The Defendant has been unreasonably difficult during the representation and differences have subsequently developed between Petitioner and Defendant with respect to the manner in which the case should be handled. 3. Despite a fee agreement requiring payment by Defendant of Petitioner's fees, the Defendant has failed to provide payment ror such legal fees, and the prospect of such payment is unlikely. 4. OPINION AND ORDIR OF COURT This matter is before the Court on Plaintiff's Motion for Summary Judgment on the ground that Defendant has failed to file her Answer to the Request for Admission and Interrogatories within thirty (30) days of service. We heard argument on March 6, 1996. FACTS Plaintiff First National Deposit Dank filed the Complaint in the above captioned matter on August 8, 1994. Defendant accepted service through her attorney on November 18, 1994. On January 17, 1995, Defendant filed an Answer to Plaintiff's COlnplaint. On April 4, 1995, Plaintiff filed a Certificate of Service with the Prothonotary verifying that Defendant's attorney had been served with a copy of Plaintiff's Request for Admisoion and Accompanying Interrogatorieo by mailing those items by certified mail, return receipt requested. As of the date of argumont court, Defendant has failed to file her Answer to the Request for Admissions and Interrogatories. NO. 94-4436 CIVIL TERM DISCUSSION The Pennsylvania Rules of Civil Procedure provide that "after the pleadings are olosed, but within suoh time as not to delay trial, any party may move for Ilummary judgement on the pleadings and any depollitions, anllwerll to interrogatories, admill8ions on file and Ilupporting affidavitll." 42 Pa.R.C.P. Rule 1035(a). Summary judgment Ilhall be entered if "there ill nn genuine iSllue as to any material fact and that the moving party is entitled to judgment IlIl a matter of law." I!L. at 1035(b). It is not the function of a oourt to deoide illsues of faotl all doubt II as to the existenoe of a genuine issue of material faot mUst be resolved againllt the party moving for summary judgment. In Innovate the Superior Court further held that summary judgment was properly ontered for defendant based on the admissions made as a oonsequenoe of the defendant's failure to respond to the plaintiff's request for admissions. I4L Plaintiff filed a Certifioate of Service with a oopy of Plaintiff'e Request for Adminioll and Aooompanying Interrogatories on April 4, 1995. Nearly a year has passed einoe that transaction and Defendant has otill failed to file an answer to Plaintiff's requosts. In light of tho above authority, this Court finde that it is proper to deem admitted the fact. in tho Plaintiff's Request for Admiseions. Consequently, Defendant has admitted the following factsl 1. Defendant applied for a Visa Gold Account and received a caehier's check in the sum of $4,000.00 as a oash advanoe. 2. At the time that she reoeived the oash advance ehe reoeived the Viea Gold Account Agreement and hae failed to pay the $4,019.35 balance on her. aooount. 3 . NO. 94-4436 CIVIL TERM 3. There are no offaetl or credite which are due from Plaintiff. 4. Defendant haa agreed to pay the collection coat the Plaintiff is incurring including but not limited to realonable attorney's feel and court cOltl and that $004.00 il a reaeonable attorneY'1 feel to effectuate collection of the past due balance. 5. There are no facts which Defendant relieB on al a balie for ant defense in thil action and no documente, wr tingl, papers, or letters which Defendant intend I to utilize as evidence of or as a balis for any defense in this action. 6. Defendant has not paid Plaintiff any payments since June 13, 1994 and agreed to pay a finance charge pursuant to paragraph 5 of the Visa Gold Agreement. Paragraph 5 cal.le for a finance charge to aoorue at the rate of 19.8% per year. 7. The doouments attaohed to Plaintiff's Request for Admissions are true, correot, genuine, and authentio copies of the original dooument and are admissible into evidenoe at trial. In light of the above admissions, there are no genuine iasues of material faots at issue in this matter. Defendant admitted responsibility for the prinoipal balanoe in the amount of $4,018.35, attorney's fees in the amount of $804.00, and finanoe oharges as of the date of this order at a rate of 19.8% per year. Not only are there no genuine issues of material fact, but Plaintiff is entitled to judgment as a matter of law in the amount of the sum of $4,822.35 and finance oharges as of the date of this order at the rate of 19.8% per year.
