Plaintiff, Ford Motor credit company, i. a oorporation duly organized and existing under the law. of the state of Delaware, and authorized to do business in the Commonwealth of Pennsylvania, with offices located at One Amerioan Road, Dearborn, Michigan 48122. 2. Upon information and belief, is an individual residing at 3 Pennsylvania 17240. 3. On or about December 10, 1990, Defendant (buyer) entered into a written Pennsylvania Vehicle Retail Instalment Contraot (hereinafter called the contract) to purchase a used 1989 Ford Tempo "Vehicle" from a dealer Harbold's Ford, Inc. (creditor) according to the terms, prices and conditions oontained within the aforesaid contract, a true and correct complete copy of said Contract being attached hereto, made a part hereof and marked Plaintiff's Exhibit "A". 4. Pursuant to the aforesaid Contract, Defendant make fifty-four (54) monthly payments of $234.71 the 9th of each month commencing January 9, 1991. 5. "Creditor" subsequently assigned the aforesaid Contract to Plaintiff, Ford Motor Credit Company, on or about December 10, 1990. 6. Defendant subsequently made twenty-five payments to Plaintiff. Defendant, Terry L. campbell, West M~in street, Newburg, agreed to payable on (25) monthly 7. Defendant did default upon the aforesaid contraot by failing to make timely instalment payment to Plaintiff and in aooordanoe therewith the entire remaining balanoe beoame due and payable immediately. B. The aforesaid Contract provides that in default, Plaintiff may repossess the "Vehicle" and acoord with the terms of the aforesaid Contract. 9. The aforesaid contraot further provides that in the event of default, buyer agrees to pay lawyers fees and legal costs as permitted by law. 10. On or about August 9, 1993, Plaintiff repossessed the vehiole. 11. At time of repossession, the vehicle had an odometer reading in excess of 86,000 miles. 12. On August 9, 1993, Notice of Repossession and Right to Redeem and Notice of Sale were mailed to Defendant, via certified mail, to his last known address, a true and correct copy of said notJ.ces being attached hereto, made a part hereof, and marked Plaintiff's Exhibit "8". 13. Said notices were not returned to Plaintiff by the Postal Services as being undeliverable. 14. Pennsylvania Courts have held that notices by mail are completed when said notice is placed within the control of the Postal Authorities. the event of sell same in l~, /:laid vehicle was subsequently sold at private sale, in a oommeroially reasonable fashion, on October 14/ 1993, to Billings Service center/ for $1,000.00, a true and correct copy of the sales invoice and vehiole condition report being attached hereto, made a part hereof and marked Plaintiff'S Exhibit "C". 16. Plaintiff avers that all times it aoted in full compliance with the terms and conditions of the aforesaid Contract. 17. Plaintiff avers that at all times it acted in full compliance with th~ terms and conditions of the Pennsylvania Motor Vehicle sales Finance Act, 1947, June 28, P.L. 1110, section 1 et. seq., as amended, 69 P.S. section 601 et seq. 18. Plaintiff incurred the sum of $428.00 in repossession expenses in repossessing and selling the aforesaid vehicle, a true and correct copy of the repossession expenses being att~ched hereto, made a part hereof and marked plaintiff's Exhibit "D", 19. As a consequence of the foregoing, there is currently due and owing to Plaintiff by the Defendante the unpaid balance as reflected in the following sums: Balanco at time of Reposeession $ 6/311.43 Less Sale Proceeds 1,000.00 Less DPW Spec. 61. 96 Plus Repossession Expenses 428.00 PlUS Unpaid I,ate Charges 60.97 Plus Unpaid Credit Charges 170.71 Plus Interest at 6% from 10/26/93 295.45 Plus Attorney's fees at 10% 620.46 TOTAL DUE $ 6,825.06 20.
