ANDERSON, Defendant STIPULATION AND AGR!eM!NT Plaintiff, Kingsbury Associates, a Pennsylvania general partnership with its principal place of business located at 2920 Dickinson Avenue, Camp Hill, Pennsylvania, and, Defendant, Gregory G. Anderson, an adult individual residing at Lot No. 35, Kingsbury Mobile Home Park, 5169 East Trindle Road, Mechanicsburg, Pennsylvania desire to enter this stipulation and Agreement in order to resolve litigation pending in the Court of Common Pleas of Cumberland County. Plaintiff and Defendant, desiring to resolve amicably all litigation among them raised in the above"captioned matter, including all causes of action or claims raised therein, hereby stipulate and Agree as follows I 1. Plaintiff and Defendant agree that all funds presently held by the Prothonotary of Cumberland County shall be released to Defendant Gregory Anderson upon signing of this Agreement and stipulation and upon transfer of title to his mobile home located at Lot No. 35 of the Kingsbury Mobile Home Park to Plaintiff, Kingsbury Associates; and a. Defendant Gregory G. Anderson agrees to immediately transfer hie complete interest and title to the mobile home p~esently looated on Lot No. 35 of the Kingsbury M~bile Home Park to Kingsbury Assooiates, 3. plaintiff, Kingsbury Assooiates shall permit Defendant, Gregory G. Anderson/ to remain in the mobile home until september 15, 1995/ and Defendant Gregory G. Anderson specifically agrees to remove himself and pereonal property from the mobile home and the Kingsbury Mobile Ham. Park on or before September 15, 1995, and 4. plaintiff Kingsbury Associates shall pay Defendant Gregory G. Anderson an amount of $1,500.00 upon Anderson's moving from the Kingsbury Mobile Home Park, provided the mobil~ home remains in its present condition and Anderson, is current on ~all rent in the amount of $220.00 for the months of July 1995/ August 1995 and a portion of September 1995/ or as long as he resides within the mobile home, and 5. Defendant Gregory G. Anderson shall continue maintaining the mobile home in its present condition until he permanently vacates the mobile home on or before September 15, 1995 in accordance with this Agreement and stipulation and order of Court. 6. Counsel for Kingsbury Associates shall hold title of the mobile home in escrow after it has been transferred to Kingsbury Associates until September 15/ 1995 or when Defendant moves from the Kingsbury Mobile Home park, which ever first occurs. 3 7. Pl~intiff shall prepare a Praeoipe to Settle, Disoontinue and Dismi.. the above-atated aotion upon Defendant Gregory G. And~rson's moving from the Mobile Home Park, 8. In the event Defendant Gregory G. Anderson has not moved hi..slf and personal property from the mobile home and the Kingsbury Mobile Homs Park prior to september 15, 1995, Defendant Gregory G. Ander.on agrees that the Court of Common Pleas of Cumberland County .hall i.sue an Order directing the immediate ejection of Plaintiff from the Kingsbury Mobile Home Park and from the mobile home, 9. N~ing in this stipulation and Agreement shall be oonstrued as a sale or exchange of assets. 10. Plaintiff Kingsbury Associates and Defendant Gregory G. Anderson agree that Kingsbury Associates shall have oomplete control and possession of the mobile home after Defendant Gregory G. Anderson vaoates the mobile home prior to September 15, 1995. 11. By executing this Agreement, Plaintiff Kingsbury Associates hereby releases, acquits and forever discharges Anderson from any and all claims, demands, charges, penalties and causes of action which were raised or could have been raised in tho above-captioned matter. Likewise, Defendant Gregory G. Anderson hereby releases, acquits and forever discharges Kingsbury from any and all claims, demands, charges, penalties and causes of action which were raised or could have been raised in the above-oaptioned mutter. 4 IN REI PRETRIAL CONFERENCE A pretrial conference was held in the chambers of Judge Oler, sitting in for the Honorable George E. HOffer, on Wednesday, April 26, 1995. Present on behalf of the Plaintiff was Andrew C. Sheely, Esquire. The pro se Defendant, Gregory G. Anderson, did not appear at the pretrial conference nor did he submit a pretrial memorandum. This is an ejectment action. Plaintiff owns a mobile home park, and Def~ndant hae allegedly remained on the premises after refusing to sign a lease and has violated park rules and regulations. Plaintiff seeks ejectment or eviction and past r~nt. It is noted that Defendant failed to amend certain portions of hls New Matter in an AnSWer to Plaintiff'S complaint, sRid amendment having been required by a pretrial order in response to Plaintiff's preliminary objections I as a result, those paragraphs have been the subject of a "default jUdgment" taken by Plaintiff. Plaintiff Kingsbury Associates is the owner of the Kingsbury Mobile Home Park located at 5169 Trindle Road, Hampden Township, Mechanicsburg, Pennsylvania. 