5. On or about February 15, 1994 Defendant entered into a
oontraot with Plaintiff whereby Defendant agreed to lease from
Plaintiff a Case Model 580 BK loader/backhoe, serial number
5500176344 for a period of three (3) months at a monthly rental
rate of $1,950.00 and at the end of three (3) months, purchase
said loader/backhoe for a price of $49,300.00 less 100% of the
three month rental paid for the loader/backhoe. A true and
oorrect copy of the contract between Plaintiff and Defendant
dated February 10, 1994 is attached hereto and incorporated by
reference herein as "Exhibit A".
6. On February 16, 1994 Defendant received delivery of the
above referenced loader/backhoe.
7. Defendant materially breached the terms and conditions
of the contract with Plaintiff by failing to make a rental
payment to Plaintiff on April 14, 1994 as required by the terms
of the parties contract.
B. As a result of the material breach of the parties'
contract by Plaintiff as averred in Paragraph 7, above, plaintiff
repossessed the loader/backhoe.
9. The current account balance due Plaintiff by Defendant
by reason of Defendant's rental of the loader/backhoe is
$4,854.00.

material served in November, 1994 be forthcoming. A true and
correct copy of Plaintiff's counsel's letter of March 21, 1995 to
Defendant's counsel is attached hereto and incorporated by
reference herein as "Exhibit D".
3. Pursuant to Pa.R.C.P. S 4006(a) (2) Defendant was to
serve a written response to the Interrogatories on or before
December 29/ 1994.
4. In accordance with th~ terms of the Request for
production of Documents served upon Defendant and Defendant's
counsel, Defendant was to produce and permit Plaintiff's counsel
to inspect and copy various documents designatecl, in the Request
for Production of Documents and provide a written response
thereto on or before December 29, 1994 in accordance with
Pa.R.C.P. S 4009(b) (2).
5. The designated time period for Defendant to provide
responses to the Interrogatories and the Request for production
of Documents and to make requested documents available to
Plaintiff's counsel has elapsed with no indication from Defendant
or Defendant's counsel when a response to the discovery material
would be forthcoming.
WHEREFORE, Plaintiff requests this Court to issue an Order
directing Defendant to serve Plaintiff's counsel with written
responses to the Interrogatories and the Request for Production
of Documents within twenty (20) days of the date of the

~NITIONB AND I~STRUCTIONB
1. The words "you" and "yours" shall refer to Defendant
Timothy Hake, trading and doing business as Bob's Refrigeration,
his or its agents, represontatives, attorneys and/or any person,
': irm or entity acting or purporting to act on his or its behalf
or at his or its direotion.
2. The words "identify" and "identity" when used in
reference to an individual shall mean to state his or her full
name and current address. When used in reference to a
corporation or other business entity, the words shall mean to
state its full name, present address, any fictitious name under
which it operates and the present owners, officers, and
directors thereof and their curr.ent addresses.
3. The term "business entity" shall mean and refer to any
corporation, partnership, sole proprietorship, joint venture,
company, entity or business operation,
4. The term "tangible personal property" shall mean, but
shall not be limited to, jewelry, furs, furniture, office
equipment, boats, airplanes, motor vehicles, motor cycles,
televisions, radios, record players, any and all electrical
appliances, power tools, photographic equipment, works of art,
musical instruments, coin, stamp or other collections, silver,
china or any other tangible item whether or not owned by you

The word. "document" as herein used include, but are not
limited, to any written or graphic matter or any kind whatsoever,
however produced or reproduced, any electronically or
magnetically recorded matter of any kind or character, however
produced or reproduced, and any other matter concerning the
recording of data or information upon any tangible thing by any
means, including, but not limited to the original, non-identical
copy, rough or rinal draft of the rOllowing (regardless of
