oustody of his chlldran because ho bollevos that he con provide 0 more stable
household envlronmont lor thel11 und thot Iw Is more available than the Mother to
provide cure lor them on on on-goll1[J bosls. Fothor relut.od that ho Is remorlled and
his cUlrent spouse has Il job position that will permit him to work port,tlme In tho
event thot he Is provldod clJstody. This, according to tho Futher, will allow him to
be with his doughtors 1110ro so thut they aro not In tho cora 01 babysllters. Father
Indicated ho would provldo 0 Ilberol visitation with Mothor, although he did not
provide 0 specific schedule.
6. Tho Delendont's posltiol1 011 custody Is as lollows: Mother bellevas that
the curlent schedule which they hovo been operating under since the purtles
separated In tho spring 01 '1994 is operating well. Sho is on assistant maneger at
Burgar King In Corlisle and works every woollend os well os Tuesday and
Wednesday Irom 5:30 a.m. until 2:00 p.m. Undel the cUllent custodial
olrongemont, Fothol has the chlldron every weekend while she Is at Walk. The
woekend Is on extended weekend typically during the school year Irom Flldoy until
Monday morning at which tlmo the Father leturns the children to school.
7. Need fOI seporate counsel to represent chlld(len): Neither party
laquested.
8. Need for Independent psychological evaluation or counseling: See
attached Older.
9. A hearing In this case Is expacted to teke one-half day,
10. Other mattars or comments: The parties hsve been living seperate from
eech other since 1994. Mother has maintained primary custody of the children
who ore currently 8 and 6. In the most recent past, the parties heve been working
on a schedule that they arrived at wheleby the chlldlen ale with the Father every
weekend from Fllday until Monday morning which coincides with Mothel's work
schedule. The schedule seems to Ideally fit their respective work schedules at this
time. Father Is working part-time and Indlceted to tho Conciliator that whether or
not he worked full-timo was dependent upon If he got custody. He raloted that his
current wife has sufficient Income to SUPPOlt them In the event that he Wes given
prlmolY custody of the children. Despite this flexibility at this time, however,
Fathel hes not taken eny eddltlonal time with the chlldlen beceuse he believes that
the dllvlng distance Is an Impediment.
This is a case whereby neither party Is claiming that the other party Is unfit
or othelwlse unable to care for the children. Father suggested that he wanted to
maka sure thet the children wele not with a sitter and with him. Apparently the
chlldlen are only with a slttel, who happens to be Mother's sister, on Tuesday and
Wednesday evonlngs because Mother has to get up and go Into work around 3:30
to 4:00 a.m. Othel than that period of time In which they are essentially sleeping,
and when this fall arrives when the youngest child goos to school, the children
under the currant schedule ale either with the Mother when she Is not working or

of the Consent Agreement of the parties, the followinG Order is
entered:
1. The defendant, Tracy A. Bitner, is enjoined from
physically abu6ing the plaintiff, Kristen L. Bitner, or from
placing her in fear of abuse.
2. The defendant is ordered to refrain from stalking and
harassing the plaintiff.
3. The defendant is ordered to refrain from damaging or
destroying any property owned by the plaintiff or any property
jointly owned by the parties.
4. This Order shall remain in effect for a period of one
year.
6. The Pennsylvania state and carlisle police Departments
will be provided with a copy of this Order by attorneys for
plaintiff. This Order shall be enforced by any law enforcement
agency when a violation occurs by arrest for indirect criminal
contempt. The arrest may be without warrant upon probable cause
that this Order has been violated, whether or not the violation
is committed in the presence of the police officer. In the event
that an arrest is made under this section, the defendant shall be

of the parties' Consent Agreement, the following Order is entered
with regard to custody of the parties' children, Danielle and
Chast ity Bitner.
1. The plaintiff, hereinafter referred to as the mother,
will have primary physical and legal custody of the children.
2. The defendant, hereinafter referred to as the father,
will have partial custody of the children at times mutually
agreed upon by the parties.
3. The mother and father will share the following holidaya
at times mutually agreed upon by the parties: Easter,
Thanksgiving, Christmas, Memorial Day, the Fourth of July, and
Labor Day.
4. The father will have the right to see the children on
their birthdays at a time to be agreed upon by the mother and
father.
6. The mother and fathor, by mutual agreement, may vary
from this schedule at any time.
6. Each parent will notify the other immediately of medical
emergencies which arise while the children are in that parent's
care.
7. Neither parent ahall do anything which may eatrange the
children from the other parent, or injure the opinion of the
children as to the other parent or which may hamper the free
and natural development of the children's love or respect for the
other parent.

1994, by the plaintiff, Kristen L. Bitner, and the defendant,
Tracy A. Bitner. The plaintiff is represented by Joan Carey of
Legal Services, Inc. i the defendant is unrepresented but is aware
of his right to have an attorney, The parties agree that the
following may be entered as an Order of Court.
1, The defendant, Tracy A. Bitner, agrees to refrain from
abusing the plaintiff, Kristen L. Bitner, or from placing her in
fear of abuse.
2. The defendant agrees not to stalk or harass the
plaintiff.
3. The defendant agrees to refrain from damaging or
destroying any property owned by the plaintiff or any property
jointly owned by the parties.
4. The defendant, although entering into this Agreement,
does not admit the allegations made in the Petition.
5. The defendant understands that the Protective Order
entered in this matter shall be in effect for a period of one
year,
6. The defendant understands that this Order will be
enforceable in the same manner as the Court's prior Temporary
Prot~ctlve Order entered In this case,
7. The defendant and the plaintiff agree to the entry of
a custody Order regarding their children, Oanlelle and Chastity
Bitner, providing the following:
a. The mother will have primary physical and legal
custody of the children,
b. The father will have partial custody of the
children at tImes mutually agreed upon by the parties.
c. The mother and father 8gree to share custody of the
children at times mutually agreed upon by the parties on the
following holidays: Easter, Thanksgiving, Christmas,
Memorial Day, the Fourth of July, and Labor Day.
d, The father will have the right to see the
children on their birthdays at a time to be mutually agreed
upon by the mother and father,
e, The mother and father, by mutual agreement, may

changed,

g. The parents realize that their children's well
being Is paramount to any differences they might have
between themselves. Therefore, they agree that neither
parent will do anything which may estrange the children from
the other parent, or Injure the opinion of the children as