2. Defendant presently resides on Lot No. 35 in the Kingsbury Mobile Home Park. 3. No lease agreement exists between Plaintiff and Defendant for the lease of Lot No. 35. 4. Plaintiff provided Defendant with a oopy of a lease and Park Rules and Regulations. 5. Defendant refused to anter a lease agreement prior to the initiation of the above-captioned law suit. 6. Defendant was advised of violations of Park Rules and Regulations regulating the construction of additions and modifications on the mobile home within the park. 7. Defendant has no leqal owner.hip intere.t or lea.e aqreement in referenae to Lot No. 35 in the Kinqsbury Mobile Home Park. 8. ".~ , , , I,i Defendant never signed the written lease agreement and oontinues to refu.. to enter a lease agreement while exeroising possession and oontrol over that portion of Plaintiff'~ property desoribed as Lot No. 3~ in the ~ingsbury Mobile Home Park. In addition, Plaintiff has repeatedly attempted to notify Defendant by certified mail of Defendant's continuing violations of Park Rules No. 14 oonoerning construotion of additions on Mobile 1I0mes and late payment of rent. In short, Defendant refuses to sign a lease or oomply with regulations concerning the construction of additions, refused to pay rent payment in timely fashion and violates other park rules and regulations. 11. PROCEDURAL HISTORY Plaintiff, ~ingsbury Associates, filed an Amended Complaint on or about November 18, 1994. Defendant, Gregory G. Anderson, filed an Answer, New Matter and Counterclaim to Plaintiff's Complaint on or about December 19, 1994. Plaintiff filed Preliminary Objections to the Defendant's Answer, New Matter and Counterclaim on or about J'anuary 10, 1995. Following argument Court, an Order dated February 27, 1995 issued by the Honorable J. Wesley Oler, Jr., directed Defendant to file an amended pleading in reference to certain paragraphs of Defendant's New Matter. As a result of Defendant's failure to file an amended pleading, plaintiff, after serving a Notice of Intent to take Default Judgment, entered a default judgment in reference to the Order of Court dated February 27, 1995. 2 Prior, to the February 27, 1996 Order of court, Defendant's prior attorney, Floyd Baturin, Esquire, filed a petition for leave to withdraw as oounsel for Oefendant. The Petition to Withdraw was granted and Attorney Daturin withdrew from the oase as of Karoh 7, 1996. III. ~Ller ReQUeSTED BY PLAINTlrr Kingsbury Assooiates seeks to have Defendant ejeoted andlor, in the alternative, evicted from the Kobile lIoma Park for refusing to enter a lease agreement with Plaintiff and for failing to complY with Park Rules and Regulations after being notified of such violations. PlaintiffS further request that Oefendant Anderson remove the mobile home and all other possessions from the mobile home park in accordance with the ejeotion and eviction action. Plaintiffs ruquest the Defendant pay for all rent which is presently due to Plaintiffs from his use of the mobile home park lot during the term of the pending action. Accordingly, plaintiffs request an Order of Court distributing all funds presently in Escrow to Plaintiffs. Plaintiffs further request that Defendant pay Plaintiffs costs, expenses and legal feos. ESTIMATED TIME OF TRlA~ Plaintiff believes that a non-jury trial would likely last two (1) - (2) hours. X. STATUS OF SETTLE"ENT NEGOTIATIONS The parties were extremely close to settling the matter last year and Plaintiffs forwarded a settlement agreement in accordance with repreeentations made by counsel for Defendant. However, on the eve of eettlement, Defendant refused to sign a lease or stipulation as requested as part of the settlement offer notwithstanding meeting all of the requested terms as requested by counsel for Defendant. Plaintiff, Kingsbury Associates, is the record legal owner of oertain real estate being improved with a mobile home park, being known as Kingsbury Mobile Home Park, same being situate