carpet previously ordered by DefendAnt.

datIl only one item on my 11st of 8 repairs has been
completed, and that one is repalr of the uneven edge along
thl front edge of the Hot t~b marble work.
Now in addltion to the orlginal llst of 8 items to be
rlpalred arl thl horrible acraping and sandlng marks
your worker. left on the South shower wall and on almost the
entire shower floor, and loose and ungrouted marble on the
ahower ceUing.
Unless you make arrangements with me by 5:30 pm tonight,
at my place of buainesa, to complete the repalrs in a timely
marmer, I wUl immediately hire another company to r;omplete
thl repairs. I have had expert flooring peoplp examlne
thl marble work and the cost to repair ~s difficult to
esti~te and will have to be done on a T & H basls.
I will also hold Essis , Sons, Inc. responsible for Qny
liquidated damagel assessed to Clemons & Sons Constr. by
Brad Hollinger/Deb Welsh because of your failure to complete
the marble work. Larry Wright was at all times entirely
aware of the liquidated damages clause that I was working
with on thil job.
Since you are refusing to install carpet 1n the Hollinger
reaidence per work order No. A 84557, [will be forced to
order other carpet to complete the job, unless you make
aatilfactory arrangements with me by 5:30 pm tonight at
my place of businesl, to have the above mentioned carpet
inatalled ln the Hollinger residence.
I sugg'lt you contact me at my telephone number or in
wrlting regarding completion of and payment for marblel
carpet work at the Hollinger. residence instead of
continually call1ng Brad and Deb at their place of work
since your work orders were made with Clemons and Sons
Constr., and not with the Hollingers.
