On or about February 15, 1994 Defendant entered into a oontraot with Plaintiff whereby Defendant agreed to lease from Plaintiff a Case Model 580 BK loader/backhoe, serial number 5500176344 for a period of three (3) months at a monthly rental rate of $1,950.00 and at the end of three (3) months, purchase said loader/backhoe for a price of $49,300.00 less 100% of the three month rental paid for the loader/backhoe. A true and oorrect copy of the contract between Plaintiff and Defendant dated February 10, 1994 is attached hereto and incorporated by reference herein as "Exhibit A". 6. On February 16, 1994 Defendant received delivery of the above referenced loader/backhoe. 7. Defendant materially breached the terms and conditions of the contract with Plaintiff by failing to make a rental payment to Plaintiff on April 14, 1994 as required by the terms of the parties contract. B. As a result of the material breach of the parties' contract by Plaintiff as averred in Paragraph 7, above, plaintiff repossessed the loader/backhoe. 9. A true and correct copy of Plaintiff's counsel's letter of March 21, 1995 to Defendant's counsel is attached hereto and incorporated by reference herein as "Exhibit D". 3. Pursuant to Pa.R.C.P. S 4006(a) (2) Defendant was to serve a written response to the Interrogatories on or before December 29/ 1994. 4. In accordance with th~ terms of the Request for production of Documents served upon Defendant and Defendant's counsel, Defendant was to produce and permit Plaintiff's counsel to inspect and copy various documents designatecl, in the Request for Production of Documents and provide a written response thereto on or before December 29, 1994 in accordance with Pa.R.C.P. S 4009(b) (2). 5. The designated time period for Defendant to provide responses to the Interrogatories and the Request for production of Documents and to make requested documents available to Plaintiff's counsel has elapsed with no indication from Defendant or Defendant's counsel when a response to the discovery material would be forthcoming.