in Hampden Township, Cumberland County, Pennsylvania, having been acquired by Deed dated August 10, 1992 and recorded September 11, 1992 in the Cumberland County Reoorder of Deeds office in Deed Book "W", Volume 35, Page 610, same being bounded and described as followSI ALL THAT CERTAIN TRACT of ground situate in Hampden Township, Cumberland County, Pennsylvania, bounded and desoribed in accordanoe with a survey dated Auguet 17, 1992, survey Book No. 1007, of Hartman and Associatee, Inc., ae followSl BEGINNING at a point in the oenter line of the Trindle Road, at the line of land now or late of Marlin Bretz, said point bein9 looated 200 feet more or less North East of the oenter line of Sheely Lane, thence from said Point of Beginning, by land now or late of Harlin Bretz, land now or late of William D. Plaintiff, Kingsbury Associates, acquired an immediate right to possession of the premises by virtue of the August 10, 1992 deed as referred to in Paragraph No. 3 hereinabove, said being recorded in the Cumberland County Recorder of Deeds office in Deed Book "W", Volume 35, Page 609. ~. Defendant, Gregory G. Anderson, currently resides in a mobile home located on Lot No. 35, Kingsbury Mobile Home Park, saJ.d lot being 2 eituat.d on Plaintiff'e real property ae described in Exhibit IlA". 6. Defendant, Gregory G. Anderson, ie ourrently the equitable and/or le9al owner of the mobile home lcoated on Lot No. 3~, Kingsbury Mobile Home Park, said lot being situated on Plaintiff's real property as described in Exhibit "A". COUNT I. !JIOTMINT 7. Paragraphs 1 through and inoluding 6 hereinabove are incorporated herein by referenoe thereto. B. Defendant Gregory G. Anderson was provided with a written lease agreement, park rules and regulations by Plaintiff on or about september lB, 1992. 9. Defendant Gregory G. Anderson never signed the written lease agreement and continues to refuse to enter into a lease agreement. 10. Defendant, Gregory G. Anderson, has exercised and continues to exercise exclusive possession and control over that portion of Plaintiff's property described as Lot No. 35 in the Kingsbury Mobile Home Park. 11. Efforts by Plaintiff, Kingsbury Associates, directing Defendant, Gregory G. Anderson, to remove the mobile home and himself from Plaintiff's property have been without success. 12. Plaintiff is entitled to immediate and exclusive possession of lands which Defendant currently occupies. 3 13. Der.ndant has not executed a new lease over that portion of Plaintiff'. property desoribed in Lot No. 35 in the Kingsbury Mobile Home Park. WHEREFORE, Plaintiff, Kingsbury Aesooiates, respeotfully reque.t. that this Honorable courtl (1) Enter judgment in favor of Plaintiff, Kingsbury Associates, and against Defendant, Gregory G. Anderson, for possession of Lot No. 35, Kingsbury Mobile Home Park, said property being described in full by d~ed dated August 10, 1992 and reoorded in the cumberland County Recorder of Deeds office in Doed Book "W", Volume 35, Page 6091 (2) Enter an Order of Court directing Defendant, Gregory G. Anderson, to immediately remove the mobile home, himself and all possessions from plal.ntiff's property, Lot No. 35 Kingsbury Mobile Home Park, Hampden Township, Cumberland County, Pennsylvania, all at Defendant's costl (3) Enter an Order of Court directing Defendant to pay for and assume Plaintiff's court costs, legal costs and feesl and (4) Any other relief deemed just and equitable. COUNT II. 8VICTION 14. Paragraphs 1 through and including 13 hereinabove are inoorporated herein by reference thereto. 4 1~. on or about February 23, 1994, Plaintiff sent Detendant Greqory G. Anderson a l~tter by oertified mail directing Defendant to remove himself and his mobile home within thir.ty (30) days for non- payment of rent. 16. Defendant refused to acoept servioe of the February 23, 1994 letter. 17. On or about March 9, 1994, Plaintift sent Defendant Greqory G. Anderson a letter by regular mail advising that Defendant failed to pay a late relltal fee in the amount of $32.00 and requesting that such amount be paid within ten (10) days. lB. Defendant refused to acce~t the March 9, 1994 letter and it was returned to Plaintiff. 19. On or about June 6, 1994, Plaintiff sent Defendant Gregory G. Anderson a letter by certified mail advising that Defendant had violated the Mobile Park Rules and Regulations by failing to obtain approval from Plaintiff or a building permit from Hampden Township prior to constructing an addition on his mobile home located at Lot No. 35. 20. The June 6, 1994 letter further advised Defendant Gregory G. Anderson that this was his second violati.on and that he should leave the rosidence within fifteen (15) days. 21. Defendant Gregory G. Anderson refused to acoept the June 6, 1994 letter which was Bent certified mail. 5 23. On or about Jun. 22, 1994, Plaintiff. provided further written notification to Floyd M. Baturin, Esquire, attorney for Defendant Gre90ry G. Anderson, that Defendant was in violation of Park Rules and Regulations in lieu of construction the addition and that Defendant's mobile home lacked the proper skirting. 23. No lease agreement was executed between Plaintiff, Kingsbury Associates, and Defendant, Gregory G. Anderson for any term. WHEREFORE, Plaintiff, Kingsbury Associates, requests that this Honorable Court enter judgment against Defendant and in favor of Plaintiff, direct that Defendant immediately vacate the trailer located and Lot No. 35 and award Plaintiff money damages and lost profits in an amount in excess of eight hundred ($800.00) dollars. ~UNT IIII TRESPASS 24. Paragraphs 1 through and including 23 as set forth in count I and II hereinabove are incorporated herein by reference thereto. 25. As a result of continually maintaining a mobile home and other possessions on Plaintiff's riot No. 35, Kingsbury Mobile Home Park, Defendant has deprived plaintiff, Kingsbury Associates, of the full use and enjoyment of Plaintiff's property. 26. Plaintiff, Kingsbury Associates, is the record legal owner of certain real estate being improved with a mobile home park, being known as Kingsbury Mobile Home Park, same being situate in Hampden Township, Cumberland County, Pennsylvania, having been acquired by Deed dated August 10, 1992 and recorded Septembet. 11, 1992 in the Cumberland County Recorder of Deeds office in Deed Book "W", Volume 35, Page 610, same being bounded and described as follows: ALL THAT CERTAIN TRACT of ground situate in Hampden Township, Cumberland County, Pennsylvania, bounded and described in aocordance with a survey dated August 17, 1992, Survey Book No. 1007, of Hartman and Associates, Inc., as follows: BEGINNING lit a point in the oenter line of the 'rrindle Road, at the line of land now or late of Marlin Bretz said point being located 200 feet more or lQSS North East of the oenter line of Sheely Lanel thence from said point of Beginning, by land now or late of Marlin Bretz, land now or late of William D. Plaintiff, Kingsbury Associates, acquired an immediate right to possession of the premises by virtue of the Auguet 10, 1992 deed as referred to in Paragraph No. 3 hereinabove, said being recorded in the Cumberland County Recorder of Deeds office in Deed Book "W", Volume 35, Page 609. 5. Defendant, Gregory G. Anderson, currently resides in a mobile home located on Lot No. 35, Kingsbury Mobile Home Park, said lot being situated on plaintiff's real property as described in Exhibit "A". 2 6. Anderson, ia ourrently the equitable and/or le9al owner of the mobile home and addition looated on Lot No. 3~, Ringebury Mobile Home Park, said lot being aituated on Plaintiff'e real property as described in Exhibit "A". Anderson was provided with a written lease agreement, park rules and regulations by Plaintiff on or about september lB, 1992. 9. Defendant Gregory G. Anderson never signed tho written lease agreement and continues to refuse to enter into a lease agreement. 10. Defendant, Gregory G. Anderson, has exercised and continues to exercise exclusive possession and control over that portion of Plaintiff's property described as Lot No. 35 in the Kingsbury Mobile Home Park, by using said lot for the location of a mobile home and addition. 11. Efforts by plaintiff, Kingsbury Associates, directing Defendant, Gregory G. Anderson, to remove the mobile home, an addition and himself from Plaintiff's property have been without success. 12. Plaintiff is entitled to immediate and exclusive possession of lands which Defendant currently occupies. 3 13. Anderson a letter Py certified mail direoting Defendant to remove himeelf. and hi~ mobile home within thirty (30) daYB for non- payment of rent. 16. Defendant refused to aooept service of the February 23, 1994 letter. 17. On or about March 9, 1994, Plaintiff sent Defendant Gregory G. Anderson a letter by regular mail advising that Defendant failed to pay a late rental fee in the amount of $32.00 and requesting that suoh amount pe paid within tell (10) daYB. lB. Defendant refused to accept the March 9, 1994 letter and it waB returned to Plaintiff. 19. On or about June 6, 1994, Plaintiff sent Defendant Greqory G. Anderson a letter by certified mail advising that Defendant had violated the Mobile Park Rules and Regulations by failing to obtain approval from Plaintiff or a building permit from Hampden Township prior to constructing an addition on his mobile home located at Lot No. 35. 20. The June 6, 1994 letter further advised Defendant Gregory G. Anderson that this was his second violation and that he shoUld leave the residence within fifteen (15) days. 5 31. Defendant Gregory G. Anderson refused to aooept the June 6, 1994 letter whioh was sent by oertified mail. 22. On or about June 22, 1994, Plaintiff provided further written notifioation to Floyd M. Baturin, Esquire, attorney for Defendant Gregory G. Anderson, that Defendant was in violation of Park RUles and Re9ulations in lieu of construotion the addition and that Defendant's mobile home lacked the proper skirting. 23. No lease agreement was exeouted between Plaintiff, Kingabury Assooiates, and Defendant, Gregory G. Anderson for any term. WHEREFORE, Plaintiff, Kingsbury Associates, req,uests that this Honorable Court enter judgment against Defendant and in favor of Plaintiff, and (1) direct that Defendant immediately vacate the trailer looated and Lot No. 35 and award Plaintiff money damages and lost protito in an amount in excess of Thirty-Two and No/loa ($32.00) dollars, (2) Enter an Order of Court directing Defendant to pay for and assume Plaintiff's court costs, logal costs and fees; (3) Any other rulief deemed just and equitable, including the release of all funds presently held by the Prothonotary in the above-captioned matter to Plaintiff. 6 COUNT IIII TRI8P~S8 24. As a result of maintaining a mobile home on Plaintiff's premises as set forth herein, Defendant has deprived Plaintiff, Kingsbury Associates, of the profits derived from the reasonable use and rental of Plaintiff's property. During the month of February 1994, weather oonditions were extreme and there was an abundance of snow. Nonetheless, it was Plainti~f'a obligation and responsibility to have the roadways in and to the mobile home park promptly and properly cleared for all the residents. The Plaintiff had failed to do so, and was lIeglectful in removing and olearing the snow from the roadways and paths whioh made same impassable for days and, therefore, Defendant was prohibited from leaving the mobile home park and was unable to get to his plaoe of employment for a total of four (4) days which resulted in lost wages. In addition, no mail. del.i.vory or piokup was possible for this time period. 31. Defendant did not construct an addition onto his mobile home. After the severe weather conditions of the winter of 1994, Defendant's mobile home was damaged and, in an attempt to repair the damage, Defendant merely repaired his property by replacing the damaged front steps to include a small poroh area. Defendant was unaware that he needed prior approval by Plainti~f in order to repair his property. DISCUSSION Motion to strike or dismiss. Under Pennsylvania Rule of Civil Prooedure 1022, eaoh paragraph of a pleading is to "oontain a. far as praotioable only one material allegation." Under Rule 1019(a) "[ t) he material faots on whioh a aause of action or defense is based [are to] be stated in a conoise and summary form." Where a pleading is not in oonformity with suoh rUles, it is subjeot to a preliminary objection. Pennsylvania Rule of civil Prooedure 1028(a)(2). In the pr.esent oase, paragraphs 30, 31 and 32 of Defendant'e new matter olearly are not in conformity with rule of oourt and Plaintiff's preliminary objection ae to them will be sustained. Generally, a motion to strike will not be permitted to serve as a subetitute for a motion for a more specific pleading. 2 Goodrioh-1\mram 2d Sl017 (b) 112, at 256 (1991). In the present caso, a review of Defendant'e new matter and counterclaJ.m leads the Court to conclude that the pleading is sufficiently specific with respeot to time, damages and other averment. therein to permit an adequate reply on the part of Plaintiff and to advise Plaintiff of the issues to be met. In the present case, Defendant's three hundred dollar counterclaim alleges damages in the form of lost wages as a result of Plaintiff's breach of an obligation to keep roadways within its mobile home park passable.
